Judge Datuk Lau Bee Lan, who handed down the decision in her chambers, said the children of M. Ramanoojom, 79, were citizens under Article 14(1)(b) of the Malaysian Federal Constitution.
Lau also ordered the children, son Thirupathi, 34, and daughter, Meena, 31, to make an official application for citizenship and the MyKad identity card at the Malaysian High Commission in India within three months.
In the originating summons by Ramanoojom in Sept 2007, the children named the Home Minister, the director-general of the National Registration Department, and the Government of Malaysia as defendants.
According to the affidavit, Ramanoojom, a Malaysian citizen, said he married N.Pushpam (an Indian citizen) in India on Sept 13, 1960 and both his children were born there.
He said he had made an application to have them brought to Malaysia in 1978 in Madras but failed until his wife died in 2005.
Ramanoojom, who was represented by lawyer M. Manoharan, when met outside the court said he was very happy with the decision and thankful it was achieved before he died.
He said both his children were in India and they desired to return to Malaysia.
