Letter for Penangnites and Malaysian

Dear Penangnites & Malaysian

I am ordinary penangnite whom love diversity of Penang and presently helping the residents of Kg Buah Pala to fight the eviction by the Developer. I am not a politician or allligned to any political parties and i do not have any political aspiration either. I am not a Hindraf or MIC-BN Collaborator working against PAKATAN Government. I came across a very frigthening " Kg Buah Pala Horror Story" upon studying the documents of Kg Buah Pala in the last three weeks upon receiving SOS from the Village.

Kg Buah Pala Villagers presently remains about 300 illiterate and uneducated indians whom ancestors are the workers of Glugor Estate under Helen Margaret Brown Estate planting nutmegs in Penang during the British days. Presently they are cowherdes and selling cow milk to make a meagre living.

Before Independence the Village Land was acquired and held under Lot 698 North East District under Crown Trust of Strait Settlement Act for housing purpose for the estate workers .Most of the Land have been taken by State and developed except of very small piece of Village Land which housed the estate wokers quaters now know as Kg Buah Pala which is the only final remnants of Glugor Estate which planted nutmeg in Penang.

They have been struggling for last 50 years against previous penang government to save the Village from being torn down and to claim their rightful Malaysian Land Titles under the Torrens Systems. Their struggle is common knowledge to vicinity penangnites like at Bukit Gelugor residents.

The previous State Government under YB Koh Tsu Koon initially approved the Village Land Alieanation in favour of Cooperative in the Year 2005 and again in the 25th April 2007 for 50% premium reduction payable by the Cooperative.

The Villagers took the State Government, Cooperative and the Developer under YB Koh Tsu Koon to Court on the Year 2007 to save the village and claim their rights on the Land and at that time YB Koh Tsu Koon have not issued the Malaysian Land Title to the Cooperative because the cooperative have not paid up the premium for the Land Alienation. Their rights on the Land was protected because Malaysia Title was not given to the Cooperative.

Prominient DAP & PAKATAN Leaders came to village as WHITE KNIGHTS during the Election Campaign 8/3/08 and promised to save the Village from BN Land Scams if they win the Election and form the Penang State Government. Every Penangnite knew DAP Election Mantra in Penang was " Land Scams ... YB Koh Tsu Koon ...BN Government".

At that point of election time as at 08/03/08 the Malaysian Land Title for the Village Land has not been issued to the Cooperative because the Cooperative have not fully paid the premium and have not settled the Villagers as per YB Koh Tsu Koon conditions for the Land Alienation approval to the Cooperative on the Year 2005.

Upon PAKATAN formed State government on 8/3/08, The Malaysia Land Title was issued to Cooperative on 27/3/2008 after premium RM 2.24 was paid on 14/3/2008 to the present PAKATAN Government. The Malaysian Title was issued to Cooperative within 19days PAKATAN became the State Government which extinguished the Villagers rights on the Land under the Lot 698 of CrownTrust Strait Settlements and murdered them in Court of Law !

The market value for the 6.5 Acre Village Land is about RM 60 million. The Cooperative only paid RM 3.2 Million to the Penang State Government for the Land.The PAKATAN government have knowledge of it when they accepted the Balance Premium of RM 2.24 million on 14/3/2008 from the Cooperative before issuance of title on the 27/3/2008 to the Cooperative.

Now YB Lim Guan Eng claims that previous BN Government did the Land Scam and approved the Land Alienantion on 25th April 2007 below market value and he has no choice but to issue the Title to the Cooperative. Is YB Lim Guan Eng telling the Malaysian that inspite of all the Legal Expertise he has in his stable that he could not have save or attempted to save the Village or the Land which valued over RM 60million ? That YB Lim Guan Eng has no choice but to issue the Land Title to the Cooperative within 19days ( 27/3/2008)upon he came the CM (03/08/08)? Does he says that PAKATAN Govt have no remedy for fraudulent land alienation in Penang inspite of the all the lawyers including lawyers who can sue Sultans in their stable?

Now YB Lim Guan Eng claims that the previous State Government under YB Koh Tsu Koon did the Land Scam on the Village Land and He personaly did not make any promises to the Villagers!!!!

After much pressure from the Villagers,YB Lim Guan Eng have only released PARTIAL exco minutes documents which points the finger at the previous government whom gave the approval on 25th April 2007 and balance premium was only paid on 14/3/2008 to PAKATAN Government and Malaysian Title was issued to Cooperative on 27/3/2008. Why is that only Partial Documents are being diclassified and released to public???

Under S.81(2) NLC 1965... in any Land Alienation approval , the Premium must be paid within a specified time in the Notice of Payment ( Borang 5A) otherwise the State Approval shall be deemed lapse and the Land Alienation Application shall be withdrawn!!!! . The usual practice for time limit for premium payment usualy is only 3 months from the issuance of notice of premium payment. If the YB Koh Tsu Koon approval was on 25/4/07,what would have been the time limit for the payment of premium??? Is the Time period is 11 months... as the Cooperative paid the Premium only on the 14/3/08 to the Pakatan Government led by YB Lim Guan Eng?

Why did the PAKATAN GOVERNMENT accepted the RM2.24million from the Cooperative on 14/3/2008 even though they knew the Land was worth more than RM60million???? Why didnt DAP State Government didnt make a fuss or claim Land Scam when they were issuing the Malaysian Title to the Cooperative or attempt anything in Court of Law to prevent the loss of RM 60million worth of Land? Is YB Lim Guan Eng telling that he has lost 60million worth of Land in first 19 days of being the Penang CM???

Under s.78 National Land Code , Until the issuance of the Registered Land Title in favour of intended applicant Proprietor, the Land shall remain with the State until such time. Therefore the Kg Buah Pala Land was in PAKATAN Government hand from 8/3/08 until PAKATAN government issued the Malaysian Title on 27/3/2008 !!!!!! Couldnt have the PAKATAN Government with all the prominient lawyers in their stable save or attempted to save the Village within the provision of Law or to prevent the issuance of the Registered Title to the Cooperative on 27/3/2008 especially where the Land was in hand of PAKATAN Government????? And to prevent the loss of Land valued RM 60million to the Developer!!!

It is very interesting that Penang Chinese Chamber of Commerce President Tan Sri Tan Kok Ping is supporting YB Lim Guan Eng on handling of Kg Buah Pala issue?? What would be the interest of Chamber of Commerce.....$$$$$$?

The Villagers had placed their faiths and hopes in PAKATAN and rallied for PAKATAN during 2008 Election hoping that their struggle over 30 years to get their own Malaysian Land Title shall be over when PAKATAN forms the government which seen as WHITE KNIGHTS for the People . Their Adun is from DAP and always told them not to worry and was assured them that their land is safe and they should continue their Court struggle and fight for the Land .

Little did the Villagers realize that the Malaysian Title has been issued by PAKATAN Government to the Cooperative on 27/3/2008 without a hint which has murdered Villagers in Court of Law and brandish them as squatters and tresspassers.

The Villagers was betrayed of the highest kind by the present State Government whom i believe sold out the Villagers in favour of the Cooperative and Developer. As We are all aware, No matter which ever government rule the State the Developers will try to play their cards to take advantage of prime land in the State.

As one reporter told me... " Government may change... but lies does not change"

The issuance of Malaysian Title on 27/3/2008 by the PAKATAN Government to the Cooperative murdered the Villagers in Court of Law where the Court of Appeal ruled that the Villagers are tresspasser on the Cooperative Land because Title has been issued to Cooperative and summarily judged in favour of the Cooperative without the benefit of full trial to the Villagers!!! And therefore no locus standii or rights to pursue the matter in court. The leave to appeal to Federal Court was not granted by Yang Arif Augustine Paul.

It seems that Penang Govt under YB Lim Guan Eng made a calculated judgement on Kg Buah Pala that the 300 odd viilagers are minority indians and that any resistance can be steamrolled and the issue can isolated from majority chinese as indian issues by using racial cards as HINDRAF collaborators and as MIC-BN collaborators where the majority of Penangnites are chinesse whose sentiments are against BN Government and shall not be bothered with happenings at Kg Buah Pala.

The truth of the treacherous betrayal on the minority and marginalised by Penang DAP Government whom i believe is in the path toward Capitalist Governance where all the poor and middle income irespective of race shall be marginalised and all other malay and chinese kampungs and natural environment, hillside , heritage properties , landscape and culture shall be destroyed in the name of Development of Penang.

More kampungs in Penang like Tanjong Tokong, Teluk Kumbar, Bukit Bendera , expering Leasehold houses will be in Developer's deck of cards for destruction in the name of development and conveniently pointing finger at previous government land scam unless we address the issue now with affirmative action as Penangnites!!!

