War crimes court leaves Gadhafi probe to Libya

(CNN) -- U.N. war-crimes prosecutors are leaving an investigation into the death of ousted Libyan strongman Moammar Gadhafi to Libyan authorities for now, they said Tuesday.

Gadhafi's daughter Aisha pressed the International Criminal Court's prosecution office last week to look into the October death of her father and brother Mutassim. In a written response to her attorney, the prosecution office said it would decide whether it needed to mount its own probe next year.

"The Office of the Prosecutor will review such activities and make its findings public in May 2012 during the prosecutor's second report to the United Nations Security Council," the response read. "During this report, the OTP will present its strategy with regards to future investigations of alleged war crimes committed in Libya, including the killing of Moammar Gadhafi."

Any International Criminal Court investigation "will depend on the activities of the Libyan national authorities and whether they are genuinely carrying out such investigations," the letter states.

But Aisha Gadhafi's attorney, Nick Kaufman, said his client believes the ICC needs to be involved now to make sure a "professional investigation" takes place.

"Aisha Gaddafi questions to what extent an objective and effective investigation which meets international standards -- including ballistic and forensic analysis of the crime scene and preservation of other exhibits -- can take place if the prosecutor delays his involvement until the next report to the UNSC," he said in a statement to CNN.

Gadhafi ruled Libya with an iron fist for nearly 42 years before being overthrown in August. Libya's transitional government said he was killed in the crossfire between its fighters and Gadhafi loyalists after he was captured in his hometown of Sirte on October 20.

In a December 13 letter to prosecutors, Kaufman said Moammar and Mutassim Gadhafi "were captured alive at a time when they posed no threat to anyone," only to be "murdered in the most horrific fashion" after their capture.

An autopsy determined the 69-year-old fugitive died from a gunshot wound to the head, but the pathologist who performed the procedure would not reveal whether the wound was inflicted at close range or from a distance. The bodies of the ousted ruler, his son and his longtime defense minister were put on display in a meat-market refrigerator for several days before being buried.

Aisha Gadhafi fled to Algeria along with several other family members as the regime crumbled in August. She is a lawyer who assisted in the defense of ex-Iraqi dictator Saddam Hussein, who was hanged in 2006, and a onetime U.N. goodwill ambassador.

Gadhafi's son and top aide, Saif al-Islam Gadhafi, was captured in November, Libyan authorities said. Senior Libyan military officials said they believed he was trying to make his way to neighboring Niger, where a brother, Saadi, was granted asylum.

Gadhafi's youngest son, Saif al-Arab, was reported killed in a NATO airstrike in April. And son Khamis Gadhafi, who led an army brigade blamed for the massacre of prisoners in a warehouse outside Tripoli, was killed in a late-August battle in northwestern Libya, rebel commanders said.

Hindu Americans Shocked and Outraged at Attempts to Ban the Bhagavad Gita in Russia

Washington, D.C. (December 20, 2011) -- The Hindu American community expressed shock and outrage over a recent attempt in Russia to ban the Bhagavad Gita, one of Hinduism’s holiest scriptures. The case was reportedly initiated by state prosecutors in the Siberian town of Tomsk, where they are trying to ban the scripture by labeling it “extremist.” According to representatives of the International Society for Krishna Consciousness (ISKCON) in Russia, the state prosecutors have taken select words from the Bhagavad Gita out of context, in an effort to officially proscribe the text. The version of the Gita in question is a Russian translation by A C Bhaktivedanta Swami Prabhupada, the founder of ISKCON.
In response to the case, a number of Hindus in Russia have come together to form the Hindu Council of Russia in order to protect their rights. Hindu community leaders have also approached the Indian embassy in Russia for assistance, while the Hindu American Foundation (HAF) has formally presented its concerns to Russian embassy officials here in Washington, D.C. (click here to download the letter) and requested a meeting to further address the situation.
"The actions of Russian prosecutors are indefensible and represent a draconian attempt to restrict the religious freedom of Hindus in Russia,” said Suhag Shukla, HAF Managing Director and Legal Counsel. “By promoting a narrow and intolerant agenda that demonizes a sacred scripture revered by more than one billion Hindus worldwide, Russian officials are acting contrary to the principles of a free democratic society.”
Originally scheduled to issue its verdict on Monday, December 19, the court reviewing the case decided to postpone its verdict until December 28 to gather additional opinions of experts from Moscow and St. Petersburg.
"We urge the Russian judiciary and government to uphold the basic rights of their Hindu citizens,” said Jay Kansara, HAF’s Washington, D.C. based Associate Director. “Any court ruling or law that would prohibit the Bhagavad Gita or any other Hindu religious literature would be considered a direct attack on the civil liberties of Russia’s Hindu community and an affront to Hindus throughout the world.”

