Indonesian worker gets 30 years in jail for rape

KUALA LUMPUR: The Sessions Court has sentenced an Indonesian construction worker to a total of 30 years in jail and ordered him to be given 20 strokes of the rotan for the rape of an 11-year-old girl and carnal intercourse with her against the order of nature.

Judge Datin Kunasundary Marimuthu passed the sentence on Shamsul Ariffin Muhamad, 22, after the accused changed his plea to guilty at the trial here Monday.

She imposed a 20-year jail sentence and 12 strokes of the cane for rape, and a 10-year jail sentence and eight strokes of the cane for carnal intercourse against the order of nature.

She ordered the jail terms to run concurrently from March 7 this year.

The offences were committed at the women's changing room of a condominium swimming pool here at about 4.30pm on March 6 this year.

“The offences were committed with cruel intention. Your action was to satisfy your inner animalistic passion and, due to your inhumane behaviour, your sentence cannot be discounted,” Kunasundary said before sentencing.

"The accused must be isolated from the public, and for the sake of justice for the family and the victim, you will be locked away for a long time," she added.

In mitigation, Shamsul Ariffin, who was unrepresented, said he was remorseful and had repented for the offence, adding that he was also taking care of his parents in Indonesia.

Deputy Public Prosecutor Liyana Zawani Mohd Radzi asked for a heavy sentence, saying the offence was a higher degree of rape, and that the sentence should serve as a lesson to the accused and the public.

The victim's mother told the court that her daughter was embarrassed and had lost much weight due to stress from the incident. - Bernama

Woman claims son sodomised, wants justice for him

KOTA BARU: A mother of a five-year-old boy, who was allegedly sodomised by an elderly relative, wants justice for her son.

The 29-year-old woman from Peringat here claimed that despite her son singling the suspect out in an identification parade, the case had yet to be concluded.

“My son is never the same after the incident,” she said at her home on Sunday.

The woman said the alleged incident took place on July 20. She said her son came home crying and complained of pain in his anus.

"I then asked him what had taken place and he told me that an elderly relative had an unnatural act with him in some bushes nearby.

"I was extremely shocked and brought him to the Universiti Sains Malaysia hospital in Kubang Kerian for a checkup.

"After an examination, the doctor confirmed there was penetration in my son's anus," she said.

She added the hospital authorities reported the matter to the Welfare Department and the police.

She said her son had identified the suspect in an identification parade after she lodged a police report on July 21.

"I had been anxiously waiting for the case to be closed and for authorities to bring the person to justice although I had received threats from his family members to settle the matter.

"However, the Welfare Department officials told me not to keep the matter a secret and should see this case out," she said.

District police chief Assistant Comm of Police Baharom Abu, when contacted via text message, said the case was still being investigated and that the police had arrested the 62-year-old suspect.

He was remanded for three days.

ACP Baharom said the suspect was allowed police bail owing to his age and physical condition.

He said police were waiting for the full medical report from the hospital before handing the case to the state Deputy Public Prosecutor for follow-up.

He said the case was being investigated under Section 377 of the Penal Code for unnatural carnal intercourse against the order of nature.

It is learnt that the suspect is in Kuala Lumpur.

Alleged Tioman rape victim lodges police report

KUANTAN: The girl who claims to have been sexually assaulted in Pulau Tioman has lodged a police report against a Customs Department officer for allegedly raping her.

The 17-year-old girl alleged that the officer, who goes by the name of Kamil, was one of four individuals who raped her.

"On March 18, 2016, at daytime, I was called by Kamil to a room at the jetty Customs office. He told me to keep a rape committed against me the day before a secret.

"After that, he took off his shirt and forced me to give him a massage. A few minutes after that, Kamil took off his pants and forcefully removed my clothes," she said in her report filed here Saturday.

The girl claimed she tried to fight back but failed and Kamil proceeded to rape her.

She alleged that Kamil then told her not to lodge a police report or he would take action against her and her father.

It was reported that the series of sexual assaults took place between March and May after the girl took up a part-time job at the Kampung Tekek jetty.

The Form Four student claimed that she became semi-conscious after taking a soft drink given by a security guard on March 17 before she was gang-raped by four people at the jetty toilet and the Customs office.

She also claimed that a female neighbour sexually assaulted her on May 7 when she went to her house.

She alleged that the neighbour also took nude pictures and a video of her, which were then uploaded onto the Internet.

She then claimed the neighbour's brother proceeded to rape her after that.

Rompin OCPD Deputy Supt Muhammad Aidil Roneh Abdullah had said that six people, including a woman, were detained for investigations, but denied the involvement of a Customs personnel.

Deputy Prime Minister Datuk Seri Dr Ahmad Zahid Hamidi had assured that there would be no cover-up in criminal cases involving Government officers and no one would escape punishment if there was evidence of a crime.

Police: Rape suspect cut himself with blade

SEREMBAN: A rape suspect, who was being taken to court in a police vehicle from the Nilai police station to be remanded, had cut himself with a blade, requiring him to receive 50 stitches.

State police chief DCP Datuk Jaafar Mohd Yusof said the incident was witnessed by 14 other suspects who were being transported in the same Black Maria to be remanded for other offences on May 25.

"The suspect is lying that he had no knowledge how he had sustained the life-threatening cuts to his neck and wrists.

"We have ample evidence to show that he had cut himself up with the blade which he hid in a sling bag," he said at a press conference here Sunday, adding that the incident happened about 1km before the Seremban court complex.

The 25-year-old suspect had lodged a report on June 2 claiming that he had been assaulted by several officials from the Home Ministry after being arrested at a store in Bandar Baru Nilai where he was employed at about 3am on May 25.

He alleged that he lost consciousness after he was assaulted by policemen at the Nilai police station.

The suspect claimed that he only regained consciousness at the high dependency ward of the Tuanku Ja'afar Hospital on May 26 and realised that he had sustained injuries, which required him to be given 50 stitches.

