TOI Correspondent from Barasat reports: ”"A 62-year-old homoeopath, who was beaten up by a couple of drunken eve-teasers, died after a cardiac arrest in Barasat Kamdambagachi on Monday afternoon. One of the accused was later arrested from his hideout.
Bikash Bondhu Mullick was attending to his patients in his chamber when the two youths – Sheikh Jamaluddin and Sirajul Islam – started a drunken brawl outside his chamber. Mullick went out as the commotion grew louder.
He found the duo passing lewd comments at the teenage daughter of his neighbour. Though the girl was inside her house, Mullick protested against the duo’s indecent behaviour. When they refused to pay heed, Mullick started shouting at them.
Jamaluddin then allegedly caught Mullick by a hand and started pulling him towards the road with Sirajul hurling a string of abuses at him. As the heated argument continued, the duo allegedly pushed Mullick, who fell over a tree trunk. Writhing in pain, he caught hold of his chest and fell unconscious. Sensing trouble, the duo fled at once.
Only then did Mullick’s family members and other local residents muster the courage to come out. They took
him to Barasat district hospital at once, but Mullick was declared dead. Mullick was known for his benevolent activities in the area and was popular for his good behaviour.
As the news of the death spread, a mob launched an agitation alleging police inaction against criminals in the area. They also claimed that police had refused to dismantle some temporarily constructed sheds inside a local park (Kola Bagan), which, they alleged, was a popular hunting ground for the goons. The locals burnt down the sheds and a ramshackle building where anti-socials gathered every night. Some hooch dens in the area were also destroyed.
“Seven to eight youths drink alcohol in the open every night. They tease young girls. No one can dare walk by the park. Drunken brawls are rampant. Despite repeated appeals, the police took no step,” alleged Asim De, a local resident.
“My father had protested against the anti-socials several times. He was repeatedly threatened with dire consequences. He had recently undergone a bypass surgery. When they pushed him, he suffered a cardiac arrest and died on the spot,” sobbed daughter Malati Mullick.
Within two hours of the incident, police swung into action and arrested Jamaluddin from a hideout at Purba Icchapur in Kadamba Gachi.
“We have already arrested one of the accused. Raids are being conducted to nab the others. A police picket has been posted in the area to avoid further violence. We are trying to find the other accused. The arrested will be produced in court on Tuesday,” said a senior police official.“”

