Koh says will resign but gives no succession plan

KUALA LUMPUR, Nov 6 — Senator Tan Sri Dr Koh Tsu Koon has announced he will resign as Gerakan president before his second term ends but refused to disclose his succession plan.

The embattled party president told reporters that he will let party delegates decide who will be his successor.

“I will step down earlier if new leaders are ready and have the support of the delegates,” Koh said during a press conference after attending the party’s AGM.

He added that he wants to stay for only two terms because he is not “dependent on party and government posts”.

However, Koh (picture) explained that he is not seeking any signal from the delegates and hopes a leader will naturally appear.

“I am not asking for any signal, I am asking them to work hard. Please work hard so that we can become united and work hard for party, country and the people.

“I am checking with the delegates [if there are capable new leaders to succeed me]. That is why I am throwing this so maybe some names will float and people can discuss but don’t speculate,” he said.

The minister in the Prime Minister’s Department also stressed that he is ready to step down next year if the party shows that it is “dedicated” and “united.”

“If there are capable leaders and we are united and have the fighting spirit. If they can move the party forward and Gerakan is very determined, dedicated and united. Why not? I am assessing now [who can replace me] but it is not for me to decide but it is for the delegates because we are a very democratic party,” he said.

Koh’s first term as president will end during next year’s party election and will seek to be re-elected for another three years.

The former Penang chief minister added that no leader is irreplaceable and indispensable.

“Of course some people like me to go and some people do not want me to go. I don’t expect any signal. No leader is irreplaceable and indispensable. You always have to get ready fast. That is all,” he said.

Koh also refused to comment on his predecessor asking him to not overstay his welcome but instead listen to party members who have lately questioned the leadership.

Former president Tun Dr Lim Keng Yaik recently announced his decision to quit as party adviser, citing his dissatisfaction with Koh’s leadership.

The former Beruas MP accused Koh of being too afraid to resolve internal party conflicts, referring to the recent Penang Gerakan leadership crisis.

The party president is expected to face a barrage of criticism during the party’s national delegate conference as many are unsatisfied with the party leadership.

The growing unhappiness towards the party leadership culminated when Penang Gerakan leader Datuk Dr Teng Hock Nan survived ouster attempts by grassroots leaders.

Waiting on developer's mercy

KUALA LUMPUR: Abandoned housing projects are commonplace throughout Malaysia's property landscape. But for the villagers of Kampung Berembang, this fact comes as a painful truth.
Once home to a few thousand inhabitants, Kampung Berembang in the vicinity of Ampang has been reduced to a shantytown of rude huts, with only 30-odd families left.
With their original houses forcibly bulldozed by the Ampang Jaya Municipal Council in 2006, many of the villagers have had to move to other locations throughout the Klang Valley.
Those who have been fortunate enough to remain have been forced to live in tents for a few years, adding zinc sheets and leftover wood to craft into makeshift houses.
The villagers are stuck between a rock and a hard place. To the northeast lies a YTL cement factory, with its cement trucks rumbling precariously every five to 10 minutes along Jalan Berembang.
A water retention area for the SMART tunnel sits to the north, while to their west are planned quarters for government workers from Sabah.
Even their skyline has been taken away from them, with the whole village dangerously resting beneath high tension power cables.
But there is little choice for the few villagers who still remain and the hundreds of Berembang “refugees” all across the city, as they wait on the mercy of developers to build a new place for them to live in.
In a state of limbo
In 2006, the state government at the time had promised to build a 17-storey low-cost flat for the villagers in a joint venture between Permodalan Negri Selangor Bhd (PNSB) and Perspektif Masa Sdn Bhd.
Located directly behind the South Korean embassy off Jalan Ampang, the building should have been finished by November 2008. But to this day, it remains in a state of limbo, with only about 30 workers laying bricks for a housing project more than three acres large.
In his surprise visit to the construction site recently, Selangor state exco member (Housing, Building Management and Squatters) Iskandar A Samad witnessed only a handful of labourers in the area, with a logistics and safety officer as the only official in sight.
Accompanied by nearly two dozen Kampung Berembang villagers, Iskandar said that much of the work on the site could have been completed in one or two months.
He first visited the site early this year. Last week, he made another two more visits.
On his third visit on Nov 4, Iskandar had been accompanied by both the contractors and developers, as well as over 60 workers.
“Whenever there is an (official) visit, all the developers, agents and engineers will come,” he said at the building's construction office, adding that more than 70% of the construction had been done.
Less than 30 minutes after Iskandar's arrival, officials from Vertex Builders (contractors) and Acmar International (developers) made their appearance.
This did not stop the state exco from berating them for a job poorly done.
Weekly report
A quick look into the contractors' logbooks revealed that only 32 labourers showed up for work compared with 63 when he came to the site on Nov 3.
Iskandar grabbed the logbook and flipped through the pages, showing both the media and contractors that the total number of workers showing up for both Monday and Tuesday last week were 23 each.
“When I came yesterday (Nov 3), the number of workers was 63. Today (Nov 4), it is 32. You want me to come every day, is it?” he asked the site's contractors angrily, who tried to placate Iskandar with excuses.
Iskandar then issued an ultimatum to both Vertex and Acmar, demanding that the building be completed by February 2011. He also said that the PNSB owed the Selangor government a weekly report on the building's progress, threatening drastic action if his words were not taken seriously.
Asked what excuses the Selangor government had been getting from the developers, Iskandar said: “They have lots of excuses, like they have other projects at the moment... But their excuses have got nothing to do with this one!”
When pressed by FMT, both Vertex and Acmar claimed that the delayed deadline was not their fault.
“We paid the workers Deepavali money on Nov 4, which is why so many of them showed up. We cannot make them work on Deepavali day (Nov 5),” said a Vertex Builder spokesman, who refused to be named.
Even so, the spokesman admitted that the site's labourers were usually on the job seven-days-a-week.
Asked why it had taken a long time to complete its work, Acmar International (project building divison/construction) senior manager Richard Ng said, “I can't answer you this, because it's all (based) on the top management's decision. We've only been here a few months.”
Passing the buck
However, Ampang Jaya Municipal Councillor Hayati Abdul Samad was convinced that both Vertex and Acmar officials were passing the buck.
“Most of the workers here are Indonesian, so why would they be celebrating Deepavali?” she said, pointing to the scant few that showed up on Nov 4.
Hayati also alleged that many of the workers who showed up during Iskandar's visit on Nov 3 were from other nearby construction sites.
“They were here just to show their face. They were just following us around, and not doing any work,” she told FMT.
Hayati also said that the contractors were often late in paying their workers, causing many of them to run away.
When approached, an Indonesian worker who preferred to remain anonymous admitted that he had not been paid for more than a month.
'We will fight'
Like Hayati, many of Kampung Berembang's villagers were not swayed by Acmar International's words. According to resident Nor Alizan Ali, the developer appeared to be more keen on developing the area into a luxurious condominium area known as D'Rapport.
FMT noticed a well-serviced Acmar International office located along Jalan Nipah, not too far away from the unfinished low-cost flats. According to an iProperty website, D'Rapport apartments have been offered from as low as RM880,000 to as high as RM5.1 million each (Link: (http://www.iproperty.com.my/developments/developmentreview.aspx?pid=1174).
However, complicating matters is the village's position, which is cut into two by the Selangor-Kuala Lumpur border. The new but unfinished homes, however, sit in Ampang Jaya, Selangor.
Thus, the villagers have been forced to send their children to schools in Ulu Klang, even though a newly-completed school sits in plain view, less than a hundreds metres away. But until the housing project is completed, the school cannot be used.
Despite being pressured by a consistent rash of bad news, Nor, like many of Kampung Berembang's villagers, has not given up hope.
“Until I get that house (low-cost flat), I will not leave this place. I will fight. We will fight,” he said, pointing to the unfinished housing project.
However, the future remains bleak for him, and the people of Kampung Berembang. Many of his fellow villagers have already moved to other parts of the Klang Valley, including Puchong.
He fears that the developers would not be able to complete the housing project the next time the bulldozers return.
“If they (authorities) chase us away, we will be gone forever (from Kampung Berembang),” he said.

With massage parlours galore, pubs and bars mushrooming all over the place, broken roads and 'dead' traffic lights, and restaurants taking over the parking lots so that cars need to park illegally and obstruct traffic, it makes one wonder how much these unelected Pakatan Rakyat local councilors are earning a month in ‘under-the-table’ money.

NO HOLDS BARRED

Today, Tunku Abdul Aziz wrote an article called ‘MPPJ enforcement officers cry foul’. This is what he said:

Local council enforcement officers in Petaling Jaya have told me that they are often stopped dead in their tracks in the course of carrying out their work by Pakatan Rakyat politicians. These loud-mouthed, arrogant and bullying lawmakers, or more correctly, lawbreakers, with their own personal political agenda give direct operational orders to enforcement officers who are answerable, in any case, to their career local government officers.