DCP Jaafar said one of the cops accompanying the suspects had to stop the accused from further injuring himself.

"The policemen, who was seated at the rear end of the Black Maria entered the enclosure where the suspects sat, and stopped the accused from further injuring himself.

"By then, the accused had lost a lot of blood and was straightaway rushed to the hospital," he said, adding that police were unable to obtain a remand order for him to allow him to be treated.

Police detained the suspect after a 13-year-old girl lodged a report alleging that she had been raped by the suspect. "The girl lodged the report of the alleged rape on April 13,” DCP Jaafar said.

He also denied claims by the suspect that the officers who had arrested him were from the Home Ministry.

"They were from the Nilai station and were acting on a report lodged by the girl," he said.

DCP Jaafar said apart from the alleged rape, the police were now investigating the suspect under section 309 of the Penal Code for attempted suicide.

"We will also investigate him for lodging a false report," he said, adding that police were expected to arrest the suspect soon.

8 years jail for raping underage Facebook friend

Salesman raped the girl, 13, at a luxury apartment in Cheras but gets his 12-year jail original sentence reduced on appeal.

KUALA LUMPUR: The High Court today upheld a conviction against a salesman who was found guilty of raping an underage teenage girl whom he had befriended through Facebook.

Judge Azman Abdullah, however, reduced the jail term from 12 years to eight years against Khoo Kean Giap, 23, handed down by the Sessions Court on Sept 7 last year. However, the imposition of whipping was upheld.

Azman ordered Khoo to serve the sentence from today, rejecting an application by counsel R Devadasan to suspend execution of the sentence pending appeal.

The Sessions Court had sentenced the salesman to 12 years’ jail and imposed two strokes of the rotan after finding him guilty of raping the 13-year-old girl.

Khoo, who knew the victim through Facebook, was charged with raping the teenager in the bedroom of a luxury apartment in Cheras at 8pm in October 2012.

Mangsa cabul rayu hakim ringankan hukuman bapa saudara

PETALING JAYA: Seorang mangsa yang dicabul bapa saudaranya bertindak menulis surat kepada hakim merayu tertuduh dijatuhkan hukuman ringan.

Dalam surat itu, mangsa yang kini berusia 15 tahun mengakui dirinya turut bersalah dan dia sudah memaafkan lelaki itu, justeru dia meminta hakim memberi hukuman ringan kepada tertuduh.

China Press melaporkan, tertuduh yang kini berusia 22 tahun itu mengaku bersalah terhadap tiga pertuduhan, termasuk melakukan serangan seksual terhadap anak saudaranya mulai 2011 hingga Januari 2015.

Menurut fakta kes, tertuduh yang berkongsi bilik dengan anak saudara lelaki dan perempuan serta kakaknya pada 2011, bertindak mengambil kesempatan ketika anak saudaranya sedang tidur nyenyak dengan menyentuh bahagian sulit mangsa sebelum mencabulnya.

Mangsa yang ketika itu berusia 10 tahun bagaimanapun tidak menolak mahupun mendedahkan perbuatan bapa saudaranya dan tertuduh kembali mencabul mangsa sebanyak dua kali lagi pada Januari 2015.

Perkara itu hanya terdedah ketika gadis itu mendapatkan khidmat nasihat kaunselor mengenai masalah cinta.

Timbalan Pendakwa Raya memohon mahkamah menjatuhkan hukuman penjara 21 hingga 24 tahun kerana tertuduh menyalahgunakan kepercayaan yang diberikan kakaknya, selain dia turut mempunyai teman wanita ketika itu dan aktif dalam seks.

Hakim menetapkan 22 Jun ini sebagai tarikh untuk menjatuhkan hukuman.

An Indian teen was raped by her father. Village elders had her whipped.


In a scene captured on a cellphone video, one of the men wags his finger angrily at her. He rages: This girl must be punished.

A villager ties her waist with rope, holding the other end, and lifts a tree branch into the air. She bows her head. The first lash comes, then another, then another. Ten in all. She lets out a wail.

Eventually the crowd starts murmuring, "Enough, enough," although nobody moves to stop the beating. Finally, the man throws down his stick. It's over.

She is 13 years old. Or maybe 15. Her family doesn't know for sure. She has never set foot in a school and has spent most of her life doing chores at home, occasionally begging for food and performing in her father's acrobatic show, for which she is given 20 rupees, about 30 cents.


Her crime? Being too scared to tell anyone her father raped her.

Misogyny tough to shake

India is a country of 1.2 billion people, with a growing economy, a young population and an energetic prime minister eager to sell the country on the world stage. A generation of women are taking stronger roles in the workforce, in colleges and online who aren't afraid to push against outdated misogyny - be it acid attacks, rape and sexual harassment, or the portrayal of women in movies and advertisements.

Yet patriarchal prejudices ingrained for centuries have been tough to shake loose despite a growing clamor for change - and continue to affect life from the village water pump to the judicial system and beyond.

Male-dominated village councils have existed in India for centuries to resolve disputes between neighbors and serve as enforcers of social mores in the country's stratified caste system. Although elected village bodies were established by the Indian government in 1992, unelected clan councils continue to operate with impunity throughout rural India, issuing their own edicts in the name of preserving harmony.

Five years after the Supreme Court said such councils should be illegal, the central government and some states are only beginning to pass or contemplate laws that would limit their behavior.

These councils often prevent or break up marriages and love affairs between couples from different castes, and they have instigated honor killings. Women typically receive the harshest punishments.

They also intervene in cases of sexual assault - mediating resolutions between two families, attempting to smooth over devastating wounds with a few hundred rupees and even in some cases forcing a victim to marry her rapist. Amid international outrage about the 2012 fatal gang rape of a Delhi student, laws were passed to make it easier for rape victims to file charges. But the road to the police station is still a long one.