Journalist slams report in state-controlled Iranian paper as Nazi propaganda; experts say it shows "how desperate Iran actually is."
BERLIN – A report in a state-controlled Iranian paper last week asserting that the “Zionist regime” “spreads homosexuality” across the globe in order to pursue its goal of world domination has sparked fierce criticism from experts on Iran because of its homophobia and anti- Semitism.Mashregh News, an outlet affiliated with radical Islamists in Qom, wrote that the US and the UK are using money from Jews to spread homosexuality throughout the world. The article blasted Israel for promoting demonstrations for gay rights and specifically decried Tel Aviv as the gay paradise on earth. It also ridiculed Conservative Judaism for accepting gay rabbis, and urged Western governments to stop people from engaging in gay – and therefore immoral – actions, and provide medical treatment for homosexuals in order to stop their conduct.
Writing on Monday on the gay website GGG, Chris Karnak said the Mashregh item “reads like an article from the Nazi agitation paper Der Stürmer.”
Dr. Wahied Wahdat-Hagh, an expert on minority groups in Iran, told The Jerusalem Post on Tuesday that the article is “against gays, against the West and anti-Semitic.” He added that “the text legitimizes the execution of gays in Iran; they made a text not only to ridicule the West but to provide a reason why Iran executes gays.”
The Iranian report also attacked Hollywood for depicting gays in positive terms on the silver screen. Moreover, according to the article, schools in California include homosexuality in their education plans because of a recommendation of a Jewish university.
Saba Farzan, a German-Iranian expert in the field of human rights in the Islamic Republic, wrote the Post via email on Tuesday: “This recent attack on human decency by the Iranian regime is tragically not surprising, but these vicious words continue to hurt. Once again this barbaric dictatorship has revealed its hatred towards gays and lesbians as well as towards the State of Israel and Western countries.”
“This is especially ridiculous as in the Middle East, Israel is the only state where the gay community is safe and protected,” she continued. “The Islamic Republic shows with this uncivilized world view how desperate it actually is.”
A-G’s Chambers: Deterrent sentencing for rape cases a must
PETALING JAYA, Sept 5 — Rape offenders should be meted harsh sentences to deter others from committing similar crimes against women and children, said the Attorney-General’s (AG) Chambers in a statement released late today.The Star Online quoted the statement, which was signed by AG Tan Sri Abdul Gani Patail (picture), as reading in part, “The department’s stand is that rape cases require deterrent sentencing to reflect the abhorrence and revulsion of the public towards such crimes.
“This aberration of justice for those who most need the protection of law must be rectified.”
It also said, “In determining the appropriate punishment, especially for statutory rape cases, among the major factors to be considered by all parties involved is public interest and the seriousness of offence committed.”
The news portal reported the AG’s Chambers, in reference to statutory rape, as saying, “In principle, an adult, or a person above the age of 18, especially persons known and trusted by the child victim, should not take advantage of a child as the child has not reached maturity.
“Even if it is said (alleged) that there was consent from the child victim for a sexual act, the consent must be questioned, due to the age and immaturity of the party which is said to have given its consent.”
The statement by the AG’s Chambers follows the recent public uproar over the cases of former national bowler Noor Afizal Azizan and electrician Chuah Guan Jiu who were bound over for five years and three years respectively on a RM25,000 good behaviour bond each after being found guilty of statutory rape.
In both cases, the judges had stated that they had taken the “bright futures” of both men into consideration as well as the fact the sex acts were consensual.
The AG’s Chambers added that it had filed an appeal against the Penang Sessions Court’s decision on August 29 for Chuah’s case and that it was considering the use of the court’s inherent power to review the decision in Noor Afizal’s case.
Broken lift causing misery to disabled man
K Selvarajoo has rely on neigbours to carry him down five flights of stairs each time he has to go for his medical appointments.
PUCHONG: Wheelchair bound K Selvarajoo, 45, is a miserable man since the only lift at Block A of the Pangsapuri Aman low cost flats in Puchong broke down six months ago.
Selvarajoo, 45, has missed three of his medical appointments and his wife K Panchali has to rely on her neighbours to help carry him down five flights of stairs to go for his check ups.
The flats, built seven years ago to resettle the Indian squatters around Puchong, is now in a deplorable state after a new management oufit took over maintanence operations.
“I have to beg my neighbours to help carry him down to the ground floor,” said Panchali, adding her husband missed three check-ups because her neighbours were at work.
M Thangaveloo, 52, another resident claimed the Subang Jaya Town Council (MPSJ) appointed Cantuman Usaha (M) Sdn Bhd in January to manage the flats.
“There are two blocks in Pangsapuri Aman, Block A has nine floors and and Block B five floors,” he said.
Thangaveloo pointed that there are only two lifts for more than 250 residents of Block A and frequent usage had caused the lift to break down often.
He said the new management has refused to conduct monthly inspections despite the residents having to cough up RM55 in monthly maintenance fees.
“Beside the frequent lift breakdowns, there are also no proper lighting, the suroundings are unkempt and there’s no fencing around the flats to prevent robberies,” said Thangaveloo.
‘Pakatan Rakyat a disappointment’
Thangaveloo also said that the management seems to put money ahead of resident benefits.
“For a example, despite individual meters for each unit for water supply, the management locks the main pipe if there are errors in other residents bills.
“We hoped Pakatan Rakyat would sort out our matters, but they too disappointed us,” said another resident named Suresh.
Suresh alleged that a PKR man known as PKR Ravi from Puchong Intan promised the residents to help get the lift fixed.
“He wanted RM40 from each family and said the balance required to solve the problem would be topped up by Puchong MP Gobind Singh Deo.
“Many of the residents paid up the RM40 and were issued receipts. That was two months ago and the PKR man has not come back to us.”
“We also sent a memorandum to Gobind Singh. But there has been no reply. Our local councillor Norhesni Ismail has never visit our flats in the last four years,” said Suresh.
State should take over
Meanwhile, MIC Youth chief T Mohan expressed shocked after visiting the low cost flat today.
“It is unbelievable the management and MPSJ has not looked into the lift problem for the past six months,” he told reporters.
“What is the point of the Pakatan state government keeping RM2 billion in reserve when people are suffering without basic amenities?” he asked.
He also suggested that MPSJ take over the management operations of the flats immediately.
“We will give the state government two weeks to resolve the problems faced the residents, otherwise would bring up the matter at highest level.
“In my opinion, all the apartments and low cost flats should be handled by town and district councils,” said Mohan.