Most of Penang people live in Villages, Hillsides, expiring Leasehold Houses and Rent Control Houses.... which shall be ideal target for greedy Developers who want prime Lands in Penang where they can make most handsome profit through very helpful politicians.

Penang People should arise as PENANGNITES above the veil of deceits by politicians using racial cards as to divide and rule penangnites to fulfill their own greed for materialistic gain despite the destruction of our multicultural society, landscape and heritages.

Today may be Kampung Buah Pala ... Tommorow shall be Our homes!!!!

Let us come together and save Our Pearl of Orient from Destruction in the name of Development..... People People have put to stop of of Lies in the name of Development and Racial Politics in Penang!! Lets us Remind THEM again as Penangnites!!!

Let's meet, deputy CM tells High Chaparral villagers - Malaysiakini

Penang Pakatan Rakyat government has arranged for a meeting with Kampung Buah Pala residents tomorrow night in an effort to end the long-running High Chaparral crisis.

About 10 state officials arrived at the village in Bukit Gelugor today morning and handed out invitation letters from Deputy Chief Minister 2 P Ramasamy.

The letter signed by Ramasamy (right) said that the meeting would be held in Chief Minister's operations room at Level 28 Komtar at 8pm on Wednesday.

Kampung Buah Pala Residents Association assistant secretary C Tharmaraj accompanied the state officials during the 10am stroll.

The nearly 200-year-old traditional village has 24 households, comprising 65 families and 300 residents.

The letter of invite urged villagers to attend the meeting on their own accord.

The association secretary J Stephen Draviam said the letter obviously forbid the villagers' lawyer from attending the meeting.

Villagers told to vacate land by Aug 2

The letter stipulated that the meeting was organised to resolve all problems arising from the Federal Court decision on June 24.

The Federal Court ruling upheld an earlier Court of Appeal decision favouring the new land owner Koperasi Pegawai Kanan Kerajaan Pulau Pinang and developer Nusmetro Venture (P) Sdn Bhd.

The villagers were served an eviction notice by the developer on July 2 for vacant possession of the land by Aug 2.

They will have to move out from the village where current residents and their ancestors have lived for six generations, and pave way for a lucrative condominium project called Oasis.

A scheduled meeting with Chief Minister Lim Guan Eng earlier this month was aborted when the officials refused the village legal advisor Darshan Singh Khaira from accompanying the residents.

Kampung Buah Pala is also commonly known among locals as Tamil High Chaparral, named after the popular Western television series in 1960s, for its population of cowherds, cattles, goats, other livestocks and lively Indian cultural features.

Several civil societies have joined the villagers to urge the state government to preserve the site as a state living human heritage village.

We need our legal advisor, say villagers

The association will hold a meeting with the villagers tonight to decide on the state government's proposed meeting tomorrow.

Tharmaraj said the association hoped that the state government would allow Darshan (left) to attend the meeting.

"We are just residents of a village. We need our legal advisor's assistance to find a way to end our predicament," he told Malaysiakini.

During a visit to the village last night, MIC youth national coordinator T Mohan said he would lead a group of party youth on Aug 3 to resist any attempt by the developer to demolish and flatten the village.

"Let the authorities arrest me if they want," he said, adding that Pakatan state government had failed to initiate any constructive measures to resolve the High Chaparral crisis thus far.

Human Rights Party (HRP) leader P Uthayakumar and his Hindu Rights Action Force supporters have already vowed to stop the developer from bulldozing the village.

DPP not willing to give documents to Anwar

(Bernama) - The prosecution Monday filed a motion to postpone the implementation of the High Court order for the provision of the documents sought by Datuk Seri Anwar Ibrahim before the start of hearing on his sodomy trial.

The notice was filed at the High Court's Criminal Division here at 2 pm, signed by Datuk Nordin Hassan, one of the Deputy Public Prosecutors for the sodomy case.

Also filed with the notice was an immediate recommendation that the case be heard as soon as possible. However, the court had yet to fix a date for the hearing.

On July 16, Justice Datuk Mohamad Zabidin Mohd Diah allowed Anwar's application and ordered the prosecution to supply the documents concerned within seven days.

Another Deputy Public Prosecutor, Shamsul Sulaiman, when asked about the postponement in providing the documents, said the court must hear the application before Thursday because the seven-day deadline would end on that day.

Anwar, 62, was charged with sodomising his former aide, Mohd Saiful, 24, at a condominium at Bukit Damansara, here on June 26 last year. The court had fixed July 24 for mention of Anwar's application to set aside the sodomy charge against him and the date for mention of the case.

Dr Burhanuddin, a colossal name in Malay left politics, was not a KMM member. KMM only contacted him a week after the fall of Singapore. Ibrahim Yaakub and I interviewed him before suggesting that the Japanese Military Administration employ him as Advisor on Malay Customs and Religion. Dr Burhanuddin accepted the post graciously. Had he declined, KMM would have brought in Ustaz Abu Bakar Al Baqir, founder of the religious institute, Madrasah Maahad Il Ihya Assharif in Gunung Semanggul, Perak.

Dr Burhanuddin worked in Singapore initially, but when the Japanese Military Administration for Sumatra and Malaya was incorporated, and its HQ moved to Taiping, Perak, so did Dr Burhanuddin. We should commend Haniff bin Sulaiman, a faithful Taiping KMM member for introducing Dr Burhanuddin to the public in Perak through talks and religious sermons. That made it easy for the Malay Nationalist Party (MNP), the successor of KMM, to gain a foothold in Perak, when Dr Burhanuddin founded it in 1945.

He had written many protest letters to the press on the Israeli Occupation of Palestine, and was once arrested and detained in a Police lock up. Although not a KMM member, he was very influenced by it.

Ahmad Boestamam

According to a statement given to me dated 12 November 1975, Ahmad Boestamam, another great name in Malay left politics, joined KMM a couple of months before the Japanese invasion. He took over the post of Assistant Secretary from Abdullah Kamil, who had left Kuala Lumpur. Boestamam stated that although he was a member of the daily Majlis editorial board, led by Ibrahim Yaakub in Kuala Lumpur, he was never once invited by Ibrahim Yaakub to join KMM, although two other editorial board members (Abdul Samad Ahmad and Mohamad Salehuddin) were.

Zaid wants Ku Li to join PKR, to reject ‘racism and fascism’

KUALA LUMPUR, July 21 — Datuk Zaid Ibrahim issued an open invitation today for Tengku Razaleigh Hamzah to join PKR and reject what he says is the racism and fascism which has become prevalent in Umno.

Zaid, a former minister who was sacked from Umno, said in a posting on his blog this morning that Tengku Razaleigh was the most senior Umno leader who was not a racist.

The former minister, who joined PKR recently, also took aim at Prime Minister Datuk Seri Najib Razak for keeping quiet over the racial overtones displayed by Umno-controlled newspapers over the controversial death of DAP political aide Teoh Beng Hock.

“Only a Malay prime minister who is not racist can save this country.

“Tengku Razaleigh is a strong nationalist; indeed he is a pure Malay fighter but we never hear in his speeches anything which is hateful or racially insulting,” said Zaid.

Zaid also appeared to mock Najib in heaping praises on Tengku Razaleigh.

“He will not use the police and or the MACC to bring about the downfall of his political rivals. He will not appoint racists as newspaper editors. His wife will not be offended if her photograph does not appear in the newspapers.”

The remarks are a clear reference to the Pakatan Rakyat’s (PR) accusations against the Barisan Nasional (BN) in allegedly using the police to aid in the recent power grab in Perak, and also the current anti-graft investigations of the Selangor government which has now been overshadowed by the suspicious circumstances of Teoh’s death.

Zaid also appeared to be referring to an article on Sunday in the Umno-controlled Berita Harian that was written by New Straits Times group managing editor Zainul Ariffin Isa.

Zainul had suggested that the opposition was using Teoh’s death as part of an agenda to weaken Malay-controlled institutions. He also criticised Selangor Mentri Besar Tan Sri Khalid Ibrahim for questioning “those of his own race to act fairly”.

Zaid said that it was unfortunate that Tengku Razaleigh still harbours hope that he can save Umno.

“For me, Umno today is no longer the Umno which Ku Li fought for previously. I think it is better if Ku Li considers joining Parti Keadilan Rakyat.”

Zaid said that many Umno leaders and lawmakers could no longer differentiate their nationalist responsibilities from racist and fascist thinking.

“That is why they cannot save the country. That is why Berita Harian and Utusan Malaysia constantly reflect evil philosophies of racial and religious hatred.