"In rape cases, their role is underground and not officially or publicly acknowledged," said Jagmati Sangwan of the All India Democratic Women's Association, a longtime critic. "They will ask the family of the victim to go for a compromise, go for mediation, and that suppresses the interests of the victim."

Sube Singh Samain, a leader for an association of clan councils in the northern state of Haryana, said they serve a vital role in a county with an overburdened justice system and where legal cases can be costly. He said that village elders have banned the sale of meat, restricted mobile phone use by youth and even prohibited loud music at weddings. ("The music is so bad the cows and bulls fall over and run away," he said.) They also step in to smooth things between families, sometimes urging people to withdraw police complaints.

"We say, 'Let's not go to the courts; let's resolve it,' " he said. "We encourage them to go back to the police if a [complaint] has already been filed and say, 'I was not in a right state of mind; I want to take back my statement.' "

Some of the most brutal decrees have garnered international headlines.

In 2014, for example, a clan council in the state of West Bengal ordered the gang rape of a woman as punishment for having a relationship with a man outside her tribal community - with a leader allegedly urging the council to "go enjoy the girl and have fun," according to a police complaint.

In Maharashtra, representatives from an advocacy group called the Committee for Eradication of Blind Faith work with about 100 people a year who have been victimized by caste councils - called panchayats - most of them female.

Women are forced to retrieve a coin from a vat of boiling oil to prove their purity. One woman was forced to walk, scantily clad, through the forest while the panchayat members threw balls of dough straight off a fire at her back.

"You can't have a parallel judiciary that's completely unaccountable and gives arbitrary punishments - many of them barbaric," said Hamid Dabholkar, the head of the advocacy group. "That is what happened in this case where the girl was beaten when she herself was a victim."

Hard life takes darker turn

Before she died, Anusuya Chavan's existence had been as precarious as the tightrope she walked in her husband's acrobatic shows. For the most part, she was able to shelter her two younger daughters from their father's rages, but eventually her own drinking and battle with tuberculosis caught up with her. She died last year.

At the time, her teenaged daughter begged to go live with one of her older siblings, but the father, Shivram Yeshwant Chavan, told her no. He needed someone to cook, keep house and earn money for him.

Up until then, the girl's life had not been easy, but there were small comforts. She had no friends, but she liked turning handstands in the dirt with her sister, Laila, 7. Or buying a snack of spicy puffed rice or kulfi, a frozen dessert, with pocket change her father slipped her.

Then one night in January, her father came home from his job playing a steel drum in a wedding band, drunk on local hooch. She was sound asleep on the ground in their home, her sister curled up tight next to her. He got down on the ground, too, and put his hand over her mouth.

Victimized twice

In early March, a farmer and local labor activist named Sachin Tukaram Bhise was headed to a nearby village to find day laborers for his wheat and sugar cane farm when he heard a village council was to be called by members of the local Gopal community, near Mauje Jawalwadi. Shivram Chavan's sons did not know the whole story but feared the worst and had ostracized their father; he was ready to confess.

The Gopals are a largely illiterate, impoverished group who were once nomads making their living as cow herders and itinerant street performers. Many have since settled down to menial jobs in the fertile farming region in the shadow of the basalt crags of the Sahyadri mountain range.

As Bhise watched, villagers from around the area gathered in the main square of the village amid tin-roofed sheds. The teenager and her father were brought to kneel before the member council.

Chavan bowed his head and admitted what he had done, Bhise recalled, and said he was ready for whatever punishment the council would give him. Then the elders turned to the teenager and began to berate her.

"They said it was the girl's fault. That the father was drunk and he was not in his senses," Bhise said. "I got angered at the whole thing. How could a girl invite such an act? The 'panch' said, 'You're useless,' 'You're the culprit.' She was crying."

Bhise took out his cellphone camera and surreptitiously began to film as the council issued its verdict - a fine of about $67 and a whipping of 15 "sticks" for the father, five "sticks" for the girl. They would be whipped until each of the thin tree branches broke.

Bhise took his evidence to the police, who later arrested all seven members of the council, charging them with conspiracy, extortion and assault. The father was held on child abuse charges.

'They beat me very lightly'

"It did not hurt me because they beat me very lightly," the teenager said quietly about a month later.

She was curled up on a tarpaulin outside the place where she now lives with her brother and his family - a hut of pieces of fabric stretched over bamboo poles, secured by rocks. It sits on a ridge overlooking a sweeping mountain vista.

As she spoke, the girl began to cry, tears slipping easily from her eyes. She touched the feet of a Marathi-speaking visitor, a gesture of respect, and says she has only herself to blame.

"I asked them to beat me because I was at fault," she said. "The fault was I did not tell anyone about this at home. I told them my father just held my hand. That was my mistake."

Her sister-in-law, Jaya, who was sitting with her on the tarpaulin, agreed that she had been wrong.

"If she had told them, the brothers would have beaten the father. There would have been no panchayat and the matter would have been resolved at home," she said. "If the brothers hadn't beaten him, then the sisters-in-law would have."

Now, the woman said, the young girl just wants to close the case and put it behind her. Since the attack, she has been interviewed by a female police officer, given a medical examination and a small amount of money from the state's victims' fund.

Last month, the state government of Maharashtra approved a measure that prohibits the gathering of village councils to impose a "social boycott," one of the most common - and devastating - punishments. It effectively banishes an individual or family, cutting them off from communal water pumps, stores or the local temple.

Some in the Indian government have called for other states to follow suit, and the government has tightened its laws to prohibit social boycott in some cases.

Maharashtra Chief Minister Devendra Fadnavis said that he had pushed through the bill because of a rising number of disturbing cases of caste panchayats acting improperly.

"We cannot allow atrocities against any individual or groups," he said. "We will not allow parallel institutions of justice by non-state actors, and we cannot compromise on the dignity and rights of individuals."

