Police cover up about Kugan´s death

he distraughted family of a 22-year-old man who died in police custody yesterday lodged a police report this evening allegeding foul play.

Kugan Ananthan, who was detained in connection with several car theft cases, died at the Taipan police station in USJ yesterday morning.

The youth was detained by the police on Jan 15 in Kajang for questioning regarding several car theft incidences in the Subang Jaya district.

Kugan was subsequently held at the Puchong police station under a two-week remand to facilitate investigations.

Selangor police chief Khalid Abu Bakar was reported as saying yesterday that Kugan had died of breathing difficulties.

Photographs and video footages of Kugan taken yesterday at the mortuary however revealed severe marks on his body. There were also deep cuts in his wrists and blood was oozing from his nose and mouth.

Four family members of Kugan filed the police report today and they were joined by lawyers, human rights activists and several politicians from both Barisan Nasional and Pakatan Rakyat.

kugan death protest 210109 posters 02Among them were PKR’s Kapar MP S Manikavasagam, DAP’s Puchong MP Gobind Singh and Teluk Intan’s DAP MP M Manoharan.

Also present was a group of MIC Youth members led by its head T Mohan. Hindraf representative, led by S Jayathas, were also there.

Some 80 people had also gathered at the police station to show their anger over Kugan’s death.

They held up banners with pictures of the deceased, showing the injuries he sustained while in police custody.

Some of the banners read: “Police are licensed killers”, “Police are killing Indians” and “Police are thirsty for Indian blood” in both Malay and English. They also briefly chanted slogans demanding a probe into Kugan’s death.

Heavy police presence

Talking to reporters later, Kugan’s family members said that the deceased did not suffer from asthma and could not have died from breathing difficulties as claimed by the police.

kugan ananthan injuries 210109 backManikavasagam and Gobind added that the police were attempting to cover up the death and that there should be a full and open investigation by the Home Ministry, which oversees the police department.

Manikavasagam also said that he would organise rallies to protest against the police.

The crowd then dispersed peacefully after gathering for about 30 minutes.

There was a heavy police presence outside of the station while the police report was being lodged.

Eight Federal Reserve Unit (FRU) vehicles were parked within sight of the police station.

Yesterday Khalid told reporters that Kugan had asked for a glass of water during interrogation and upon drinking the water, he collapsed and lost consciousness.

“A doctor from a clinic nearby who was summoned to examine the man, and later confirmed that he had died,” he had said.

The state police chief also said that a thorough probe would be conducted on the matter and asked people not to speculate on the cause of death.

Group storms hospital mortuary

(NST) - A group of about 50 people stormed the Serdang Hospital mortuary on Tuesday night and locked themselves inside for three hours with the body of a youth who had died earlier in police custody.

The body of A. Kugan, 22, an odd-job worker, was the subject of police investigation as his family had alleged he was a victim of police brutality.

The group had allegedly pushed out a medical assistant and his two staff before conducting their own checks on the body. They left the mortuary about 2.30am.

When the hospital staff went inside, they found that the clothes had been torn off the body. The medical assistant immediately lodged a police report.

Kugan had been detained at the Subang Taipan police station since Jan 14.

He collapsed on Tuesday while being interrogated. His body was sent to the hospital for a post-mortem.

Selangor police chief Datuk Khalid Abu Bakar questioned the motive of the group, saying it was tantamount to tampering with evidence.

"The investigating officer was not present nor was the doctor. What were they doing with the body?"

Hours after the group left the mortuary, photographs allegedly showing bruises on Kugan's body were circulated on the Internet and among reporters.

"Do they want to see justice done or just hamper police investigations? Let us conduct the investigations first. Do not take the law into your own hands," Khalid said, promising a fair and thorough probe.

Kugan's family and several political parties lodged police reports yesterday urging the authorities to investigate the circumstances leading to his death.

Kugan's father, R. Ananthan, demanded that those responsible for his son's death be brought to justice, adding that there were bruises on Kugan's neck, back, hands, legs and wrists.

Some 200 people, including representatives of MIC and Pakatan Keadilan Rakyat, (PKR), accompanied Ananthan to the police station here yesterday, carrying placards and photographs of Kugan.

Kugan was arrested after a car chase in Sungai Chua, Kajang.

He was caught after a brief struggle while his accomplice escaped on foot when their car was cornered.

Kugan was being investigated for a series of robberies and theft of luxury cars.

Government Must Act Urgently to Stop Custodial Killings

I strongly denounce the action of the police officers who were involved in beating up Kugan Ananthan, resulting in his death. It is disturbing to note such barbaric behaviour among some members of the police force.

But what is even more shocking is the fairy tale spun by Selangor police chief Khalid Abu Bakar who has been reported saying Kugan had died of breathing difficulties.

Khalid should be ashamed of himself for trying to protect his officers who had caused grievous bodily harm to the 22-year-old man.

I watched the video recording of Kugan taken at the mortuary. The footage revealed severe marks on his body, deep cuts on his wrists and bruises on his legs. Blood was oozing from his nose.

Kugan was held under a two-week remand to facilitate police investigations linking him to several car theft cases. The job of the police is clearly to find enough evidence to charge him in court. It was not to beat him to death.

This is not the first time we are witnessing abuse of detainees or custodial deaths. Human rights lawyers, civil rights activists and members of non-governmental organisations have highlighted cases of police abuse in the past. But there has been no concerted action taken by the government or police.

According to statistics revealed in Parliament last year, there were a total of 1535 custodial deaths in the country between 2003 and 2007.

However, the lack of action by the government to punish errant police officers only goes to show the disturbingly close link between the government and the force.

The nation was shocked when reports of police personnel abusing and pouring hot water on carpark attendant B.Prabakar surfaced. But the fact that the incident and public outcry did not stop other officers from abusing Kugan only goes to show the leverage of power enjoyed by the police force in Malaysia.

But such audacity and blatant disregard for the law displayed by the police force has to stop. I strongly urge the Home Minister Syed Hamid Albar and police chief Musa Hassan to initiate a thorough investigation into the custodial death of Kugan and take serious action against the police officers who had abused him.

Prime Minister Abdullah Ahmad Badawi must also issue a serious warning to the police force to stop abusing its powers to prevent custodial deaths in the future. In fact, the IPCMC is relevant now more then ever.

Insiden kematian seorang pemuda India di Balai Polis Taipan, USJ, Subang Jaya ketika masih ditahan sangat mengejutkan. Kematian Kugan Ananthan 22 tahun mengingatkan kita kepada insiden M. Ulaganathan, juga mati ketika masih ditahan polis. Mahkamah Tinggi Kuala Lumpur memutuskan bahawa kematian M. Ulaganathan adalah disebabkan kecuaian dan pengabaian melampau pihak polis. Berulangnya insiden seperti ini pasti menghakis keyakinan rakyat terhadap kewibawaan pihak polis sebagai sebuah institusi keselamatan.