Police probe death threat against NGO leader
Seremban district police chief Saiful Azly Kamaruddin says the case is being investigated under Section 507 of the Penal Code for criminal intimidation.
PETALING JAYA: The threat made against the family of a Seremban-based NGO leader is being investigated under Section 507 of the Penal Code for criminal intimidation.
Seremban district police chief ACP Saiful Azly Kamaruddin said this earlier today.
On Aug 30, the Negeri Sembilan Community Welfare Association’s president S Jaya lodged a police report after receiving a threating letter via the post.
The contents of the letter, authored by one known as Muzaffir, had threatened to rape and torture her three daughters to death if her family did not leave the country in seven days.
The threat was made after her husband, S Ravinthran, posted three videos on Youtube criticising Deputy Prime Minister Muhyiddin Yassin and Negeri Sembilan Menteri Besar Mohamad Hassan.
The letters also asked Ravinthran to apologise to Muhyiddin and Hassan for his remarks.
On the case, Saiful said that his team would send the letter to the forensic department for further investigations.
He also said that the police are monitoring Jaya’s home for the past six days to protect her family’s safety.
“And we will continue to monitor her home after this,” said Saiful.

Najib must undo his father’s mistake
Jeffrey Kitingan claims that former premier Tun Razak Hussein had acted unconstitutionally when he signed away Sabah's oil to Petronas.
KOTA KINABALU: Maverick politician Jeffrey Kitingan said Prime Minister Najib Tun Razak must undo the “greatest injustice” his late father Razak Hussein did in “signing away” Sabah’s oil and gas resources to Petronas in 1975.
“How can (then) prime minister Razak give away something that does not belong to him as prime minister?” Jeffrey asked during a press conference here today where he also showed reporters copies of documents on the issue.
“Najib must undo his late father’s greatest injustice against Sabah and reverse the vesting of Sabah’s oil and gas resources back to Sabah from Petronas.
“The real issue is not whether the then prime minister had the authority to sign away Sabah’s oil and gas resources to Petronas, but why should he sign away Sabah’s oil and gas without consultation with or approval from Sabah when the oil and gas belonged to Sabah,” he said.
Jeffrey, who is also Sabah chairman of the Sarawak-based State Reform Party (STAR), said Razak had on March 26, 1975 signed away Sabah’s oil and gas to Petronas by executing the “vesting order” under Section 2(2) of the Petroleum Development Act 1974.
He said the “vesting order” granted in perpetuity and conveyed to and vested in Petronas the ownership in and the exclusive rights, powers, liberties and privileges of exploring, exploiting, winning and obtaining petroleum whether lying onshore or offshore of Malaysia.
“The grant, conveyance and vesting was to be irrevocable and shall endure for the benefit of Petronas and its successor.
“But under Section 24(1) of the Land Ordinance (Sabah Cap. 68), oil and gas in Sabah are, and deemed always to have been, reserved to the state government, together with the right to enter lands and to search for, win, carry away and dispose of the same,” he said.
Razak’s action ‘unconstitutional’
Jeffrey also argued that “under Section 24(2) of the Land Ordinance, the minister (in charge of such resources) is authorised to grant licences to search for, win, carry away and dispose of the oil and gas and to grant leases of the same.
“Under the same section, the state is also entitled to impose payment of royalties on the oil and gas produced.