“It does not make sense when Umno leaders ask their media messengers to describe the anger and sadness felt by Malaysians over Teoh’s death as politicisation.

“They even describe the sadness of the public as something which is questioning Malay institutions. Since when is MACC a Malay institution? This is the kind of racial poison which has been absorbed into the minds of Umno’s leaders and media,” he said.

Zaid also expressed hope that the Malay community would not be “deceived by racial poisoning,” because he said the Malays were a noble and responsible people.

The Malays, he said, were also proud of their Islamic values which viewed with contempt any form of racism.

“When the Malays and their leaders reject racism and fascist thinking then only can Malaysia be saved,” he said.

Hindu Priest Suffers Serious Religious Assault in National Service in Singapore

My dear brothers and sisters of Singapore and humanity in general,

We request your urgent attention!

Madana Mohan Das (a full-time Hindu Priest, IC No.: S9029832A, serving his compulsory National Service as a Private at Jurong Camp 1), is a Hindu Brahmin priest and as a priest, he has to follow strict dietary principles of our faith by not eating meat, fish, eggs, onion, garlic and mushrooms. We are not allowed any intoxication including coffee and tea. Our priests only eat food cooked as prayer offerings, technically called Prasadam.

When he was enlisted into Basic Military Training (BMT), he was allowed to have his food brought in from the temple. Upon completion of his BMT, he was posted as a driver. The commanding officer then made a request for him to be posted as a clerk so that he could be allowed to have his food brought from the temple and perform his national service without compromising his faith.

However we were told that this request was rejected and he has been disallowed to have his meals to be brought to him from the temple. We have sent a letter dated 15 May 2009 to Mindef about this situation but they flatly denied providing any assistance. He is allowed to book out of the camp every Tuesday and Thursday evening and the weekends. Only then has he the chance to eat a proper meal at the temple whereas the rest of the days, he is sustaining on dry ration brought from the temple on Tuesdays and Thursdays.

In the meantime, his superiors forced him to eat the food at his camp and have asked him to cut off his Sikha, the tuft of hair kept by Hindu priests. They charged him twice; once for food and once for the sikha. He chose to go for court marshal. He was told that the trial would be in two weeks’ time. While he was waiting for his trial, they suddenly charged him again for the same “offence” and took him on the 20th of July, 2009, to the Detention Barracks (DB), the army jail for an indefinite period of rigorous punishment. But Madana Mohan Das is going on a hunger strike until death, inside the jail as he would not eat anything except Krishna Prasadam (sanctified food), being a full-time temple priest all his life.

Is this justice? In the national service, the Muslims are given provision to have Halal food. The Sikhs are allowed to keep their long hair covered with a turban. Why then can't a Hindu priest be given facility to practice his religion peacefully? Is it because we are a minority that we can be played around with? Is this what our country's much-advertised multi-racial and multi-religious harmony stands for? We don't think so. But we are confused by this incident.

The victim is not against serving his national service, nor are we. We would like to emphasize that we fully support Madana Mohan Das serving his national service. But we are very much disturbed by the insensitivity shown by his superiors towards his religious faith.

Fervent appeals to different ministers of influential disposition were to no avail. So we are appealing to you people for support in a bid to uphold justice and basic human rights.

Therefore, we are here on a campaign to let everybody know about the injustice and religious intolerance shown to an 18-year old Hindu priest. We think that the citizens of Singapore in general, regardless of race, religion, caste, creed and color, agree that everyone has the right to practice his/her religion freely. We humbly request you to spread this word around for the sake of upholding justice. Please send this email to as many people as possible.

Beng Hock died at MACC compound, July 16, in very suspicious circumstances. He was buried yesterday.

The beloved Beng Hock left behind, including his wife and their unborn child, will have to face the grim reality that the killers are still roaming free at large.

For Beng Hock's family, it's a cruel, tormenting torture of a life time that Ahmad Said Hamdan can't possibly empathise.

For Malaysians irrespective of race, as can be vividly seen from pictures of silent outrage at Beng Hock's funeral yesterday, justice cannot be delayed. Justice cannot be denied.

Malaysians will not allow MACC to be a Malaysian Agency for Cover-ups and Conspiracy, or a licensed Syarikat Pembunuh Rakyat Malaysia, or SPRM in Malay.

Najib should know MACC is parked under the Prime Minister's Department. Give us the truth now.

Pakatan Rakyat Youth steps up pressure for setting-up of royal inquiry into Teoh’s death

PUTRAJAYA, July 21 — A day after Teoh Beng Hock was buried, Pakatan Rakyat (PR) stepped up the pressure to demand the government sets up a Royal Commission of Inquiry into his death.

Pakatan Rakyat (PR) Youth leaders handed over a memorandum to a special officer from the prime minister’s officer this morning.

Teoh, the political aide to Selangor executive councillor Ean Yong Hian Wah, was found dead on July 16 outside the Malaysian Anti-Corruption Commission (MACC) office in Shah Alam. The 30-year-old was earlier interrogated as part of MACC’s investigation into the misuse of state allocations by Selangor assemblymen.

“In the memorandum, we urged the federal government to establish the royal commission because if the government fails to establish the royal commission, it will only create negative perceptions and questions on what actually happened,” Anthony Loke told reporters at the entrance of Perdana Putra.

The DAP Youth chief believes that only through a commission can the truth behind Teoh’s death be revealed.

“If Barisan Nasional members call for a royal inquiry, it shows that even ministers do not have a 100 per cent confidence in the police. There are too many outstanding cases like Kugan’s. The police needs to manage its own house before investigating other government agencies,” he said.

Loke said it was important for the ministers to approve the setting-up of the commission at the Cabinet meeting tomorrow.

“We don’t see any reason why the royal inquiry cannot be established. We hope that the commission can be set up tomorrow during the Cabinet meeting. If this matter is further delayed till next week, it will show that there is no interest on the government’s part to solve this issue,” he added.

He also rebuked claims by the government that the Opposition had politicised Teoh’s death.

“This is not about race. A human being died in the compound of MACC. This is not an issue of race,” he said.

KUALA LUMPUR, July 21 — In what appeared to be a veiled criticism of the prime minister’s economic reforms, Tun Dr Mahathir Mohamad played the race card in a posting on his blog yesterday by claiming that non-Malays, and particularly the Chinese, were the real masters of the country.

While he did not name the prime minister, Mahathir put up a stout defence of the NEP with well-worn arguments in what appeared to be an expression of concern over the current administration’s economic liberalisation policies.

“Because they (the Malays) are willing to share their country with other races, the race from the older civilisation of more than 4,000 years and who are more successful, as such today whatever they have now is also being taken away from them,” he wrote in what appeared to be a reference to the Chinese community.

Datuk Seri Najib Razak has announced reforms to the capital markets, taking away the 30 per cent Bumiputera requirement, sparking concerns among some Malays that government protection for them was being taken away.

The prime minister also announced recently the setting up of a merit-based scholarship programme in what was seen as an attempt to appease the non-Malay communities who have been complaining of unfair distribution of aid for top students.

But Mahathir argued in his latest blog post that 39 years after the NEP was introduced, the Bumiputera share of the corporate pie remained at just 20 per cent while the Chinese share stood at 50 per cent even though they consisted of just 26 per cent of the population.

“The Bumiputera property holdings are only 15 per cent while the rest are held by non-Bumiputeras because urban property is worth more than rural property.

“Non-Malay leaders who put themselves in the shoes of the Malays, if they are honest, will feel the disappointment of the Malays in seeing nearly all business and industry in the hands of the non-Malays.”

Those who lived in high-end housing estates were mostly non-Malays, he said while claiming that a significant number of Malays lived in squatter houses.

The latest remarks by Dr Mahathir, who still commands significant support among Umno members, could potentially stoke nationalist sentiments against Najib’s reforms.

In defending the NEP, Mahathir is also signalling once again his displeasure with some of Najib’s policy directions.

Last week, Mahathir criticised the government for reversing his policy of teaching science and mathematics in English.

In his latest comments, the fiery former PM said the NEP was not introduced by force, or by seizing assets, but was even amended many times when there were non-Malay objections.

He pointed out, in oft-heard arguments made by Malay nationalists, that the Malays had gave non-Malays voting rights and citizenship during independence.

“At that time the official name for the country was the Federation of Malay States (Semenanjung Tanah Melayu) but when it was joined with Singapore, Sabah and Sarawak it became Malaysia.

“With that, the identity of the Malays in their own country was lost,” he said.

Mahathir anticipated that “with this article I am sure to be branded a racist by the non-Malay racists”.