Bagi memastikan keyakinan rakyat dipulihkan, saya menuntut agar sebuah badan siasatan yang bebas dan telus diwujudkan serta merta bagi menyiasat insiden kematian Kugan Ananthan. Foto serta bukti yang menunjukkan adanya kecederaan pada si mati sudah tentu membangkitkan rasa tidak puas hati bukan sahaja kepada keluarga mangsa, malah juga kepada seluruh rakyat Malaysia yang mahukan institusi polis memulihkan kembali kewibawaannya.

Saya selaku ahli parlimen dan Ketua Pembangkang Dewan Rakyat, komited untuk membawa isu ini ke Dewan Rakyat kelak. Beserta dokongan rakan-rakan ahli-ahli parlimen lainnya kami akan mencari jalan untuk meningkatkan tahap profesionalisme pihak polis serta memulihkan keyakinan rakyat terhadap institusi keselamatan tersebut.

Polis akan tetap menyiasat punca kematian seorang tahanan di lokap Balai Polis USJ 8, Subang Jaya walaupun laporan bedah siasat menunjukkan kematiannya adalah akibat paru-paru berair.

Ketua Polis Selangor Datuk Khalid Abu Bakar berkata siasatan itu akan diteruskan kerana terdapat dakwaan bahawa kematian tahanan A. Kugan, 22, pada 20 Januari lalu berunsur penderaan semasa di lokap.

"Saya harap keluarga mangsa mahupun orang ramai bersabar terhadap proses siasatan ini kerana saya beri jaminan seratus peratus bahawa kami (polis) akan menyiasatnya secara telus dan adil," katanya.

"Kita dapat maklumat bahawa seorang timbalan menteri berada semasa mayat dituntut di Hospital Serdang dan terdapat kekecohan di situ. Saya sudah arahkan pegawai supaya percakapannya (timbalan menteri itu) dirakam," katanya.

Mangsa ditahan di hadapan sebuah kondominium di Puchong pada jam 1 pagi dan dilaporkan bergelut dengan polis sebelum ditahan.

Maklumat polis menunjukkan mangsa adalah anggota kumpulan yang terlibat dalam kes samun kereta mewah di sekitar Lembah Klang dan Johor.

Hasil intipan di kondominium itu, polis menahan mangsa yang ketika itu sedang memandu kereta Honda bersama seorang lelaki dalam lingkungan umur 30-an. Bagaimanapun rakannya itu dapat melarikan diri.

Hasil tangkapan itu, Polis berjaya mengesan 15 buah kereta mewah, dua daripadanya ditemui di kondomium berkenaan manakala 13 buah lagi di sebuah gudang di Puchong.

Polis akan mengambil kenyataan dua timbalan menteri berhubung insiden semalam di mana kira-kira 50 menyerbu bilik mayat Hospital Serdang yang menyimpan mayat pemuda berusia 22 tahun, yang mati dalam tahanan polis.

Difahamkan, Timbalan Menteri di Jabatan Perdana Menteri, Tu Murugiah dan SK Devamany turut berada di situ.

Menurut the Star, Ketua Polis Selangor, Datuk Khalid Abu Bakar berkata, bedah siasat ke atas mayat Kugan Ananthan menunjukkan dia meninggal dunia kerana terdapat cecair dalam paru-parunya.

Sementara itu, Penasihat Pemuda MIC, S Vell Paari berkata, pergerakan itu akan berusaha sedaya upaya untuk membantau keluarga Kugan.

Vell Paari juga berkata, beliau telah memaklumkan kepada ketua pergerakan itu, T Mohan supaya mendapat laporan perubatan kedua mengenai punca kematian Kugan.

"Kita tidak boleh hanya bergantung kepada laporan bedah siasat hospital," katanya kepada malaysiakini.

Ketika dihubungi, Murugiah berkata, anggota keluarga Kugan sudah pun masuk ke dalam bilik mayat ketika beliau tiba di situ.

"Saya mendapat panggilan dari anggota keluarga mangsa hampir jam 11 malam dan saya terus bergegas ke hospital... apabila sampai di sana, anggota keluarga mangsa sudahpun menyerbu masuk ke dalam bilik mayat," katanya.

"Sebab saya ke sana adalah untuk menenangkan keadaan apabila keadaan menjadi kecoh selepas melihat mereka kecederaan pada badan (Kugan)," katanya.

It appears like the government refuses to allow Malaysians to assemble for picnics or whatever unless they first apply for a police permit. The problem is, when you do apply for one, they will reject your application. So it is a Catch 22.

NO HOLDS BARRED

Some have asked me about the meaning of Civil Disobedience (http://en.wikipedia.org/wiki/Civil_disobedience). It’s actually quite simple. You defy the powers-that-be, but you do it in a passive, not active, manner. You do not resist. You just do nothing. And is this not what Malaysians are good at, doing nothing?

For example, when they charged me in court and asked me to plead ‘guilty’ or ‘not guilty’, I refused to enter a plea. I told the judge, “I shall not respond to the charges on the grounds that the charges are both mala fide and defective.” The judge, however, took that as a ‘not guilty’ plea.

I then raised my voice and told the judge, “I did not plead not guilty! I said I refuse to respond to the charges.” He still took that as a ‘not guilty’ plea and I now face trial.

In another earlier case, I pleaded ‘not guilty’ and the court set bail. I then refused bail and was sent to the Sungai Buloh Prison for three days. My wife came to prison at the behest of the prison authorities who were worried about my safety. Sirul and Azilah had threatened me in front of a senior prison officer, Thana, and they were worried that I might not survive prison.

I told my wife they should not have phoned her to come to prison and that I still refuse bail. Even the tears my wife shed would not move me until she told me they were throwing a party at the Selangor Club on Friday and that I was invited. Hmm…..a party. I am a softie when it comes to partying.

Okay, I told her, prison can wait. Partying comes first. I agreed she post bail and made the party that Friday. Okay, not everyone’s perfect.

Now, how do we take Civil Disobedience to the next level?

Tomorrow, at 9.00am, they will be charging 24 people in the Petaling Jaya Court for the alleged crime of ‘illegal assembly’ during an Anti-ISA Candlelight Vigil at the PJ Civic Centre on 9 November 2008. On Sunday last, they broke up a picnic that was attended by about 200 people at the same PJ Civic Centre. The police declared the picnic an illegal assembly and threatened to use force if the crowd did not disperse.