“Furthermore, land and natural resources come directly under the State List under the Inter-Governmental Commission (IGC) Report and the Federal Constitution.
“This action by Razak may well be unconstitutional.
“How could Razak give away something that does not belong to him as prime minister?
“By signing away Sabah’s oil and gas to Petronas, Razak has committed the greatest injustice to Sabah,” said the Harvard scholar.
He argued that it is only right that Najib, who was here on a two-day visit recently, undo the injustice by getting Petronas to reverse the vesting and restore ownership of Sabah’s oil and gas to the state.
“It is never a better time for Najib to show his sincerity in resolving Sabah’s oil issue by giving back the oil and gas resources to Sabah, which will also by a stroke of the pen wipe out Sabah’s poverty problems.
“It is also time for the Chief Minister to show that he is truly a Sabahan at heart by not only seeking a review of the ‘oil royalties’ but also to ask the federal government to give back the oil and gas resources to Sabah, since he has said that the current state-federal relationship is very good,” he added.
At the press conference, the video of the speeches of Tengku Razaleigh Hamzah was also played to show the explanations on the imposition of royalties by the state and federal governments as well as on Tengku Razaleigh being asked to leave the ill-fated Nomad airplane before it took off from Labuan in 1976.
Sabah on its part, however, only signed an agreement with Petronas on June 14, 1976, days after the demise of Sabah’s then chief minister, Fuad Stephens, who perished with most of his senior state ministers in the Nomad air crash on June 6, 1976, after a botched negotiation with federal leaders on oil in Labuan earlier.
Each of the reporters present today was also given copies of the CDs containing the video clips. Also present were senior leaders of STAR from Sarawak, Midi ak Johnek and Alim ak Mideh @ Giovanni Adlim, as well as Sabah leaders of the party.

“By signing away Sabah’s oil and gas to Petronas, Razak has committed the greatest injustice to Sabah,” said the Harvard scholar.He argued that it is only right that Najib, who was here on a two-day visit recently, undo the injustice by getting Petronas to reverse the vesting and restore ownership of Sabah’s oil and gas to the state.
“It is never a better time for Najib to show his sincerity in resolving Sabah’s oil issue by giving back the oil and gas resources to Sabah, which will also by a stroke of the pen wipe out Sabah’s poverty problems.
“It is also time for the Chief Minister to show that he is truly a Sabahan at heart by not only seeking a review of the ‘oil royalties’ but also to ask the federal government to give back the oil and gas resources to Sabah, since he has said that the current state-federal relationship is very good,” he added.
At the press conference, the video of the speeches of Tengku Razaleigh Hamzah was also played to show the explanations on the imposition of royalties by the state and federal governments as well as on Tengku Razaleigh being asked to leave the ill-fated Nomad airplane before it took off from Labuan in 1976.
Sabah on its part, however, only signed an agreement with Petronas on June 14, 1976, days after the demise of Sabah’s then chief minister, Fuad Stephens, who perished with most of his senior state ministers in the Nomad air crash on June 6, 1976, after a botched negotiation with federal leaders on oil in Labuan earlier.

If Pakatan Rakyat is so concerned about a fixed election date, the Umno Youth chief says, the opposition coalition should reveal when it will dissolve its state assemblies.