Enforcing municipal or city council laws in these circumstances takes on a bizarre tug of war aspect when politicians, often from the same party, descend on the scene issuing diametrically opposed instructions. Interfering to the extent of ordering enforcement officers to leave unlicensed food traders well alone for fear of losing their votes is considered, in their circle, as politically savvy and chic. No doubt all part of their ticket to Putrajaya.

The fact that this is blatant abuse of power, or not to put too fine a point on it, corruption, seems to escape them completely as they set about, single-mindedly, to develop popular ground support, for future parliamentary elections. They studiously look away from breaches of the rules and regulations of their own making, committed by MCA supporters who might, just might, change their political allegiance if they were allowed to continue to trade illegally. Why not help them to become “legit”? In this way MPPJ will earn some revenue.

Kak Wan, what do you want me to do with these ballot papers?

In my ‘PKR, and its ballot papers, up for sale’ post yesterday, I had said that I was going to meet an individual last night who had contacted me to say that he was in possession of PKR ballot papers for use in the ongoing party elections, and that he would pass the same to me as evidence of his claim.
In fact, that meeting was scheduled to take place this afternoon, but the individual was extremely concerned that I would be followed and that he might be identified by ‘interested’ parties, and so, at his request, I said that the meeting was to take place last night.
I met him about an hour ago.
He was very nervous.
He showed me a stack of ballot papers. They comprised ballot papers for the post of Deputy Presidency, Vice Presidents and Majlis Pimpinan Pusat.
The ballot papers for the Deputy Presidency and Vice Presidents were all serialised whilst the one for the MPP were not.
He had about 100 copies of the ballot papers in all.
I asked if that was all he had.
He  replied that if I could wait, he could go back and meet me again later at another location with another 1,000 or more if I wanted.
I asked if I could have the 100 or so ballot papers that he had with him.
He offered to give me one of each provided I promised to blank out the serial numbers as he did not want to get any one into trouble.
I asked who those people might be.
He did not want to reply.
I asked him to explain to me how possession of these ballot papers might be used in the elections.
He explained that the central election committee returning officer could manipulate the list of members attending at the ongoing elections, where voter turnout is low, adjust it upwards and stuff additional ballot papers into the ballot box. Worse, it seems that at some elections, there is not even an attendance list to reflect the number of members attending to vote. This makes it even easier to stuff additional ballot papers into the ballot box.
I asked if he was representing any of the candidates and was that why he was exposing this to me, as the person or persons he was supportive of were being affected.
He admitted that he was doing this because the leadership he favoured were being cheated, but he also said that he was doing this in the hope that something would be done to stop this cheating and, if nothing was in fact done, he saw no reason to remain with the party any longer.
I asked if he knew who was behind this.
Without hesitation, he named Azmin, aided, he said, by the party HQ secretariat, and certain members of the central election committee over which the chair, Dr Molly Cheah, no longer has any control.
I do not have access to a scanner right now, so I have taken photos of the ballot papers, with the serial numbers blocked, which I now reproduce below.

Is not this election a sham?
If PKR stands for justice, will not Kak Wan step in now?

I am a Malaysian first, second, and last

We are a nation that defines race in our constitution. Well, there is nothing wrong with that. But we should know that we are in the league with countries like South Africa and Israel.

Other countries have their own definition of race, but very few take pride enshrining it in their constitution.

Whatever your stand on that, let us admit one thing, we are not in the best of companies.

Religion teaches us that God created us as equals, and some even say that we are all related (albeit distantly). Say what you want, twist and cite all the verses in every holy scriptures you can, but the crux of the matter is that we are all the same before Him, we are all related even.

Yes people, that makes us brothers, sisters, first cousins, second cousins and distant cousins if you must.

In my opinion, 1Malaysia was a long and overdue call. A battle cry, after years of trouble. However, being a sceptic that I am, it was a call that sounded too good to be true.

And i didn’t wait long to be proven right. The first crack was when the government ministers hesitated to declare themselves a Malaysian first vis a vis their race. I assure you their silence (elegant or not) speak volumes, and is more deafening with each passing day in the eye of the Malaysian public.

Second was when an independent member of parliament from Pasir Mas (who later had a heart attack) started ranting on and on about a topic that would have landed anyone else into ISA. Surprisingly a statesman followed suit. Mind you, this statesman was the first to introduce the term ‘Bangsa Malaysia’ in the 90′s and the idol to millions including myself at one point or another.

Third was when government servants, I repeat ‘servants’ made seditious, racial remarks in school, and in government run camps. They seem to forget they are paid by the Malaysian public – brown, yellow, green, red and black people combined. Worse was when our leaders said they didn’t have the power to do anything about it. I couldn’t believe my ears because if they don’t, who does?

Fourth was when they called a rapper to give his statement for voicing out his anger, due to the fore-mentioned injustices online. A hint, this rapper was first famous for his one-hit ‘negarakuku’.

I pity him. I really do and my heart goes to him, his family and friends for speaking up. They cannot be blamed for emulating and taking cues from the MP of Pasir Mas.

But that was the last straw for me.

Don’t get me wrong, I am proud to be a Malay and all that it entails, but being Malaysian is always first, and everything else comes second.

It is always about putting the national interest before oneself, before society and community. And when you do that, you automatically become a Malaysian first.

People look hard for reasons to disunite, even when there’s none. At the end, the winner will be a powerless master in a broken country from disunity.

It is not wrong to say that we would fare better without politicians fanning the flames. As far as i’m concerned, most of them are hypocrites. They demand one thing and request another. They speak like they own the world and preach us to sacrifice what we have, when they themselves are reluctant to sacrifice an iota of their common sense for the benefit of the masses.

Not to say they have a lot of common sense to begin with.

To all my brothers, sisters, cousins, whoever you are, wherever you are, whatever you are, we are all Malaysians in the eyes of the world, and we are a sight and strength to be reckoned with, together.

Similar to a combination of colors forming a rainbow or pieces of jigsaw puzzle that is priceless together, but worthless apart.

Let us not tear this magnificent rainbow away.

As we move towards the year end, our resolution must be to put this country first before any man, woman or child. That our differences should and must be our strength, not weakness and that we should build the future by graduating from the past.

Our children should thrive in an environment that promotes respect, tolerance, and celebration of each other’s differences, not antagonize, suspect and oppress one another. They should stand equally tall, speak equally loud and strive equally hard to realize each and every one of our dreams.

They should all be Malaysian first,second and third and none else in between.

Then and only then will we truly live the spirit and virtue of 1Malaysia.

I offer no apology for saying all this and more.

Trams could complement no-car zone

Meanwhile, one political economist has said there is no reason why trams cannot be eventually extended all over Penang. He noted that trams are used extensively and effectively over long stretches in cities such as Amsterdam and Berlin.

Where to find the money for this? Well, if we can afford submarines and fighter planes, then surely we can afford an improved public transport system.

Second Qantas jet returns to Singapore after engine trouble

(CNN) -- A Qantas passenger jet landed safely in Singapore on Friday after turning back due to engine problems shortly after takeoff, Australian Transport Safety Bureau spokesman Neville Blyth told CNN.

"I saw flames five minutes into flight and we could see flames through the left-side window," said passenger Terence Sim.

It is the second Qantas jet in two days to return to Singapore as a result of engine trouble.

In Friday's incident, the Boeing 747-400 was carrying 412 passengers and 19 crew members and was headed to Sydney, Australia, according to a Qantas spokesman, who would not provide his name, citing company policy.

On Thursday, a Qantas Airbus A380 jet made an emergency landing at Changi Airport after one of its four engines shut down as it started a flight to Sydney. As the plane headed back to the airport, part of the engine's covering, or cowling, tore off.

Airbus announced Friday that it asked all operators of A380s with Rolls-Royce engines to inspect them as a precaution.

The Australian Transport Safety Bureau says it has deployed investigators to examine the cause of Thursday's engine failure on the Airbus A380 and is currently gathering more information regarding Friday's incident.

None of the passengers aboard the Boeing 747-400 also had been aboard the Airbus A380, according to the Qantas spokesman.

BN must still improve despite twin wins, says DPM

KUALA LUMPUR, Nov 5 — Tan Sri Muhyiddin Yassin warned today that the Barisan Nasional (BN) victories in Batu Sapi and Galas yesterday would be meaningless if the ruling federal coalition failed to harness the momentum.

Calling BN’s wins in the two by-elections an encouraging sign, the deputy prime minister said they should not be taken for granted.

“To me, this is only the beginning. We cannot assume that this trend will continue if we don’t take actions to double up our efforts,” he told reporters today at the MIC Deepavali open house at the Putra World Trade Centre.

Muhyiddin said the win in Galas, Kelantan, was especially significant as it was an opposition stronghold held by PAS.

“There are many quarters who had said that will be difficult for us to get through to the Kelantan voters because they are more inclined to PAS, but from this outcome, it shows that they are rational and can make evaluations about what the BN government has done,” he said.

He then attributed the both electoral wins to the government’s policies, the prime minister’s leadership and the hard work by the governing coalition since the political tsunami of Election 2008, when BN lost its customary two-thirds majority in Parliament.