NEW DELHI: Parliamentarians across the political spectrum on Monday asked the government to ensure that the religious rights of Hindus in Russia are protected after a member pointed out an IANS report about the Bhagvad Gita facing a ban and the prospect of it being branded as “extremist” literature there.
Angry MPs forced the adjournment of the Lok Sabha till 2pm after Biju Janata Dal leader Bhartruhari Mahtab raised the issue in the house and asked the government to intervene immediately to ensure the religious freedom of Hindus in Russia.
He said a court in Siberia’s Tomsk city was set to deliver its final verdict on Monday in a case filed by state prosecutors, as was reported by IANS on Saturday when Prime Minister Manmohan Singh was on an official visit to Moscow.
“I want to know from the government what it is doing. The religious rights of Hindus in Russia should be protected. The government should impress upon the Russian authorities through diplomatic channels,” he said.
The case, which has been going on in the Tomsk court since June, seeks a ban on a Russian translation of the “Bhagavad Gita As It Is” written by A C Bhaktivedanta Swami Prabhupada, the founder of the International Society for Krishna Consciousness (ISKCON).
It also wants the Hindu religious text banned in Russia, declared as literature spreading “social discord”, and its distribution on Russian soil rendered illegal.
Indians in Moscow, numbering about 15,000, and followers of the ISKCON religious movement in Russia have appealed to the Indian government to intervene diplomatically to resolve the issue in favour of the scripture, an important part of Indian epic Mahabharata written by sage Ved Vyas.
When Mahtab raised the issue, the lower house plunged into chaos, with MPs urging Speaker Meira Kumar to let them speak on the matter. She, however, refused and instead asked them to send notes and associate with Mahtab.
Lalu Prasad of the Rashtriya Janata Dal (RLD) was heard shouting that the Hindu scripture does not preach extremism.
Bharatiya Janata Party (BJP) members were also seen rising from their seats to protest the issue before Meira Kumar adjourned the house till 2pm.

KUALA LUMPUR, Dec 20 — The reported “gay marriage” between a Malaysian and his lover in Ireland has triggered outrage online, with one Facebook group urging he be brought home to be “saved”. The controversy erupted after pictures taken at Ariff Alfian Rosli’s same-sex civil union surfaced on the internet last week, three years after the University College Dublin medical student was reported missing by his family.
In the photos, the 28-year-old could be seen wearing a black baju Melayu with kain samping while his partner — known only as Jonathan — wore a black tuxedo and green tie.
Local criticism of the same-sex union has been swift and harsh, with mainly Muslim users attacking Ariff Alfian on Twitter for straying from Islam and dishonouring his family.
“Ariff Alfian Rosli is a disgrace! Rot in hell!” user @DTOTHEZAK wrote on the popular micro-blogging site.
Another user, @shkyla, wrote: “Looking at those wedding pictures of Ariff Alfian, makes me want to vomit. Blergh, disgusting.”
Muslim groups have also been quick to condemn Ariff Alfian, with the Kepong Islamic Youth Organisation (PBIK) lodging a police report yesterday over his alleged failure to adhere to Malaysia’s Islamic laws.
Other critics have taken a different tack, preferring instead to “rehabilitate” what they saw as a Muslim who had strayed far from the teachings of Islam.
This includes the Facebook group, “The Campaign to Bring Ariff Alfian Rosli Home to Malaysia to Save His Faith”, which was set up on Saturday.
The campaign’s description of its goal reads: “As Malaysians, Malays and Muslims, other than condemning and cursing, we also have the alternative to support Ariff Alfian’s return to Malaysia so his faith can be restored to the true and noble path.”
As of 4.30pm today, the group had just over 170 members.
The Prime Minister’s Office has also pledged to investigate the matter, and an Umno official is expected to arrive in Dublin later this week to convince Ariff Alfian to return home.
Ariff Alfian, who left for Dublin eight years ago on a Petronas scholarship, has declined to say if he is involved in a civil partnership or a same-sex relationship.
“I feel I have been inadvertently thrust into the public eye. I just want to get by without upsetting anyone or causing any trouble. My overriding concern is for my family,” the Irish Times quoted him as saying today.
He also denied claims he had converted out of Islam, stressing that his faith was unshaken and that he would remain a Muslim until the day he dies.
Ariff Alfian added that he had not “gone missing”, as both Irish and Malaysian authorities have been aware for several years that he was legally residing there.
He said he was in regular contact with most of his family but admitted he has not spoken to his father, retired naval officer Rosli Haron, since they fell out in 2009.
Petronas, which stopped sponsoring Ariff Alfian in 2009, is reportedly demanding repayment for the RM890,000 it paid for his education in Ireland.