However, Barisan Nasional Youth chief Khairy Jamaluddin threw the ball back into the opposition’s court.
“Why don’t we also blame the Pakatan-held states?” he asked.
“If they are so concerned about a fixed election date, tell them to announce when they would dissolve their respective state assemblies,” he told FMT.
Among other concerns, the prime minister was said to be worried that if he called for the polls before the term expired in next April, the four states under Pakatan might opt not to dissolve their assemblies for simultaneous state elections.
Pakatan controlled the states of Selangor, Penang, Kedah and Kelantan.
Since taking over the reins in 2009, Najib had set his sights on re-taking these states, especially the resource-rich Selangor.
Commenting on the speculations concerning the election date, Khairy said this was common even in the past.
However, the Umno Youth chief pointed out that it was others, and not the prime minister or the government who were speculating about the date.
“The election date is the prerogative of the PM and he has the freedom to choose when he wants to ask the
Yang di-Pertuan Agong to dissolve Parliament,” he said.
Following Najib’s recent speech in Sandakan where he had repeatedly mentioned his favourite number – 11, speculation had been rife that the polls would be held in November.
However, Minister in the Prime Minister’s Department Nazri Abdul Aziz accused the pundits who read between the lines of the speech of making a “stupid” prediction.
According to him, the election could not be held in November as the Budget 2013 would need to be debated and passed first.
Earlier this week, Bersih co-chairperson S Ambiga also took Najib to task for putting the nation on election mode by dropping hints.

The bottom line, Surendran said, was that Najib and Umno were afraid of putting their mandate to the test.
“PM and Umno are terrified of going to the polls. So Khairy is just making a desperate attempt to deflect attention from this. So he can stop this nonsense right now,” he added.

KUALA LUMPUR – A massage parlour and a car wash outlet in Sunway mentari have given new meaning to the phrase “customer loyalty”.
They have come up with a creative way to entice more customers to engage their services by offering free sex after nine car washes.
However, their three-month old win-win partnership went bust after police stormed the massage parlour on Monday night.
In the 9pm operation, nine Vietnamese women aged between 18 and 28, believed to be prostitutes and GROs, were arrested.
Selangor National Key Result Area (NKRA) Crime Prevention Division officer-in-charge, ASP Emmi Shah Fadhil, said police got wind of the activity after the raiding team found several car wash loyalty cards from five customers who were caught having sex with the prostitutes.
“It was supposed to be just another routine operation,” he said.
He said the team later found out that customers who sent their cars to the nearby car wash will be given a loyalty card each.
“To get the extra ‘offer’, customers must send their cars for washing nine times within a certain period. The 10th car wash will entitle them to free sex,” said Emmi Shah.
He said those who sought sex immediately would need to fork out between RM130 and RM180 per session.

He said the women were found to have violated their social visit passes and had been working without permits.
They were taken to Petaling Jaya headquarters for further investigation.
Selangor police had conducted 4,220 raids and detained ,304 women involved in prostitution and vice activities from January to Aug 31 this year. Of the total, 214 women are locals while 2,090 were foreigners.