It appears like the government refuses to allow Malaysians to assemble for picnics or whatever unless they first apply for a police permit. The problem is, when you do apply for one, they will reject your application. So it is a Catch 22. You are breaking the law if you assemble without a police permit but when you apply for one they will refuse to give it to you.

Now, let us look at a hypothetical situation. This is just hypothetical mind you. I am not suggesting we actually go out and do this.

Say, this Sunday, four of us sit down on the ground holding candles in front of the PJ Civic Centre. Just four people -- not more than four people. That would be considered an illegal assembly. The police will then come to arrest us and we shall spend the night in the PJ Police Station.

We would then be brought to court and charged for participating in an illegal assembly. When the charges are read out in court and we are asked to plead ‘guilty’ or ‘not guilty’, we tell the court, “Guilty and proud of it.”

Depending on the mood of the judge, we will either be fined or a jail sentence will be imposed, or both. We then refuse to pay the fine and go to jail.

The following Sunday, another four people do the sit down with candles in front of the PJ Civic Center and we go through the whole process again. Another four people will go to jail. We continue doing this until the jails are full and there is no more space to house us. As it is now the jails are already full. Sungai Buloh Prison is filed up to twice what it was built for, as are the other jails all over the country.

We keep sending four people to jail every week until they abolish or waive the ridiculous law that requires an assembly of four people to apply for a police permit.

That is what is meant as Civil Disobedience. I am not, of course, suggesting we actually do this. I am just giving you an example of Civil Disobedience, which is what Gandhi did to bring the British government down and which eventually gained independence for India.

Anyway, in the meantime, while you ponder on the above, read this item which was e-mailed to me by a close friend:

The Umno ‘Wow Factor’

A farmer named Lakbir Singh was overseeing his herd in a remote pasture in Bolehland when suddenly a brand-new BMW advanced out of a dust cloud towards him.

The driver, a young Malay man in an Armani suit, Gucci shoes, RayBan sunglasses and YSL tie, leans out the window and asks the farmer, "If I tell you exactly how many cows and calves you have in your herd, will you give me a calf?"

Lakbir looks at the man, obviously a yuppie, then looks at his peacefully grazing herd and calmly answers, "Sure, why not?"

The yuppie parks his car, whips out his Dell notebook computer, connects it to his Cingular RAZR V3 cell phone, and surfs to a NASA page on the Internet, where he calls up a GPS satellite to get an exact fix on his location which he then feeds to another NASA satellite that scans the area in an ultra-high-resolution photo.

The young man then opens the digital photo in Adobe Photoshop and exports it to an image processing facility in Hamburg, Germany. Within mere seconds, he receives an email on his Palm Pilot that the image has been processed and the data is stored. He then accesses a MS-SQL database through an ODBC connected Excel spreadsheet with email on his Blackberry and, after a few minutes, receives a response. Finally, he prints out a full-colour, 150-page report on his hi-tech, miniaturized HP LaserJet printer and finally turns to the farmer and says, "You have exactly 1,586 cows and calves."

"That's right. Well, I guess you can take one of my calves," says Lakbir.

He watches the young man select one of the animals and looks on amused as the young man stuffs it into the trunk of his car. Then Lakbir says to the young man, "Hey, if I can tell you exactly what your business is, will you give me back my calf?"

The young man thinks about it for a second and then says, "Okay, why not?"

"You're a graduate from Oxford and a Member of Parliament for Umno," says Lakbir.

"Wow! That's correct," exclaims the yuppie with the customary Umno's Wow Factor, "But how did you guess that?"

"No guessing required," answered Lakbir. "You showed up here even though nobody called you; you want to get paid for an answer I already knew, and to a question I never asked. You tried to show me how much smarter you are, and you don't know a thing about cows. This is a herd of sheep. Now give me ba
ck my dog."

Judge blocks statement from Najib’s former ADC

SHAH ALAM, Jan 22 — In a major setback today for the defence in the Altantuya Shaariibuu murder trial, Justice Datuk Mohd Zaki Md Yasin denied them access to the witness statement of Deputy Prime Minister Datuk Seri Najib Razak's former aide-de-camp DAP Musa Safri.

Mohd Zaki said he was bound by a ruling of the Federal Court that witness statements recorded under Section 112 of the Criminal Procedure Code is privileged.

The application was made by defence lawyer Kamarul Hisham Kamaruddin, who is representing Corporal Sirul Azhar Umar, 36, jointly charged with Chief Inspector Azilah Hadri, 32, for the murder of Altantuya.

Altantuya is the former lover of Abdul Razak Baginda, a close aide of the DPM. Investigators say she was shot and her remains blown up with C4 explosives at a forest clearing near here in 2006.

Mohd Zaki said that from the onset of the trial the defence counsel had sought to get the 112 statements from all prosecution witnesses and this was rejected on the same grounds.

The move is a setback for Sirul's defence team as they wanted Musa's witness statement to rebut Abdul Razak's affidavit.

Abdul Razak was recently acquitted of abetting the two policemen in the murder.

It was argued yesterday that the rebuttal evidence could only come from Musa but the prosecution did not call him to the stand as their witness.

The trial is set to resume on Feb 4 when Sirul is scheduled to testify from the dock.

Azilah and Sirul, members of the police's Special Action Unit (UTK), are accused of murdering Altantuya, 28, at a jungle clearing in Mukim Bukit Raja between 10pm on Oct 19, 2006 and 1am the following day.

They were ordered to enter their defence on Oct 31 last year.

Azilah had testified earlier that he had been instructed by Musa to help Abdul Razak, whom he said claimed to have been blackmailed by a "Chinese woman," believed to be Altantuya, for unknown reasons.

Police to quiz two deputy ministers over dead suspect

PETALING JAYA, Jan 22 — The police are expected to record the statements of two deputy ministers in connection with the incident at the Serdang Hospital mortuary where the body of a suspected car thief was alleged to have been tampered with.

Selangor CPO DCP Datuk Khalid Abu Bakar said a post-mortem showed that A. Kugan died of liquid in the lungs. He was being questioned at the Taipan police station in Subang Jaya when he died.

Kugan’s family and several other people alleged stormed the hospital morgue on Tuesday where Kugan’s body was being kept, removed his shirt and took photographs.

It was reported that Kugan was arrested on Jan 15 on suspicion of being involved in the theft of luxury cars. He was taken to the Taipan police station on Tuesday when he suddenly collapsed and died while being questioned.

Meanwhile Bernama reported that Selangor police chief Datuk Khalid Abu Bakar has confirmed following the post-term, police will investigate the death and assured that there “will be no cover-up in the investigation". He hopes that the family and the general public will be patient.