For Perkasa, indelible ink a stain too far

KUALA LUMPUR, Dec 20 — Perkasa asserted today that Malay voters could boycott coming polls if the Election Commission (EC) proceeds with its plan to use indelible ink. Calling the move “outdated”, its secretary-general Syed Hassan Ali claimed this would result in a polls outcome favouring the federal opposition.
Drawing comparisons with lesser developed countries like Somalia, Bangladesh, Pakistan, Afghanistan and Cambodia, he said it was “embarrassing” for an advanced nation like Malaysia to adopt such a system.
“Who will benefit if the Malays do not vote? In all likelihood, I will not vote as well if the decision to use indelible ink stands.
“And perhaps many Perkasa members would not vote as well,” he warned in a statement here.
EC chairman Tan Sri Abdul Aziz Yusof announced yesterday the commission’s decision to use indelible ink in the next general election to prevent multiple voting, fulfilling a key demand by the Bersih 2.0 coalition for electoral reform.
Syed Hassan, however, insisted today that the push for indelible ink was orchestrated by those hoping to discourage the community from voting.
“Perkasa believes it came from those who in actual fact do not want to use the ink but because it is a way to discourage the Malays and Muslims from voting, they pushed for it.
“Think carefully before implementing this decision,” he said.
Last month, the Attorney-General cleared the way for the use of indelible ink in elections — one of the eight demands by Bersih 2.0 — when he told a parliamentary panel only a minor change in electoral regulations was required.
Panel head Datuk Seri Maximus Ongkili said Tan Sri Abdul Gani Patail had informed the parliamentary panel on electoral reform that “either a constitutional amendment or a regulation change” was required so the EC can mark voters to avoid multiple voting.
It is understood Rule 19 of the Election (Conduct of Election) Regulations 1981 will have to be amended to allow the ink to be used. but this can be done at any time as it only requires approval from the Yang di-Pertuan Agong before Parliament is notified. The EC had planned to use indelible ink — which it purchased for RM2.4 million — during Election 2008 but backed out at the last minute, citing public order and security issues.
Prime Minister Datuk Seri Najib Razak formed the bipartisan polls panel after weeks of international condemnation following his administration’s clampdown on the July 9 Bersih 2.0 rally for free and fair elections.
The government also promised to adopt the movement’s eight demands, which include the use of indelible ink, cleaning up the electoral roll and extending campaign periods, as part of the committee’s scope.
The coalition of 62 NGOs has since gone on a nationwide campaign demanding that Putrajaya fulfil its eight demands before calling for a general election that is expected soon.
Opposition leaders, who strongly back Bersih, have warned of further rallies should the government fail to implement these demands.

‘Corrupt’ deputy minister under probe

MACC, however, did not indicate it is investigating two aides working under Prime Minister Najib Tun Razak and his deputy Muhiddin Yassin.

PETALING JAYA: The Malaysian Anti-Corruption Commission (MACC) has confirmed that it is investigating allegations of corruption against Deputy Finance Minister Awang Adek Hussin.

Awang Adek along with Advance Maintenance Precision Management Sdn Bhd and Gerbang Perdana managing director Yahya Abd Jalil were allegedly involved in covert dealings.

Details of these dealings were recently revealed by an anonymous blogger, “The Whistleblower 711” on his blogsite.