RCI on Illegal Immigrants in Sabah – another example of yet another broken promise by the BN?
DAP Sabah kicked off a series of Janji Ditepati public hearings starting in Kota Kinabalu on Monday to seek feedback from the people of Sabah and see if the promises made by the BN during its 49 year rule have indeed been fulfilled or if the government’s Merdeka slogan is yet another in a long series of broken promises by the BN to the people of Sabah.
The last time a series of such public hearings were held was in 1962 when the Commission of Enquiry for North Borneo and Sarawak (better known as the Cobbold Commission) sought public feedback in Sabah and Sarawak for a period of 2 ½ months. Indeed, the Cobbold Commission, which was appointed in January 1962, took five months to complete and was submitted to the British on the 21st of June 1962. The final report was released on the 1st of August, 1962. The Commission was chaired by the former Governor of the Bank of England, Lord Cameron Cobbold, with a four member Commission namely Wong Pow Nee, Chief Minister of Penang, Mohammed Ghazali Shafie, Permanent Secretary to the Ministry of Foreign Affairs, Malaya, Anthony Abell, former Governor of Sarawak and David Watherston, former Chief Secretary of Malaya.
In contrast, it took Najib 6 months to announce the members of the Royal Commission of Inquiry on Illegal Immigrants in Sabah and to come up with the Terms of Reference. And even the Terms of Reference may have been delayed further if not for the departure of two prominent BN Members of Parliament from Sabah. Three weeks later, concerned Sabahans are still waiting for any signs of life that the RCI has started work.
For a Prime Minister who is overseeing a Government Transformation Program that is supposed to make the government more efficient and responsive, it is ironic that the Najib premiership appears to be more inefficient and incompetent compared to the governance of 50 years ago in 1962 as demonstrated by the Cobbold Commission who were operating in a time without the convenience of modern technology.
Will the RCI on Illegal Immigrants be another meaningless Public Relations exercise by the BN similar to the RCI on Police Reform, the RCI on the VK Lingam video clip and the RCI into the Teoh Beng Hock case?
Will Najib call for the next general election without even allowing for the RCI on Illegal Immigrants to start, let along to be completed, so as to avoid the public spotlight on the many problems that such an RCI would unveil, including strong and indisputable evidence that a significant number of illegal immigrants have been included in the electoral roll?
I challenge Najib to assure the people of Sabah that he will not call for the next general election until the RCI on Illegal Immigrants in Sabah has completed its work and that he will take the necessary steps based on the findings to ensure the illegal immigrants who have been wrongly issued ICs and included in the electoral roll will be removed from the electoral roll to ensure a clean and fair elections. - LKSiang

LONDON:
RELATIVES of 24 Malaysian rubber plantation workers killed by British
troops in 1948 yesterday lost their High Court battle for a full
inquiry by the British government.
Britain
said last November it would not hold a formal probe into the Batang
Kali killings in then British-controlled Malaya, but the families'
lawyers claim there was enough evidence to justify an independent
inquiry.
British
soldiers surrounded the Sungai Rimoh rubber estate in Batang Kali on
Dec 12, 1948, shot the 24 workers and set the village on fire, London's
High Court heard.
The
incident, which has been referred to as "Britain's My Lai" after the
infamous Vietnam War massacre, happened during the Malayan Emergency,
when British troops fought communist insurgents.
The
court heard that Britain's 1964-1970 Labour government had launched a
police investigation into the deaths, but the incoming Conservative
administration dropped it in 1970, claiming a lack of evidence.
The current British government argued that the decision not to hold an inquiry was reached lawfully.
"There are no grounds for disturbing their conclusion," judge John Thomas said yesterday.
But
lawyers for the victims' families claim that statements given by
soldiers to the original investigation showed they admitted unlawful
killing.
"We are appealing," said John Halford, a solicitor representing the families.
"As long as the injustice remains, the families will be pursuing legal action."
A relative of one of the victims of the killings said he was disappointed.
"I
am disappointed with the finding that no inquiry is required," said
Chong Koon Ying, whose father, Chong Voon, had been killed in the

He said the participants were mainly teenagers and young professionals who had not experienced how it felt to be under foreign rule.
"Most of them are under 55 years old. They never knew what it was like under foreign rule. So they take 'Merdeka' for granted.
"They do not know how to appreciate because they have been thinking that we are always free," he told reporters after attending DRB-Hicom's Hari Raya Open House, here Wednesday.

them from out of town, who had been subject to MPPP enforcement action
for unlicensed trading.
The Penang state assembly member for Komtar, Ng Wei Aik, had his government car scratched and the hood dented after a couple of protesters jumped on the bonnet. Malaysiakini reported him as claiming that it took police 40 minutes to arrive even though the Pattani Road police station was nearby. Ng also claimed that Perkasa was among those backing the protest.
The state Umno Youth chief has denied his party was involved in the protest.