When asked if this may be an indication of snap polls in the next year, Muhyiddin said the matter was up to the prime minister.
At today’s event, MIC president Datuk Seri S. Samy Vellu echoed Muhyiddin’s views on possible snap polls.

“We are like the army, whenever we get instructions from the prime minister, we will go out and work hard to make our party successful.

“When the general calls, the army has to follow,” he added.

In agreeing with the DPM that voters were now returning to BN's fold, Samy Vellu said: “It shows that they (the voters) want a government who can be with them, help them and help their children succeed in this country.”

The outgoing president then added that MIC will continue to work hard, regardless when the next general election will be called.

“As always, we will continue to strengthen ourselves for the next general election, and not just work hard when the election is near,” he said.

Yesterday, BN sailed to victory in both the Galas and Batu Sapi by-elections.

BN’s Abdul Aziz Yusoff wrested the PAS-held seat in Galas when he polled 5,324 votes against the Islamist party’s Dr Zulkefli Mohamad’s 4,134 votes, claiming victory with a 1,190-vote majority.

In Batu Sapi, BN’s Datin Linda Tsen Thau Lin clinched the seat with a 6,359-vote majority when she polled 9,773 votes against PKR Ansari Abdullah’s 3,414 votes and SAPP Yong’s 2,031 votes.

Ku Li delivers, what has Umno to offer?

GUA MUSANG: Gua Musang MP Tengku Razaleigh Hamzah believes that loyalty has no expiry date so long as the candidate does not go back on his promises.

This was reflected in Galas when Barisan Nasional (BN) wrested the state seat from PAS by a bigger majority of 1,190 votes, nearly double the majority PAS won in the 2008 general election.

Leading the charge was Razaleigh, fondly known as Ku Li, who is no alien to the voters in Galas, which comes under his Gua Musang parliamentary seat.

He has proven to the BN, particularly Umno, that the party need not spent money to win votes, need not promise the stars and the moon to convince the people, and need not show its power by implementing projects.

Razaleigh showed that the only way to win over the hearts and minds of the voters is by being loyal and sincere to the people.

When he became the BN election director, he crafted a strategy that paid off: no new buildings, no new schools or projects, no resurfacing roads and repairing bridges, no handing out of cash.

He also made sure that no ministers came to officiate at functions as their convoy of flashy and expensive cars would put people off.

It was a also gentlemanly campaign: both rivals avoided “hitting below the belt” such as character assassinations and making derogatory comments.

Charm offensive

Razaleigh proved that a battle could be won without making any fuss, or hurting each other’s feelings.

He charmed the people with his warm and friendly personality but, most importantly, he showed that he had never lost the trust of the people whom he had loyally served the past 40 years as an MP.

There had been some minor bumps on the Galas road when former assemblyman Mohd Soufi Deraman and Wanita chief Wan Huzani Mohd Nor created some stir with their plan to boycott the election. But Razaleigh decided to lie low as he went about from house to house to strengthen ties and renew old contacts.

Voters in this remote constituency have known Razaleigh since 1971 and have stayed faithful to him through his ups and downs.

Even when he formed Semangat 46, a splinter party of Umno, the voters did not abandon him.

Yet again they rallied around his banner when they voted out PAS yesterday. The Chinese, Indians and the Orang Alsi delivered the votes without seeking any funds or gifts.

Such was the pulling power of Ku Li that even PAS speakers did not go out of the way to run him down. And Umno must surely be sitting up and taking notice of this old warrior who still has the gumption and fire in his belly to take up the cudgels for Umno.

In short, BN’s victory in Galas is Ku Li’s victory.

We lost to a superior BN machinery, says PAS

GUA MUSANG: PAS does not see its defeat in Galas as a signal that the voters are returning to the Barisan Nasional (BN) fold. Instead, it claims that it merely lost to a superior Barisan Nasional election machinery.

PAS Kelantan election director Wan Abdul Rahim Wan Abdullah said the defeat here mirrored the party's loss to the BN at the Pengkalan Pasir by-election in 2007. It then went on to recapture the seat in the 2008 general election.

“We lost simply because of the BN's superior election machinery, which concentrated on recapturing Galas,” Wan Rahim told FMT.

He said that in a general election when the ruling coalition would have to spread its resources nationwide, a victory would not have been possible.

"Of course, we concede defeat and accept it like a gentleman. We congratulate the BN on its victory. We simply cannot compete with the might of its resources. But we remain optimistic that we can recapture Galas in the coming general election," he said.

PAS' Dr Zulkefli Mohamad lost to BN's Abdul Aziz Yusoff by a 1,190-vote majority, which surpassed the majority gained by the Islamist party in the 2008 general election when the late Che Hashim Sulaima won with a 646-majority against BN's Mohd Saufi Deraman.

Zulkefli, a local medical practitioner and the party's Gua Musang chief, gained 4,134 votes. Abdul Aziz, Umno's Gua Musang division secretary, garnered 5,324 votes.

Chinese votes back in BN?

A rough check of the Galas polling data showed an increase in Chinese votes for BN in the predominantly Chinese settlements in the state constituency.

The popular opinion among analysts and observers was that the Chinese votes would only go in one direction – towards the opposition.

But it did not turn out that way – it went in the opposite direction. However, Wan Rahim said the data also indicated an increase in Chinese votes for PAS.

He said that a barometer of Chinese support towards PAS in the area was Kampung Pulai where 80% of the residents are Chinese.

"Yes, the votes for BN-MCA (Chinese component party) went up but so also were the votes for PAS. This means Chinese support towards PAS has increased although MCA did a better job at campaigning."

This could be attributed to the high voter turnout, said Wan Rahim. The Election Commission said the turnout stood at 83%, 2% higher than the 2008 turnout in a constituency of 11,533 eligible voters.

He, however, preferred a low-key response when asked about the polling data from Kampung Baru Gua Musang, another predominantly Chinese settlement here. In the last general election, PAS dominated all four polling streams but yesterday its dominance had withered away.

"I have not seen the polling data yet. I will have to see it first before I make any comments," Wan Rahim said.

'Galas win shows rakyat accepting 1Malaysia'

GUA MUSANG: The Barisan Nasional victory in the Galas by-election shows that the rakyat have begun to accept the policies of the BN government, including the increasingly popular "1 Malaysia" concept.

Kelantan Umno chief and Galas state by-election deputy director Mustapa Mohamed said the win also showed that the people favoured moderate values in a political party.

"This shows that the people are accepting the government policies, including its economic and government transformation programmes and the 1Malaysia concept,” he said.

"It is clear that the people are now leaning towards moderation. They don't like people who are rough, arrogant and indulge in baseless allegations,” said Mustapa, who is International Trade and Industry Minister.

However, he stopped short of saying that the victory would mean that the BN was ready to retake Kelantan.

"I don't like to be eager or greedy, or be blind to reality. This is not our culture... But I can say that the win is a sign that the Kelantanese have begun to accept us," he said.

"We are seeing a revival not only in Galas but also on the national stage. It is important that we do not disappoint the people,” he said.

Mustapa said that the 1,190-vote majority was unexpected.

"We expected a slim win. Such a huge majority was unexpected," he said.

He thanked all the voters for supporting the BN.

Meanwhile, freshly-minted Galas state assemblyman Abdul Aziz Yusoff thanked Allah, the voters and the BN for the victory.

"I am thankful to God and all the voters in Galas who have put their trust in me. I also thank Prime Minister Najib Tun Razak, his deputy Muhyiddin Yassin, Mustapa, and Tengku Razaleigh Hamzah,” he said.

"I want to stress that this is not my success but a victory for the Galas people."

Asked what would be his first duty, he said: "I will try to meet all the voters to thank them. I will try my very best to settle problems in Galas. I promise to serve to the best of my abilities."

Ansari: BN win 'based on lies'

SANDAKAN: PKR's defeated candidate Ansari Abdullah said today that the opposition fought an uneven battle in the Batu Sapi parliamentary by-election.

Ansari, 56, a lawyer, said that while the Barisan Nasional (BN) victory was not a surprise, the win was based on lies.

“The ruling coalition retained its seat because it bought the people’s votes. We have proof and will be uploading them onYouTube,” he said shortly after the official results were announced by Election Commission returning officer Mohamad Awang Supain at the Sandakan community hall.

He said PKR has handed over the evidence to the police and Election Commission, but so far, no action had been taken.

A tired and emotional Ansari snapped when a reporter asked him whether he was satisfied with the results.

“Do not be crazy. Do not ask me this question,” he said.

He said that PKR had predicted that it would not stand a chance against the BN, but added: “We did say we will not finish third.”