Also disclosed were the names and transactions between Yahya and two aides working under Prime Minister Najib Tun Razak and Deputy Prime Minister Muhyiddin Yassin respectively.

In a statement issued to FMT yesterday, MACC said that it was aware of the contents of the blog and was investigating the allegations against Awang Adek.

The statement, however, failed to mention whether MACC was invetigating Najib and Muhyiddin’s aides.

Top-level informants

On Sunday, FMT reported “The Whistleblower711′s” allegations implicating, and naming, the deputy minister and the two aides.

The blogger claimed to have top-level informants who had named the three government officials and claimed that they had been “bought” by one businessman for the purpose of obtaining contracts from the federal government and its agencies.

The author claimed that the businessman, who is also an Umno leader in Johor, had been channellling several thousands of “monthly contributions” to the government officials.

Proof of these contributions was published in the blog in the form of scans of several cash deposit slips, together with serial numbers.

These were alleged to be the personal accounts of the government officials.

The author claimed that the modus operandi of the businessman was to issue and cash out the cheques at a well-known bank.

Then a deposit, of either a partial or full amount, would be put into the personal accounts of the government officials.

“MACC would like to stress that all allegations or accusations related to any corruption offences, either received or obtained proactively by MACC will be acted upon as provided under Section 29(3) of the MACC Act 2009 (on powers to investigate).”

No updates

However, the statement noted that MACC would not be disclosing any of the developments or outcome of investigations regarding the case.

“Because under Section 29(4) of the MACC Act, it states that all complaints need to be kept a secret until a person is charged in court,” it said.

“MACC wants to stress that this agency is always serious and takes proactive action on all information involving corruption.

Every corruption case is investigated without fear and favour, including this case,” said MACC.

When contacted, MACC investigations division director Mustafar Ali confirmed that the commission was looking into the case.

Senate stamps approval on assembly bill

Opposition senators fail to stop the passing of the law in a voting by division system.

KUALA LUMPUR: Opposition senators failed to stop the Peaceful Assembly Bill 2011 today after a majority of Dewan Negara members voted in its favour in a voting by division system.

The voting system, which was requested by the opposition, saw 30 members supporting it while eight others dissented.

Earlier, when tabling the bill, Deputy Minister in the Prime Minister’s Department Liew Vui Keong said the bill allows citizens the rights to gather peacefully and without weapons, with certain conditions deemed necessary to maintain public safety and order.

“The bill is the way forward towards strengthening the rule of law and upholding fundamental rights in Malaysia, in particular, the rights to gather peacefully and without weapons,” he said.

The bill was approved by the Dewan Rakyat on Nov 29 with six amendments.

One of the amendments, involving Clause 9(1), allows organisers of assemblies to notify the police only 10 days before the event and not 30 days as in the original bill.

Clause 12(1) was amended to shorten from 48 hours to 24 hours the period for the police to respond to the organisers’ notification of an assembly.

Clause 12(2) was also amended to shorten from five days to 24 hours the period for the vested party to make an objection to the police over the notice of assembly.

The period for the police to respond to the objection was also shortened, from 12 days to five days, as per an amendment to Clause 14.

An amendment to Clause 15 enables the police to impose restrictions on various aspects of the assembly, including the time and place, to maintain safety and public order to safeguard the rights of others.

Clause 16 was amended to shorten the period of appeal by the organisers to the minister.

When winding up the debate later, Liew hit out at Senator Syed Husin Ali for claiming that there were traders who raked in profits from the July 9 rally.

“This is not true because many traders told me they suffered losses in millions of ringgit because of demonstrations in their areas since 1999,” he said.