Ampang shooting: Cops set up new probe team
(Malaysiakini) Police have set up a new team to investigate the incident in which police gunned down 26-year-old D Dinesh last month.
According to Latheefa Koya (right),
who is acting on behalf of two eye-witnesses to the controversial
shooting, police did so after a letter was sent to the federal police
headquarters in Bukit Aman last week.
"The case is now investigated by the Selangor police contingent headquarters under the purview of one ASP Borhan," she said yesterday.
Latheefa said the eye-witnesses, Y Ilavaresan and K Moses, and the deceased's father W Darmasena gave their statements to police on Monday.
Prior to this, Ilavarasen and Moses refused to give their statements because the investigating team was from the same police station as the team involved in the shooting.
The duo said they had driven in separate cars and were supposed to meet up with Dinesh for supper when the incident took place near Ampang Waterfront at about 2am on Aug 21.
Contradictory versions
They claimed they saw Dinesh came out of his car near a traffic light after it was blocked by two unmarked cars.
Moses, who was two cars away from Dinesh at the traffic light, said he saw Dinesh - who was not armed with any weapon - "running back" to his car when he was shot. Dinesh died at Ampang Hospital two days later on Aug 23.
Ilavarasen (left) and Moses said the men who shot Dinesh, who didn't identify themselves and were in unmarked cars, indiscriminately fired at least 10 rounds of ammunition.
However, the police claim that Dinesh was in a 14-car convoy heading to Pandan Perdana to resume a gang fight that had broken out there hours earlier.
Police said they fired twice in self-defence, as the car Dinesh was in rear-ended into a police car, after which the parang-wielding men attacked the police car.

‘Rulers were against Islamic state’
Hindraf chief Waythamoorthy says their unanimous stand was discovered when he scrutinised documents on Malaya's pre-independence talks in the London archives.
GEORGE TOWN: Malay rulers were against any move to turn the country into an Islamic state from the very beginning of the then Malaya independence talks, said Hindraf Makkal Sakti.
Hindraf supremo P Waythamoorthy said the Malay rulers backed an establishment of a secular state to safeguard rights and interests of all Malaysians.
He said documents on pre-independence talks revealed that the Malay rulers wanted Islamic religious matters to be under their jurisdiction.
He said Malaysians must know that during pre-independence days, all states in Malaya were identified and recognised as separate countries.
He said respective rulers wanted control over Islamic religious affairs and maintain a secular state in their respective “countries.”
He said the rulers made a collective representation on this to the Reid Commission through their Queen’s Counsel, Neil Lawson, who was a member of British Communist Party.
The Reid Commission was formed to receive recommendations and draft the Constitution for the imminent independent Federation of Malaya.
“The rulers unanimously agreed and accepted only the proposition and implication of parliamentary democracy and civil law to reign supreme over everything else.
“They never wanted an Islamic state,” Waythamoorthy revealed, pointing out that the system of constitutional monarch was a fundamental foundation of an independent Malaya.
Karpal was right to oppose hudud
He was responding to the political furore caused by PAS’ desire to turn Malaysia into an Islamic state and introduce hudud as the supreme legislation.
He said DAP national chairman and senior parliamentarian Karpal Singh was absolutely right to oppose PAS’ Islamic agenda as unconstitutional.
He said that the Islamisation process of administration started by former premier Dr Mahathir Mohamad was unconstitutional and against the spirit of country’s independence.
He said Umno had committed so much unconstitutional misconduct, intimidation and bullying via religious extremism and racism under its 55 years of misrule in the country.
He chided other Barisan Nasional component parties for having been impotent to stop Umno hegemony for half century.
Since pre-independence days, he said the rulers opposed Islamisation of administration and federal government interference or involvement in religious affairs.
Hence, he said an Islamic agenda would be unconstitutional and against the very spirit of independence and wishes of rulers to be just and fair to all Malaysians.
“This was well documented in Malaya’s pre-independence talks,” said Waythamoorthy.
Malay-Muslims not the only citizens
He said the rulers’ unanimous stand against an Islamic state was discovered when he scrutinised documents on Malaya’s pre-independence talks in the London archives.
He extracted about 40,000 documents on Malaya’s pre-independence talks to facilitate Hindraf’s multi-million ringgit class action suit against the UK government.
Waythamoorthy, who returned to Malaysia after five-years in England, filed the suit in the London High Court on July 2.
The suit seeks justice for all the wrongs done by the British government, the country’s former colonial masters, on Malaysia’s ethnic Indians.
Waythamoorthy rubbished suggestions by pro-Islamist groups that the country’s Islamic agenda was an exclusive Malay-Muslim issue and not for others to deliberate on it.
He said the agenda affects about 13 million non-Muslim Malaysians who have equal citizenry rights to oppose any attempt to establish an Islamic state.
He said the pro-Islamist groups should not foolishly talk as if only Malay-Muslims have dignity, rights and sensitivity.
He said ethnic Indian and Chinese communities who represented the world’s earliest civilizations have all the rights to uphold a secular state and civil law supremacy.
“Islamic agenda was matter of national interests and the Malay-Muslims should realise they are not the only citizens in the country.
“It’s the birthright of each Malaysian to debate, deliberate and dispute it,” said Waythamoorthy.