Last week, Zaid called for a halt to the ongoing PKR party elections, citing irregularities at several divisions.
This call has been ignored.
Yesterday, Mustaffa Kamil joined the chorus, expressing his concerns that party members would be betrayed for the benefit of a select few.
The party leadership still chooses to remain silent.
I received an e-mail from an individual at about 2pm today.
He said he has a stack of PKR ballot papers, which should, as a matter of security, be under the lock and key and the custody of the central election committee.
He gave me a number by which I could contact him.
I called.
He confirmed by phone that he has these ballot papers in his custody.
Without serial numbers, he says these will be used to boost the votes of certain candidates where voter turnout is low.
This, he says, can only be done with the collusion of the central election committee appointee mandated to oversee the elections.
He has agreed to meet me tonight to pass the ballot papers to me as evidence of his claims.
I asked if he was a member of PKR?
He said not for very long more.
I will report to you after I have met the individual tonight.
My question, though, is if this is true, will the PKR leadership continue to turn a blind eye?

Dengan penuh hurmat takzim,saya menjemput Datin merujuk kepada buku hasil penulisan Datin bertajuk diatas
(selepas daripada ini akan dirujuk sebagai Buku Tersebut) yang telah dilancarkan pada akhir July 2010 khususnya Bab 11,12 dan 13. Sebagai pembuka kata saya menyusun sepuloh jari menuntut ampun dan maaf kepada Datin dan YBhg. Dato Shafee Yahaya serta keluarga sekiranya dalam surat terbuka ini kelak, terdapat kata-kata saya ataupun fakta dan keterangan yang saya bentangkan yang menyinggung perasaan Datin serta keluarga. Saya berharap Datin akan menerima penerangan saya ini dengan perasaan terbuka.
2. Nama saya Mat Zain bin Ibrahim seorang pesara Pegawai Kanan Polis DiRaja Malaysia (PDRM) berpangkat Senior Asisten Kommisioner II (SAC II) G/5776. Jawatan akhir saya ialah sebagai Ketua Jabatan Siasatan Jenayah (KJSJ) Kuala Lumpur yang saya sandang sejak Disember 1998 sehingga bersara pilihan sendiri pada akhir 2001. Saya lebih dikenali sebagai Ketua Pegawai Penyiasat kes “Mata-Lebam” satu insiden bersejarah dimana bekas Timbalan Perdana Menteri Malaysia Dato Seri Anwar Ibrahim (DSAI) dibelasah oleh Ketua Polis Negara ketika itu Tan Sri Abdul Rahim Noor (kes yang akan turut saya sentuh dalam Surat Terbuka ini kerana kaitannya dengan penulisan Datin dalam
Buku Tersebut).
3. Mungkin tidak ramai yang perasan, (termasuk Pegawai-Pegawai Kanan PDRM yang sedang berkhidmat mahupun yang seangkatan dengan saya dan telah bersara) bahawa ketika bertugas sebagai KJSJ Kuala Lumpur saya juga merupakan Ketua Pegawai Penyiasat yang menyelia dan menangani kes dakwaan salah guna kuasa terhadap YAB Perdana Menteri Malaysia ketika itu, YAB Dato Seri Dr.Mahathir Mohamed (Tun Mahathir) yang terbit daripada pendedahan yang dibuat oleh Dato Shafee Yahaya ketika memberi keterangannya di Mahkamah Tinggi (Civil) Kuala
Lumpur, pada 12 Jun 2000.Saya akan dedahkan apa yang sebenarnya berlaku dan apa yang Polis temui dalam penyiasatan kes ini dalam perenggan-perenggan yang akan menyusul nanti.
3.1. Untuk makluman Datin, selain daripada dua kes berprofil tinggi yang saya sebutkan diatas,saya juga adalah Ketua Pegawai Penyiasat yang menyelia dan menangani kesemua empat (4) laporan Polis yang dibuat oleh DSAI diantara 9 July 1999 hingga 20 Ogos 1999 ( ketika DSAI dalam penjara Sungai Buloh) berkaitan dakwaan salah guna kuasa dan
menghalang proses undang-undang terhadap Tun Mahathir, Tan Sri Mohtar Abdullah (Allahyarham) Peguam Negara ketika itu, dan Dato Abdul Gani Patail (kini Tan Sri Abdul Gani Patail, Peguam Negara). Laporan-laporan yang dibuat oleh DSAI ini adalah bersangkutan dengan penyiasatan dakwaan penyelewengan dan kesalahan rasuah melibatkan Tun Daim Zainuddin,Datuk Seri Rafidah Aziz (kini Tan Sri Rafidah),Tan Sri Abdul Rahim Thamby Chik dan Tan Sri Eric Chia (mendiang).

4. Saya mengambil kesempatan ini untuk mengucapkan setinggi-tinggi tahniah kepada Datin yang berjaya menghasilkan suatu percetakan  berkualiti tinggi Buku Tersebut. Sebenarnya saya telah mengetahui mengenai pelancaran Buku Tersebut menerusi laman blog Din Merican pada 26 July 2010. Namun saya hanya berkesempatan membelinya di-Bookstore MPH, The Great Eastern Mall, beberapa hari sebelum Eidul Fitri ketika sedang menunggu waktu berbuka puasa bersama keluarga disalah sebuah restoran disitu. Untuk makluman Datin, saya tidak pernah mengenali Din Merican walaupun beliau sering menyebut nama saya dalam rencana-rencana beliau lebih-lebih lagi apabila membuat liputan berkaitan perbicaraan kes Datuk Ramli Yusuff, bekas Pengarah Jabatan Siasatan Jenayah
Komersil PDRM, dan juga seorang Peguam Rosli Dahlan. Sepertimana juga saya tidak pernah menemui atau berkenalan dengan Datin dan Dato Shafee Yahaya sendiri, saya juga tidak pernah kenal atau menemui Din Merican ataupun Peguam Rosli Dahlan walaupun Datuk Ramli Yusuff adalah sahabat saya yang saya kenali sejak dalam PDRM.

5. Saya berharap Datin terima bahawa saya tidak sekali-kali berhasrat untuk mempertikaikan, jauh sekali untuk memperkecilkan sejarah hidup Dato Shafee yang gemilang daripada seorang “Estate Boy to ACA Chief”. Tumpuan saya adalah terhadap fakta-fakta yang terkandung dalam Bab 11,12 dan 13 Buku Tersebut oleh kerana ianya berkaitan dengan saya secara peribadi. Sama ada secara langsung ataupun menerusi pihak ketiga antaranya, Datuk Param
Cumaraswamy atau pun Kim Quek (sepertimana terkandung dalam muka surat 273 hingga 287), Datin telah meyoal “What happened to the probe on Dr. Mahathir?”. Jika diselidik rekod PDRM berkaitan penyiasatan kes ini, ianya akan menjurus kepada saya oleh kerana saya adalah KJSJ Kuala Lumpur ketika itu, yang bertindak selaku Ketua Pegawai Penyiasat yang menyelia dan menangani kes tersebut. Adalah tidak adil kepada PDRM khasnya sekiranya saya berdiam diri kerana saya tahu perkara yang sebanarnya. Meminjam salah satu quotation yang Datin gunakan dalam Buku Tersebut; ”And mix not truth with falsehood,n or conceal the truth while you know (the truth)” Surah Al
Baqarah 2:24. saya akan berasa bersalah kepada PDRM dan juga kepada isteri dan anak-anak dan cucu-cucu saya jika saya tidak tampil menjelaskan perkara sebenar.

