The Palace Coup (Part 1)

Many Malaysians may not know this but the Perak Fiasco this year is not the second constitutional crisis that has rocked Malaysia (after the UMNO crisis). In fact, UMNO’s deregistration as an association by the Registrar of Societies in 1987 was also not Malaysia’s first constitutional crisis but the second.
The dubious award of Malaysia’s first ever constitutional crisis was bestowed on the Sabahan State Government in 1985 when the Berjaya-appointee Sabahan Governor, Tun Haji Mohd Adnan Robert, despite stern objections from his advisors including the Sabah State Attorney Datuk Nicholas Fung and Sabah High Court judge, Justice Datuk Charles Ho, had decided to swear-in a minority coalition party leader as the Chief Minister of Sabah, a coalition that had won less state seats (22 seats combined) in the just completed State Elections than the victor (26 seats), an action that contravened the State Constitution and the Federal Constitution of Malaysia.
So, what happened during the early dawn hours of 22 April 1985 that eventually propelled the State of Sabah into total chaos? An action by one single man in his capacity as the Governor? Or was he somehow “persuaded” (against all logical reasons) by Datuk Haji Yahya Lampong and the inaction of others present (except for Nicholas Fung and Charles Ho) to continue with the swearing-in ceremony? Before you continue reading, always keep this in mind. A Sultan or a State Governor can appoint a Menteri Besar or a Chief Minister but he cannot dismiss him after swearing him in. The appointed MB or CM can only be dismissed in the State Legislature by a vote of no-confidence, if he is convicted of a crime or if he dies in office.
Once again, let us start from the beginning.
Sabah held its state elections on 21 April 1985, a wide open contest between three political parties, namely Berjaya (BN component party and incumbent state government) led by CM Datuk Harris Mohd Salleh, USNO (previous BN component party and state government) led by Tun Datu Haji Mustapha Datu Harun, and the recently formed, months-old, Parti Bersatu Sabah (PBS), led by Datuk Joseph Pairin Kitingan (former Berjaya Vice President).
By 11pm on Election Day, it was evident that Berjaya had lost the Sabah state elections. CM Harris had in fact lost his seat in his Tenom constituency. The only Berjaya candidates that survived the backlash were the Speaker of the State Assembly, Tan Sri Haji Sunoh Marso, two deputy ministers, Haji Malek Chua and Hiew Ming Kong, plus three others.
Celebrations were however held at the USNO camp. At almost 1am on 22 April 1985, when USNO and PBS had jointly won 25 seats (simple majority), USNO’s director of elections, Haji Karim Ghani called Pairin’s residence to implement the secret plan between USNO and PBS to form a coalition state government, a plan hatched between Pairin and Mustapha to unseat Berjaya prior to the elections. The telephone call was answered by Pairin’s PBS legal advisor, Datuk Herman Luping, who told Haji Karim that “he will get back to him after speaking to Pairin”, a call that was never returned as PBS continued to win one constituency after another. Treachery? Well, nobody said that politics was clean. The initial pact was made at a time when neither USNO nor PBS thought that their respective party could win the Sabahan elections alone.
It was not until later when the return call never came that Mustapha realized that Pairin had double-crossed him. Moral of the story so far - never trust your political opponents.
It was also then that the State Attorney General Datuk Haji Yusuf Rashid, mentioned to Datuk Haji Yahya Lampong that USNO’s 16 seats plus Berjaya’s 6 seats (a total of 22 seats) were sufficient to form the State Government, provided that the Governor grant the 6 nominated seats to them. (The Sabah Governor has the privilege to do so as the Sabahan Legislature consists of 48 contested seats and 6 nominated seats.)
A call (at 2am) was hastily made to the USNO camp for a meeting between the two leaders. At 2.30am, Karim called Datuk Haji Majid Khan (Berjaya’s elections director) to confirm the meeting at Tun Mustapha’s residence. Majid and Abdul Malek Chua arrived about 15 minutes later and were taken to meet Mustapha. In the meeting, Mustapha was skeptical about this “plan of action” that could unseat PBS but a subsequent telephone call from the Istana “inviting Tun Mustapha to take the oath of Sabah CM” banished all doubts from the USNO President’s mind.
Why did the Governor do it knowing very well that PBS had won 26 seats to Berjaya’s 6 seats and USNO’s 16 seats? Events soon unfolded that Harris had called the Governor after receiving the call from USNO at 2am, informing him that Berjaya has formed a coalition with USNO and that their combined total of 22 seats plus the 6 nominated seats (by the Governor) constitutes a simple majority win in the 54-seat Sabah Assembly. It was then that instructions were given to Adnan’s ADC, Haji Mandalam Marziman, to prepare for the swearing-in ceremony in the wee hours of the night (or is it day?). It was also then that Madalam received a call from the PBS legal advisor, Datuk Herman Luping, as to whom he would need to contact to organize the formal swearing-in ceremony for Pairin as the CM of Sabah.
Mandalam then proceeded to contact the Governor’s private secretary, Sukarti Wakiman, to inform him of Adnan’s decision and to contact the Protocol Officer, Ahmad Jalil, to prepare the arrangements for the ceremony. Ahmad Jalil was already at his office and called the Secretary to the Cabinet, Richard Ngui Thien Soong, to bring all the Instruments of Appointment and Oath of Office to the Istana. It was also then that Ahmad Jalil called Mustapha’s residence to inform him of Adnan’s decision and to invite him to the Istana. The time was almost 2.45am now. By then Harris had already dispatched Nicholas Fung and the State Secretary, Hamid Egoh, to the Istana to help out with the arrangements for the ceremony.
When Richard Ngui arrived at the Istana, he told Ahmad Jalil that the Instrument of Appointment and Oath of Office already had Datuk Harris’s name on it (optimistically never expecting Berjaya’s humiliating defeat) and that Jalil should just blanko off the Harris' name and retype Tun Mustapha’s name on it. It was now that the Sabah State Attorney Nicholas Fung pointed out to Adnan that PBS was the victor and that it was unconstitutional for Adnan to swear in Mustapha, to which the Governor interjected that he knew “what he was doing”.
By then, the guests were all arriving at the Istana and these included Mustapha, Yahya Lampong, Majid Khan, Malek Chua and the Commissioner of Police, Mohd Noor Khamis. When Nicholas Fung saw Yahya and Majid, he once again strongly reiterated that it was unconstitutional for Adnan to appoint Mustapha as the CM. It was then pointed out by Yahya that under Articles 6(3) and 10(2) of the State Constitution that Adnan has the discretion to appoint a member of the Assembly so long as he is satisfied that the member is likely to command the confidence of the majority of Assembly members. Nicholas Fung was not easily cowed and warned of the dire consequences if the swearing-in ceremony was permitted to go ahead, but to no avail. It was then that Adnan asked if Kuala Lumpur had been consulted of his decision to which Majid replied that Harris was trying to get in touch with Musa Hitam (the acting PM as Mahathir was in London). It was also then that Adnan asked if a judge was necessary to which High Court judge, Justice Charles Ho was immediately called up on the phone to attend the ceremony at the Istana.
Harris managed to contact acting PM, Musa Hitam at around 3.40am, and informed him of the Berjaya loss and the subsequent proposal to form a coalition party with USNO. Harris also told the acting PM that Adnan had decided to appoint Mustapha as the CM to which Musa said, “Datuk, give me a few hours.” Musa was of course naturally apprehensive over the events happening in Sabah as it might create a law and order situation of which the Federal Government had no intention of sticking their head into. After all, Musa might be the acting PM but he was the Home Minister. Pairin might not be able to contact Musa but he finally got through to the Federal Attorney General, Tan Sri Abu Talib of which he explained the situation. Abu Talib then advised Pairin to take legal action against Adnan if the latter had already sworn-in Mustapha because the Federal Attorney General and the Governor possess no power to dismiss the CM once he is sworn-in.