Be a better leader, critics tell Ramasamy

They say the DAP peace deal does not resolve the problems Penang Indians face
BUTTERWORTH: A group of DAP grassroots leaders have asked Deputy Chief Minister II P Ramasamy to review his leadership skills, claiming that he appears detached from problems plaguing the Indian community.
The group consists of veteran and young members of branches within the mainland parliamentary constituencies of Bagan, Bukit Mertajam and Batu Kawan. They are all Indians, but they preferred not to be named out of respect for the peace deal that DAP has worked out to end Ramasamy’s open spat with party chairman Karpal Singh.
In separate interviews with FMT, they said Indians in the state had benefited little from Penang’s achievements since DAP took the reins of the state administration in 2008. As a result, they added, many Indians who voted for Pakatan Rakyat candidates in the last election were now reverting to Barisan Nasional.
Several of them said Ramasamy probably meant well, but was hampered by inexperience, ignorance or the lack support from his aides. They said some of the aides appeared ignorant and arrogant to the grassroots.
They complained that the state had yet to fulfil some of its promises to the Indian community.
“Where is the macro-economic master plan for Penang Indians?” said one.
They alleged that state agencies had not given enough jobs to Indians or provided them with affordable housing.
“Indians are unable to shake off their perception of feeling marginalised. Our graduates do not feel welcome in state-linked companies or in the public sector.”
They said BN parties were taking advantage of the situation. One of the critics cited the case of a young graduate who managed to get a job with a state agency only after seeking the intervention of a MCA divisional leader.
Another critic acknowledged that Ramasamy’s office did provide funds to Tamil schools but said the officials seemed unaware that some parent-teacher associations had channelled the money to MIC-linked functions.

Agenda at work

Ramasamy charged back at his critics, denouncing them for taking their complaints to the press before consulting him.
He said his door was always open for anyone to voice out grievances, particularly with regard to Indian interests.
“Come and see me. If I do not entertain you despite the validity of your complaint, then go and complain to the media. Instead, some have spoken to the media first. It shows an agenda at work.”
He acknowledged that Penang Indians faced plenty of problems, but said these were the result of decades of neglect by former state administrations.
“The plight of the poor and marginalised cannot be overcome immediately. It takes time, but it would be hindered if people continue to obstruct efforts to rehabilitate the community.”
He said his critics were lying when they said qualified Indians could not get jobs with state-linked agencies. He said he had found jobs for “hundreds of Indians”.
He said the scope of his duties was wide and included handling the plight of Indians in southern Kedah and northern Perak besides the 40 state constituencies in Penang.
He urged Indians to work together to improve their lot, including seeking input from civic organisations.

Pada hari ini, KEADILAN boleh mendedahkan satu komunikasi (dalam bentuk email) di antara Saudara Wan Shahinur Izran dengan Saudari Donna Yong yang menguruskan perniagaan restoran di Singapura bagi pihak keluarga Dato’ Seri Shahrizat Jalil (sila rujuk dokumen email yang disertakan bersama).
Email ini membincangkan pemindahan wang yang diperlukan untuk membiayai perniagaan restoran mewah di Singapura. Bagi tempoh 3 bulan di antara Oktober 2010 dan Disember 2010, keluarga Dato’ Seri Shahrizat Jalil dianggarkan memindahkan sejumlah S$530,000; bersamaan RM1.3 juta dari dana milik kerajaan untuk membiayai perniagaan peribadi di Singapura. Jika ini berlaku sepanjang tahun 2010 dan 2011, kemungkinan jumlah wang yang telah dilarikan mencecah RM10 juta hanya untuk satu perniagaan di Singapura.
Amalan ini sudah tentu turut berleluasa dengan syarikat-syarikat lain yang dimiliki oleh mereka di Singapura. Oleh kerana syarikat-syarikat ini adalah milik penuh keluarga Dato’ Seri Shahrizat Jalil, wang dari NFC boleh sahaja dipindahkan terus ke akaun syarikat-syarikat ini, kemudiannya dikeluarkan oleh keluarga menteri untuk membiayai pembelian peribadi seperti kondominium mewah di Orchard Scotts.
Dato’ Seri Najib Tun Razak tidak boleh berdiam diri lagi kerana pendedahan demi pendedahan membuktikan berlaku penyelewengan berleluasa dalam penggunaan dana rakyat berjumlah RM250 juta itu.
Kami mendesak beliau mengambil tindakan segera membekukan kesemua akaun bank dan perbelanjaan NFC serta syarikat-syarikat berkaitan yang dimiliki oleh keluarga Dato’ Seri Shahrizat Jalil, sementara siasatan yang lebih telus dan serius dijalankan secepat mungkin.

Umno is making a mockery of Interlok for showtime with its panel members

When you choose a panel to make their recommendation on the divisive methodology practiced by Umno in its educational curriculum, it should be one that is independent of influence or influx of Umnorism whether in the public or private sphere. Not possible in Malaysia, just show time and typical sandiwara.