“But if they are willing to accept the truth they can compare the sacrifices of the Malays who are the original owners of this land with their sacrifices for the interests of the country.”

He argued that the way forward for peace and progress was for the distribution of wealth in the country to be fair even if unequal.

What the heck does ‘politicising’ mean, anyway?

Many of you, in your comments to the “Guan Eng…” post yesterday seemed to find ‘politicise’ and ‘politicising’ imprecise in its meaning.

I’ve looked at the post again and, yes, the fault is mine.

I could have made myself more clear.

Let me try to atone with a little more clarity in presenting my thoughts.

A few comments to that post will actually aid me in trying to make my point.

Let me reproduce here what I said in that post in relation to what Guan Eng said.

“And I heard Guan Eng make a promise to take a campaign through the country to force the government to appoint the Royal Commission.

I’m all for this, and I’m going to badger Guan Eng’s office to honour his word to the crowd gathered at Kelana Jaya yesterday, but only if they will strictly honour the family’s wishes”

So, no colimac, there’s nothing wrong with Guan Eng’s statement. I’m all for the nationwide campaign. I’m only against Beng Hock’s death being politicised in the course of such a nationwide campaign.

AND also talk about the standard operating procedures during such a questioning. Get at least a qualified doctor and/or lawyer to talk about these things, instead of hitting the BN in every speech. Leave the rakyat with something harder to chew on upon leaving the stadium.

Though, I’d like to make mention that Nik Nazmi did share about Beng Hock’s personal character. Only 1 out of 10 speakers? Most to most, 2 out of 10…

kelana jaya stadium is seriously not a convenient place to be in. I am pretty sure, most of those who were there, stays around PJ area and drives their own car. In addition to that, the announcement came too late and I guess people are getting tired with all these rally and speeches.

I got tired when Khalid Ibrahim started to speak, and went back (which is towards the end of the rally). Personally, we were there so that we could show our support for the cause and make up the numbers. We think that is important, whether or not there will be good speeches or otherwise.

Like you, i hope that the DAP will not politicised the matter, and that PR will somehow facilitate the public in showing their disgust and anger towards the authority in their handling of the case.

Honestly i think those leaders who made speeches, need to take lessons in making good ones. They sound too shallow and does not really express their heartfelt sadness. But this is only my personal opinion lar….

I think the selangor Speaker made a good speech. Was surprise with his fluency in bahasa.

I’m going to try and answer you now, Patriot.

Every parent, sibling and fiancee, regardless of race, must surely be able to empathise with how Beng Hock’s parents, siblings and fiancee must be feeling right now.

Who cannot begin to feel for them, and to understand their need to know the truth behind Beng Hock’s tragic passing, so that they may, in time, bring closure to this sad episode in their lives and to move on?

Which parent, sibling and fiancee, regardless of race, would not join the growing call for the establishment of the Royal Commission of Inquiry to get at the truth of the final hours leading up to Beng Hock’s death?

In my view, none, unless Beng Hock’s death and, more pertinently, the public outcry for the formation of the Royal Commission, begins to be perceived by certain quarters as fronting an agenda other than getting at the truth of this young man’s death.

The sms I received announcing the Kelana Jaya rally read : “JUSTICE FOR BENG HOCK – Vigil at Stadium MBPJ Kelana Jaya, Selangor @ 4.30pm on Sunday, 19th July, 2009. Pakatan Rakyat & NGO leaders will also be present…”

At the stadium, these were some of the banners that I saw on display.

I think the very first banner summed up why the 3,000 odd crowd were there.

We wanted justice for Beng Hock and we wanted the truth.

Period.

I’m in complete agreement with you save for your last sentence.

In fact, I’d say the reverse.

The politicians need us, the rakyat, and in big numbers, to pressure the government to give in and agree to the establishment of the Royal Commission.

Without the rakyat coming out in large numbers to push for the Royal Commission, the Pakatan politicians haven’t a hope of seeing this Commission ever realised.

Trouble is, politicians on both sides of the divide are not averse to trying to ride the current wave of public anger at Beng Hock’s death to try and get some collateral political mileage other than the plain and stated objective, loudly demanded in the banners : Justice for Beng Hock; truth for the rakyat.

Give you an example of collateral political mileage?

Sure.

Malaysiakini reported yesterday that before attending Beng Hock’s funeral yesterday, bith Kit Siang and Karpal held a press conference at which Kit Siang reiterated the demand for the formation of the Royal Commission.

Additionally, Kit Siang “urged Najib to order the MACC to “stop the war against Pakatan”, adding that the anti-graft body has “become Umno’s tool to topple the Selangor government”.

Now, that is a collateral political mileage and is irrelevant to and goes beyond the “Justice for Beng Hock; truth for the rakyat” aspiration of the more than 3,000 at Kelana Jaya on Sunday last.

As irrelevant as Khir Toyo’s RM24m bungalow and the question why MACC have not yet moved to investigate the former Selangor MB for corruption, that was brought up again and again by so many speakers at Kelana Jaya.

Sure, we all want an independent anti-corruption agency that will investigate and prosecute without fear or favour.

And if MACC is not it, then we want to be rid of MACC and have a new authority in place.

However, merge the issue of getting at the truth of the circumstances surrounding Beng Hock’s death and the need to revamp MACC because, as Kit Siang put it, ‘the anti-graft body has “become Umno’s tool to topple the Selangor government’ , and we may find that many who would otherwise not hesitate to join the growing clamour for the truth and the establishment of the Royal Commission of Inquiry, will not be prepared to do so publicly.

And as well know so well, silent support will not get us anywhere.

MCA has come out in support of the call for the Royal Commission, probably realising that civil society generally, and the Chinese community, in particular, is completely outraged, and therefore feels compelled to take the stance it has so as not to be outdone by DAP.

MIC has backed the call, probably feeling confident enough to do so, given that MCA was the first to break rank with BN on this issue.

Rais Yatim and Khairy have made statements supportive of the formation of the Commission.

What’s UMNO’s official position?

Nazri, riding on the spin-doctoring of the UMNO MSM, has chided the opposition for turning Beng Hock’s death into a race issue.

You and I know the truth, but how many have been taken in by this spin-doctoring?

I was at Beng Hock’s funeral yesterday.

Anwar and a delegation from PKR were there.

PAS, led by Salahuddin, were there.

I did not see anyone from UMNO.

And the Malays there to pay their last respects to Beng Hock were few in number.

Would this have anything to do with the UMNO MSM spin-doctoring?

I don’t know.

Just as I do not know if the poor turnout at the Kelana Jaya stadium last Sunday might in any way be attributed to the UMNO MSM spin-doctoring.

What I do know is that the Royal Commission of Inquiry, with terms of reference and a composition that may allow for an independent investigation into the circumstances of Beng Hock’s death, will only come to pass if there is enough pressure brought to bear on the government by the people.

And I fear that we may not be able to achieve those large numbers if our “Justice for Beng Hock; truth for the rakyat” aspiration becomes saddled with the collateral political mileage sought by politicians.

So, Guan Eng, please get your nationwide campaign to call for the Royal Commission of Inquiry to investigate Beng Hock’s death off the ground. However, please leave out any considerations of collateral political mileage in this campaign.

Yes, respect the wishes of the family. Don’t turn this campaign into something else other than its stated objective.

Don’t misrepresent yourselves to the rakyat, by overtly campaigning for the Commission, but covertly hinging other agendas to the same.

Most importantly, don’t give UMNO and its MSM any room to spin-doctor and divide the very people you need to make the Commission a reality.

Let your campaign through the nation in the coming days and weeks, if need be, be about “Justice for Beng Hock; truth for the rakyat” and nothing else.

Police record statement from Tan Boon Wah

SHAH ALAM, 21 July 2009: Kajang Municipal Councillor Tan Boon Wah arrived at the Selangor police headquarters last night to give his statement to police to assist investigations into the death of political aide Teoh Beng Hock, 30, at Plaza Masalam on 16 July.

Tan arrived at 9pm with his wife and lawyer.

Teoh, who was the aide to Ean Yong Hian Wah, the Selangor state executive councillor for New Village Development and Illegal Factory Taskforce, was found dead last Thursday on the roof of the fifth floor of Plaza Masalam after being questioned by the Malaysian Anti-Corruption Commission (MACC).

Earlier, Selangor police chief Datuk Khalid Abu Bakar had advised Tan to present himself at the police station since he had made a police report against the MACC last Saturday.

Tan had earlier refused to give his statement to the police.