When Justice Charles Ho arrived at the Istana, he was briefed by Nicholas Fung and Hamid Egoh as of the situation to which the Judge told the Governor that it was unconstitutional, that the judiciary did not want to get involved in this illegal event and that who was willing to take the blame if there was any bloodshed? Charles Ho then proceeded to tell Tun Adnan that he wanted nothing to do with this decision and that he was going home. Nicholas Fung left with Charles Ho. Adnan told Hamid Egoh to proceed with the ceremony. It was almost 4am. Moral of story so far, listen to what your subordinates have to tell you.
It was about this time that Kota Kinabalu police chief, OCPD Supt. Victor Lim got a call on his walkie-talkie that Harris and Mustapha were present at the Istana for the swearing-in ceremony. He immediately alerted Pairin and Luping. Luping immediately tried to contact Sukarti at the Istana but was told by Mandalam that Sukarti was not available. Luping then drove to Hamid Egoh’s house but the latter was already at the Istana. It was then that Luping (and a group of PBS supporters) drove to the Istana but found themselves barred from entering. Pairin was kept informed of the worsening situation and he decided to call Musa Hitam, of which he failed to contact at his home. (Musa was in fact at Bukit Aman monitoring the Sabah situation.)
When Hamid Egoh was resting after the swearing-in ceremony, he received a call from Abu Talib, demanding to know what was happening in Sabah. After a lengthy argument, Hamid Egoh told Abu Talib that Mustapha had already been sworn in as the 7th CM of Sabah.
Pairin finally managed to contact his good friend, Musa at about 6.30am. Musa reassured Pairin that they were doing everything to defuse the tense situation and that the Federal Government had to uphold the system of parliamentary democracy and that they will respect the wishes of the people of Sabah. Pairin then instructed his legal team to prepare two letters to Adnan, the first emphasizing that PBS had won the elections and therefore the right to form the state government, and the second as a warning to Adnan that unless he dismisses Mustapha, legal action will be taken against him.
It was at about 9am that Pairin managed to contact Hamid Egoh at the State Secretariat. After properly lambasting the State Secretary for allowing the illegal swearing-in of Mustapha as the CM (probably left, right and centre), Pairin asked Hamid if he still had the power and authority as a State Secretary to set up a meeting with Adnan. Hamid immediately contacted Sukarti, instructing him to make an appointment for Pairin to meet with Adnan. 15 minutes later, Sukarti called Hamid to tell him that Adnan would see Pairin at noon. Hamid conveyed the news to Pairin, who immediately agreed.
Adnan however changed his mind and cancelled the meeting at the last minute. He got his personal secretary to inform Hamid Egoh that he was busy and tired and that Hamid should relay this news to Pairin. When Pairin heard about this snub, he had to move fast lest his supporters start a riot.
Adnan however had an early visitor in the form of KK OCPD, Supt Victor Lim who proceeded to hand over the two letters from Pairin’s legal advisors. This was the first time that Adnan heard (from Supt Victor Lim) that Kuala Lumpur was not pleased with his actions. It was also at this time that Herman Luping turned up at the Istana gates to seek an interview with the Governor with regards to Pairin’s swearing-in ceremony. Of course Adnan refused to see him and asked Supt Victor Lim to convey to Herman that they should deal with the “new” CM and not him.
Kota Kinabalu streets were now completely deserted after Mustapha had announced over the radio that the people of Sabah should not be apprehensive and unduly alarmed over his appointment as CM. Mustapha had also instructed the Press Secretary, Fauzi Patel, to draft a similar statement for Adnan’s private secretary, to be issued by the Istana confirming the Governor’s decision to appoint him as the CM. Fauzi Patel of course had to have this statement confirmed by Hamid but was told to clear it with Nicholas Fung. Nicholas, on the other hand, refused to have anything to do with it as he had no intentions of working for Mustapha and was planning to resign the position of the Sabah State Attorney. A further attempt by Hamid to send the draft to Fung through the Secretary of the Cabinet, Ngui, proved to be equally futile. Hamid was therefore left with no other choice but to vet the statement himself. He then asked Sukarti to forward a copy each to be forwarded to the Information Department, RTM and Bernama.
To highlight the incredulity of the people of Sabah, even the press division of the internal Information Department withheld the release of this statement. Department Head, Justine Miol had to personally go to see Hamid Egoh to confirm its authenticity as he could not believe what he had just read.
At about noon, RTM began relaying Musa’s statement on the Sabah Elections, “The Sabah Election is now over and the people have already made their choice. To the winners, I congratulate them. However, I would like to appeal to all parties, especially those who lost, to respect the wishes of the majority of the people. For we in the Federal Government will also continue to respect the wishes of the majority, based on the system of parliamentary democracy which we hold in high esteem…The Federal Government will continue to ensure that the security situation is under control. In this connection, I would like to remind any group planning to take action which could threaten the security that the Government would not hesitate to take firm actions against them.”
About an hour later, Musa came up with another statement, “I would also like to take this opportunity to explain the Barisan Nasional’s stand in connection with the developments in Sabah after the elections that have just ended…I would like to inform that at 3.40am yesterday, Datuk Harris Salleh had asked my permission that Berjaya under his leadership join USNO to form the new State Government of Sabah. I explained to Datuk Harris that I could not give him the permission as I have to consider…” Moral of the story so far, have high ranking pals in the Federal Government.
The shit had just (literally) hit the fan. This was the second indication (the first was from Supt Victor Lim to Adnan) that the Federal Government had not viewed favorably the turn of events at the Istana, but this was official while Supt Victor’s words were merely unconfirmed hearsay.
Adnan was jolted to the hilt when he heard the statements made by acting PM Datuk Musa Hitam. First was the threat by Musa to take firm actions against anyone who threatened the security of the State (which he did when he made Tun Mustapha the CM subverting the Constitution) and the second was Musa’s disassociation of BN from any actions partaken by the Governor and Berjaya after the elections (meaning that he would not be obtaining any help from Kuala Lumpur). The meeting that Pairin had so far failed to get (with him) suddenly gained prime importance. Hamid was contacted to immediately set up the meeting at 2.30pm “alone with Datuk Pairin”, insisted Adnan.
Despite conveying the message to Pairin that the Governor wanted to see him alone, ten full carloads of supporters (together with Nicholas Fung) accompanied Pairin to the Istana. Pairin arrived early at the Istana (2pm) and was immediately brought to meet Adnan. It was here, less then 24 hours before, that Mustapha was appointed and sworn-in as the new CM and it was here now that Adnan is conspiring with Pairin to bring about the revocation of the appointment (together with Nicholas Fung and Hamid Igoh). Abu Talib was contacted to give his advice and the Federal Attorney General reiterated that Mustapha cannot be dismissed (Kalong Ningkan case) but recommended them to talk to Mustapha urging him to resign on his own accord.
Herein lies the problem. How could they urge Mustapha to resign when they had appointed him less than 24 hours ago? Yacob Marican was fished in to assist and he recommended using Razak Rouse (USNO legal advisor) as the conduit because of the latter’s close friendship with Tun Mustapha. Razak was invited to join the group at the Istana but dreaded the responsibility once it was impressed upon him the full nature of the business at hand. Meanwhile, an official letter was drafted to Mustapha revoking (not dismissing) his position as the CM of Sabah. This letter was then handed to Sukarti, who gave it to Jalil to personally deliver it to Mustapha. Meanwhile preparations were made for the “second” swearing-in ceremony of the day.