He was speaking to reporters after a launch of a road safety campaign at the Kajang-Seremban Highway today.

“We regretted that the family and members of the public barged into the Serdang Hospital mortuary where the body was kept, yesterday.”

HINDRAF – Stop the crucifixion of Malaysian Indian

22 years old Kugan a/l Ananthan proclaimed dead after being in custody in Police Station (Balai Polis) - Subang Jaya. What is happening to the Malaysian Indians? Why don’t the UMNO led government just arrest and kill us all as the NAZI’s did in the holocaust once for all as we as the thirds class citizen and are such a sore eye to you. Look at his injuries suffered in the police station at www.makkal.org. Look at the main media spinmaster at New Straits Times that can claim that a 22 year old man can die all of a sudden within 5 days being in police custody. Such atrocities prevail in this modern time for the unwanted Malaysian Indians we are. Does humanity chooses its color, race, religion or are we going to wait for the tailored version post mortem by the UMNO led government to dictate on what actually happened through its spinmasters?

Aren’t we not deserving human to enjoy the same rule of law and constitutional right to life amongst other Malaysians but rather treated as animals and slave?

Why the rule of law, constitutional rights of being a Malaysian takes a back step when it involves a Malaysian Indian? What have we done to deserve such treatment when our forefathers had toiled for the progress and benefit of the nation?

The recent case of Prabakaran’s permanent bodily harm inflicted by the police force has not even settled and we have a dead body of a Malaysian Indian in the police station.

As for the missing Solomon the other who was arrested seems to be out of radar. Is he going to end up as another dead body? The police force has neither released him nor confirmed his whereabouts until today. There is clearly no transparency or accountability by the police force on his matter.

The abuses and human right violations that are perpetrated either in the police stations or outside the police station seems endless without regard to the rule of law and the constitution.

The UMNO led government seems to be providing the protection to the police force in their modus operandi in marauding the public as and how they wish. This is clearly an indication of a police state that is against the principal of democracy in fairness and justice and above all total annihilation of the Malaysian Indians.

What causes Marginalisation?

What I am writing here is happening here in the 21st century WIMAX City of Penang. There is one little Tamil school sitting up on a ledge at the edge of the city with about 100 pupils – with nothing other than a few classrooms, a small canteen and an office.

There is this little girl, Darshini who has been given a week to produce her birth certificate or to leave school by her new school Headmaster.

She is 11 and is in Standard 5 and does not have a Birth Certificate. Her parents’ marriage is not registered, they were married in a temple, married in 1996 or so, she is the second child –. She has seven other sisters and brothers. All her siblings have their birth documents in order except for her – because when she was born her father was working away from Penang for an extended period. Finally when they did get around to applying for a delayed Birth Certificate, the system just overwhelmed them and as the mother put it, she just stopped trying. The procedures are very many, they involve knowing exactly how the system works. There was no assistance available to them, especially to the mother, because here husband just could not take time off from his work, plus I suspect, he was equally vulnerable on this count. Their financial resources were extremely limited. .

Because of the inability to raise this large a family 3 of her brothers and sisters have been given away for adoption. Her father is a crane operator earning about RM900. The flat that they live in again is at the very edge and on top of a hill near Paya Terubong.To get to the main road from where they live, where they could take a bus was a couple of kilometers away. Then with so many little children to take care of and no other support from anyone else, they just could not stay on to fulfill all the requirements of the procedure for the Birth Certificate long enough to get it done. Each time, a visit to the registration department was a major chore for the mother. Several hours of waiting only to be told of more things to do, or things that were not done to the satisfaction of the officers concerned. At the hospital, they were told the Doctor who signed the original birth notification document was not there anymore and therefore they could not get the Doctors attestation, one of the many requirements for the issue of a delayed birth certificate. That really stopped them – until this incident at school when it brought this whole thing up again in an uglier form.

As I was thinking about all of this, the thought keeps cropping up, just how does all of this happen, now and here. The answer I can come up with is just this. Our social , economic and political system works in such a way that marginalization of the poor and the weak, at the periphery of the system, that we see above, is a natural outcome, it is unavoidable. It is so self reinforcing. Poor means ignorance, ignorance means poor and both mean abandonment. Everything above is about the poor and the weakest at the periphery experiencing total abandonment and dispossession. The system seems to operate to do this.

As the Headmaster of the school said, he is frustrated, as the problem keeps on happening. What he was saying is explained best by the following – you can stop one or two old men from dying. But the young keep on becoming old. Stopping one or two from dying does nothing to the problem, the young just keep getting old. What we need to do to have an effect is to stop the young from becoming old. And unless we approach the problem in that way, we are effectively doing nothing. We need a totally different approach to the way this system operates. We have to change the way this system operates if we are to make an impact to this state of affairs. No more political bullshit, we need action with true knowledge and appropriate intent.

We need a system which seeks to realize the full potential of each and every citizen and we need true leadership if we are going to root out this endemic problem of marginalization.

The Hindu Rights Action Force (Hindraf) has sought the help of US president-elect Barack Obama to close the Kamunting detention camp in Taiping, Perak.
Four Hindraf members made the plea in a press statement issued today, saying that the movement welcomes Obama’s decision to close the camp for suspected militants in Guantanamo Bay.
The four held up a banner outside the US Embassy in Jalan Tun Razak, Kuala Lumpur, in a 15-minute demonstration this morning.The assembled police force of about 100 personnel was surprised at the ‘small’ turnout. However, this was Hindraf’s bid to get around the restriction on gatherings of more than four people, which require a police permit.In the statement signed by S Jayathas, Hindraf also congratulated Obama on his inauguration - scheduled for 1am tomorrow, Malaysian time.
Hindraf - banned by the government on Oct 15 last year - also said it counts on his support to help Indian Malaysians who “are being suppressed by the Umno-led government”.R Shan, the movement’s representative in New York, is expected to hand over a petition to Obama in Washington today.A similar petition will be submitted to Najib Abdul Razak when he becomes the prime minister of Malaysia in March.
Hindraf came to prominence in 2007, when it took up a variety of causes close to the Indian Malaysian community. Tamil Tiger chief fled to S-E Asia?

NEW DELHI, Jan 21 – With Sri Lankan troops closing in on the last remaining Tamil Tiger stronghold of Mullaitivu, speculation is rife that rebel chief Velupillai Prabhakaran has fled to South-East Asia to “fight another day”.

Prabhakaran is the leader of the Liberation Tigers of Tamil Eelam (LTTE), a rebel organisation that seeks an independent Tamil state in part of Sri Lanka.

He is wanted by Interpol for murder, organised crime and terrorism.