And in April, the Gopal community decided to disband the panchayat system and take criminal matters directly to the police from now on, community leader Dilip Dinkar Jadhav said.

Marry the rapist?

For a while it seemed that the members of the panchayat, or at least the man who administered the beating, did not want to be found. A trip to his village - a few families living on a narrow dirt lane near a small yellow Hindu temple - turned up nothing.

"We don't know him," one of the neighbors said.

But after a flurry of telephone calls, Arun Jadhav agreed to meet. He appeared with Dilip Jadhav at a roadside restaurant on the area's busy National Highway 4, studded with expensive auto dealerships that cater to the area's prosperous farmers and white-collar workers. Arun Jadhav, 45, an illiterate trumpet player, was reserved, a Nike ball cap pulled low over his eyes. Dilip Jadhav, 45, a wedding-band manager with a gold-tone watch and a neat checked shirt, had an air of a man used to sorting problems.

Arun Jadhav, who is not directly related to Dilip Jadhav, said he had been called to the village that day to attend a memorial service for the teenager's mother that evolved into the panchayat meeting.

"Somebody asked me to take responsibility for hitting these people and that's what I did. I had tea and then I left," he said.

Both men agreed that the teenager deserved the beating because she hid the truth about the assault.

Dilip Jadhav said it has fallen upon him to secure a future for the young girl, which will be difficult.

"If something like that happened to my daughter, then we would get her married off to the rapist," he said. "We don't go to the police station. If they take the kids to the police station everybody knows about her and she is a bigger liability. It's better if she gets married to him."

He thinks he has found a match for the teenager, though - a young widower of 20, maybe 21, also a musician, whose wife recently died. Within six months she'll be married.

Saudi Court Sentences Gang Rape Victim to 200 Lashes And Custodial Sentence

The victim of a violent gang rape has been sentenced by a Saudi Arabian court to 200 lashes and six months in jail for the crimes of speaking to the press and indecency.

According to Sharia Law, a Saudi Arabian woman must be accompanied by a male guardian at all times in public, something the 19 year old victim did not obey when she went to meet a friend, according to website Live Buddhism.

While in a car with a student friend, retrieving a picture, two men got into the vehicle and drove them to a secluded area. She said she was raped there by seven men, three of whom also attacked her friend.

The Shi’ite Muslim woman had initially been sentenced to 90 lashes after being convicted of violating the Kingdom’s religious diktats on segregation of the sexes, where woman are treated as second class citizens.

After the sentences were handed down following the rape in 2006, which included lenient custodial sentences for the men guilty of the violent crime, the woman’s lawyer appealed to the Saudi General Court. But instead of choosing to overturn the punishments for being the victim of a crime, the court more than doubled her sentence. At the same time, they also roughly doubled the prison sentences for the seven men convicted of raping her, according to Saudi news outlets.

Abdul Rahman al-Lahem, who defended the woman, reached out to the media after the sentences were handed down. The court has since banned him from further defending the woman, confiscating his license and summoning him to a disciplinary hearing later this month.

Saudi Arabia defended the controversial decision to punish the victim, saying that she was at fault for being out without a male friend, something which was met with international outcry.

“The Ministry of Justice welcomes constructive criticism, away from emotions,” it said in a statement.

The statement also said that the “charges were proven” against the woman for having been in a car with a strange male, and repeated criticism of her lawyer for talking “defiantly” about the judicial system, saying “it has shown ignorance.” They also added that the sentence was increased because the victim had spoken to the media. “For whoever has an objection on verdicts issued, the system allows to appeal without resorting to the media,” a statement on the official Saudi Press Agency said.

Politicians from the West reacted angrily to the news, with Jose Verger, the Canadian minister responsible for women, calling it “barbaric” and saying the country would complain to Saudi authorities.

U.S. State Department spokesman Sean McCormack said, “I think when you look at the crime and the fact that now the victim is punished, I think that causes a fair degree of surprise and astonishment. It is within the power of the Saudi government to take a look at the verdict and change it.”

UK political activist Angharad Yeo, who is half Saudi and has campaigned against violation of women’s rights at home and abroad. said it “sends a clear message that women are not valued and only seen as a possession.”

The UKIP member described the ruling as “disgusting”, adding that a woman was being punished “because men in Islam are weak and pathetic and hide behind Islam. What message does that send to young women?” she asked.

“You can’t ever protect yourself and your well being is a lottery. Should you be unfortunate enough to be assaulted, expect for it to be your own fault.”

The New York based Human Rights Watch said the verdict “not only sends victims of sexual violence the message that they should not press charges, but in effect offers protection and impunity to the perpetrators.”

Sex Gangs May Have Abused Hundreds Of Girls

Children have suffered on an "industrial scale" says the PM, as a report details horrific abuse and a failure to protect victims.

Nearly 400 girls may have been sexually exploited in Oxfordshire over a 16-year period, according to a report that has criticised authorities for failing to protect victims.

The Serious Case Review said a paedophile ring was able to rape and abuse six victims for five years because the girls' complaints were not taken seriously.

They were reported missing 500 times between 2005 and 2010, the review said.

One victim described how she turned up at a police station covered in blood in the early hours, but was ignored.

The review found multiple failings and said authorities could have stopped the abuse in 2005, rather than 2010 when it was finally uncovered.

However, it found no evidence of "wilful professional neglect" by police and social workers.

The report reveals 373 girls have been identified as possible victims of sexual exploitation within the last 16 years in the county.

The horrific accounts of six victims are documented within the review, along with their contact with authorities.

One girl said: "I turned up at the police station at 2/3am, blood all over me, soaked through my trousers to the crotch. They dismissed it as me being naughty, a nuisance."

Another told the authorities: "The Asian men felt they ran Oxford. That was exciting. People were afraid of them. I felt protected. People respected them."

Thames Valley's police chief said she deeply regretted her force's failings.