This time, RTM and the State Information Department were called in to record the ceremony. There were only four guests at the ceremony (Hamid Egoh, Nicholas Fung, Victor Lim and Charles Ho). It was then that Justice Charles Ho contemplated the evident fact that Adnan’s decision to proceed with Pairin’s appointment as CM without first obtaining Mustapha’s resignation would complicate matters even more. RTM broadcasted the ceremony nationwide later in the evening. On Mahathir’s return to Malaysia, he openly backed what Musa had done to defuse the situation in Sabah.
While the uproar was still at the height of the controversial event, Pairin sprung another surprise by announcing that he had included 3 (out of the 6 nominated members) into his cabinet, namely Bernard Dompok, Nahalan Haji Damsal and Puan Ariah Tengku Ahmad to represent the Malay interests in the state. 3 Kadazans to represent the Malay interest (even though two of them were Muslims)? USNO in the meantime had beseeched Pairin to honor the election pact to form a coalition government but was told in the State Assembly (20 May 1985) that “PBS was perfectly capable of representing the Muslim interest and therefore a coalition with USNO would have served no purpose.” It was then that Yahya Lampong challenged Pairin’s position as CM stating the fact that as Mustapha had never resigned from that post after being appointed by Adnan and since Adnan did not have the power to dismiss Mustapha, Pairin’s subsequent appointment was ipso facto unconstitutional. This revelation shocked many PBS MPs as not all of them knew what really happened on the 22nd of April between the Governor and their party leader. Yahya proceeded to lead all USNO MPs out of the Assembly.
On 22 May 1985, USNO lawyers filed a writ at the KK High Court seeking to declare Tun Mustapha as the rightful CM of Sabah and that the revocation was unconstitutional, null and void; that the Governor’s appointment of Pairin was unconstitutional, null and void; that the Governor has acted unconstitutionally in appointing the State Cabinet; and that all acts and things done by Pairin in the capacity of CM were null and void.
Joseph Kurup (PBS Secretary-General) retorted by threatening to initiate procedures to dismiss all USNO members for their walkout in the May 20th Assembly session. The stakes are now well and truly raised. Whatever that had possessed Adnan to make the decision to appoint Mustapha took on a new dimension when a bomb exploded in the Segama complex the following day. The second bomb exploded on 29 May. This was to be the onset of a series of bombings in Sabah.
To offset the USNO writ, Pairin announced that the Legislative Assembly will meet on May 30th to pass a vote of confidence on his position as the CM. USNO countered this move by applying to the High Court on May 27th for an injunction to stop Pairin from proceeding with the session but to no avail as the application was rejected because the High Court was of the view that they did not have the jurisdiction to interfere with Assembly proceedings. (How much has changed leading to the Perak Fiasco.)
On May 30th, Pairin easily won the vote of confidence. Capitalizing on this victory, Pairin continued his attack on USNO, branding them as conspirators in a coup to snatch power from those who had legally won in the elections. Later, in his defense of the USNO writ, Pairin claimed that Mustapha had conspired with Harris to illegally install Mustapha as the CM and that their attempt to seize power by fraudulent means had been motivated by their desire to prevent the previous government’s financial and administrative misdeeds from being exposed.
On June 4th, the third bomb went off at Tanjong Aru, recording the first fatality. Moral of the story so far, get away from places where bombs are likely to be detonated and never compound one mistake with another (to cover the first one).
To preempt the hearing of the USNO writ, Pairin once again called an emergency session of the Assembly, this time to express its confidence in Adnan’s appointment of Pairin as the CM. USNO members once again boycotted this session as they deemed Pairin’s administration to be illegal and proceeded to lodge a police report to the effect that the vote of confidence constituted a contempt of the court. Here is where the shit really hit the fan. In moving the motion, Mark Koding (Pairin’s deputy) said that Adnan was forced and coerced to appoint Mustapha as the CM.

Section 23 a multiracial neighbourhood caught in a religious dispute
SHAH ALAM, Aug 31 — Section 23 here is a typical Malaysian middle-class housing estate, with rows of new and identical double-storey houses which have two cars parked outside, but in recent days has been turned into ground zero of a major debate on race relations.
Last Friday, a small group of Malay-Muslims raised race tensions when they marched to the Selangor state secretariat after Friday prayers and threatened bloodshed and threw on the road a severed cow's head if plans went ahead for the construction of a new Hindu temple in Section 23.
They claimed to be residents of Section 23 which they said was a 90 per cent Muslim neighbourhood. They also claimed that the temple would disrupt their way of life and interfere in their own prayers.
But anecdotal evidence suggests that Section 23 has a fairly high number of Indian families living there.
Unsurprisingly, many of them are happy with the plans for the new temple to be relocated from its current location in Section 19, where their very few Hindus.
The proposed spot for the temple relocation sticks out in broad daylight surrounded by a zinc fence. Next to it is a children’s playground and a community hall. Some residents have apparently raised their concerns regarding the temple being extremely close to a playground.
One of the other major concerns of this predominantly “Malay-Muslim” area is that the temple is situated too close to the Surau Al-Jannah, approximately 150 metres away.
Indians in the neighbourhood are perplexed over the objections.
“I don’t think that there will be any traffic problems as some other residents have claimed if the temple were to be relocated here. As everyone is aware, there are two roads that we can use to enter the housing area,” said I. Ramasamy, 59, a retiree who thinks that the move by the state government is a logical one and should not cause any distress or tension.
“We are happy if the plan goes on and the temple is relocated from Section 19 to 23. I go to the temple in Section 19 to pray, and sometimes when it rains the place there becomes flooded. People from Section 19 who have no transport can always take the bus to the new temple as there is a bus stand nearby. This way, devotees from Section 19 and 23 both stand to gain.”
The current location in Section 19 is viewed as not conducive by Indian residents because the area is a majority Malay-Muslim area, whereas Section 23 offers a more balanced ratio between the races.
According to another Indian resident, M. Sekar, 46, a teacher in a technical school, there are about 120 double-storey semi-detached houses in Section 23, and of that number around 30-40 are Indian families.Taking that into account, the Indian community actually makes up about one-third of the neighbourhood population, which contradicts recent claims of 90 per cent Malay domination. There are also a number of Chinese families in the neighbourhood.
Resident R. Doraraj feels that what took place last Friday was uncalled for, and the matter should be brought out in the open and discussed in a transparent manner.
“Religious issues are always very sensitive. Maybe they felt that what happened the other day was right, but to some of us it wasn’t. The argument that our temple, our place of worship would disrupt their daily activities just doesn’t hold.
"What about the mosques and Friday prayers? As Malaysians we have no problem with Malays practising their beliefs, even if their place of worship is near us. We respect their practices, and they should respect ours,” stressed the soft-spoken Doraraj.
About two weeks ago, some members representing the interests of the non-Muslim community in Section 23 sent a letter to their state assemblyman with over 100 signatures from residents in the area consenting to the temple relocation.
“It was reported in the media that the people of this community unanimously opposed the temple being built in the area. We did not agree with that statement so the Indian community sent a letter of approval for the construction with more than 100 signatures,” said Ramasamy.
Asked to comment on the call made by protestors for the temple to be moved to Section 22, many of the Indian residents were shocked and baffled, saying that they had no idea that the temple was originally going to be built there.
“That area is not a housing area, it is an industrial zone. Its location is too far for devotees to go for prayers, and furthermore it is near a burial site. I am surprised because I did not know of this plan,” said N. Murugesu, 42 who has been living in the neighbourhood for more than a year.
However, most of the Section 23 Indians say their relationship with their Malay neighbours and friends remained intact, and that they still took care of each other.
Many of them say they are looking forward to the dialogue being planned for the residents on Sept 5 so that they can finally address this issue.

Recent events, particularly in the past few weeks, cannot but raise the concern and even alarm of Malaysians who want to see the evolution of a Bangsa Malaysia after half a century of nationhood – as Malaysia is only just a decade from the Vision 2020 deadline of achieving a Bangsa Malaysia out of the diverse races, languages, cultures and religions in the country to become a fully developed nation in 2020.