Khalid had said if Tan failed to give a statement on the report he had made, a notice would have to be issued under Section 11 of the Penal Code to order him to give a statement at the station, or face the prospect of being charged for making a false report.

Meanwhile, Home Minister Datuk Seri Hishammuddin Hussein said today that police would call 40 people to assist in the investigation on Teoh's death. — Bernama

Angry in Malaysia

"My dear brothers, take note of this: Everyone should be quick to listen, slow to speak and slow to become angry, for man's anger does not bring about the righteous life that God desires. Therefore, get rid of all moral filth and the evil that is so prevalent and humbly accept the word planted in you, which can save you." (James 1:19-21 TNIV)

If you are a follower of Jesus in Malaysia, you are probably angry. Consider the following.

1. Two Muslim journalists infiltrate a Catholic church incognito. They had heard that a number of Muslims had been converted to Christianity through this church. They found no evidence of such conversions. During mass they come forward to take the communion wafer. They did not swallow and held the wafer in their mouths till they had left the church building. They then spat out the wafer and took pictures. They then published an article about their "adventure" together with pictures of the spat-out communion wafer. To date there is no reprimand from any official government body. Police reports have been made.

I come from a free church tradition. I believe the communion bread remains bread though I believe the Spirit of Christ is at the Lord's Supper. This is beside the point. Malaysia is a multi-racial, multi-religious country where the constitution protects the dignity of all religions. The silence from the government is deafening. Imagine if some Christian journalists had thrown the Koran on the floor, taken pictures, and published the story. Of course we should forgive our enemies. But there are other issues involved, including holding the government responsible to its call to protect the dignity of all religions.

2. In recent times the Malaysian Anti Corruption Commission (MACC) has been aggressively investigating public servants from opposition parties. (Of course whether a party is considered an opposition party depends on your perspective. In truth the "opposition" parties form the duly elected governments in a number of states.) Christians should be at the forefront of any fight against corruption. But when politicians from the governing party are rarely investigated while so many politicians from "opposition" parties are investigated, something is seriously wrong.

The glaring double standard gives lie to the fact that the Anti Corruption Commission is a non-partisan body committed to eradicating corruption wherever it is found. It seems that the Commission is but a political tool of the ruling party.

3. And now we learn that a political aide, who was interrogated by the Commission, has fallen to his death from the 14th floor of the Anti Corruption Headquarters. He had been taken to the MACC office at 6pm on Wednesday (July 15th) to assist in the Commission's investigation into the alleged abuse of constituency development funds by several state assemblymen. Did he jump? Was he pushed? We do not know.

What we know is this. He was interrogated till 3.45am in the morning. In the words of Goh Keat Peng:

[Why was a witness being held for questioning for ten hours and only released at 3.45am? What kind of case is it and what is the urgency of the case in question that the witness had to be deprived of sleep and forcibly kept awake till 3.45am? Was the nation deemed to be in grave danger had the witness in question been sent home at a respectable time and asked to report again for questioning the next morning?

The nation could endure long years of waiting over so many other much longer pending cases involving so much more public money and have much greater weight in public interest but this particular case could not wait for the next morning when the witness in question would have been fresher and better rested?

Like I said, if you are a follower of Jesus in Malaysia you should be angry. I am. Which is why I remember James 1:19-21. I know righteous anger can quickly become unrighteous. I know that when I get angry my discernment is compromised. I am more vulnerable to manipulation. I become rash and speak and act prematurely. When I am angry, I need to bear in mind at least two things:

1. Unrighteous anger will not accomplish God's purposes. If our concern is to be agents of God's work, unrighteous anger is out.

2. When we are consumed by anger we only see the evil "out there." We stop working at the evil inside us. We forget the ongoing call to "get rid of all moral filth and the evil that is so prevalent" in our own lives.

However, fear of unrighteous anger should not paralyse us from doing what is right. Followers of Jesus are called to speak up against injustice.

["Speak up for those who cannot speak for themselves, for the rights of all who are destitute. Speak up and judge fairly; defend the rights of the poor and needy." (Proverbs 31:8-9 TNIV)]

And as John the Baptist discovered, "speaking truth to power" may demand the highest price (Matthew 14:1-12). There is a time to speak up. There is a time to act. There is a time for righteous anger. But we must guard our hearts and ensure that all we say and do flow out of the twin loves for God and neighbour (Mark 12:28-31).

Whatever righteous anger may look like, it must come from a heart that has such a deep passion for God that we are deeply pained that His ways are violated. It must come from a heart with such a deep compassion for human beings (of whatever race or religious background) that we are roused when human life is violated. And it must come from a heart that is always suspicious of its own righteousness.

There was negligence on the part of MACC, admits Abu Kassim

KUALA LUMPUR (July 20, 2009) : Malaysian Anti-Corruption Commission (MACC) deputy chief commissioner Datuk Abu Kassim Mohamed admitted that there was negligence on the part of the commission in ensuring the safety of Teoh Beng Hock, and said remedial steps will be taken.

Teoh, the political aide to Selangor exco member Ean-Yong Hian Wah, was found dead on the level five landing of Plaza Masalam, Shah Alam, where the state MACC office is located, hours after he was interrogated by MACC officials on Thursday.

"We have to regain the public's confidence so that they dare to come forward to assist us in our investigations," Abu Kassim said.

He told Nanyang Siang Pau on Sunday that the incident had greatly affected MACC's image.

"All our efforts so far have gone to waste because of the incident," he was quoted as saying.

He said if police investigations implicate any MACC officer in Teoh's death, the commission will ask the police to take action.

Abu Kassim said that according to state MACC officers, they thought Teoh had left the office after interrogation and did pay attention to his whereabouts. This was negligence on the part of the officers, he said.

However, he did not feel that there was inadequate security at the MACC office as it is manned by officers round the clock.

"Teoh came to the MACC office to have his statement taken under very safe situation," he said.

Nevertheless, MACC will ensure that in future, anyone who opts to stay on in the office after being questioned will be closely monitored, he added.

"We will also make it a rule that officers record all movements of people taken to the office for questioning."

Teoh was found dead after apparently falling from the 14th floor office of the Selangor MACC.

Pada tahun 1998 semasa siasatan Kes Rasuah, pihak pendakwaan dengan kerjasama pihak polis telah menggunakan tipu helah dan pemerdayaan untuk mendapatkan sampel darah Dato' Seri Anwar. Semasa di Hospital Kuala Lumpur, Dato' Seri Anwar telah memaklumkan Dr Halim Bin Mansar bahawa beliau enggan beri sampel darah bagi tujuan analisa DNA, ini adalah kerana beliau telah mensyaki akan berlakunya pemalsuan dan perekaan keterangan. Dato' Seri Anwar kemudiannya bersetuju memberikan sampel darah apabila diberitahu Dr Halim bahawa ianya hanya untuk ujian HIV, Hepatitis B dan VDRL sahaja dan bukan untuk tujuan lain.

Seorang pakar forensik dari hospital yang sama juga iaitu Dr Zahari bin Noor telah memberi keterangan bahawa beliau telah menasihati pihak polis agar tidak menggunakan sampel darah tersebut untuk analisa DNA. Pihak polis yang penuh dengan muslihat tetap menggunakannnya walaupun keizinan Dato' Seri Anwar hanya terhad untuk ujian HIV, Hepatitis B dan VDRL. Sampel darah tersebut telah diambil tanpa kebenaran Dr Zahari oleh pegawai polis bernama Mohd Rodwan Mohd Yusof. Ini adalah jelas bahawa sampel darah tersebut telah diperolehi melalui tipu helah serta pemerdayaan untuk tipu helah dan pemerdayaan seterusnya.

Dengan menggunakan sampel DNA tersebut, pihak pendakwaan mengemukakan keterangan untuk membuktikan bahawa Dato' Seri Anwar kononnya pernah menjalinkan hubungan seksual dengan wanita lain dan mengemukakan satu tilam yang kononnya mempunyai kesan-kesan seminal yang mengandungi profil DNA lelaki dan perempuan. Semasa pemeriksaan balas, keterangan ahli forensik Lim Kong Boon telah diputar belitkan serta dikeluarkan dari rekod mahkamah. Ini adalah kerana wujudnya kenyataan yang meragukan oleh ahli forensik tersebut bahawa sampel DNA tersebut mungkin telah diletakkan (planted) oleh pihak ketiga ke atas tilam tersebut. Dalam erti kata lain, beliau tidak dapat mengesahkan samada kesan-kesan tersebut adalah melalui aktiviti hubungan seksual ataupun tidak serta mengakui keterangan mengenai kononnya terdapat kesan air mani itu bukanlah berasaskan pemeriksaan saintifik tetapi melalui keterangan dengar-kata pihak polis.