"We are ashamed of the shortcomings identified in this report and we are determined to do all we can to ensure nothing like this ever happens again," said Chief Constable Sara Thornton.

Between 2005-10 the six vulnerable girls were reported missing 500 times - half of those when they were in council care - but it did not raise alarm bells with authorities.

Chair of the Oxfordshire Safeguarding Children Board Maggie Blyth said: "The Serious Case Review has seen no evidence of wilful professional neglect or misconduct by organisations, but there was at times a worrying lack of curiosity and follow through, and much work should have been considerably different and better."

Their trial detailed how they "actively targeted" girls from the ages of 11 and 12, the majority of whom had been sent to live in care homes.

The girls were plied with alcohol, introduced to drugs, then sold for sex in guest houses, private houses and hotels, and abused by multiple men, some of whom had travelled to Oxford from "far afield".

The humiliation and degradation involved knives, meat cleavers and baseball bats. The girls' ordeals sometimes lasted days.

Like similar cases in Rotherham, Rochdale and Derby, the report states the victims were white girls and the perpetrators mainly men of Asian heritage and Muslim culture, but says "no one was aware of evidence of any holding back due to ethnicity".

KOTA KINABALU: Former restaurant manager Riduan Masmud has lost his appeal against his conviction and 12-year jail sentence for raping an underage girl last year whom he later married.

The 42-year-old, who has been out on bail, kept his head low when High Court judge Justice Stephen Chung dismissed the appeal yesterday.

He then ordered that Riduan start serving his sentence, which included two strokes of rotan.

Justice Chung said the jail term would begin immediately and dismissed an application by Ram Singh, Riduan’s counsel, for a stay of execution, adding that there was no reason for Riduan not to be sent directly to prison.

He said he had taken into account the points raised by Ram, including those pertaining to the competency of the two child witnesses, and found nothing to disturb the Sessions Court ruling on the case.

The victim and her school friend had testified against Riduan during the trial.

“Before recording the child witnesses, the trial judge had asked a series of questions on their competency as witnesses and after enquiring, the judge was satisfied that the children understood the procedure of court and proceeded to record their evidence under oath,” Justice Chung said.

“The trial judge also had the advantage of hearing and seeing them giving evidence in court and found that they were competent witnesses.”

Also, Justice Chung said, there was independent evidence that Riduan had had sexual intercourse with the victim inside the car and that there was penetration.

“Thus, rape has been established,” he said.

He said he had also taken into consideration the DNA evidence that was recovered from several items in the vehicle.

Riduan, a father of four children aged between two and 17, was found guilty on Jan 24 last year of raping the schoolgirl, who was about 12 at the time, in a parked vehicle near the Kionsom Waterfall in Inanam between 9am and 10am on Feb 18, 2013.

He married the girl in May that year in a bid to escape conviction and later admitted to attempting to bribe her father with RM10,000 to withdraw his police report.

For that offence, the Sessions Court sentenced him on June 22 last year to three day’s jail and fined him RM10,000 in default two months imprisonment.

Ram said he would appeal against the High Court decision today.

Two brothers arrested in India over rape of Japanese tourist

PATNA (INDIA) (AFP) - Indian police have arrested two brothers accused of repeatedly raping a 22-year-old Japanese tourist over three weeks near Bodh Gaya, Buddhism's holiest site, an official said Saturday.

The tourist had been held hostage at gunpoint in a secluded underground room close to a pilgrimage site, according to a preliminary investigation.

"When her health condition deteriorated due to repeated rape and poor living conditions, she was brought to Gaya (district headquarters) for medical treatment on December 20," a police officer who is part of the investigation told AFP on condition of anonymity.

But she managed to escape and reached Varanasi where she met some Japanese tourists who helped her contact the Japanese consulate in the nearby city of Kolkata, the officer added.

Sajid Khan, 32, and his 25-year-old brother Jawed Khan, both tourist guides, were arrested in the case on Friday, police deputy superintendent Alok Kumar Singh said.

"We have arrested the duo for confining and raping the Japanese student," Singh told AFP by telephone from Bodh Gaya.

The Bodh Gaya complex, 110 kilometres (68 miles) south of Bihar state capital Patna, is home to one of the earliest Buddhist temples still standing in India and attracts visitors from all over the world.

The Japanese woman, a university student, had come to Gaya from Kolkata where she had checked into a hotel in November.

India has faced intense scrutiny over its efforts to curb violence against women following the fatal gang rape of a medical student in New Delhi in 2012 which sparked global outcry.

Since then, several attacks on foreign women have also been reported, leading to a dip in tourist numbers to the country.

Last January, a 51-year-old Danish tourist was robbed and gang raped at knife-point in Delhi.

In 2013, a Swiss cyclist holidaying in central Indian state of Madhya Pradesh was robbed and gang raped by five men, all of whom were later sentenced to life terms.

Jobless man claims trial to sex with 11-year-old

KUALA LUMPUR: A jobless man claimed trial in the Ampang Sessions Court here today to engaging in carnal intercourse against the order of nature with an 11-year-old girl.

Nik Mohd Zamrie Nik Omar, 36, allegedly committed the offence in a surau near Ampang here, at noon on Dec 3.

The charge, under Section 377c of the Penal Code, carries a jail term of up to 20 years and whipping upon conviction.

The accused also claimed trial to robbing the victim of a mobile phone and RM6 at the same time and place.

Judge Suraiya Mustafa Kamal did not grant bail and set Jan 27 for mention.

Deputy public prosecutor Noor Fazlin Ab Zawawi appeared for the prosecution.

Meanwhile, Nik Mohd Zamrie was fined RM2,500 or four months’ jail by magistrate Zulyana Zulkapli after pleading guilty to having an imitation pistol.

He admitted committing the offence in front of Restoran Permai, Kampung Tasek Permai, Ampang near here at 5.30pm on Dec 11.