Of late, there is not only a recrudescence of the irresponsible politics of race and religion, the exploitation of the race and religion cards have reached new intensity utterly reckless of their damage to the multi-racial, multi-religious, multi-lingual and multi-cultural fabric of Malaysian society.
As a result, there is a further polarization of race and religion with the hardening of intolerant attitudes and stances, creating situations unseen or unheard of in the previous history of the nation – like the cowhead sacrilege in Shah Alam on Friday where a group protesting against the construction of a Hindu temple threatened bloodshed and committed the ultimate act of religious insensitivity, insult and profanity to Hindus by severing the head of a cow and stomping on it.
Let all patriotic Malaysians of goodwill recognize the danger signals to our plural society. Let all patriotic Malaysians regardless of party come together to save Prime Minister Datuk Seri Najib Razak’s 1Malaysia motto from heading for the rocks 150 days after becoming Prime Minister to stave off divisive and centripetal forces from further dividing and polarizing Malaysians along race and religious lines.
After five months, Najib’s 1Malaysia had failed to inspire Malaysians as an all-encompassing inclusive policy to unite Malaysians – best illustrated by the fact that Pakatan Rakyat whether at parliamentary, state government or state assembly levels are completely excluded from the formulation of a 1Malaysia policy so that it could be embraced by all Malaysians as a policy to unite rather than to divide the people.
This is the most important food for thought for all patriotic Malaysians of goodwill on the occasion of the 52nd National Day.
Already many Malaysians are asking what is there to celebrate on this National Day with the backdrop of a national polity which is not prepared to rise to the challenges and aspirations for change so unmistakably expressed in the messages of the political tsunami of the March 8 general elections last year.
Can Najib’s 1Malaysia symbolize a reaffirmation of a national resolve and commitment to build a Bangsa Malaysia where all Malaysians regard themselves as Malaysians first and their race and religious identities in second place or will it go down in history as representing the very opposite?
THE SHAH ALAM SECTION 23 HIND TEMPLE LOCATION
Tapak Kuil Seksyen 23 Shah Alam
Sebenarnya, kuil Seksyen 19 telah berada di situ sejak zaman sebelum wujudnya Shah Alam lagi. Pada masa itu kawasan di mana kuil tersebut dibina dinamakan Ladang Sungai Renggam. Apabila PKNS ambil-alih, maka dijadikan kawasan perumahan. Semasa membina dan menjual rumah-rumah di Seksyen 19, PKNS tidak menunjukkan kuil tersebut di dalam pelan mereka. Sebaliknya yang ditunjuk adalah rumah-rumah teres dua tingkat.
Maka, para pembeli rumah sekitar kuil tersebut, 80% dari mereka yang merupakan orang Melayu Islam pun terperanjatlah apabila berpindah ke rumah baru mereka dan mendapati kuil masih berada di situ. Sedangkan mereka diberitahu bahawa kuil tersebut akan dipindahkan. Malangnya, PKNS di bawah pemerintahan Kerajaan Negeri UMNO/BN, tidak menunaikan janji mereka dan tidak juga bertanggung-jawab dalam soal ini. Kalau diusahakan pada ketika itu, masih terdapat banyak kawasan lapang, maka perancangan yang lebih sesuai dan tepat dapat dilaksanakan.
Seperti yang diduga dan sepertimana biasa, kerajaan BN tidak melakukan apa-apa. Penduduk terpaksa bersabar selama 26 tahun, menagih janji dari PKNS dan kerajaan BN Selangor, sehinggalah naiknya kerajaan PR. Kami mengusahakan dengan serius dan bersungguh-sungguh sehingga terhasilnya cadangan kuil Seksyen 19 dipindahkan ke Seksyen 23.
Sepatutnya Noh Omar mencerminkan diri sebelum mengeluarkan pendapatnya. Takut-takut meludah ke langit, terjatuh ke muka sendiri. Siap dengan kahak lagi! Sekiranya tapak di Seksyen 23 mahu dikatakan tidak peka dan tidak sensitif, kedudukan di Seksyen 19 mahu dipanggil apa? Mendera? Menyeksa? ataupun derhaka?
Kalau ikut kehendak masyarakat Hindu yang juga merupakan rakyat negeri ini, mereka ingin kuil tersebut kekal sahaja di situ. “Inilah tapak asal kami, sepatutnya PKNS mengambil kira kehadiran kuil kami di sini semasa merancang pembangunan kawasan Shah Alam”, kata mereka. Tetapi apa boleh buat, nasi sudah pun menjadi bubur, mereka amat menyesal mengundi BN sejak dari dulu lagi. Akhirnya hasil perbincangan yang waras, mereka sanggup bertolak ansur. Sanggup berpindah, asalkan tidak terlalu jauh. Kuil ini dikunjungi penganut Hindu dari Seksyen 19, 20 dan 23.
Oleh itu, PKNS ditugaskan untuk mencari tempat yang sesuai. Tapak yang dicadangkan adalah seperti yang dinyatakan. Cadangan dikemukakan kepada MBSA dan seterusnya kepada Exco kerajaan Negeri. Semua menganggap ianya sesuai dan masalah di Seksyen 19 di mana suasana diperhangatkan oleh NGO Melayu/UMNO seperti Pewaris, perlu diselesaikan dengan segera.
Ini yang perlu kita perlu fahami. Tapak di Seksyen 23 bukan untuk kuil baru. Ianya adalah untuk memindahkan kuil yang sedia ada di Seksyen 19. Kedudukannya tidak terlalu hampir dengan kawasan perumahan, di mana terdapat Dewan orang ramai dan juga sebuah padang permainan di antara tapak kuil tersebut dengan kawasan perumahan. Ianya merupakan kawasan Industri. Kalau kilang boleh diletakkan di situ tanpa sebarang bantahan dari penduduk, mengapa tidak kuil? Sedangkan jarak kawasan Industri dari perumahan sudah mengambil kira terlebih dahulu semua aspek yang wajar dipertimbangkan.
Saya faham ada yang ingin mempolitikkan isu ini. Memang suku sakat Ketua Bahagian UMNO duduk di situ. Saya rasa Najib kena ‘mendidik’ ahli UMNO. Kikis semangat perkauman yang sempit yang diasaskan selama ini. Adakah beliau mampu lakukannya? Adakah beliau ingin lakukannya? Najib ke Batu Caves dengan begitu gah ceria, 1Malaysia katanya. Kita ingin lihat sejauh mana falsafah Najib difahami ahli partinya sendiri atau ianya semua hanya satu sandiwara untuk mengaburi mata rakyat?
Seorang penduduk Seksyen 23 memberitahu saya, “Jangan layan sangat YB, puak-puak ini, bukan sekadar kuil mereka bantah. Buat kuliyyah di Surau pun mereka bantah juga”.

PRESS STATEMENT REBUTTING REPEATED DEFAMATORY STATEMENTS BY SIVANESAN OF DAP

I refer to the statement by Sungkai ADUN Sivanesan in Malaysia
Nanban on 27th August 2009 who have repeated defamatory statements
the latest being that I have taken RM35, 000 given by K. Vasanthakumar.
Sivanesan is no doubt confused and clouded on the facts and have made
allegations with bad intentions. Being a lawyer, he should understand
hearsay is as good as rumours without an ability to prove the factual
truth before an accusation being made. He is not a Hindraf member nor
has he any right to speak on behalf of Hindraf. He seem to
have been giving contradictory statements which is based on his
attempt to create a media spin to serve his political master is none
of his business – initially he said that I had collected a sum of
RM700, 000.00 for purposes of filing the civil suit against the UK
Government without any factual evidence. This I have denied
and am in the process of filing a defamation suit against him and 2
other DAP leaders.