“We don’t know if he is still there. He may have already fled in a boat,” Sri Lanka’s army chief, Lieutenant-General Sarath Fonseka, told journalists in the capital Colombo over the weekend.

When pressed for more details, he said: “We have no specific information. The only escape route available to them is via the sea towards South-east Asia.”

Indian analysts say Prabhakaran, who has led one of the bloodiest insurgencies in the region for nearly three decades and started the cult of suicide bombings, could have fled to Thailand or Malaysia.

Analysts noted that the LTTE has had a presence in Phuket, Thailand, since the late 1980s.

And, in 1990, the port authorities in Penang impounded an LTTE commercial vessel, seizing diving and communication equipment and ammunition.

“Both Thailand and Malaysia have large ethnic Tamil communities which have been supportive of his war,” said retired Indian army major-general Ashok Mehta. He had served in Sri Lanka during the Indian army’s operations against the rebel outfit in the late 1980s.

“It is common for the leaders of insurgent groups to relocate themselves when the going gets tough. Prabhakaran also may have fled to fight another day,” he told The Straits Times.

“I personally don’t think that he has fled, but anything is possible,” said Mr N.N. Jha, a former Indian envoy to Colombo.

“I think he is very much there. It is not in his character to flee,” said retired Indian army colonel R. Hariharan, who headed the military intelligence when the Indian troops were deployed on the island.

“It would be ironic that a man, who ordered his cadres to swallow cyanide capsules and die rather than surrender, had himself fled,” Mr Jha said.

On the possibility of the rebel leader going to India, Lt-Gen Fonseka said: “He will not be permitted there.”

He was referring to India’s request for the extradition of the rebel leader, who is accused of planning the 1991 assassination of former Indian prime minister Rajiv Gandhi.

“It is unlikely that Prabhakaran would cross over to Tamil Nadu,” said Mehta, referring to the southern Indian state separated from Sri Lanka by a narrow strip of sea and whose people share close linguistic and cultural affinities with the island’s Tamils.

Tamil Nadu was the LTTE’s main sanctuary before New Delhi, which trained and armed the Tigers in the early 1980s, banned the group following the assassination of Gandhi.

“Unlike Osama bin Laden, who took shelter in the caves of the Tora Bora mountains in Afghanistan’s border with Pakistan to escape the US bombings, there are no caves along the southern Indian coast,” Mr Mehta said.

“Again, India has stepped up its coastal vigil following the Mumbai terror attacks and I don’t think he (Prabhakaran) has that kind of support in Tamil Nadu as he used to have.”

Many in the military believe that nabbing Prabhakaran – or even forcing him to flee abroad – would send the rebels into a tailspin, crushing their morale and decision-making structure so badly that the group would fall apart.

The loss of Prabhakaran would be devastating to the group, said Indian journalist M.R. Narayan Swamy, who wrote a biography of the rebel leader.

“He is their brain. He is their heart. He is their god. He is their soul, and the whole organisation runs around him,” he said. – The Straits Times

Catholic priest to be charged for taking part in Bersih rally

KUALA LUMPUR, Jan 21 — A Catholic priest from Shah Alam will be charged at the Petaling Jaya Magistrate’s Court Friday for taking part in an illegal assembly organised by the Coalition for Clean and Fair Elections, better known by its Malay acronym Bersih.

Rev Father Paulino Miranda was among 24 people who were arrested at the PJ Civic Centre in November last year, allegedly for taking part in an illegal rally, organised by Bersih in conjunction with its first anniversary.

Others who were arrested include DAP politicians Tony Pua, the MP for Petaling Jaya, Lau Weng San and Ronnie Liu, who are the Selangor state assemblymen for Kampung Tunku and Pandamaran respectively.

A spokesman for the Kuala Lumpur Catholic Lawyers’ Society (CLS) Annou Xavier, told Malaysian Insider that Father Paulino received the summons to appear at the PJ Magistrate’s Court three days ago.

Annou claimed that those arrested were later released on police bail, and were initially told there would be no charges against them.

He added that the CLS would be representing Fr Paulino in court. He called on all Catholics to turn up at the PJ Magistrate’s Court to show their support.

Father Paulino could not be reached for comment.

A spokesman from the Church of the Divine Mercy, where Fr Paulino is the parish priest, told Malaysian Insider he is away attending an annual meeting involving the Catholic bishops and clergymen.

However, she confirmed that Fr Paulino had received the summons and will be present for the court hearing Friday, scheduled for 9am.

Horror flight on board MH161

I am a Malaysian currently residing and working in Dubai. On Dec 25, 2008, I flew with Malaysian Airlines flight MH161 to Kuala Lumpur to visit my parents. I was in seat 36H (an aisle seat) and the seat next to me, 36K (window seat) was vacant. The flight stopped over at Karachi for an hour.

In Karachi, more passengers boarded the plane. One male passenger boarded, showed his boarding pass to a stewardess and she pointed to seat beside me (36K). The man looked at me and said, ‘She’s a Hindu, I cannot sit beside her.’ The stewardess responded, ‘So what? What’s wrong with Hindu?’ The man then began to yell and shout that he would not sit next to a Hindu.

The crew insisted that he had to because there were no other seats available because the plane was full. Then this passenger sat down but began to verbally abuse my faith and the crew members. I sat in my seat but was physically cringing away from him. The flight supervisor was summoned and until then the man was still seated next to me. Imagine my shock, horror and fear in being next to a hostile, abusive person.

One steward did stand next to me but did not offer any help and I did not feel safe or reassured. I reached out and told that steward that I did not feel safe anymore. I said this to him softly in English and he told me to sit and wait. He then walked off and a female crew member took his place. All this time I was under the impression that this hostile passenger beside me was a Pakistani.

I then told the stewardess in Malay that this man should not be seated beside me after what he had said about me. There were other Malaysian passengers sitting in the same area and all of them heard me. She smiled and merely nodded.

Finally, the flight supervisor, ‘SB’, approached the passenger and after an angry exchange, the passenger said, ‘Move her then!’ and SB replied, ‘Yes, we will move her’. More angry words were exchanged and it was revealed that the passenger was actually a Malaysian. When this news was revealed, the passenger actually stood up with his fists up, ready to be physically violent. I was then hauled out of my seat and taken to the back of the plane. I was kept in the kitchen.

By this time I had gone into shock and was crying uncontrollably. I was shaking with rage because I was in a position where there was nothing I could do to defend myself. No one else seemed to be doing anything too.

I could not see what was happening from the rear of the plane but I did see uniformed security personnel approaching my original seat. I could not hear or make out what was happening as there was a group of people standing around my original seat. Eventually, the group left and it was announced that the plane would be taking off.