Laporan kepada YDH DIG Tan Sri Ismail Hj.Omar, atas sifat Timbalan Ketua Polis Negara (kini Ketua Polis Negara) dengan salinan kepada YB Dato Seri Hishamuddin Tun Hussein, Menteri Dalam Negeri.
6. Sambil itu saya ingin Datin ketahui bahawa sebelum terbitnya Buku Tersebut saya ada mengemukakan satu laporan bertarikh 6 hb.Mei 2010 atas tajuk “Dakwaan Pemalsuan Keterangan Dalam Siasatan Insiden Mata-Lebam 1998 Berkaitan Kecederaan Dato Seri Anwar Ibrahim (DSAI) Ketika Dalam Tahanan Lokap Polis Bukit Aman:- Penyemakan Semula” yang dialamatkan persendirian kepada YDH Tan Sri Ismail Omar ketika itu Timbalan Ketua Polis Negara dengan salinannya dialamatkan persendirian kepada YB Dato Seri Hishamuddin Tun Hussein, Menteri Dalam Negeri. Tan Sri Ismail Omar telah mengesahkan menerima surat saya berkenaan itu menerusi surat peribadi beliau kepada saya bertarikh 21hb Mei 2010.
6.1. Secara kebetulan  dalam laporan saya tersebut itu, antara lainnya, saya telah menyentuh berkaitan penyiasatan terhadap Tun Mahathir, yang terbit daripada pendedahan yang dibuat oleh Dato Shafee Yahaya. Dalam Surat Terbuka ini, saya akan menyentuh sedikit sebanyak kandungan laporan saya kepada Tan Sri Ismail Omar itu bilamana berkenaan.
Siasatan terhadap Tun Mahathir terbit daripada pendedahan oleh Dato Shafee Yahaya.
7. Siasatan kes ini adalah bersandarkan laporan Polis Tun H.S.Lee Rpt: 14752/2000 yang dibuat oleh DSAI pada 13.6.2000. Kes diklasifikasikan dibawah Seksyen 2 Ordinan 22 (Kuasa-Kuasa Perlu) Dharurat 1970. Perintah dibawah Seksyen 12 untuk menyiasat kes ini dikeluarkan oleh Timbalan Kanan Pendakwa Raya Dato’ Mohd. Zaki bin Mat Yasin.
7.1. Dalam laporan Polis ini, DSAI telah mengaitkan keterangan bersumpah Dato Shafee Yahaya yang dibuat diMahkamah Tinggi Kuala Lumpur pada 12.6. 2000 yang membawa maksud bahawa Tun Mahathir telah menyalahgunakan kuasa serta menghalang proses keadilan dengan mengarahkan Dato Shafee Yahaya, ketika itu Ketua Pengarah Badan Pencegah Rasuah (BPR), menghentikan penyiasatan BPR terhadap Tan Sri Ali Abul Hassan bin Sulaiman yang pada masa material itu, adalah Ketua Pengarah Unit Perancang Ekonomi di Jabatan Perdana Menteri.
7.2. Untuk makluman Datin selain daripada laporan yang dibuat oleh DSAI, terdapat sejumlah 14 laporan-laporan Polis yang lain dibuat antara 14.6.2000 hingga 22.7.2000. Terdapat laporan-laporan yang dibuat secara individu dan ada juga laporan-laporan dimana pengadu mendakwa mewakili beberapa ramai yang lain atau sesuatu kumpulan, malah ada yang menyertakan senarai nama dan tandatangan mereka-mereka yang berkenaan. Hampir kesemua pengadu-pengadu berkenaan dikenalpasti sebagai ahli biasa atau memegang sesuatu jawatan dalam parti-parti politik pembangkang khasnya Parti Keadilan Nasional.
7.3. Antara mereka yang telah membuat laporan tersebut ialah Hj. Mahfuz Hj. Omar, Chua Tian Chang @ Tian Chua, Saifuddin Nasution Hj. Ismail, Mohamad Ezam bin Mohd Noor, Lokman Noor Adam, Rusalan Hj. Kassim, Badarulamin bin Bahron dan lain-lain. Kesemua pengadu menggesa pihak Polis dan Jabatan Peguam Negara mengambil tindakan terhadap Tun Mahathir kerana telah menyalahgunakan kuasa dan menghalang proses keadilan.
7.4. Pegawai Penyiasat yang telah saya arahkan untuk merakamkan percakapan Dato Shafee dirumah Datin itu ialah Deputi Superintenden Narenasegaran (Naren) (sudi rujuk muka surat 324 Buku Tersebut dibawah tajuk “The aftermath”) (kini beliau berpangkat Asisten Kommisioner Polis bertugas sebagai KJSJ Pahang). Untuk makluman Datin, pegawai ini ada memaklumkan kepada saya betapa “simple dan humble serta peramahnya” Dato Shafee dan Datin ketika beliau berkunjung kerumah Datin, untuk merakamkan sambungan percakapan Dato Shafee atas arahan saya itu. Mengenai salinan percakapan Dato Shafee pula, saya yang tidak membenarkan untuk diberi kepada Dato Shafee. Saya percaya Dato Shafee sendiri tahu peruntukkan undang-undang dan peraturan mengenai perkara membekalkan percakapan saksi.
7.5. Terus terang saya menyatakan bahawa saya sendiri yang tidak berpuas hati dengan keterangan yang diberikan oleh Dato Shafee itu. Malahan Dato Shafee sendiri yang menyatakan bahawa memang TIDAK ADA ARAHAN SECARA LANGSUNG oleh Tun Mahathir untuk menutup atau menghentikan siasatan kes berkenaan. Namun begitu Dato Shafee ada menyatakan bahawa setiap perjumpaan dan teguran-teguran Tun Mahathir mengenainya, jika diambil secara keseluruhan akan membawa maksud bahawa Tun Mahathir mengarahkan beliau (Dato Shafee) menutup atau menghentikan penyiasatan terhadap Tan Sri Ali Abul. Dato Shafee mengesahkan bahawa perjumpaan beliau dengan Tun Mahathir adalah “on a one to one basis”. Oleh demikian tidak ada saksi bebas terhadap apa yang sebenarnya transpired antara mereka berdua. Dalam situasi ini, pembuktian dakwaan Dato Shafee akan bergantung kepada sejauh mana, atau apa yang dirakamkan/dicatitkan oleh Dato Shafee sendiri dalam diari atau fail berkaitan siasatan sabjek dalam persoalan.

7.6. Memadai untuk saya menyatakan bahawa dalam kesungguhan PDRM menyiasat kes ini, saya telah mendapatkan persetujuan dan kerjasama BPR untuk menyerahkan 2 kertas siasatan untuk penelitian saya iaitu;
7.6.1. Kertas Siasatan HQ/BPR/KS:23/7/98-disiasat oleh Penguasa BPR Abdul Halim Hj.Ibrahim (kemudian diambil alih siasatan oleh Penguasa BPR Tan Kang Sai). Kes ini adalah berkaitan dakwaan pembabitan Tan Sri Ali Abul Hassan dan seorang Dato (saya tidak menyebut namanya bagi mengelakkan sebarang tanggapan khilaf terhadap dirinya) yang ada kepentingan sendiri, projek pengswastaan Aktibiti Pemeriksaan Berkanun Jabatan Keselamatan dan Kesihatan Pekerja.
7.6.2. Kertas Siastan HQ/BPR/KS:20/6/98-disiasat oleh Encik Mohd. Jamidan bin Abdullah ketika itu Ketua Pentadbiran Siasatan BPR Malaysia. Kes ini adalah berkaitan dengan penggeledahan pejabat Ketua Pengarah UPE dimana RM100,000.00 dijumpai dalam laci Tan Sri Ali Abul Hassan.
7.7. Untuk makluman Datin, penelitian keatas kertas-kertas siasatan ini saya buat adalah semata-mata untuk mencari bukti dan keterangan, sama ada Dato Shafee ada membuat sebarang catitan atau arahan bertulis, yang menjurus kearah kertas siasatan BPR terhadap Tan Sri Ali Abul ditutup atas arahan Tun Mahathir. Saya perlukan bukti ini sebelum saya membuat janjitemu untuk merakamkan percakapan Tun Mahathir sendiri dan bersemuka dengannya sekali lagi, sepertimana pernah saya lakukan pada 8.10.1998 ketika menyiasat kes “mata-lebam” (peristiwa mana yang akan saya sentuh dalam perenggan-perenggan yang akan menyusul).
7.8. Sambil itu mungkin Datin boleh mendapatkan pengesahan daripada Dato Shafee sendiri sepanjang beliau menjadi Ketua Pengarah BPR mulai 16.7.1994 sehingga 11.9.1998, berapa kali Pegawai Polis “merampas” kertas siasatan BPR.
“Jikalau kail panjang sejengkal”.
7.9. Saya percaya Datin bolih menerima hakikat bahawa Tun Mahathir bukan sembarangan orang. Apapun beliau adalah seorang Perdana Menteri, ketika siasatan tersebut dibuka terhadapnya. Ini tidak bermakna Polis takut merakamkan percakapan beliau. Saya sendiri pernah bersemuka dengan Tun Mahathir pada 8.10.1998, “on a one to one basis” dalam suasana yang lebih “tense” lagi ketika menyiasat kes mata-lebam tersebut. Sedikit pun saya tidak gentar kerana saya berbekalkan fakta-fakta yang benar dalam tangan saya, walaupun pada ketika itu saya sedar ada makhluk atau makhluk-makhluk yang telah cuba mempengaruhi Tun Mahathir untuk percaya bahawa kecederaan DSAI adalah “self-inflicted”. Pada perjumpaan itu saya telah jelaskan kepada Tun Mahathir apa yang sebenarnya berlaku dan siapa yang “disyakki” melakukannnya oleh kerana siasatan masih diperingkat awal ketika itu. Yang pentingnya saya telah ketepikan sebarang tanggapan bahawa kecederaan DSAI tersebut disebabkan “self-inflicted” pada pertemuan itu. Yang lebih pentingnya apa yang “transpired” dalam pertemuan itu semuanya saya rakamkan dalam diari penyiasatan saya. Apa yang saya katakan kepada Tun Mahathir dan apa yang beliau katakan dan nasihatkan kepada saya, semuanya saya rakamkan. Malahan apabila Tun Mahathir sekadar menganggukkan kepalanya tanda persetujuan kepada sesuatu cadangan saya pun  telah dirakamkan dalam diari tersebut yang kekal dalam kertas siasatan kes mata-lebam sehingga hari ini. (Tidak keberatan untuk saya menyatakan bahawa ketika Pegawai-Pegawai SPRM merakamkan percakapan saya dalam minggu pertama July 2008, berkaitan laporan DSAI itu, beliau ada menyoal saya mengenai reaksi wajah Tun Mahathir ketika saya menemuinya pada 8.10.1998 itu. Dengan mudah saya merujukkan mereka kepada diari penyiasatan saya yang ada dihadapan Pegawai perakam tersebut).
Berkaitan siasatan terhadap Tun Mahathir ini pula bagaimana harus saya bersemuka dengan beliau jika saya tidak lengkapkan diri dahulu dengan fakta-fakta dan bukti yang terperinci dan padat sebelum merakamkan percakapan beliau yang masih seorang Perdana Menteri ketika itu. Seperti kata pepatah “Jikalau kail panjang sejengkal, lautan dalam jangan diharungi”. Alangkah mudah tugas Polis ketika itu jika Dato Shafee sendiri telah merakamkan atau mencatitkan arahan yang tepat dalam kertas siasatan-kertas siasatan yang berkaitan. Sebenarnya itulah yang saya harap untuk temui ketika saya meneliti 2 kertas siasatan BPR tersebut. Malahan Dato Shafee mempunyai masa yang begitu banyak sejak 20.6.1998 hingga bersara pada 11.9.1998 untuk berbuat demikian dan tidak melepaskan tanggung jawab tersebut kepada Pegawai-Pegawai selepasnya oleh kerana Dato Shafee sendiri yang bersemuka dengan Tun Mahathir dalam isu ini dan tiada orang lain.
7.10. Untuk faedah Datin,saya perturunkan  sebahagian daripada laporan saya bertarikh 9.11.2000 kepada Jabatan Peguam Negara berkaitan kes ini;