Now he seems to be referring to a statement by K.Vasanthakumar that the
latter had given me RM35, 000.00 as base for his malicious and
defamatory statement on hearsay.
At the height of the mass arrest of Hindraf Supporters pre and post
November 25th 2007, K.Vasantha Kumar had formed a company in the name
of Hindraf Enterprise as Hindraf was not a formally registered NGO and
had used the account of Hindraf Enterprise to collect funds for
purposes of bailing out Hindraf supporters who were arrested and for Hindraf activities.
He was the signatory of the said account. Those
sums collected on behalf of Hindraf were withdrawn by him and held by
various individuals closely linked to Hindraf at that moment which
includes himself, Raidu (Ganapathy Rao’s brother) my ardent
Hindraf friends and family . On the 5th December 2007 (whilst I was out of the country) the IGP and AG had accused Hindraf and me of having links with terrorists
namely the LTTE. There was more reason to belief that the account of
Hindraf enterprise would be frozen and a decision on the
particular situation was made to entrust various individuals to hold
the sum of monies, which included me and others named above. I was
out of the country at the time of the decision and the said amount was
banked into my account by Vasanthakumar on his own prerogative.
These funds have been used partly to bail Hindraf supporters and
activities carried out by HINDRAF in seeking the release of the Hindraf ISA detainees, pay the detainees fines and Court attendance, accommodation and allowances for those attending
court from outstation ect. In fact Raidu stood bail for Uthayakumar
on 12th December 2007 for RM50, 000 from these sums collected in the
account of Hindraf Enterprise. All monies are accounted for and the
fund banked into my account during my absence is still with me.
I stress that at no instance have the funds collected been used other
than for the purpose in ensuring the release of Hindraf Supporters (who
were initially charged with attempted murder), the 5 detained under
ISA and the cause of the marginalized and suppressed Malaysian
Indians. In this process I do not expect any form of gratitude from
anybody nor any gratification as I do what I am doing out of my
personal conviction and belief that Malaysian Indians have been
cheated and short changed by Malaysian politicians. At the time of
filing the civil action against the UK Government in August 2007
Ganapathi Rao and Vasanthakumar was not part of Hindraf and none of
us in Hindraf knew the both of them. They only approached Uthayakumar
in late September 2007.
Sivanesan should know his facts before making wild and unfounded
allegations, which I view very seriously and his irresponsible act
for a cause that he serves his political masters as opposed to the
public interest. He and his fellow DAP leaders are deliberately making
unfounded allegations to divert from the Kg.Buah Pala issue where
Hindraf have taken a very firm stand that the village which is almost
200 years have to be preserved. Linking me with a financial scandal is
a cheap form of political antic and sandiwara by Sivanesan.
What ever it is, the truth has to prevail, and it is up to the
community to understand and comprehend the truth and what I do is
always for the truth for the systematically marginalized Malaysian
Indians as I have personally sacrificed my life for the goodwill of the
community without any expectation.
Sivanesan and those who have been around longer than HINDRAF
should be mature enough to understand the objective of HINDRAF and
its genuine leaders rather than posturing to serve their political
masters.

Kg.Buah Pala drama between Police and the Developer!
Timeframe :
From 6.45pm - Two plaincloth policemen came to Kg.Buah Pala to arrest Tamaraj, Murugan and Arumugam the committee members of Kg.Buah Pala under the instruction of Tuan Ibrahim and OCPD and Sjn.Uda.
-The policemen asked Mr.Murugan and Mr.Tamaraj to produce their IC and kept it with them, the committee members did not refuse the arrest but their IC was given back to them few minutes later after receiving a phone call.
-Police advised the committee to to meet Sjn.Uda at the Patani Road police station and I followed the committee to the station.
-At the entrance of the police station, Const.Rahiman said he has instruction from Sjn.Uda not to let the Villagers to enter the Station, we were instructed to stay outside in the rain until we pressure them to enter and our intention is to lodge a reoprt.
*Reporters present at the police station was chased out from there soon we enter the station although they came in with a valid pass.
From 7.44pm - Mr.Tamaraj and Mr.Murugan lodge a report against the for police harrassment, humiliation and threatening in Kg.Buah Pala.
From 7.58pm - One of the policeman involved in the earlier arrest attempt came and check the report made by Mr.Tamaraj and Mr.Murugan.
From 8.09pm - Report completed and we proceed to the 3rd floor to meet Sjn.Uda as instructed earlier. At the BILIK STANDBY- (2) DETEKTIF, a plaincloth Special Branch officer by the name of Naga, informed us that he received instruction that the Buah Pala Villagers are coming to surrender themself and he is stationed there to handle the situation. We were puzzled.
* At this point of time we already sense that something is not right and we suspect that it is related to the Developer or State Government's involvement and relation with the Demolition attempts.
At 8.21pm Sjn.Uda came into the office and he was not aware about the arrest instruction and the whole process. After discussing with Mr.Tamaraj and Mr.Murugan for few minutes and few phone calls, we were asked to meet Puan Sarah on the report made against Mr.Tamaraj months ago.
From 8.43pm - while waiting for Puan Sarah, we were asked to leave and come back once we receive call from Pn.Sarah. At the same time we were instructed to meet Insp.Megat at Jelutong Police Station regarding the case the committee made against Police.
From 9.01pm - At Jelutong police station.
Myself,Mr.Murugan, Mr.Tamaraj, Mr.Sugumaran and Mr.Steven were at the Police Station to meet Insp.Megat who came about 30mins later. He invited us to his office, upon entering the office, we realise something shocking written on the white notice board! The deadline for demolition is on the 1st Sept 2009 and the Suspects to be arrested on the 30th Aug 2009? Does'nt this trigger anything?

Insp.Megat was so humble while referring to the report made on the earlier incident of harrasment for less than a minute and went missing for about 15mins before coming back to proceed with collecting information on each Committee member. He then sat in front of the computer and made a personal check and keyed-in the detail check form.
After completing the detailed report he then told that he wants to detain Mr.Stephen, Mr.Tamaraj and Mr.Sugumaran for 2 reasons. A lady by the name of Santha who is a DAP member and Mr.Tamaraj's neighbor made a report against Mr.Tamaraj on the 9th July 2009 and a developer's contractor Nordin b.Mohd made a report against Mr.Stepehen and Mr.Sugumaran for harrassment on the 4th Aug 2009(Mr.Sugumaran was not in the Village on the said date).
He refuse to entertain further questions from us and he is firm to his decision to detain them. he kepts on informing us that it is a direct instruction from OCPD. He also said " Call whoever, any Dato's that can help you with this case, he also refuse to give details of the case to us, he only gave few info's and most of the thing he said was not accurate!
Lawyer for the Villagers, Darshan Singh arrived at the at the police station about an hour after the detention, he was not welcomed by Insp.Megat, who answered all the question with one answer "Ask my Boss!" when Darshan asked him who is your boss, he answered ASP Siddambaram. When called Siddambaram, he said they will be remanded tommorow morning at 11.00am and according to Megat it is at 11am. They refuse to cooperate with the Lawyer and doesnt even want to reveal the report no. and the person who made the report. which is crucial information for lawyers and it is their right to know. They kept on passing the ball between Siddambaram and Megat.
The Villager starts flooding the police station during the process of detention and at about 12am, there were around 200 villagers and supporters against the detention. At about 1am, when the police tried to ferry the detainees to Patani Rd Police Station, the warrior womens came in to the rescue, they blocked the police van and hailed "Kami tak Buat Salah, tangkap developer" and stood in front of the van, and pushing it until they themself reverse and took the committee members back to the station, the commotion lasted for about 20minutes. Until police gave up! and granted bail to them. Now, why do they grant the bail after all this commotions? they can just release them earlier under the same bail!.