All this time I was in the kitchen, shaking and crying. All that was done for me was crew members taking turns to ask me if I was okay and offering me Coke and water! The plane began to taxi and I was then taken to another seat (42H). As I sat down, I asked the steward, ‘Is he off the plane?’ and the answer was, ‘No.’ I was appalled.

After the plane took off, the flight supervisor, SB, came and sat beside me. He explained to me that they could not put him off the plane because he was a deportee and if they had insisted on putting him off, then the plane would not have been cleared for take off. I was still crying at this point. I asked, ‘Why am I in a different seat? He should be!’ but my question was not answered.

The plane was not full. There were eight seats vacant in the rear, four on the right aisle and four seats on the left. Seat 42H, where I was put, was one of those vacant seats in the rear. If the MAS crew knew there was a deportee boarding, should they not have made arrangements to place him at the rear of the plane? What kind of airline policy allows a deportee to sit beside a female passenger travelling alone?

I spent the next five and a half hours on the flight in tears. I was not able to sleep because I knew that a hostile passenger was only six rows down from me. I was not afraid but in rage. My friends who are reading this would know the kind of person I am. I have always stood up for my rights and for the rights of people whom I love. I would not usually tolerate such abuse and I would not have hesitated in defending myself.

What stopped me was knowing that I was on a plane, in a confined space and that there were other passengers around me too, women and children. The abusive passenger was not removed from the plane and when we landed at KLIA, he disembarked like a normal passenger and was not escorted or arrested. I also disembarked knowing that I was now in the same terminal, on my own, as this hostile passenger.

I am very disappointed with the way MAS dealt with the incident. That passenger should have been taken to the rear of the plane and restrained. I was the victim of the incident yet I lost my chosen seat that I had paid for. Apart from offers of water, Coke and some verbal reassurances, the crew did not do anything else for me.

I have contacted other major airlines and this is how they would have dealt with the matter: I would have been moved to Business/First Class and I would have been escorted into the terminal until I safely exited the airport. MAS did not do anything for me. First of all, they jeopardised my safety and well-being by forcing the passenger to sit beside me knowing that he was hostile towards me and then they did nothing else to keep me safe.

I was in the same cabin as that passenger, wondering if he was going to walk by or pass me. I spent the entire five and a half hours in tears because I could not stand up for my rights and also because I had to keep my own rage pent-up.

Once I landed, I rang my husband in Dubai and related the events to him. He took immediate steps to contact MAS but to no avail. I stayed for one week in Malaysia and every single day, I tried to call their Customer Complaints Department. All I got was a voice mail. I left numerous messages but no one called me back. No one contacted my husband in Dubai. It is only after he put it up on the MAS blog that we have received some kind of response. Fourteen days after the incident, someone from MAS called me to offer an apology.

My husband also received an email from someone who has offered me 25 percent discount on a return flight from KL to Dubai and actually referred to that abusive passenger as a ‘fellow customer’! She also clearly stated that measures taken were to prevent that passenger from getting angrier. So in other words, they do admit that.

These are the questions I posed to MAS:

Why force a passenger who is racially abusive and hostile to my appearance and faith to sit beside me? There were other seats available at the rear as I discovered later.This was not a passenger who was merely fussing about his seat, this was a passenger who was potentially a threat to another passenger.

Why did the flight supervisor immediately give in to his demands and agree to move me? I was not the passenger causing trouble.

Upon retrospect, I think I was lied to. I do not think the passenger was a deportee. It was a lie told to me to keep him on the plane and keep me quiet. If a lie was told, that means that the crew took measures to protect the hostile passenger and themselves but not me, the victim. If so, then the MAS crew perpetuated the racism and discrimination initiated by the passenger.

If this is the case, then the entire crew participated in jeopardising my safety and appropriate action should be taken against them. If the passenger was truly a deportee or an INA (inadmissible because of visa) then the plane captain should have documents about him. If a deportee or INA caused trouble on a flight, the captain should have been informed immediately.

Why was the captain not informed and if he was, why did he not come to see me? I have been informed that KLIA security had been called but there was no one waiting when the plane landed. The abusive passenger disembarked like any other normal passenger. Why was he not nabbed or restrained? Why did not the crew ensure my safety in the terminal too?

I am demanding a formal, written apology from Malaysian Airlines. I want a truthful, reasonable explanation for all the five points I have listed above. I want some compensation for what I suffered. So far, I have only received an e-mail informing that the matter is under investigation.

Man dies during police interrogation

Bernama, Jan 21 2009 -- A man who was detained to help investigation into cases of car thefts died suddenly when he was being interrogated at the Taipan Police Station, Subang Jaya, near here today.
Selangor Police Chief Datuk Khalid Abu Bakar said the incident occurred at about 11am when the man was being questioned about robberies and thefts involving luxury cars by a gang operating in the Klang Valley.


“During interrogation, the man asked for a glass of water and upon drinking the water, he collapsed and lost consciousness. A doctor from a clinic nearby who was summoned to examine the man later confirmed that he had died,” he said.

Khalid disclosed this to reporters after receiving a mobile police station donated by the Selangor government, which was handed over by State Secretary Datuk Ramli Mahmud at the Shah Alam District Police Headquarters, here.

He said the 22-year-old man from Puchong was detained on Jan 15 on suspicion of being involved in robbing and stealing luxury cars such as the Toyota Camry and Honda Accord in Sungai Chua, Kajang near here.
The suspect’s remains had been sent to the University of Malaya Medical Centre (UMMC) for a post-mortem and the case had been classified as sudden death for the time being.

Khalid said family members of the suspect had informed police that he was suffering from asthma.

“We don’t want any party to speculate as cases of custodial deaths are a sensitive issue. The man had also given his cooperation throughout the interrogation.

“No matter what the case may be, I give my assurance that a thorough investigation will be carried out and we are waiting for the outcome of the post-mortem,” he said.

Earlier, Khalid received a van which had been refurbished to become a mobile police station costing RM140,000 contributed by the Selangor government which is equipped with a communication network connecting it to the Section 15 Police Station in Shah Alam to monitor the industrial areas in Section 22, Section 26 and Section 27, here.

Meanwhile, Ramli said he would propose that more mobile police stations be donated to the police to control crime especially in high-risk areas such as in Shah Alam and Petaling Jaya.

Cops vow no cover-up in probe into detainee death (updated)

PETALING JAYA: Selangor police have vowed there would be no cover-up in investigations into the death of a suspected car thief who collapsed and died inside the Taipan police station in USJ, Subang Jaya during questioning.

State police chief Deputy Comm Datuk Khalid Abu Bakar said police were investigating the case under Section 330 of the Penal Code for voluntarily causing hurt to extort a confession.