Para 5: RUMUSAN.
Setelah meneliti serta menimbangkan keterangan-keterangan yang terkumpul khasnya percakapan Dato Shafee Yahaya sendiri yang pada saya, telah dirakamkan dengan terperinci serta juga penelitian terhadap dua Kertas Siasatan BPR iaitu HQ/BPR/KS:23/7/98 dan HQ/BPR/KS:20/6/98 saya merumuskan kes ini seperti berikut:-
5.1.Anggapan Dato Shafee bahawa Perdana Menteri Dato Seri Dr. Mahathir Mohammad telah mengarahkan beliau untuk menutup kes siasatan terhadap Tan Sri Ali Abul Hassan bekas Ketua Pengarah EPU, lebih merupakan persepsi beliau sendiri. Tidak ada sebarang keterangan untuk menyokong persepsi dan andaian oleh kerana Dato Shafee sendiri tidak ada membuat sebarang catitan dalam mana-mana fail, diari atau dokumen-dokumen lain. Pertemuan Dato Shafee dengan YAB PM mengenai isu dalam persoalan ini dibuat atas dasar satu dengan satu (on a one to one basis). Oleh yang demikian apa juga transpired antara mereka hanya mereka sahaja yang privy kepada butir perbincangan.
5.2.Sekalipun Dato Shafee menyatakan yang beliau telah mentaklimatkan Tan Sri Ketua Setiausaha Negara mengenai apa yang berlaku ketika beliau berjumpa dengan Perdana Menteri ketika membincangkan kes dalam persoalan ini,percakapan Tan Sri KSN jikapun dirakamkan tidak mempunyai “evidential value” oleh kerana kesaksian Tan Sri KSN hanya berguna untuk untuk mengesahkan sama ada benar Dato Shafee ada mentaklimatkan beliau mengenai perkara itu atau sebaliknya. Manakala keterangan mengenai apa yang sebenarnya yang dibincangkan atau yang diarahkan oleh PM kepada Dato Shafee akan merupakan keterangan “hearsay”sahaja.
5.3.Semakan serta penelitian keatas kertas-kertas siasatan BPR HQ/BPR/KS 23/7/98 dan HQ/BPR/KS:20/6/98 mendapati tidak terdapat sebarang catitan dalam minit arahan ataupun diari penyiasatan pegawai-pegawai BPR yang terlibat dalam kedua-dua kes yang berkenaan, yang menjurus kearah kes-kes berkenaan ditutup atau dihentikan atas arahan Perdana Menteri. Didapati penyiasatan yang rapi telah dijalankan dan telah mematuhi prosidur pengedaran yang sewajarnya.
5.4.Saya berpendapat siasatan ini jika diteruskan dan percakapan saksi-saksi seterusnya dirakamkan juga tidak akan berkesudahan dengan perolehan keterangan kukuh untuk apa-apa tindakan terhadap mana-mana pihak. Kebanyakkan kesaksian yang akan diperolehi dijangka akan berbentuk “hearsay” atau tidak mempunyai nilai kesaksian yang baik.Dengan rendah diri, berdasarkan daripada hujah-hujah yang saya utarakan diatas, izinkan saya mencadangkan siasatan kes ini dihentikan setakat ini sahaja melainkan jika ada keterangan yang baru ataupun jika Dato Shafee sendiri membuat laporan Polis serta mengemukakan keterangan lain untuk menyokong dakwaannya. Pun begitu saya memohon nasihat YBhg. Datuk mengenai cadangan saya ini.