Deputy public prosecutor Goh Ai Rene appeared for the prosecution while Nik Mohd Zamrie was unrepresented.

Meerut on boil over alleged gang-rape, forced conversion

Meerut: Even before communal embers get extinguished in Saharanpur, tension gripped neighbouring Meerut after a young madrasa teacher alleged gang-rape and forced conversion into a community.

The 20-year-old, who was a regular teacher of Hindi and English in the Sarawa village madrasa in Kharkhauda, alleged that she was abducted on July 23 and taken to a madrasa in Hapur and later shifted to another one in Muzaffarnagar. She claimed that she was gang-raped and later forced to adopt the religion of a particular community and her named changed.

The woman managed to escape from captivity on August 2 and contacted her family who rescued her and later filed a complaint with the police.

Of the four persons named in the FIR, village chief of Sarawa and a madrasa official have been arrested and a hunt is on for the other two. The SHO of Kharkhauda has also been removed from his post.

The victim later claimed that she had seen 40 more girls in the Muzaffarnagar madrasa. She said they have been kept in captivity in a secret underground room.

With tensions rising and BJP leaders demanding complete probe, the UP Police searched the said madrasa only to find – reportedly – around 15 girls who had been registered there as having come there on a vacation. The police also failed to find any trace of a secret cellar.

The girl was taken for medical examination yesterday. She has claimed that her stomach was sliced, fuelling fears that the whole issue may be linked to a organ transplant racket.

The district administration is maintaining a strict vigil in the area.

Police and Provincial Armed Constabulary (PAC) personnel were deployed in the area after members of a particular communities attacked and pelted stone at the houses of members of another community last night in Kharkhauda and Atrada areas.

According to Superintendent of Police (rural) Captain MS Begh, the 20-year-old woman's father had lodged a complaint last night in Kharkhauda police station against Village Pradhan Nawab Khan, cleric Sallaullah, his wife and daughter Nishant for abduction and rape, as per PTI.

Begh said, the woman managed to escape and returned to her house on July 30 and narrated her ordeal to her parents.

He said the woman's medical examination has confirmed rape and cuts were found on her abdomen. He rejected media reports that the girl's kidney had been removed.

Meerut District magistrate Pankaj Yadav today said that Sallaullah, his wife and daughter have been arrested. Since the incident occurred in Hapud, he said the final decision post magisterial inquiry into the matter will be taken by Hapud district magistrate.

A magisterial inquiry into the incident will be conducted by Deputy District Collector SP Singh, who will submit a report within a week, District Magistrate (Hapud) Rajesh Kumar Singh said.

India: Dalit Women gang raped by Muslims, commit suicide

“July 16, 2014 (Agencies) Lucknow: A Dalit Muslim woman was gang raped by suspected Muslim perpetrators, when a politics of Dalit-Muslim unity is gradually worsening the situation of Dailts in Uttar Pradesh by their greedy Muslim counterparts. A massive outrage broke-out in Uttar Pradesh Hathras district post a 22-year-old gang-rape victim, who was set afire after raping, succumbed to her injuries. Furious people of the district staged protests and burnt the buses, trucks and other vehicles passing by the roads. They were expressing their fury as police hadn’t taken any steps against the accused and they were still roaming freely.”

“Uttar Pradesh Police said that on July 12, five men visited the victim at her husband’s home in Etawah and told her that her brother had sent them to fetch her. She was to accompany them to her parents’ home in Purvi Naurangabad near Sikander Rao in Hathras, they said. The unsuspecting woman went with the five men, who were later joined by two others.

Telling about the tragedy, victim’s father said that his daughter was set on fire after being gang-raped. He further revealed that he somehow doused the fire and rushed her to the hospital, where doctors told him that his daughter was 90 percent burnt and had very less chances of surviving. The sources have confirmed that Mahila Police Station in-charge also went to the hospital to record victim’s statement in which she disclosed the names of the accused.

However, the police didn’t show any haste in arresting the accused. However, police lackluster approach in the case has irked the people of the district and they have begun expressing emotions violently on the roads. They were present at the roads along with the dead body of the victim.

Local people jammed the Etah-Aligarh highway, and the mob set vehicles on fire. Demonstrators also pelted stones at policemen, who resorted to lathicharge to quell the crowd. Police and personnel of the Provincial Armed Constabulary from Aligarh, Hathras and Agra districts were rushed to the spot.

The woman’s relatives said she was under depression, as the police, whom the family had approached on Sunday, had taken no immediate action.”

“Hathras SP Dipika Tiwari told a media that the victim, before dying, had recorded a statement in front of police.

At last an FIR has been registered against Zeeshan, Tullan, Vakeel, Taufeeq and some unidentified men, under Sections 376 (rape), 342 (wrongful confinement) and 306 (abetment of suicide) of the IPC. Police is investigating the cause behind this rape of a Dalit woman, led by some Muslim perpetrators with an apparently jilted motivation.

Mohit Gupta, Aligarh SSP, who is also DIG in-charge, Hathras, said, “We had already arrested two people, and on the demand of the victim’s family, we conducted the post-mortem examination at night. But some anti-social elements tried to exploit the situation.”

Hathras DM Shamim Ahmed said there was no delay in lodging an FIR. He said his administration planned to lodge an FIR against the miscreants responsible for disturbing the law and order situation.

The district administration later convinced the victim’s kin to cremate her. The victim’s brother told a media, “She was my only sister. And her last rites were performed without the usual rituals.”

Meanwhile, the Samajwadi Party-led Uttar Pradesh government hasn’t made any remarks on the issue so far.

A lead to riot situation may be vitiated, if staunch action can not be taken to reveal the truth behind the truth of gang rape of a Dalit woman and also to punish the Muslim perpetrators already arrested and to be arrested in the related case under proper law and order. Communal tension is prevailing out of situation around Hathras and adjacent places. Protesting Hindu Dalits are being gradually disillusioned by the fake call of Dalit-Muslim unity automatized by both Samajwadi (read Namajwadi) Party and Bahujan Samaj Party.”