This is the most interesting part in the whole incident, A lady by the name of Santha, who was named by the Police as the complainant for the report made on Tamaraj, suddenly appeared in front of the Van which is in the middle of the commotion and almost reached the Junction to turn left towards Patani Rd. She claimed that she never made any report against Tamaraj recently, and willing to confront the police on this issue, Insp.Megat was right there beside me but pretending not knowing the Issue, I asked him to verify the matter but he refused to talk, Santha went into the police station and explained that the report was made long time ago and it is not a deal now. She withdrew the report and Tamaraj's case is considered closed.

'Cow head' demo: Home minister issues stern warning
He stressed that in issues involving race and religion, the government would not bow to pressure and would not hesitate to act against those who refused to heed to such a warning.
"If such incidents are not curbed, they could result in prolonged communal tension and conflict, and I see this (temple) issue as a very sensitive issue," he said in a statement.
Hishammuddin said although there were calls for him to invoke the Internal Security Act in addressing the issue, the Act would only be used as a last resort or in a situation which could harm national security.
"I also wish to state that there are other laws that can be used in such a case," he added.
Action against internet postings
On postings in the Internet that incited the Indians, he said the police, Malaysian Communications and Multimedia Commission and the Attorney-General were taking action as agreed by him together with Information Communication and Culture Minister Dr Rais Yatim and Minister in the Prime Minister's Department Nazri Abdul Aziz.
After Friday prayers, the residents had marched from the state mosque to the state secretariat building while parading with a severed cow's head.
The cow is considered sacred to Hindus, although the organiser later claimed that it was not intended to belittle the religion.
Yesterday, Selangor police chief Khalid Abu Bakar said the case is being investigated under the Sedition Act.
He added that a special team is probing the case and has recorded statements from several people. - Bernama
Hindraf files report, urges cops to act fast
Hindraf coordinator K Selvam told Malaysiakini said he lodged the report at the Shah Alam district police headquarters. He was accompanied by another 16 leaders and supporters from the movement.
According to Selvam, the act of marching with the cow's head could create racial tension. “They marched about 300 metres with the head....it was seditious and the police did not do anything (to stop them),” he said.
PM cannot be quiet
Last Friday, some 50 residents from Section 23 in Shah Alam staged the protest against the proposal to relocate a Hindu temple to their area.
Before dispersing, several protesters spat and stomped on the cow's head. The cow is considered sacred to Hindus.
Selvam said the movement will stage a candlelight vigil on Saturday at Dataran Merdeka if the police fail to act against the protesters.
"We are urging the police to take action and the government should do something about it.
"The prime minister (Najib Abdul Razak) cannot just sit quiet on this matter because he keeps promoting the concept of 1Malaysia and this is a multiracial country," he said.
Earlier today, Selangor police chief Khalid Abu Bakar told Malaysiakinit that a special team has been set up to probe the matter and they hope to wrap up investigations by Tuesday.
The case is being investigated under the Sedition Act.

When an MAS pilot who had child porn on his mobile phone was arrested in Australia, his father said it is not really that big an issue. He argued that what his son had on his mobile phone is what everyone else would also normally have on his/her mobile phone as well.
This particular father defending his son against the charge of having child porn on his mobile phone is the MACC chief, the anti-corruption agency that is being used to try to topple the Pakatan Rakyat government and the agency behind the death of Teoh Beng Hock.
Understandably, Malaysians were outraged and whacked the MACC Chief, Ahmad Said Hamdan, for what he said. They felt that exploiting children for profit and pleasure was morally wrong, no matter what the law or religion might say about the matter.
In fact, one of the issues Islam-haters raise when they whack Islam concerns the story that the Prophet Muhammad took an underage girl, Aishah, as his wife. The fact that the Prophet was said to have had nine wives at one time and 11 in total was not as repugnant to these people compared to the fact that his last wife was just a child.
Of course, this is what the stories say although there are many Muslims who would dispute this story as unfounded and negative propaganda with the argument that they have not read this in the Quran -- and what is not in the Quran just can’t be accepted as fact and must therefore be mere myth. These people are of course labelled as ‘anti-Hadith’ but they would rather call themselves ‘pro-Quran’. ‘Pro’ is so much more positive than ‘anti’; don’t you think so?
I am sure there are many people who don’t understand what I am talking about. Never mind. Today’s piece is not about the schism in Islam between the various schools of thought. Maybe another time we can talk about that issue.
Okay, back to the child porn thing. So this MAS pilot had child porn on his mobile phone. So what? After all, it was for his personal use. It was not for public viewing. It is not like he was selling it to make money or something like that.
Why penalise this MAS pilot? Parents should look after their children. It is the parents’ responsibility to educate their children. If their underage children star in porn movies why blame others? It is the parents who should take the blame. How can someone be denied child porn just because there are certain religious fanatics who are against the exploiting of children for pleasure and profit?
If you don’t like child porn then don’t watch it. But don’t deny others their right and pleasure just because you are against it. And it is parents who do not control and educate their children that should be blamed, not those who watch child porn.
Yes, this is what rights and freedom are all about. Oh, and the same goes for wine, beer, liquor, gambling, prostitution and drugs as well. We should not ask for them to be banned. Look after your kids. Make sure they don’t indulge in all these activities. If they do then it is your fault. And just because you are a poor/bad parent does not give you the right to demand that wine, beer, liquor, gambling, prostitution and drugs be banned from your neighbourhood.
And if the local neighbourhood pusher tries to get your children hooked on any addictive substance or liquid, make a police report. The law forbids this. The Malaysian police will immediately spring into action and arrest the culprits. It is not like the Malaysian police are on the take and that for the right price they will not take action against criminals. The police will show these people no mercy. This has been proven thousands of times in the past.
Some Malaysians, for example, those parents in Taman TTDI Jaya, want the shops in their neighbourhood to stop selling liquor because this liquor is being sold to children. They must understand that it is the responsibility of parents to educate their children to not drink. They can’t pass this responsibility over to others. This is what parents do not seem to understand. And if their children indulge in child porn, whom do you blame? Those who enjoy watching child porn? Of course not! It is the parents who should be blamed. How can we ban child porn just because parents can’t control and educate their children?
I know some will now argue that we can’t compare child porn with children drinking, taking drugs or indulging in prostitution even though all involve exploiting children for profit and pleasure. Hey, a sin is a sin. How can we classify them into acceptable sin and unacceptable sin? It is not like we are forcing children to do all this. It is their choice to do or not to do. And it is the parents’ job to ensure they do not do. Banning is not the solution even if legislation does not work because enforcement is zero and because the police will close one eye for the right price.
This, Malaysians must understand.
Shah Alam MP blames Umno for cow-head protest
PETALING JAYA, Aug 30 — Shah Alam MP Khalid Samad has blamed Umno for the shocking display of bigotry two days ago, saying the brother of the local Umno chief was one of those carrying the cow’s head to protest relocating a Hindu temple.
The PAS man’s allegation comes in the wake of accusations by other Pakatan Rakyat leaders that Umno is trying to destabilise the state government by using race baiting tactics such as painting the Malay-Muslim community as under siege from non Malays.
“I am very sure Umno is behind it,” Khalid told The Malaysian Insider today referring to the protest.
A group, claiming to be Muslim residents of Section 23 in Shah Alam, the new site of the temple which is to be relocated, held a demonstration outside the Selangor state secretariat, dragging a severed cow-head, an animal sacred in Hinduism, which they stomped and spat under the gaze of the riot police.
Some Section 23 residents have also accused Khalid, who is well known for his inclusive views, of lying and say they are fed-up with his calls for religious tolerance and accused him of neglecting the Muslim community.