Kenyataan tidak benar  oleh Tan Sri Musa Hassan dan Tan Sri Abdul Gani Patail berkaitan siasatan keatas Tun Mahathir.
7.11. Saya merujuk kepada muka surat 281 Buku Tersebut dan perturunkan kenyataan akhbar Tan Sri Musa Hassan dan Tan Sri Gani Patail seperti berikut;
The IGP confirmed that an investigation on Dr.Mahathir was carried out. (NST 9 April 2008)
“Our recods show we had submitted the investigation papers to the AG Chambers on 15 February 2000. The decision made by the AG at that time (the late Tan Sri Mohtar Abdullah) was that there was no case.”
In The Star of the same date (9 April 2008), it was reported that Tan Sri Abdul Gani Patail confirmed,
“The Chambers received the investigation papers from the police sometime in February 2000 and after studying it carefully, found no evidence to suggest that Dr. Mahathir had interfered in the investigations”
7.12. Saya hanya boleh menyatakan bahawa kenyataan kedua-dua Tan Sri Musa Hassan dan Tan Sri Gani Patail seperti diatas adalah tidak benar,tidak munasabah dan tidak masuk akal sama sekali. Adalah mustahil untuk kertas siasatan tersebut diedarkan kepada Jabatan Peguam Negara pada 15 February 2000 sedangkan kertas siasatan berkenaan hanya dibuka pada 13 Jun 2000 bersandarkan kepada laporan polis Tun H.S.Lee Rpt:14752/2000 yang dibuat oleh DSAI pada tarikh tersebut. Malah kertas siasatan tersebut bersekali dengan kertas-kertas siasatan BPR yang dirampas, hanya diedarkan kepada Jabatan Peguam Negara pada 9 November 2000.
7.13. Mungkin tarikh 15 February 2001 adalah lebih munasabah. Bagaimanapun jika Tan Sri Musa Hassan dan/atau Tan Sri Gani Patail mengubahnya kepada 15 February 2001 pula, ianya akan menjadi lebih tidak munasabah lagi. Oleh kerana pada 15 February 2001,Tan Sri Mohtar Abdullah yang dikatakan telah meneliti dan menutup kes tersebut telah TIDAK lagi menjadi Peguam Negara ketika itu, kerana tempat beliau telah digantikan oleh Datuk Ainum Mohammad Said pada 1 Januari 2001 (rujuk catitan Datin sendiri dalam muka surat 326 Buku Tersebut).
7.14. Mungkin juga atas sebab itu Tan Sri Musa Hassan dan/atau Tan Sri Gani Patail tidak tampil membuat pembetulan, lagipun orang yang dikaitkan itu Tan Sri Mohtar Abdullah telah pun meninggal dunia. Orang yang telah meninggal dunia memang tidak boleh menjawab lagi. Mungkin mereka berdua lupa banyak lagi orang-orang yang masih hidup yang mengetahui perkara ini yang boleh mempersoalkan kenyataan mereka.
7.15. Mungkin sekiranya Tan Sri Musa Hassan dan Tan Sri Gani Patail tidak membuat kenyataan yang tidak munasabah itu, kes ini tidak akan berpanjangan. Kenyataan merekalah yang telah membuka “flood-gates” untuk lebih banyak persoalan ditimbulkan mengenai kewibawaan PDRM menjalankan sesuatu penyiasatan. Malah kenyataan mereka berdua telah “undermine” penyiasatan Polis dalam kes ini, sepertimana juga mereka berdua sepakat memalsukan keterangan berkaitan laporan perubatan keatas DSAI dalam penyiasatan kes “mata-lebam”, yang bukan sahaja mereka telah “undermine” siasatan tersebut malahan telah menyebabkan Sistem Keadilan Jenayah kita menjadi kucar-kacir sehingga hari ini.
Cadangan kepada Dato Shafee.
7.16. Walaubagaimanapun sekiranya Dato Shafee berhasrat untuk meneruskan dakwaannya terhadap Tun Mahathir, beliau boleh memilih untuk membuat laporan Polis yang baru untuk menyebabkan kertas siasatan tersebut dibuka semula. Saya percaya Dato Shafee sendiri maklum perkara ini. Lagi pun tidak ada sekatan masa untuk sesuatu laporan kesalahan jenayah dibuat sekalipun sesuatu salah laku jenayah berkenaan berlaku 12 tahun yang lalu. Tidak ada pihak yang boleh menghalang Dato Shafee jika beliau ingin berbuat demikian.
7.16.1. Cuma saya ingin memberi ingatan supaya Dato Shafee mengingati semula setiap perkataan/keterangan yang beliau telah berikan ketika memberi keterangan di-Mahkamah pada 12.6.2000, percakapan dan sambungan percakapannya yang telah diberikan kepada Polis (lebih-lebih lagi beliau tidak memiliki salinan percakapan tersebut), laporan Polis baru jika dibuat dan keterangan-keterangan yang sedia ada dalam kertas-kertas siasatan yang berkaitan, supaya tidak berlaku pencanggahan yang material dalam keterangannya. Oleh kerana jika terdapat percanggahan yang material akan mendedahkan Dato Shafee sendiri kepada dakwaan memberi keterangan palsu. Saya percaya Dato Shafee sedar perkara ini. Apapun beliau harus “tepuk dada tanya seleranya sendiri”. Jika saya dipanggil untuk membantu penyiasatan, saya akan kekalkan posisi saya sepertimana yang saya dedahkan dalam Surat Terbuka ini.
Tiada campurtangan mana-mana pihak dalam penyiasatan kes ini.
8. Untuk faedah Datin juga,saya boleh mengesahkan disini bahawa tidak ada sebarang campur tangan daripada mana-mana pihak, sama ada daripada political masters, Pucuk Pimpinan Tertinggi PDRM atau Jabatan Peguam Negara ketika pasukan saya menangani siasatan kes terhadap Tun Mahathir ini. Malahan saya boleh menyatakan bahawa Pegawai-Pegawai BPR sendiri telah memberikan kerjasama mereka yang cukup baik ketika kami menangani isu ini. Secara kebetulan juga dalam laporan saya kepada Tan Sri Ismail pada 6.5.2010 itu, saya telah mengesahkan dalam perenggan 26 surat tersebut bahawa tidak ada campur tangan mana-mana pihak ketika saya menangani siasatan kes ini.
INSIDEN MATA-LEBAM.
9. Memandangkan Datin juga nampaknya berminat dengan insiden mata-lebam ini, sepertimana yang terkandung dalam muka surat 311 dan 312 Buku Tersebut, saya berpendapat tidak salah untuk saya menjelaskan perkara ini dengan lebih mendalam lagi, to set the records straight, memandangkan saya terlibat secara langsung dalam penyiasatan kes ini sebagai Ketua Pegawai Penyiasat dan juga membantu kelicinan prosiding Suruhanjaya Di-Raja menyiasat peristiwa ini. Lagipun ianya bukan lagi menjadi rahsia, bahkan saya pernah “mendedahkan” sebahagian peristiwa ini menerusi Pernyataan Tuntutan saya terhadap DSAI yang difailkan dalam Mahkamah Tinggi Shah Alam pada 11.8.2008. Malah beberapa dokumen saya, khasnya laporan lengkap saya bertarikh 15.4.2009 kepada Y.A.Bhg.Tun Abdul Hamid Mohamad, Pengerusi Lembaga Penasihat Suruhanjaya Pencegah Rasuah Malaysia (SPRM) dan salinannya kepada setiap seorang Ahli Lembaga Penasihat tersebut dan termasuk Pengerusi serta Ahli-Ahli Jawatankuasa Khas Mengenai Rasuah, berada dalam public domain setelah digunakan sebagai keterangan dalam perbicaraan DSAI dalam Sodomy II yang masih berjalan.
Laporan DSAI pada 1.7.2008.
10. Pada 1.7.2008 DSAI telah membuat Dang Wangi Rpt:22807/08.Dalam laporannya ini DSAI mendakwa Tan Sri Gani Patail, Tan Sri Musa Hassan, Dr. Abdul Rahman Yusof, seorang Forensic Consultant dari Hospital Besar Kuala Lumpur dan Dato Mat Zain Ibrahim (saya sendiri) selaku Pegawai Penyiasat kes mata-lebam, telah memalsukan keterangan berkaitan dengan laporan perubatan mengenai kecederaan beliau (DSAI) dalam penyiasatan kes mata-lebam tersebut.
10.1. Siasatan telah dijalankan oleh pihak Ibu Pejabat BPR (kemudianya SPRM) .Saya telah dipanggil memberi keterangan sekurang-kurangnya 5 kali di-Ibu Pejabat SPRM termasuk pihak Penyiasat SPRM telah membuat “rampasan” dokumen-dokumen daripada kediaman saya pada 4.7.2008. Saya tidak membantah rampasan ini malah memberikan kerjasama sepenuhnya kepada Pegawai-Pegawai SPRM berkenaan, kerana saya tahu itu adalah tanggung-jawab mereka selain daripada mereka bertindak secara sopan dan professional, sepertimana juga saya lakukan ketika membuat “rampasan” dua kertas siasatan BPR ketika menyiasat kes terhadap Tun Mahathir seperti yang saya jelaskan dalam perenggan-perenggan diatas.
10.2. Apa yang boleh saya katakan disini ialah kesemua dokumen (yang saya sebagai pembikinnya) yang dirampas dari rumah saya adalah salinan yang sama yang terdapat dalam kertas siasatan kes mata-lebam itu sendiri. Ianya mengandungi keterangan-keterangan dan bukti yang padat yang bukan sahaja sekadar boleh “mengaitkan” sesaorang, malahan jika dibaca bersama dengan laporan Suruhanjaya DiRaja menyiasat kes mata-lebam itu, boleh “mensabitkan” kesalahan mereka keterangan palsu terhadap mereka-mereka yang terlibat tanpa sebarang keraguan.
10.3. Namun begitu pada 11.3.2009 YB Dato Seri Mohamed Nazri Abdul Aziz, Menteri di Jabatan Perdana Menteri telah mengumumkan di Parlimen bahawa siasatan terhadap pengaduan DSAI pada 1.7.2008 tersebut telah selesai 2 bulan daripada tarikh laporan tersebut dibuat. Cuma pengumumannya dibuat pada tarikh berkenaan memandangkan kes tersebut sangat sensitif. Beliau juga turut mengumumkan bahawa satu Panel Bebas tiga orang terdiri daripada 2 orang mantan Hakim Mahkamah Persekutuan dan seorang mantan Hakim Mahkamah Rayuan telah dilantik sebagai Timbalan Pendakwa Raya, bagi meneliti kertas siasatan SPRM berkaitan kes ini. Beliau seterusnya mengumumkan bahawa Panel Bebas tersebut secara sebulat suara (3-0) mendapati Tan Sri Musa Hassan bersih daripada sebarang salah laku jenayah dalam siasatan tersebut. Manakala Panel Bebas sama secara majority (2-1) mendapati Tan Sri Gani Patail tidak terlibat dengan sebarang salah laku jenayah dalam siasatan sama. Ini bermakna seorang daripada Ahli Panel Bebas tersebut mendapati ada keterangan untuk mengaitkan Tan Sri Gani Patail dengan perbuatan salah laku jenayah. Bagaimanapun kedua-dua Tan Sri Gani dan Tan Sri Musa diistiharkan bersih (“cleared”) dari sebarang salah laku jenayah, manakala tidak ada sebutan mengenai nasib Dr. Rahman dan saya yang turut didakwa oleh DSAI dalam laporannya tersebut. Pengumuman ini seolah mengesahkan bahawa laporan DSAI itu ada kebenarannya kerana Dr. Rahman dan saya tidak “dibersihkan” sekali dengan mereka berdua.
10.4. Saya berhak untuk merasa terkejut dan kecewa dengan keputusan ini lebih-lebih lagi selaku Ketua Pegawai Penyiasat kes mata-lebam tersebut saya tahu apa yang berlaku malah telah menyerahkan segala dokumen-dokumen bukti kepada Penyiasat SPRM.
10.5. Oleh hal demikian saya telah menulis surat bantahan rujukan:MZ/SULIT/5776/7 bertarikh 15.4.2009 kepada Pengerusi, Lembaga Penasihat SPRM iaitu Y.A.Bhg. Tun Abdul Hamid Mohamad, dengan salinannya kepada setiap seorang Ahli Lembaga Penasihat dan juga Pengerusi serta Ahli Ahli Jawatankuasa yang lain seperti Jawatan Kuasa Khas Mengenai Rasuah. Selain daripada mengemukakan hujah dan dokumen bukti, saya turut menjelaskan secara terperinci caramana pemalsuan keterangan tersebut dilakukan dan siapa yang melakukannya dan Pegawai mana yang bersubahat memberi kemudahan melakukan jenayah tersebut, sepertimana yang telah saya rakamkan dalam diari penyiasatan saya ketika menjalankan siasatan kes mata-lebam tersebut.
10.6. Selain daripada itu saya telah mempersoalkan kesahihan perlantikan Ahli-Ahli Panel Bebas tersebut sebagai Timbalan Pendakwa Raya oleh Peguam Cara Negara seperti yang diperuntukkan dalam Kanun Prosidur Jenayah (CPC). Saya telah menonjolkan bahawa Peguam Cara Negara TIDAK mempunyai hak atau kuasa untuk melantik Timbalan Pendakwa Raya (TPR) mengikut perbekalan dalam CPC. Peruntukkan Seksyen 376(4) CPC adalah sangat jelas bahawa hak atau kuasa untuk melantik TPR terletak kepada Pendakwa Raya(dalam hal ini Tan Sri Gani Patail) dan kuasa tersebut hendaklah dijalankan oleh Pendakwa Raya sendiri. Oleh hal yang demikian perlantikan Panel Bebas seperti yang diumumkan oleh Menteri di JPM itu adalah tidak sah dan menjadikan keputusan yang mereka buat sebagai sia-sia. Ini bermakna pengistiharan bahawa kedua-dua Tan Sri Gani dan Tan Sri Musa sebagai bebas daripada salah laku jenayah tidak boleh diterima pakai mengikut kefahaman saya.
10.7. Untuk pengetahuan Datin, Peguam Dato Param Cumaraswamy pun ada menulis surat bantahan kepada SPRM mempersoalkan isu perlantikkan Panel Bebas ini.
10.8. Apa pun pada 23 July 2009 saya telah menerima surat balasan daripada Sekretariat Lembaga Penasihat Pencegahan Rasuah (LPPR) yang ditanda tangan sendiri oleh Y.A.Bhg. Tun Abdul Hamid Haji Mohamad. Saya merasa terkejut dimaklumkan secara bertulis bahawa bidang kuasa LPPR seperti yang diperuntukkan oleh Seksyen 13 Akta SPRM 2009 (Akta 694) TIDAK termasuk menyemak semula (review) sebarang keputusan yang telah dibuat oleh SPRM  dalam sesuatu kes. Ini bermakna LPPR tidak boleh berbuat apa-apa sekalipun SPRM telah membuat sesuatu keputusan yang salah atau tidak mengikut undang-undang. Ini turut bermakna sekalipun LPPR sedar bahawa perlantikkan Panel Bebas tersebut adalah tidak sah dari sisi undang-undang, LPPR terpaksa bersetuju menerimanya. Soal sama ada LPPR berpuas hati atau tidak dengan penyiasatan dan keputusan SPRM tidak timbul. Selepas daripada penerimaan surat LPPR sedemikian itu saya tidak menulis apa-apa suratan kepada LPPR lagi.
10.8.1. Saya berasa begitu ralat kerana diakhir laporan saya kepada LPPR itu saya merayu kepada Y.A.Bhg.Tun seperti diperturunkan;..
“Para 48.
Saya percaya Y.A.Bhg.Tun,serta Yang Berbahgia dan Yang Berhormat Pengerusi dan Ahli-Ahli pelbagai Panel SPRM tidak akan merelakan intergriti Institusi penting Negara seperti Badan Kehakiman,Jabatan Peguam Negara, SPRM dan PDRM diletakkan dalam risiko kemusnahan semata-mata untuk menyelamatkan sesaorang dikenakan hukuman jenayah. Saya merayu dan sesungguhnya yakin Y.A.Bhg. Tun akan memberi peluang pendengaran yang adil dan saksama kepada saya dan juga kepada pihak atau pihak-pihak yang dinamakan dalam perkara ini.Saya yakin Y.A.Bhg. Tun akan mempertimbangkannya bukan demi saya seorang, tetapi demi Keluhuran dan Kedaulatan Undang-Undang Negara dan demi Keadilan Awam itu sendiri. Salam sejahtera.