He said the rulers made a collective representation on this to the Reid Commission through their Queen’s Counsel, Neil Lawson, who was a member of British Communist Party.
The Reid Commission was formed to receive recommendations and draft the Constitution for the imminent independent Federation of Malaya.
“The rulers unanimously agreed and accepted only the proposition and implication of parliamentary democracy and civil law to reign supreme over everything else.
“They never wanted an Islamic state,” Waythamoorthy revealed, pointing out that the system of constitutional monarch was a fundamental foundation of an independent Malaya.
Karpal was right to oppose hudud
He was responding to the political furore caused by PAS’ desire to turn Malaysia into an Islamic state and introduce hudud as the supreme legislation.
He said DAP national chairman and senior parliamentarian Karpal Singh was absolutely right to oppose PAS’ Islamic agenda as unconstitutional.
He said that the Islamisation process of administration started by former premier Dr Mahathir Mohamad was unconstitutional and against the spirit of country’s independence.
He said Umno had committed so much unconstitutional misconduct, intimidation and bullying via religious extremism and racism under its 55 years of misrule in the country.
He chided other Barisan Nasional component parties for having been impotent to stop Umno hegemony for half century.
Since pre-independence days, he said the rulers opposed Islamisation of administration and federal government interference or involvement in religious affairs.
Hence, he said an Islamic agenda would be unconstitutional and against the very spirit of independence and wishes of rulers to be just and fair to all Malaysians.
“This was well documented in Malaya’s pre-independence talks,” said Waythamoorthy.
Malay-Muslims not the only citizens
He said the rulers’ unanimous stand against an Islamic state was discovered when he scrutinised documents on Malaya’s pre-independence talks in the London archives.
He extracted about 40,000 documents on Malaya’s pre-independence talks to facilitate Hindraf’s multi-million ringgit class action suit against the UK government.
Waythamoorthy, who returned to Malaysia after five-years in England, filed the suit in the London High Court on July 2.
The suit seeks justice for all the wrongs done by the British government, the country’s former colonial masters, on Malaysia’s ethnic Indians.
Waythamoorthy rubbished suggestions by pro-Islamist groups that the country’s Islamic agenda was an exclusive Malay-Muslim issue and not for others to deliberate on it.
He said the agenda affects about 13 million non-Muslim Malaysians who have equal citizenry rights to oppose any attempt to establish an Islamic state.
He said the pro-Islamist groups should not foolishly talk as if only Malay-Muslims have dignity, rights and sensitivity.
He said ethnic Indian and Chinese communities who represented the world’s earliest civilizations have all the rights to uphold a secular state and civil law supremacy.
“Islamic agenda was matter of national interests and the Malay-Muslims should realise they are not the only citizens in the country.
“It’s the birthright of each Malaysian to debate, deliberate and dispute it,” said Waythamoorthy.