But Khalid said that he had met the residents in June over the proposed temple relocation and thinks Umno has since then inflamed the sentiments of the residents.
He cited the actions of Datuk Noh Omar, the Umno state deputy liaison chairman and Agriculture and Agro-based Industry Minister, as the catalyst for the residents’ recent inflammatory protest. Noh had made at least one visit to the proposed temple site in August and told the media that he would seek an injunction to stop the relocation adding that the Selangor government was going against the Federal Constitution by ignoring the sensitivities of Muslims, who make up the majority of residents in Section 23.
Khalid claimed that the brother of Shah Alam Umno division chief Datuk Ahmad Nawawi was one of the two men who were caught on video carrying the cow head.
“The residents were encouraged by the minister’s speech and backing,” said Khalid.
He noted that when the state was administered by the Barisan Nasional, they were no protests when a Hindu temple was relocated to within 100 metres of a Muslim residential area in Section 16 Shah Alam and said the current temple site being disputed is at least 200 metres away from the houses.
Asked about some residents who claimed that he had lied to them, Khalid replied that he had in fact not lied when he ran for election saying that he had always insisted on being fair, including to the Hindus even though they were a minority.
“They have rights too,” he said, pointing out that the 150 year old temple was not relocated earlier when PKNS had developed a housing area all around it and that there is only one temple for Indians living in Sections 19, 20 and 23.
On the issue of neglecting the rights of Muslims, the PAS leader pointed out that their rights as Muslims have been met because they have a surau in Section 23 but they should not assume that they have the right to reject a Hindu temple.
“They don’t have a right to reject a Hindu temple. Their right to have a surau has been fulfilled. Hindus also have a right to have a temple for the 3 sections and we also want to fulfil that right.
“The Hindus also don’t have the right to reject a surau and each community has a right to have a place if worship. We have fulfilled the right of the Muslims,” he said.
Khalid said the entire issue is a misunderstanding of rights.
“If the temple was placed in their backyard or smack in the middle of their community, I can understand if it feels awkward. But now it is far from their houses. There is no infringing on rights of Muslims. I take into account distances. They assume too much and feel they have more rights than what they have,” the PAS leader added.
He added it was not true that the state government was not willing to meet residents and when he met them in June, the requisite approvals for the relocation were still pending from PKNS, the owner of the land, the Shah Alam city council and the state government itself.
He also said that he will attend a meeting between the state government and residents on Sept 5 to discuss the burning issue.
“We are willing to listen to reason but the reasons must be sound. However, I don’t think we will entertain racist or prejudiced views.
“We should condemn prejudices and move to be more tolerant. There is a lesson to be learnt otherwise there will be another round of racist talks, speeches and acts. It’s unfortunate that after 52 years of independence, this is the kind of situation we have,” he said.
Umno has often been accused by Pakatan of trying to use race, religion and other tactics to frustrate the Selangor state government. Just weeks after Pakatan swept into power in Selangor last year, some Muslim residents in Kuala Langat made an issue over a centralised pig farm, a project that was actually mooted by the former Barisan Nasional state government.
Most recently, a controversy erupted over the aggressiveness of the Malaysian Anti Corruption Commission (MACC) in wanting to grill Pakatan Selangor state lawmakers while former mentri besar, Datuk Seri Khir Toyo who has been accused of corruption over the cost of his palatial Balinese style mansion, has not been probed.
The controversy took an ugly turn when Teoh Beng Hock, a DAP political aide! Was found dead just outside the MACC headquarters in Shah Alam on July 16 after he was brought in for questioning.
Khalid delivered a parting shot at MACC, referring to comments by Section 23 residents action committee chairperson Mahyuddin Manaf, who said he was mystified by the appearance of the cow head at the protest.
“There are a lot of mysteries in Shah Alam. Nobody knows how Teoh Beng Hock died. If you ask MACC, they will probably say that the cow committed suicide,” he quipped.
Buah Pala women block police van ferrying leaders
A tense midnight drama took place at the Jelutong police station in Georgetown, Penang, when some 30 Kampung Buah Pala residents formed a human barricade and forcefully stopped a police van from ferrying their three detained leaders to the lock-up.
Police personnel then took the handcuffed trio - M Sugumaran, Joseph Stephen Draviam and C Tharmaraj - back to the station.
The police released the trio on bail some two hours later.
In the 12.30am incident, the police van was about to ferry the detained village leaders to the city police headquarters in Jalan Patani when the residents, mostly women, formed a human barricade at the station's gate.
During the commotion, there was some pushing and shoving by both the police and villagers, but no one was hurt or arrested.
Blogger Aravindraj who was at the scene proclaimed it as a victory for Makkal Sakti (people's power).
"This would go down in history that for the first time, people's power had overcome police power," they said.
Two police reports
A police officer said the trio were arrested earlier at 10.30pm based on two reports - one lodged by a resident M Shanta on July 9 and another by a Bangaldeshi called Nordin on Aug 4.
In her report, Shanta had accused Tharmaraj of threatening her during an argument in the village last month.
However, at 1.30am today Shanta suddenly appeared at the station and withdrew her report.
Nordin, a worker hired by developer Nusmetro Venture (P) Sdn Bhd, had accused Sugumaran and Stephen of threatening him when the developer brought a demolition team to tear down the houses in Kampung Buah Pala on Aug 3.
According to villagers at the police station, Stephen was nowhere near the villagers' human barricade while Sugumaran was not present at all in the village on that day.
The trio were arrested at 10.30pm when they went to the Jelutong police station to have their statements recorded following an earlier report by Tharmaraj on alleged police harassment.
Another villager K Murugan, 46, was also arrested together with them over another report lodged separately by a villager known only as Saravanan.
However, Murugan was released almost immediately apparently because the complainant had withdrawn his report.
State gov't blamed
Minutes after the news of the trio's arrest spread, villagers gathered at the police station.
However, despite requests by lawyer Darshan Singh Khaira and local MIC leaders, the police refused to allow the trio out on police bail.
"This must be the work of the state government," claimed Sugumaran upon his release.
Kampung Buah Pala is commonly known as the Tamil High Chaparral
The village faces demolition on Sept 1. Two previous demolition attempts by Nusmetro early this month were aborted following stiff resistance from the villagers.
Since 1999, the villagers and several social organisations have lobbied for the village to be preserved as a state Indian heritage village.
The High Chaparral crisis has remained as an explosive political issue for the DAP state government to date.

The backdrop of these disturbing events cast a pall on the 52nd National Day celebrations in some 36 hours’ time.
For Sarawak and Sabah, marking the 46th anniversary of their participation in Malaysia, many questions are also being asked as to why Sarawakians, whether Ibans, Bidayuhs, Chinese and Malays have been left out from the mainstream of national development apart from a handful of the privileged few.
Sarawak is a very wealthy state in terms of natural resources like petroleum and timber but in predominantly-Bidayuh Serian parliamentary constituency, the people are still without the most basic necessities before a country can claim to be developed – reflected by the fact that many schools in the area are still without piped water and electricity.
For close to half a century, the promise that Sarawakians and Sabahans will enjoy fairly and equitably in the fruits of development in the state and nation have not been honoured, leaving the people in Sarawak with many teeming socio-economic problems, such as basic infrastructures like health, education, roads, piped water and electricity; and for Bidayuhs and Dayaks, the grave problem of Native Customary Land titles.
National Day on August 31 and Malaysia Day on Sept. 16 will only be meaningful to ordinary Sarawakians if their basic rights to development and to the most basic infrastructures could be met and their aspirations to be equal citizens of the Sarawak state and Malaysian nation given full recognition.