“I can assure the family of A. Kugan and public that there will be no cover-up. If the post-mortem report indicates that force was used, leading to Kugan’s death, then we will take action against those responsible.

“Everyone should wait for the post-mortem report before jumping to conclusions or politicising the issue,” he said.

DCP Khalid said Kugan, who was arrested on Jan 15, was being questioned in connection with a car theft syndicate that was believed to have international links.

He said Kugan had led police to the recovery of 15 luxury cars from a warehouse in Puchong that were being readied to be shipped off overseas by the syndicate he allegedly worked with.

“We were in the midst of obtaining more information from him regarding his involvement with the syndicate’s activities when he was brought to the Taipan police station.

“The car theft syndicate is believed to be one of the biggest in the state and our officers were getting intelligence from him on that day,” he added.

Kugan, who was detained on Jan 15 on suspicion of being involved in stealing luxury cars in Sungai Chua, Kajang, was brought to the Taipan police station on Tuesday where he suddenly collapsed and died while being questioned.

He had asked for a glass of water and threw up after drinking, then collapsed. The policemen present immediately summoned a doctor from a nearby clinic to examine Kugan, who was pronounced dead minutes later.

His body was sent to the Universiti Malaya Medical Centre for a post-mortem to determine the cause of death.

His family had told police that Kugan suffered from asthma.

Last week, seven policemen pleaded not guilty in the Kuala Lumpur Sessions Court to injuring a car park attendant and a teenager at the Brickfields police station last year.

They were charged with voluntarily causing hurt to B. Prabakar, 28, and 18-year-old C. Solomon Raj, at a detective’s office to make them confess to a criminal intimidation case.

The offence allegedly took place between 10.15pm on Dec 23 and 3.30am on Dec 24.

It was reported that Prabakar lodged a report on Dec 30 alleging that he had been assaulted and scalded with hot water after he was arrested in Desa Sri Hartamas on Dec 23.

The seven policemen face up to seven years’ jail and a fine if convicted.

Barged into mortuary
In a related incident, the assistant medical officer (MO) from the forensics department on Wednesday lodged a report alleging that family members and unknown people had barged into the cold room where Kugan’s body was being kept.

DCP Khalid said Mohamed Azharuddin Abdul Ghani in his report claimed he and two colleagues were forced out of the room by the crowd that came to the hospital at about 11.30pm Tuesday.

He said Mohamed Azaharuddin also claimed that the family members and the crowd of some 50 people left the mortuary only at about 2.30am Wednesday after they had identified and examined the body.

“The MO alleged that when he went back to the cold room he found the shirt Kugan was wearing had been ripped and torn apart, and there were also spots of blood on the floor,” he added.

Kugan’s family also lodged a report at the Subang Jaya police headquarters claiming the police were responsible for Kugan’s death. They also refuted claims by police that Kugan had suffered from asthma.

The family’s lawyer N. Surendran said that the wounds and scars on the body was evidence enough that the police had caused Kugan’s death.

“The police are responsible for this horrible murder and we will not rest until justice is done,” he said.

He also refuted claims that the victim’s body was tampered with at Serdang Hospital when family members and some members of the public had rushed into the mortuary and took pictures of his wounds.

“All they did was open up his shirt and turn the body around to examine his injuries,” he claimed.

Query on Hindraf man's trip

KUALA LUMPUR: The Foreign Ministry is expected to raise with the British government its decision to give banned Hindu Rights Action Force (Hindraf) leader, P. Wathya Moorthy, a travel document to attend the Bharathiya Divas conference in Chennai early this month.

Human Resources Minister Datuk Dr S. Subramaniam said yesterday that last week's cabinet meeting had discussed the allegations made by the Wathya Moorthy against the Malaysian government at the conference.

"The foreign minister briefed the cabinet on what had happened and the allegations made by Wathya Moorthy."

Dr Subramaniam said it appeared the British authorities had issued Wathya Moorthy with a travel document. "He has surrendered his Malaysian passport to the High Commission in London."

In Chennai, Waytha Moorthy distributed a booklet alleging human rights abuses in Malaysia and that Indians have been "marginalised".
He called on the Indian government to impose trade sanctions on Malaysia.

Dr Subramaniam said much of the content in the booklet was "inflammatory and factually wrong". He had explained to the cabinet what the MIC was doing to counter the allegations.

"We are engaging the non-governmental organisations and other bodies to counter the claims and make known the measures taken by the government to help the Indian community."

Dr M cause of Umno's destruction, says Hindraf

KUALA LUMPUR, Jan 19 - Attempting to give him a taste of his own medicine, the Hindu Rights Action Force (Hindraf) has claimed former president Tun Dr Mahathir Mohamed to be the cause of Umno's current crisis.

The former prime minister has spent much of the past few years criticising his self-appointed successor Datuk Seri Abdullah Badawi, culminating in acid attacks for causing the Umno-dominated Barisan Nasional's (BN) setback in last year's general election.

Today, Hindraf chairman P Waytha Moorthy said that it was in fact Dr Mahathir who was the "architect" of "corruption, nepotism, prejudice and cronyism" to Umno.

Welcoming Pakatan Rakyat (PR)'s by-election victory in Kuala Terengganu as a sign that the public is disgusted with Umno, he said that the public has lost any faith in finding honest politicians within BN.

"With Mahathirism's tutelage, the whole Barisan National clan is out of touch with the reality and the needs of the public for governance that is based on equality and fairness for all Malaysians," Waytha said in a statement to the press.

He added that Dr Mahathir's leadership of Umno and BN saw it fail to serve competently and the governing coalition now lives on "past glories" in "blatant arrogance and ignorance" of the will of the people.

"The absence of these elements has prompted the will of change from the public to restore integrity in our basic institutions," he continued.

Waytha said that unless BN faces the reality and listens to the people on issues like abolition of the Internal Security Act and equality in socio-development, "it will be digging its own grave."

"Listening to Mahathir will only speed up the process."

Belumpun reda isu kerajaan pakatan pembangkang di Selangor membeli Toyota Camry bagi kegunaan anggota Exconya yang dianggap membazir wang, satu laporan telah dibuat kepada Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) mendakwa Tan Sri Khalid Ibrahim menyalahgunakan kuasanya sebagai Menteri Besar. Laporan itu dibuat oleh Gerakan Rakyat Anti Korupsi (GERAK) di pejabat SPRM Selangor, di Shah Alam, Rabu oleh Pengerusinya Mohd. Nazree Mohd. Yunus. Ia diserahkan kepada Pengarah SPRM Selangor Mohd Shamsudin Yusof. Laporan itu mendakwa Khalid menggunakan kedudukannya mengarahkan supaya 46 ekor lembu korban yang sepatutnya diagihkan kepada penduduk di Selangor dihantar ke kawasan Parlimennya Bandar Tun Razak, Kuala Lumpur. Selain Ahli Dewan Undangan Negeri (ADUN) Ijok, Khalid turut memenangi kerusi parlimen Bandar Tun Razak pada pilihan raya umum Mac tahun lalu.