Jail For Four Men Who Sexually Attacked Girl 20 Times

Article imageFour Buckinghamshire men have been found guilty of twenty sex offences against one girl.
The 14-year-old was forced to take part in sexual acts and have sex a number of times between December 2011 and July 2012.

During their three week trial, Nazakat Mahmood, Ghulfaraz Nawaz, Omar Sharif and Haroon Rauf told Reading Crown Court that they thought she was 17.

But after Mahmood, Nawaz and Rauf were arrested, Sharif contacted the girl and said he'd undermine her statement.

He then blackmailed her into having sex with him.
Investigating officer Det Con Natalie Golding from Aylesbury Major Crime said:
“This was abuse of a young vulnerable girl in the most horrific way.
“All four men used this girl and then, when she had the courage to come to police, they denied the offences and continued to deny them.
“I want to thank the victim here for her bravery in coming forward and helping us to put these men behind bars.
“Hopefully this will go some way to showing other victims of sexual offences that we will listen to you and we will take you seriously.”
The full convictions are:
  • Nazakat Mahmood, aged 28, of Batchelors Way, Chesham was convicted of seven counts of sexual activity with a child and two counts of causing or inciting a child to engage in sexual activity.
  • Ghulfaraz Nawaz, aged 27, of Benham Close, Chesham, was convicted of two counts of sexual activity with a child.
  • Haroon Rauf, aged 30, of Drakes Close, Amersham, was convicted of two counts of sexual activity with a child, one count of assault by beating,
  • Omar Sharif, aged 25, of Brockhurst Road, Chesham, was convicted of six counts of sexual activity with a child.
They'll all be sentenced on May 16.

Wan Junaidi wants rape remarks out of Hansard

 
PARLIAMENT Deputy Home Minister Wan Junaidi Wan Jaafar requested Parliament today to expunge his controversial remarks about non-Malays being less offended by statutory rape from the Hansard.

However, despite admitting that his statement could have caused hurt if read "out of context", Wan Junaidi did not apologise for what he had said.

"If you read the sentence on its own, out of context, maybe it can be offending," Wan Junaidi said in Parliament today.

Speaker Pandikar Amin Mulia agreed to the request to expunge the remarks from the Hansard.

Wan Junaidi made his request when responding to a motion by Chong Chieng Jen (DAP-Bandar Kuching) to refer Wan Junaidi to the Rights and Privileges Committee for his racist remarks.

"Maybe I overspoke the answer, but I am not racist. My wife is Chinese," Wan Junaidi said.

Chong said the decision to expunge the remark was equivalent to a retraction and as such, he accepted Wan Junaidi's decision.

Pandikar had earlier asked Wan Junaidi to state whether he would like to apologise or retract his statement.

Wan Junaidi faced a barrage of criticism last week for making the suggestion, but said today in Parliament that he uttered the statement because he had statistics to back up his claims.

“I have the statistics with me, I could read it out if you want to,” he said, referring to statistics regarding how many under-16 non-Malays have children out of wedlock and the amount of police reports lodged in comparison.

I’m no racist, says Wan Junaidi over child rape issue



Deputy Home Minister Datuk Wan Junaidi Tuanku Jaafar (pic) has dismissed suggestions by his critics that he is a racist when he compared statistics of statutory rape between Malays and non-Malays.

"How can I be a racist when my wife is Chinese and I have many relatives who are non-Muslims/Malays," he said, when asked to clarify his remarks.

He said the Malays tend to lodge reports due to their religious and cultural sensitivities on statutory rape, even if was a consensual act.

"They have no other solution, but to lodge police reports, even when they realise that consensual sex with a minor was a statutory sexual offence," he told reporters after opening the Asia Pacific non-governmental organisation conference on Human Trafficking in Kuala Lumpur today.

Wan Junaidi sparked a furore when he said, in reply to a question, that child rape was more common among Malays because non-Malays are less sensitive and under-report such cases.

He said the majority of Muslim parents were unable to accept the idea of sex before marriage .

"There are more reports involving Malays compared with other races because Muslims can't accept a child out of wedlock, pre-marital sex, and because these acts are wrong by Islamic law (zina)," Wan Junaidi said in Parliament during question time.

Wan Junaidi said statistics showed 80%, or 1,147 of the 1,424 of statutory rape cases reported last year, involved Malays.

Statutory rape covers girls aged below 16, regardless of whether it involved consensual sex and whether the accused was an adult or minor.

In comparison, he said, Chinese accounted for 4.3% (62 victims), Indians accounted for 2% (32), while other races accounted for about 13% (183).

He said this was consistent with the numbers for 2012, where out of the 1,243 underage rape victims, Malays accounted for 80%, Chinese 5%, Indians 3%, while other races accounted for 12%.

Wan Junaidi said statutory rape cases were mostly caused by access to pornographic material available easily on the Internet.

He said other reasons for underage rape included young people being influenced by friends as well as an urge to try having sex.

Wan Junaidi's remarks hit a raw nerve among netizens and civil society, who rebuked him for being insensitive.

Wan Junaidi said he had discussed with his officers the wide disparity in the number of child rape police reports before delivering the reply in Parliament but they did not give him a satisfactory answer.

"I want this to be studied and this includes getting professors to do research," he added.

Elaborating on his speech at the conference, he said his ministry was reevaluating the Human Trafficking Act 2007 to meet international standards.

He said this in response to the United States report on Human Trafficking which placed Malaysia on the Tier Two Watch list for the fourth consecutive year (2010-2013) and the possibility of being downgraded this year.

The 2013 report said that Malaysia did not fully comply with the minimum standards of elimination of human trafficking in terms of prosecution, protection accorded to victims and prevention.