Saya terpanggil untuk membantu memanjangkan kupasan sahabat saya, Dr. Muhammad Nur Manuty berhubung isu kepala lembu yang diusung oleh segelintir manusia upahan yang gagal mengawal nafsu amarah mereka. Kupasan ini cukup menarik dan mudah difahami bagi mereka yang berpegang teguh kepada tuntutan Al Quran. Saya bersetuju dengan Dr. Muhammad Nur Manuty, tindakan provokatif ke atas agama lain seperti ini boleh mencetuskan reaksi dan ketegangan yang tidak perlu sama sekali dalam masyarakat Malaysia yang majmuk dan harmoni. Bukankah Islam itu merupakan agama pelindung dan rahmat untuk sekalian alam?
Garis panduan mengenai hal ini telahpun digariskan oleh Allah SWT di dalam Al Quran yang bermaksud :
“Dan janganlah kamu memaki sembahan-sembahan yang mereka sembah selain Allah, karena mereka nanti akan memaki Allah dengan melampaui batas tanpa pengetahuan.” ( Al-An’am: 108 )
Melihat kepada ironisnya peristiwa yang terjadi, kita mengesyaki bagaikan ada pihak tertentu yang mengambil kesempatan untuk memenuhi agenda politik tersirat yang telah dirancang lebih awal. Usaha UMNO untuk merampas kerajaan Negeri Selangor dengan apa cara sekalipun menuntut semua pihak supaya berhati-hati dan berwaspada.
Dengan kejadian ini, KEADILAN menuntut agar tindakan segera hendaklah diambil terhadap pihak yang bertanggungjawab mencetuskan provokasi ini. Undang-undang (penal code) yang sedia ada mempunyai ruang untuk maksud ini. Siasatan tegas perlu dibuat without fear or favor ; siapa sebenarnya mereka (khususnya kewujudan individu yang tidak dikenali bersama kepala lembu), siapa di belakang mereka dan apakah matlamat mereka sebenarnya ?
KEADILAN memohon kesabaran dan ketenangan semua pihak. Suasana dialog dan mesyuarah dalam menyelesai segala kemelut yang berlaku hendaklah disuburkan. Ini sudah pasti dapat meningkatkan persefahaman dan saling menghormati di antara satu sama lain.

To be quite frank, I didn’t know we had a Biro Pemahaman dan Pemantapan Agama :) The gentleman who heads it seems quite accomplished, however and I’m proud to have him :)
Dr. Nur Manuty quotes Surah Al-An’am: 108, which I mentioned briefly in the post below. I am certainly no scholar of Islam, but I think the wisdom of this quote demonstrates the beauty, wholesomeness, and especially in this case, far-sightedness of Islam.
Some say that if you were to seek peace, prepare for war. I rather believe the opposite. If you were to seek lasting peace, don’t throw the first stone.
ISU MENGARAK KEPALA LEMBU DI SHAH ALAM
Adalah amat pelik dan mendukacitakan apabila melihat tindakan sekumpulan 50 penduduk mengarak kepala seekor lembu, melaungkan kata-kata provokatif dan bertakbir tidak pada tempatnya. Ia dilakukan pada hari (Jumaat) dan di bulan (Ramadan) yang cukup mulia bagi umat Islam. Seharusnya, bulan Ramadan ini dapat melatih kita untuk menundukkan nafsu amarah yang merajalela dalam diri. Tindakan kumpulan ini adalah terasing dan bukan mewakili kehendak Islam. Agama mengajar kita agar menangani isu-isu seperti yang dihadapi dengan penuh kesabaran, bijaksana dan berhikmah.
Kebebasan bersuara dan memberikan pandangan adalah suatu perlu diizinkan. Inilah iklim yang kita mahu demi membina masyarakat madani dan masa depan negara yang lebih gemilang. Namun, apabila kita lupa kepada adab dan susila yang sewajibnya, ia jadi memalukan diri sendiri, menjatuhkan imej agama dan mencalar maruah umat. Malah, lebih parah ia boleh menimbulkan tindakbalas anarki yang mungkin tidak mampu kita kendalikan lagi.

Tear Down Divisive Walls, Says Najib
KUALA LUMPUR, Aug 30 (Bernama) -- Likening unity to a bridge that connects the people and disunity to walls that divide them, Prime Minister Datuk Seri Najib Razak tonight urged the people to restore the bridge and tear down the walls that separate them.
Addressing the nation in his first National Day message as prime minister, Najib said the passing of time had witnessed the bridge, which was painstakingly built by the nation's forefathers, now shaken by certain quarters that attempted to disrupt the peace.
Najib said these groups were exploiting the fine lines that existed in a multi-ethnic society, be it political, religious or social, to serve their own warped agenda.
Noting that the biggest challenge facing Malaysians was to restore the bridge and demolish the walls what separated them, Najib said the people should continue to manage success, building upon what the country had achieved "by cultivating the principles we have long nurtured".
"Let us remember that what we now enjoy may not become better, instead it may deteriorate if neglected.
"The proof is in the world's history, where poorly managed success ends in failure," he said in the message in conjunction with Malaysia's 52nd Independence Day aired over national television Sunday night.
He also called on the people, especially the younger generation, to be mindful of the fact that the good fortune enjoyed by the country today did not come without careful planning, efficient implementation of policies and great sacrifice.
"Clearly, the success and prosperity of Malaysia all this while grew and developed out of the contribution and support of the people of all races, all religious beliefs, all walks of life, whether in rural or urban areas, whether the haves or have-nots, old or young," he said.
Najib said that each and every citizen of the country had equal opportunity under the Malaysian sky and that the only barrier to individual achievements was the lack of will to succeed, willingness to work hard, and the courage to take risks.
Najib also spoke of the country's history after gaining independence.
He said many had predicted a pending demise of Malaya as the government had limited administrative experience, amid the still-unabated communist upheaval, while socio-economic imbalance grew and spread, reinforced by the multi-ethnicity of the young nation.
"Despite the predictions, we have proven the sceptics wrong. In the five decades since our independence we have emerged among the leaders of the developing nations.
"We became the first country in the world to defeat the communist insurgency and brought social justice through a sense of equal ownership within a short period of a mere two generations," he said.
The prime minister said the underlying secret to this success was none other than unity among the people of various ethnicity and beliefs, and the conviction to the philosophy of celebrating diversity as a source of strength rather than "a point of discord that causes disunity".
Najib said that throughout the over 50 years of Malaysia's nationhood, the country had faced numerous milestones, and all of them were met for better or for worse with a united spirit.
"Beginning from the bitter chapter of the Bintang Tiga brutality, the monumental need to create meaning to our independence which was gained without bloodshed, socio-economic imbalance, ethnic discord on May 13, 1969, the economic downturn of the 80's and the Asian economic crisis at the end of the 90's. All of these were confronted and we survived all," he said.
He reminded the people, that they, however, could not afford to rely on the nostalgic past or rest upon their laurels without striving to create new successes.
To ensure that tomorrow would be better than today, Najib said, the government had introduced more effective policies that would propel the country forward towards becoming a developed nation.
Among them, he said, was the introduction of the 1Malaysia concept based on the Federal Constitution and Rukun Negara as the foundation for the government's goals.
"We do not stop at setting a mission statement, instead we have constructed concrete initiatives.
"Starting with efforts to overhaul the public service delivery system, promoting the public welfare agenda as a government priority leads to efforts to stimulate the national economy," he said.
The prime minister also called on the people to reignite the spirit of patriotism "by dedicating our efforts to stimulate the national economy so that continuous prosperity can be enjoyed by the country and its people".
Tomorrow is Malaysia's 52nd Independence Day and the theme for this year's celebrations is "1Malaysia. People First. Performance Now."
"Let us ensure the hallowed banner of our Jalur Gemilang flies proud in the eyes of the world. Together, let us pray for this noble journey to continue, blessed and guided by God," Najib said.