Barisan peguam Dato' Seri Anwar kemudiannya telah mengemukakan keterangan serta berjaya mencabar kredibiliti saksi-saksi pendakwaan. Antaranya:
  • keterangan berhubung konspirasi politik
  • keterangan berhubung kredibiliti saksi pendakwaan khususnya Ummi Hafilda; dan
  • keterangan berhubung dengan pemalsuan keterangan
Namun, Mahkamah memutuskan keterangan-keterangan tersebut adalah tidak relevan dan membuat keputusan mengeluarkannya daripada rekod Mahkamah. Tindakan tersebut dengan jelas menunjukkan percubaan memastikan Dato' Seri Anwar disabitkan kesalahan dengan apa cara sekali pun.

Di dalam Kes Liwat, keterangan Azizan Abu Bakar yang penuh palsu telah diperolehi melalui manipulasi dan tipu helah oleh pihak polis dan pendakwaan. Ini jelas dilihat apabila pihak pendakwa berulang-kali meminda pertuduhan dan tarikh kejadian dalam pertuduhan tersebut semata-mata untuk mendapatkan sabitan palsu. Dalam kes tersebut, kejadian dalam pertuduhan awal di Tivoli Villa merupakan tarikh dakwaan yang dinyatakan, walaupun Tivoli Villa belum wujud. Akhirnya pembohongan Azizan tidak diterima Mahkamah Persekutuan serta mengenepikan hukuman ke atas Dato' Seri Anwar.

Di dalam Kes Nalla, semasa Nalla telah dipertuduhkan di bawah Seksyen 57 Akta Keselamatan Dalam Negeri (ISA) yang membawa hukuman mati, terdapat percubaan memalsukan keterangan dari pihak pendakwaan iaitu Gani Patail dan juga Dato' Azahar Mohamed yang pada ketika itu merupakan Timbalan Pendakwa Raya. Dengan menggunakan Nalla, mereka meminta Nalla untuk memberi keterangan palsu terhadap Dato' Seri Anwar dengan mengatakan bahawa kononnya Dato' Seri Anwar mempunyai hubungan dengan beberapa wanita. Sekiranya Nalla bersetuju untuk bersubahat dengan mereka dan memfitnah Dato' Seri Anwar, maka beliau akan terselamat dengan semata-mata dikenakan dengan pertuduhan yang lebih ringan.

Di dalam Kes Sukma, beliau dituduh dibawah Seksyen 377D Kanun Keseksaan dimana pihak pendakwaan secara mala fide cuba mengaitkan Dato' Seri Anwar dengan perlakuan liwat ke atas Sukma. Di peringkat Mahkamah Sesyen, Sukma telah diwakili oleh peguam yang dilantik pihak polis, iaitu En. Mohamed Noor Bin Dom. Oleh kerana Sukma telah didera dan diperlakukan tanpa peri-kemanusiaan, beliau berada dalam keadaan tertekan (duress), maka Sukma telah mengaku salah terhadap pertuduhan dan dijatuhkan hukuman penjara 6 bulan, walaupun beliau sebenarnya tidak bersalah!

Sukma kemudiannya telah memfailkan Notis Rayuan terhadap sabitan dan hukuman atas alasan bahawa pengakuan bersalah yang dibuat olehnya adalah akibat deraan dan layanan buruk yang diberikan oleh pihak polis semasa tahanan reman.

Pada 10.12.1998, Sukma memfailkan permohonan lanjutan masa untuk memfailkan Petisyen Rayuan bersama Afidavit Sokongannya yang menyatakan:
  • Beliau telah dibogelkan didalam bilik berhawa dingin, dikasari, digari oleh 6 pegawai polis, dimalukan, didera dan dipukul;
  • Beliau telah ditelanjangi, diambil gambar di hadapan doktor forensik semasa beberapa sampel diambil dari beliau.
  • Beliau telah diugut dan dikasari melainkan beliau mengakui pernah melakukan hubungan homoseksual dengan Dato' Seri Anwar.
  • Apabila beliau telah mengada-adakan cerita yang tidak benar dan memberitahu mengenai hubungan homoseksual yang palsu dengan Dato' Seri Anwar yang akhirnya dijadikan sebagai satu pengakuan palsu barulah Sukma diberikan layanan yang baik, gari beliau dibuka dan beliau dibenarkan memakai pakaian semula.
  • Beliau telah dinafikan hak untuk melantik peguam pilihannya dan telah diugut agar tidak menggunakan peguam yang dilantik oleh keluarganya dan diugut bahawa beliau akan didakwa dengan kesalahan yang lebih berat melainkan beliau menggunakan khidmat peguam yang dilantik oleh polis.
  • Beliau ingin melantik Karpal Singh sebagai peguamnya tetapi tidak berupaya untuk berbuat sedemikian. Sebaliknya polis telah meminta beliau untuk membuat laporan polis mengatakan beliau tidak pernah melantik mana-mana peguam.
  • Beliau telah dipaksa untuk mengaitkan Dato' Seri Anwar terhadap pertuduhan yang dikenakan terhadap beliau dan pengakuan bersalah beliau adalah bukan secara sukarela tetapi adalah kerana tekanan keterlaluan.

Dr Zahari, doktor yang memeriksa Sukma pada 9.9.1998, menegaskan dalam afidavit yang diikrarkan olehnya pada 22.1.1999 bahawa tidak berlakunya sebarang hubungan homoseksual di antara Dato' Seri Anwar dengan Sukma. Apabila perkara ini dirayu kepada Mahkamah Rayuan, rayuan Sukma dibenarkan dan penghakimannnya telah menyatakan wujudnya penyembunyian keterangan yang material oleh pihak pendakwaan. Mahkamah Rayuan kemudiannya memerintahkan agar kes Sukma dibicarakan semula dan dihantar semula ke Mahkamah Sesyen. Pihak pendakwaan kemudiannya telah menarik balik pertuduhan terhadap Sukma.

Dalam Kes Munawar dan Mior pula, pihak polis telah menggunakan modus operandi yang sama seperti dalam Kes Sukma iaitu deraan dan seksaan bagi mendapatkan pengakuan palsu.

Usaha pihak pendakwaan, khususnya Gani Patail untuk menganiaya juga dapat dilihat pada insiden 20.9.1998 di mana Dato' Seri Anwar telah dicederakan dan menjadi mangsa kekejaman pihak polis dalam tahanan polis. Insiden tersebut kini dikenali sebagai 'insiden mata lebam'. Suatu penyiasatan telahpun dijalankan, tetapi terdapatnya tipu helah dan pemerdayaan yang sekali lagi dalam proses penyiasatan tersebut, yang sekali lagi melibatkan siapa lagi, kalau bukan Gani Patail.

Pada 20.9.1998, jam 9 malam, ACP Koh Hong Sun atas dakwaan Kes Liwat, Dato' Seri Anwar telah dibawa ke Bukit Aman. Lebih kurang pukul 10.30 malam, bertempat di dalam lokap, Dato' Seri Anwar telah dikenakan serangan fizikal yang serius di mana Dato' Seri Anwar telah ditampar dan ditumbuk dengan kuat dan juga telah dipukul secara 'karate chop' berkali-kali sehingga separa tidak sedarkan diri oleh Tan Sri Rahim Noor, Ketua Polis Negara pada ketika itu.

Gani Patail dan juga Tan Sri Musa Hasan, Ketua Polis Negara masa kini, ada bersama-sama dengan Rahim Noor serta beberapa pegawai polis lain pada malam tersebut di tingkat 30 Bukit Aman. Dato' Seri Anwar kemudiannya ditahan di bawah Akta Keselamatan Dalam Negeri (ISA) agar beliau tidak perlu dihadapkan ke Mahkamah. Satu laporan palsu telah dilaporkan ACP Koh pada 21.9.1998 bagi merealisasikan penahanan tersebut.

Selepas diserang dan dipukul, Dato' Seri Anwar berada dalam keadaan separa-sedar dan telah dinafikan rawatan perubatan selama lima hari dan hanya pada 24 / 25.9.1998, barulah beliau dirawat tanpa pemeriksaan oleh Dr Vasantah Ponniah.

Dato' Seri Anwar kemudiannya dibenarkan membuat laporan polis pada 27.9.1998 dan pada tarikh yang sama, Dato' Mat Zain Bin Ibrahim telah dilantik menjadi pegawai penyiasat. Selepas tengah hari, Mat Zain telah membawa dua pakar forensik iaitu Dr Halim dan Dr Zahari untuk memeriksa Dato' Seri Anwar.