Please take a look at the panelists. Except for Prof Shamsul Amri Baharuddin, Universiti Putra Malaysia Malay Studies lecturer Assoc Prof Lim Swee Tin and writer Uthaya Sankar SB, the rest are infested with Umnorism.

Let me start with Siti Saroja Basri, wife of Interlok writer Abdullah Hussain. Now in the first place she has no “locus standi” as the spouse of the national laureate as there is a conflict of interest.

Further, how can she read into the thoughts and minds of her husband? Where is the independence?

Another interesting observation is, an original script of a Sasterawan can be amended for the sasterawans of Umno. Umno pandai, Rakyat bodoh.

Vision 2020 Among Dr Mahathir's Major Impact On National Development, Says Najib

KUALA LUMPUR, Dec 21 (Bernama) -- The vision 2020, aimed at achieving the developed nation status for Malaysia by the year 2020, was among three aspects of Tun Dr Mahathir Mohamad's leadership as prime minister that left a major impact on the country's development, said Datuk Seri Najib Tun Razak.

The Prime Minister said the other two aspects were saving the country's economy during the world economic crisis in 1997 and building the people's confidence emotionally and psychologically that they were capable of achieving anything beyond expectation through the slogan 'Malaysia Boleh'.

"When Tun Mahathir revealed the vision for Malaysia to turn into a developed nation, it had created a new passion for Malaysians, whereby we are now in the final stage of fulfilling the Vision 2020.

"To me, there is a most fitting way to remember the deeds of a national leader who had contributed immensely, that is, we have to fulfill all the visions that he had dreamed of," Najib said at the Gala Dinner "Tun Dr Mahathir: Famous Legacy" as well as the launch of the "Mahathir Distinguished Internship Program" (MDIP), here Tuesday night.

Also present were Dr Mahathir and his wife, Tun Dr Siti Hasmah Mohamed Ali and the Prime Minister's wife, Datin Seri Rosmah Mansor.

The Prime Minister said the government had continued the efforts initiated by Dr Mahathir by implementing various programmes including the Economic Transformation Programme and the New Economic Model, which were all inspired by Dr Mahathir's vision in turning Malaysia into a developed nation by 2020.

Najib said, in fact Dr Mahathir was also the country's economic saviour when Malaysia was hit by the financial crisis as he had refused to allow Malaysia to be under the control of the International Monetary Fund (IMF).

"...And I support what Tun (Mahathir) had said that he certainly would not hand over our country to be controlled by the IMF under whatever circumstances.

"On the other hand, if anyone wants to accuse him (Tun) of writing the letter (to IMF), I think it's all utter rubbish," he said.

Earlier, it was reported that Opposition Leader Datuk Seri Anwar Ibrahim had claimed that Dr Mahathir had written a letter to the IMF.

Najib said emotionally and pychologically, Dr Mahathir had also given the people something they might not have had before in the Malaysia Boleh spirit, which was self-confidence that eventually inspired the country's development into what Malaysia was now.

"That, I believe, is among the major impacts of Tun Mahathir's leadership, where he had rescued the country from an (economic) crisis , placing the nation on the right track towards achieving the goal of being a developed nation, and giving self-confidence to us as Malaysians," he said.

He added that to realise the vision 2020, the country needed the support and motivation from everyone particularly Tun Mahathir.

"To realise the Vision 2020, we have to cross a bridge soon. We hope we will succeed in crossing the bridge with the support of Tun Mahathir," he said.

Meanwhile, in his speech Dr Mahathir expressed his appreciation to everyone who had always supported his administration previously, and for praying for his well being as well as that of his family's.

The MDIP is a global interlectual research programme set up with the cooperation of the National Professors Council, Perdana Leadership Foundation and Institut Pemikiran Tun Mahathir to honour Tun Mahathir's leadership and contributions to the nation's development and progress for the past 22 years.

The programme, which is open to candidates from abroad, enables them undergo six months of internship in Malaysia to carry out research and analysis on Mahathir's administrative style, success and leadership as Prime Minister.

The event was held in conjunction with Mahathir's 86th birthday Tuesday.
