The Kuala Lumpur High Court had ruled today that the Malaysian Anti-Corruption Commission (MACC) has no authority or rights to interrogate witnesses beyond working hours since the clause day to day means that it must be done during working hours, i.e. from 8am to 5pm, Monday to Friday and excludes public holidays.
This landmark ruling has put the MACC into greater problems since most of the controversial interrogation were conducted after working hours with a recent death reported after working hours.
It is learnt that Tan Boon Hwa, a Kajang Councillor was arrested at 9pm and interrogated at night. It is also reported that Teoh Beng Hock who was interrogated on 15 July 2009, the same day as Tan, was found death while interrogation was also carried out at night.
The MACC appears to be in a fix and has a lot of explaining to do to the affected parties and to the rakyat as to why they had carried out the interrogation beyong their scope which now amounts to public funds been wasted to compensate the affected individuals.
A detail study on the guidelines of the MACC need to be carried out and the officials of MACC been briefed so that this excessive flaw be immediately corrected.
It clearly shows that our MACC officials have absused their powers.