Sepanjang siasatan dilakukan, laporan-laporan Mat Zain telah dimanipulasi oleh Gani Patail dengan membawa Dr Abdul Rahman Yusof yang menyediakan laporan perubatan. Mat Zain telah melahirkan kecurigaannya berikutan kejadian tersebut. Tambahan pula, Dr Rahman yang mengeluarkan laporan perubatan tidak pernah memeriksa Dato' Seri Anwar.

Pada 6.11.1998, Tan Sri Mohtar Abdullah, Peguam Negara ketika itu, membuat kenyataan media bahawa beliau masih belum menerima kertas siasatan berhubung insiden mata lebam dan pada 20.11.1998, Mohtar membuat kenyataan bahawa kertas siasatan telah diserahkan pada 19.11.1998, walhal Mat Zain telahpun menyerahkan pada 30.10.1998.

Rentetan insiden mata lebam, dengan jelasnya menunjukkan bahawa Gani Patail dan Musa Hasan terlibat dan merupakan sebahagian konspirasi menyediakan laporan polis palsu yang dibuat oleh ACP Koh berhubung penangkapan Dato' Seri Anwar serta konspirasi menyediakan Laporan Perubatan Dr Rahman yang palsu kerana beliau tidak pernah memeriksa Dato' Seri Anwar secara fizikal.

Berikutan dari Laporan polis Dato' Seri Anwar, Mat Zain memfailkan tindakan fitnah yang berlaku. Dalam Pernyataan Tuntutannnya, Mat Zain menghuraikan apa yang sebenarnya berlaku semasa siasatan insiden mata lebam. Beliau juga menjelaskan tujuan laporan Dr Rahman diadakan adalah untuk menjejaskan laporan perubatan sedia ada serta bertujuan menunjukkan bahawa kecederaan yang dialami Dato' Seri Anwar adalah "self-inflicted".

Cerita konspirasi terhadap Dato' Seri Anwar bukanlah sesuatu yang sengaja diada-adakan, sebaliknya benar-benar berlaku sepertimana didedahkan dalam Video Klip VK Lingam yang disahkan ketulenannya oleh siasatan Suruhanjaya Di Raja.

Rentetan peristiwa sejak 1998, Gani Patail dan Musa Hasan kini telah diberi ganjaran atas peranan mereka dan kini menjawat jawatan tertinggi masing-masing selaku Peguam Negara dan Ketua Polis Negara.

Di dalam Kes Terkini, selain Gani Patail dan Musa Hasan, Dato' Seri Najib Razak, juga memainkan peranan di dalam konspirasi khususnya untuk memastikan agar Dato' Seri Anwar tidak menggugat kerjaya politik Najib.

Di dalam Kes Terkini, pengadu yang membuat laporan palsu terhadap Dato' Seri Anwar adalah Mohd Saiful Bukhari Bin Azlan. Melalui apa yang telah dilaporkan didalam media-media cetak dan elektronik serta sumber-sumber yang dipercayai, Saiful ada berjumpa Najib sebelum laporan palsu dibuat olehnya. Najib yang pada mulanya menafikan pernah bertemu dengan Saiful akhirnya mengakui bahawa beliau ada berjumpa dengan Saiful sebelum Saiful membuat laporan palsu.

Dato' Seri Anwar menegaskan bahawa adalah suatu yang tidak munasabah dan tidak selaras dengan undang-undang yang sedia ada untuk seseorang yang mendakwa dirinya menjadi mangsa kesalahan seksual untuk berjumpa Timbalan Perdana Menteri yang tidak mempunyai sebarang bidangkuasa untuk menerima sebarang aduan, secara formal ataupun tidak, berhubung kesalahan jenayah.

Mengapakah Saiful tidak terus membuat laporan polis sekiranya benar dia telah diliwat yang didakwa serta-merta? Apakah perlunya beliau berjumpa Najib?

Bagi melancarkan konspirasi yang telah dirancang, Najib telah memberi nombor telefon Musa Hasan kepada Saiful yang kemudiannya mengarahkan Rodwan (pegawai di bawah Musa Hasan yang merupakan pegawai polis yang sama mencuri sampel darah Dato' Seri Anwar bagi tujuan analisa DNA dalam Kes Rasuah 1998) untuk mengendalikan proses membuat laporan polis sebelum dari tarikh insiden liwat 26.6.2008 yang didakwa berlaku.

Selanjutnya Saiful ada bertemu dengan Rodwan sehari sebelum kejadian liwat dikatakan berlaku di Bilik 619, Hotel Concorde. Apakah perlunya Saiful berjumpa Rodwan sehari sebelum insiden liwat dikatakan berlaku di bilik hotel? Saiful juga pernah menghubungi Rodwan beberapa kali sebelum tarikh insiden liwat dikatakan berlaku.

Siapakah Saiful sebenarnya? Saiful telah lama mempunyai hubungan akrab dengan pegawai khas Najib, Khairil Anas.

Jelas menunjukkan bahawa ada konspirasi di dalam Kes Terkini di mana watak-watak utama di dalam kes tahun 1998 juga memainkan peranan mereka di dalam Kes Terkini.

Dalang-dalang disebalik konspirasi juga menggunakan Masjid sebagai salah satu cara untuk menyebarkan fitnah. Ini berlaku apabila pihak berkuasa mengaturkan upacara di Masjid Wilayah membenarkan Saiful membawa sumpah palsunya pada 15.8.2008.

Upacara tersebut telah dirancang dengan kerjasama Pengarah JAWI. Salah seorang imam Masjid Wilayah tersebut, Ustaz Ramlang Bin Porigi telah diarahkan Pengarah JAWI, Dato' Che Mat Bin Che Ali untuk menyaksikan upacara sumpah palsu tersebut.

Ustaz Ramlang telah mengikrarkan satu Akuan Bersumpah pada tarikh 6.9.2008 menyatakan beliau telah terperangkap dengan situasi yang tidak diduga serta upacara sumpah palsu tersebut diaturkan dengan izin Che Mat selaku Pengarah JAWI.

Ustaz Ramlang menegaskan pengakuan sumpah tersebut tidak berlandaskan syarak dan tidak menepati kehendak usul fiqh dan berpendapat sumpah sedemikian adalah sumpah laknat.

Selepas pendedahan Ustaz Ramlang, beliau telah ditukarkan ke bahagian kewangan walaupun beliau seorang tahfiz Al-Quran dan tiada kelayakan relevan dengn kewangan dan kemudiannya dihantar satu surat tunjuk-sebab bertarikh 20.1.2009 atas alasan menjejaskan nama baik perkhidmatan awam dan akhirnya disingkirkan dari perkhidmatan pada 21.5.2009. Apabila kerajaan dipimpini oleh pemimpin-pemimpin yang corrupt serta tidak berperi kemanusiaan, inilah yang berlaku, kerjaya serta nyawa manusia menjadi buah catur politik dan permainan mereka.

Konspirasi terhadap Dato' Seri Anwar berterusan walaupun setelah pertuduhan dikemukakan. Dato' Seri Anwar telah berkali-kali memohon kepada pihak Responden agar dibekalkan dengan dokumen-dokumen bagi tujuan pembelaan, antaranya pernyataan-pernyataan saksi-saksi relevan yang telah dirakamkan polis, segala keterangan dokumentari yang akan digunakan di dalam perbicaraan dan sampel-sampel analisa DNA berkaitan pertuduhan tersebut. Dato' Seri Anwar melalui peguamcaranya telah memohon kepada pihak Pendakwaan dibekalkan dokumen-dokumen serta barangan sepatutnya.

Namun demikian, sehingga kini, pihak pendakwaan gagal, enggan membekalkan kesemua perkara-perkara yang dipohon. Keengganan dan kegagalan pihak pendakwaan membekalkan kesemua dokumen-dokumen, barangan-barangan serta sampel-sampel yang dipohon adalah bercanggah dengan piagam dan polisi pihak pendakwaan. Secara jelasnya menidakkan hak Dato' Seri Anwar.

Didalam laporan perubatan Saiful dari Hospital Pusrawi, jelas membuktikan bahawa tidak ada sebarang kemasukan atau penetrasi berlaku pada lubang dubur Saiful. Tiada apa-apa yang berlaku pada duburnya. Laporan Pusrawi ini jelas membuktikan bahawa dakwaan Saiful adalah palsu dan Dato' Seri Anwar tidak bersalah. Namun demikian, laporan Pusrawi tersebut turut tidak dibekalkan kepada Dato' Seri Anwar mahupun penguamcara beliau.