Wan Junaidi said Malaysia had taken steps to provide shelter homes and also employment opportunities to victims until they were sent back home.

"They are not confined in shelter homes but are also given skills training," he added.

Wan Junaidi, however, said any amendment to the law must be done after careful study or there would be an influx of foreign nationals and this would be a strain on the country.

"We never had malaria and tuberculosis but these diseases have returned due to the high number of foreign workers," he said.

He said the government would intensify its effort to work with NGOs to create awareness among the public on the effects of human trafficking and also to provide support to victims. – March 19, 2014.

Wan Junaidi’s shocking child rape remark

I think most of us were shocked to hear the reply in Parliament by Deputy Home Minister Datuk Wan Junaidi Tuanku Jaafar to the question of why the incidence of child rape is more common among Malays.

His outrageous unsubstantiated statement that Malays were more sensitive than non-Malays to the issue of statutory rape borders on the ridiculous. However, the sad fact is that it seems that even a serious crime such as sexual violence and child abuse is viewed or even judged through the lens of race. Even at the highest levels of government, mind-sets continue to be imprisoned by the straitjacket of racism.

No person at the Cabinet level, whose responsibility it is to look at issues which affect all Malaysians, should be making racist and sweeping statements which inevitably reflect the level of seriousness of which such issues are considered as well as the policies linked to it.

Rightly or wrongly, based on the Deputy Home Minister’s statement in Parliament, people would be justified in thinking that the government has a misplaced sense of understanding regarding sexual violence and child abuse.

What the Deputy Home Minister stated in his answer to the question in Parliament is a serious issue because this is not about his personal opinion, which would be sufficiently appalling and despicable enough. This is about the position of the government on a serious issue which affects women and girls in this country. His answers in the House, therefore becomes the position.

Therefore, I must ask, is the position of our government therefore that the incidence of child rape is more common among Malays, because Malays were more sensitive than non-Malays to the issue of statutory rape?

Another sad fact is that the Deputy Home Minister’s statement seems to focus on the issue of reporting. He appears to reject a fundamental problem: the reality that there is a high incidence of rape and sexual violence occurring to children in Malaysia, irrespective of their ethnicity.

Royal Malaysian Police statistics indicate that 10 women and girls are sexually assaulted each day. Fifty per cent of all such cases, which includes rape, involve children below the age of 16. Bear in mind that these numbers do not include cases where the rape survivor was married off to the rapist, changing the status of the crime from haram to halal.

Like a true politician born and bred in divisive racial politics, the Deputy Home Minister decided instead to take the defensive approach as if the question was a criticism of the Malay community, and respond to the effect that the children of other races are raped too but that they are more accepting or tolerant about it and therefore don’t report. What rubbish.

For the benefit of Yang Berhomat Timbalan Mentri, allow me to repeat this sobering statistic: 50 per cent of sexual violence in Malaysia occurs to girls below the age of 16. Don’t believe me? Go and visit PDRM’s Sexual Crimes Unit.

Perhaps he needs to spend some time with some of the urban poor families living in Malaysia’s cities. Many of them live in low cost and high density apartments and in conditions which would be terrifying and vulnerable for any child. READ MORE HERE

Underage rape cases drop to 1,424 in 2013

KUALA LUMPUR: The number of statutory rape cases has declined from 1,550 cases in 2012 to 1,424 cases last year Deputy Home Minister Datuk Dr Wan Junaidi Tuanku Jaafar said at Dewan Rakyat yesterday.

He said although the number of cases had declined, the trend was still worrying. Wan Junaidi was responding to a question by Che Mohamad Zulkifly Jusoh (BN-Setiu), who had asked the ministry to state the number of underage rape cases nationwide and the government's measures to stop them.

He said the government had added a special division in the Criminal Investigation Department to research combating crimes related to sexual and child abuse.

"One-stop crisis centres have been established in hospitals to help victims and handle them in a more professional manner.

"Counselling services are given in police stations to help victims who are traumatised. Reports are also taken in a special room so that victims do not have to testify in public."

He said children under the age of 16 could now testify on video at the Child Interview Centre.

"This is to protect the children from being threatened by suspects."

Malays less willing than non-Malays to accept child rape, says deputy minister

He said this was because the majority of Muslim parents are unable to accept the idea of sex before marriage compared with non-Malay parents who are presumably less sensitive over the issue.

Wan Junaidi said statistics showed 80% or 1,147 of the 1,424 of statutory rape cases reported last year involved Malays. Statutory rape covers those aged below 16, regardless of whether it involved consensual sex.

In comparison, he said, Chinese accounted for 4.3% (62 victims), Indians accounted for 2% (32) while other races made up about 13% (183).

He said this was consistent with the numbers for 2012, whereby out of the 1,243 underage rape victims, Malays accounted for 80%, Chinese 5%, Indians 3% while other races accounted for 12%.

Wan Junaidi said the statistics for the Malay community were higher than that of the other races because they were more inclined to lodge reports of teenage sex, whereas non-Muslims were possibly less sensitive over the issue.

"This is because Muslim parents cannot accept sex before marriage or babies born out of wedlock as it is against Islamic teachings," he said in reply to a question from Che Mohamad Zulkifly Jusoh (BN-Setiu) on underage rape cases.

He added that police investigations found that statutory rape cases were mostly caused by access to pornographic material available easily on the Internet.

He said other reasons for underage rape included young people being influenced by friends and also the urge to give sex a try.

Wan Junaidi said that although there was a reduction in the number of cases, it was still a worrying trend as young people aged between 13 and 16 accounted for 90% of underage rape victims.

To a question from Siti Zailah Mohd Yusoff (PAS-Rantau Panjang) on whether weak enforcement was a factor, Wan Junaidi said parents were duty bound to ensure the safety of their children and not leave it to enforcement agencies. – March 18, 2014.