Kesemua haiwan bernilai kira-kira RM110,000 adalah sebahagian 400 ekor lembu yang diperuntukkan kepada masjid di seluruh Selangor bagi ibadah korban pada sambutan Aidil Adha lalu.

Program agihan lembu korban itu dibiayai oleh beberapa anak syarikat negeri termasuk Perbadanan Kemajuan Negeri Selangor (PKNS) dan Perbadanan Kemajuan Pertanian Selangor (PKPS).

Difahamkan, pembayaran bagi membekalkan 46 ekor lembu ke kawasan parlimen Tun Razak dibuat oleh Selangor Industrial Corporation Sdn Bhd (SIC) anak syarikat di bawah PKPS.

Secara tidak langsung, Khalid dipercayai menggunakan kedudukannya mengarah wang anak syarikat kerajaan negeri Selangor untuk membayar harga haiwan korban itu bagi kegunaan rakyat luar negeri itu.

Mohd. Nazree dalam sidang media selepas laporan itu berkata, GERAK mendesak Khalid melepaskan jawatannya bagi membolehkan SPRM menyiasat kes itu.

“Sebelum ini beliau pernah mengarahkan seorang pegawainya di Pejabat Menteri Besar melepaskan jawatan kerana dipercayai terbabit dalam usaha mengumpul dana bagi sambutan 100 hari pakatan rakyat mentadbir Selangor,” katanya.

Beliau berkata, Khalid perlu berbuat demikian bagi membuktikan ketelusan dan kebertanggungjawabannya dalam kes penyelewengan wang kerajaan dan rakyat Selangor ke pihak tidak berkaitan.

GERAK juga katanya akan memohon perkenan menghadap Sultan Selangor bagi menyerahkan memorandum meminta Khalid digantung tugas atau digugurkan jika beliau enggan bertanggungjawab dalam kes ini.- 21/1/2009

A former minister told me the other day that the Government should look also into the Human Resources Development Fund to help out retrenched workers. Not for retraining but to help put food on their table if it comes to that. SatD, a Malaysian blogger abroad, agrees on that bit about retraining when arguing his case for a unemployment insurance. "Retraining assistance when someone is struggling to pay his bills, installments, children food does not mean much......".

Experience tells us we'll need to act swiftly. We are not just dealing with the possibility of 1 million Malaysians (including 500,000 who are working in Singapore) losing jobs; we have millions of foreign workers here and many of them will most probably be losing jobs, too. The socio-economic impact will be colossal.

Pengisytiharan Mentaloon: Bukti Muafakat Pimpinan Pakatan Rakyat

Pada hari Ahad yang lalu di Alor Star, saya beserta pimpinan Pakatan Rakyat yang lain secara muafakat telah bersetuju dengan Pengisytiharan Mentaloon.

Melalui pengisytiharan tersebut, Pakatan Rakyat secara rasminya kini telah menubuhkan Majlis Menteri-Menteri Besar dan Ketua Menteri Pakatan Rakyat serta Majlis Exco-Exco Kerajaan Negeri Pakatan Rakyat. Kedua-dua majlis yang dibentuk ini akan bersidang sekurang-kurangnya untuk tempoh dua kali setahun dalam memastikan wujudnya kerjasama dan perkongsian pengalaman antara lima buah negeri yang ditadbir Pakatan Rakyat.

Insha-Allah, muafakat dan kefahaman pimpinan Pakatan Rakyat akan terus diperkasa dalam usaha memastikan kejayaan pelaksanaan agenda perubahan.

Muthu: MIC Disciplinary Hearing A Hogwash

KUALA LUMPUR, Jan 20 (Bernama) -- Describing the MIC disciplinary committee hearing against him as "hogwash", 'man of the moment' Datuk M. Muthupalaniappan has chastised party leaders for using the hearing to bar him from contesting the president's post.

He is the sole presidential aspirant at the MIC presidential election in April or May.

"It is definitely a hogwash. They (the party disciplinary committee) are in a hurry to hear my case, with a view to disqualifying me from contesting the president's post.

"The party has fixed Feb 7 as nomination at branch level and if I am sacked before that date, then I would not be able to contest the president's post.

"I am chairman of the Seremban MIC branch. Only a branch chairman can contest the president's post.

"So, (their plan is that if) they can ensure that I do not contest the branch chairman post, then automatically, I do not qualify to contest the president's post," he told reporters, following a 45-minute MIC disciplinary committee hearing at the party headquarters here today.

On Dec 23, last year, the MIC disciplinary committee had issued a show-cause notice to Muthupalaniappan, 68, a former MIC vice-president, for allegedly acting against the party's interests by issuing press statements.

The presidential aspirant had replied to the notice, objecting to committee chief Tan Sri G. Vadiveloo's presence at the hearing as the latter was a witness to the charge.

At the onset of the hearing today, Muthupalaniappan, who hails from Seremban, Negeri Sembilan, said Vadiveloo had objected to the two lawyers whom he had brought, adding that subsequently, they were asked to leave the room where the hearing was held.

"He then proceeded to read the charge as per the show-cause notice. Then, I raised my preliminary objections. I told them I needed time to bring my 15 witnesses and that three dates be set aside for the hearing.

"I also wanted the disciplinary committee to furnish me proof of what I was reported to have said in the media. To this, Vadiveloo said that I should source it on my own.

"Since the allegation is made against me, it is only right that they furnish me details of my so-called wrong-doing," he said.

The senior politician said after he raised the preliminary objections, Vadiveloo refused to deliberate on the objections and said that he wanted to "close the matter by today".

"He ruled that he was not entertaining the objections. I just want a complete enquiry. This is not a kangaroo court. It must be done, in accordance to the party's regulations and by-laws.

"Since he did not want to entertain my objections, then I had no choice but to leave the enquiry. Vadiveloo also said the committee would forward its findings based on my 45 minutes with them, to the party's central working committee (CWC).

"They also said that they would not call any more witnesses," he said. The MIC CWC is the party's highest decision-making body.

Muthupalaniappan said he received a letter from the MIC disciplinary committee on Jan 7, and was asked to turn up for the hearing today.

"Actually, I came today to raise the preliminary objections and not to take part in the inquiry. But this is what happened," he added.