Selain dari laporan Pusrawi, terdapat Laporan Hospital Kuala Lumpur bertarikh 13.7.2008 oleh tiga pakar Hospital Kuala Lumpur yang mengesahkan bahawa tidak ada tanda-tanda kemasukan atau penetrasi pada lubang dubur Saiful.

Laporan HKL ini jelas menyokong laporan Pusrawi yang menolak adanya sebarang kemungkinan ada berlakunya penderaan dan kejadian liwat.

Memandangkan Kes Terkini adalah satu komplot jahat, Dato' Seri Anwar telah membuat laporan Qazaf kepada bahagian Penguatkuasaan JAWI pada 9.7.2008 terhadap Saiful berhubung dengan fitnah dan dakwaan palsu beliau bahawa beliau telah diliwat. Berikutan laporan Qazaf tersebut, Dato' Seri Anwar telah memberi keterangan kepada pihak JAWI pada 30.7.2008 dengan memaklumkan bahawa Saiful telah memfitnah dengan membuat tuduhan palsu dan mengaibkan Dato' Seri Anwar.

Dato' Seri Anwar melalui peguam syarie telah berkali-kali menghantar surat kepada penguatkuasaan JAWI meminta agar Saiful didakwa atas tuduhan palsunya. Namun apa yang berlaku adalah, kelewatan. Kelewatan meneruskan pendakwaan terhadap Saiful adalah tidak munasabah dan bercanggah dengan kemurnian prinsip Islam yang mengutamakan keadilan. Kelengahan ini akan hanya memperkukuh persepsi rakyat atas wujudnya campurtangan politik dalam urusan Mahkamah Syariah. Kelewatan ini juga disengajakan untuk melindungi Saiful yang menjadi saksi utama dalam konspirasi.

Pada 10.9.2008, Kes Terkini ditetapkan sebutan di Mahkamah Sesyen. Pada tarikh tersebut, pihak pendakwaan telah mengemukakan satu sijil bertarikh 9.9.2008 yang dikeluarkan di bawah Seksyen 418A(1) Kanun Prosedur Jenayah dengan tujuan memindahkan Kes Terkini dari Mahkamah Sesyen ke Mahkamah Tinggi. Sijil tersebut telah ditandatangani sendiri oleh Peguam Negara, Tan Sri Abdul Gani Patail. Gani Patail lagi?!

Barisan peguam Dato' Seri Anwar membantah pemindahan kes tersebut dan secara khususnya terhadap Sijil tersebut. Alasan utama adalah peranan yang dimainkan Gani Patail dalam menandatangani Sijil tersebut, walhal beliau telahpun dikecualikan dari melibatkan diri di dalam sebarang penyiasatan dan pendakwaan terhadap Dato' Seri Anwar. Kenapa perlu beliau libatkan diri? Apa yang cuba beliau pengaruhi? Apa yang beliau cuba sembunyikan? Jika tidak ada angin masakan pokok bergoyang?

Mahkamah Sesyen kemudiannya menetapkan 24.9.2008 untuk mendengar hujahan-hujahan berhubung dengan bantahan yang dibangkitkan oleh barisan peguam Dato' Seri Anwar.

Pada 22.9.2008, Dato' Seri Anwar mengikrarkan dan memfailkan Afidavit memperincikan fakta-fakta dan melampirkan ekshibit-ekshibit menunjukkan sebab Gani Patail tidak harus terlibat dalam penyiasatan dan pendakwaan terhadap Dato' Seri Anwar di dalam Kes Terkini.

Alasan tersebut adalah:
  • Penglibatan dan peranan Peguam Negara di dalam pemalsuan keterangan terhadap Dato' Seri Anwar berhubung 'insiden mata lebam' yang merupakan isu yang masih diteruskan dengan Suruhanjaya Pencegahan Rasuah Malaysia (SPRM).
  • Wujudnya prasangka Gani Patail terhadap Dato' Seri Anwar.
  • Atas sebab wujudnya ketegangan dan permusuhan di antara Gani Patail terhadap Dato' Seri Anwar dan terdapatnya dakwaan pemalsuan keterangan oleh Gani Patail, maka Perdana Menteri ketika itu, Tun Abdullah Badawi membuat pengumuman umum bahawa Gani Patail tidak akan terlibat sama sekali dalam penyiasatan dan pendakwaan Kes Terkini.
Pihak pendakwaan kemudiannya memfailkan Afidavit Jawapan terhadap Afidavit 22.9.8 yang diikrarkan oleh Peguamcara Negara, Datuk Idrus bin Harun pada 8.10.08. Di dalam Afidavit Jawapan tersebut, pihak pendakwaan tidak menafikan penegasan-penegasan yang dibuat Dato' Seri Anwar berhubung dengan peranan yang dimainkan oleh Gani Patail. Pada 29.10.2008 Dato' Seri Anwar dan Dato' Seri Wan Azizah mengikrarkan jawapan terhadap Afidavit Jawapan Idrus.

Pada 7.10.2008, Mahkamah Sesyen kemudian memutuskan bahawa Sijil tersebut tidak sah dan tidak memindahkan Kes Terkini ke Mahkamah Tinggi.

Tetapi pada 5.3.2009, Mahkamah Tinggi membenarkan Permohonan Semakan oleh pihak pendakwaan dan memerintahkan kes dipindahkan ke Mahkamah Tinggi Kuala Lumpur. Dato' Seri Anwar kemudiannya memfailkan rayuan ke mahkamah Rayuan terhadap perintah Mahkamah Tinggi tersebut.

Dan terkini, rayuannya ditolak. Bolehkah kita sebagai rakyat meneruskan kepercayaan kita bahawa institusi penghakiman dan mahkamah di negara ini bebas dari sebarang pengaruh? Berdasarkan kepada apa yang telah dibentangkan dan dihuraikan di atas, jelas terbukti bahawa pendakwaan terhadap Dato' Seri Anwar dalam Kes Terkini yang kononnya Saiful diliwat adalah merupakan pendakwaan mala fide dan penyalahgunaan proses undang-undang yang ketara pada peringkat tertinggi bagi memenjarakan Dato' Seri Anwar dengan apa cara sekalipun serta melindungi penjenayah-penjenayah konspirasi yang masih berleluasa diluar sana bagi mengelakkan terdedahnya kes-kes rasuah serta salah laku pucuk pimpinan tertinggi UMNO-BN daripada pengetahuan rakyat.

Another eclipse Vasthu Sastra

WE are currently in one of the most negative periods of the year.

The 21st century's longest total solar eclipse will occur on July 22 and in Indian astrology, this is an inauspicious event. People have to be extra careful because it will have a negative impact on them.

The eclipse will be visible in India , Nepal , China , Hawaii and over the Pacific Ocean and will last for up to 6 minutes and 39 seconds.
The path of the Moon's umbral shadow will begin in India and cross through into Nepal , Bangladesh , Bhutan , Myanmar and China . After leaving mainland Asia, the eclipse will cross into Japan 's Ryukyu Islands and curve southeast through the Pacific Ocean .

A partial eclipse will be seen within the much broader path of the Moon's penumbral shadow, which will include most of eastern Asia, and the Pacific Ocean .

A dark red shadow will creep across the sun and this can be observed in
Malaysia from 9.07am to 9.48am on July 22.
Astrologically, this eerie dark light is viewed as inauspicious and it will cause some form of discomfort. Any eclipse signals a time to be wary and this is especially true if the sun is involved because all living beings are dependent on the sun for light.

As I have said in an article in January about a solar eclipse which occurred during the Chinese New Year, the power of negative energy is said to increase during such a time. When the environment becomes conducive for negative energy to amass, the chances of it affecting people increases.

The impact of the negative energies when the sun is obscured causes a lack of courage, fatigue and low self-esteem.
People are advised not to carry out activities as usual during the eclipse period as they may behave irrationally. Everyday activities that should be avoided during the time of the eclipse are sleeping, conjugal relations, swimming, holding meetings and weddings and all religious or special events.

All Hindu temples will be closed during the eclipse period. People are urged not view the eclipse directly, and it is better not to travel during the period and stay indoors.

Those who were born during an eclipse should take even more care than others and those born under the zodiacs following the moon sign of Aries (Mesha), Pisces (Meena), Libra (Thula), Sagittarius (Dhanus) and Gemini (Mithuna) should also exercise caution this month.

After the eclipse, people should offer prayers and clean their houses to remove all "harmful energies''.

There are also six transits in the astrological chart this month which will see Jupiter moving backwards into Capricorn. The movement indicates negative effects.
During such an unfavourable period, every individual will experience some sort of disruption at work, home, business and travel.