10.9. Namun begitu saya tidak putus asa dalam mengenengahkan kebenaran ini. Dalam surat saya kepada YDH Tan Sri Ismail Omar, dalam perenggan 11, saya telah membuat “pengistiharan” yang berbunyi antaranya;
“Tanpa terpengaruh dengan pendapat pihak-pihak lain mengenai laporan DSAI tersebut sama ada telah dibuat secara rasmi atau sebaliknya, saya,selaku Pegawai Penyiasat kes mata-lebam tersebut yang mempunyai pengetahuan mendalam kes ini mendedahkan pendapat saya mengenainya seperti berikut dibawah;
a)Bahawa dakwaan DSAI menyatakan berlakunya perbuatan memalsukan keterangan berkaitan laporan kecederaan keatas dirinya dalam penyiasatan kes mata-lebam adalah benar dan betul berlaku.
b)Bahawa terdapat sejumlah 3 (tiga) laporan perubatan yang telah dipalsukan iaitu;…….”
10.9.1. Saya turut mengistiharkan bahawa saya serta Pegawai-Pegawai dalam Pasukan Penyiasat Khas kes tersebut dan juga pucuk pimpinan PDRM ketika itu tidak pernah mensubahati Tan Sri Gani Patail dalam memalsukan keterangan terhadap DSAI. Malahan saya menjelaskan bahawa saya telah mengambil segala langkah yang perlu (yang dirakamkan dalam diari penyiasatan saya) untuk menasihati dan menghalang beliau daripada melakukan sesuatu yang menyalahi undang-undang dalam penyiasatan kes mata lebam tersebut.Saya telah menasihatkan beliau ketika itu, posisi Dr. Rahman yang sedang dalam siasatan Polis berkaitan satu kes ugutan jenayah keatas seorang Dr. Abdul Halim Mansar yang merupakan Pakar Forensik Hospital Kuala Lumpur yang mula-mula menyediakan laporan kecederaan keatas DSAI atas permintaan rasmi saya, dan penggunaan Dr. Rahman menyediakan laporan perubatan bertentangan dengan apa yang telah disediakan oleh Dr. Halim, akan menyebabkan “complications” dikemudian hari. Rupa-rupanya Tan Sri Gani Patail telah mengambil kesempatan posisi Dr. Rahman sedemikian itu untuk mengarahkannya menyediakan sejumlah tiga (3) laporan palsu berlainan berkaitan kecederaan DSAI dalam insiden mata-lebam tersebut. Sekiranya terdapat mana-mana Pegawai Polis yang telah bersubahat atau memberi kemudahan kepada beliau melakukan pemalsuan tersebut, maka Pegawai Polis berkenaan telah melakukannya atas sifat peribadi untuk kepentingan dan faedah persendirian Pegawai berkenaan yang tidak ada kena mengena dengan pendirian PDRM menangani siasatan kes mata-lebam ini.
Penggunaan keterangan palsu dalam perbicaraan Sodomy II.
11. Dalam surat saya kepada Tan Sri Ismail itu juga saya telah memberi “isyarat awal” berkaitan pemerhatian saya mengenai penggunaan keterangan palsu dalam perbicaraan Sodomy II yang sedang berjalan. Keterangan palsu/tidak benar itu adalah dalam bentuk dua afidavit yang diikrarkan pada 30.6.2009 oleh dua Pegawai Jabatan Peguam Negara bagi pihak Pendakwa Raya. Perkara ini bukan rahsia kerana DSAI sendiri telah membuat laporan Polis Travers Rpt:5160/09 pada 21.7.2009 dan membuat kenyataan akhbar mengenai laporan ini terhadap, Dato Abdul Razak Musa Pengarah Pendakwaan dan Perundangan SPRM dan Timbalan Pendakwa Raya Hanafiah Hj. Zakaria dari Jabatan Peguam Negara, seorang Ahli dalam Pasukan Pendakwaan kes Sodomy II. Berpeluang meneliti kandungan dokumen-dokumen tersebut yang berada dalam public domain itu, serta mengetahui perkara sabjek yang terkandung dalam laporan Suruhanjaya DiRaja berkaitan, saya berpendapat yang dakwaan DSAI ada kebenarannya walaupun saya tidak mempunyai ekses lagi untuk mengetahui hasil siasatan berkaitan laporan tersebut. Saya memberikan isyarat awal ini adalah untuk PDRM mengambil langkah berjaga-jaga supaya tidak dijadikan “scape-goat” sekiranya sesuatu yang buruk berlaku dalam pendakwaan Sodomy II seperti mana yang menimpa PDRM dan saya dalam penyiasatan kes mata-lebam.
12. Hari ini pula, ketika saya sedang menulis Surat Terbuka ini kepada Datin, tersiar pula secara meluas dalam akhbar-akhbar dan blogs mengenai seorang Rahimi Osman yang disenaraikan sebagai seorang saksi pembelaan, menghebahkan pula yang beliau dipaksa membuat Statutory Declaration (SD) untuk mengaitkan Dato Seri Najib dan Datin Seri Rosmah Mansor dalam kes Sodomy II, yang melibatkan sahabat beliau Mohd. Saiful Bukhari Azlan dua tahun lalu. Dilaporkan pula kononya Rahimi Osman telah membuat SD yang baru pula. Ini mengingatkan kita kepada apa yang dilakukan oleh Private Investigator Bala dalam kes bunuh Altantuya.
12.1. Apa sudah jadi dengan Sistem Keadilan Jenayah kita? Seolah BAB XI dalam Kanun Keseksaan berkaitan Keterangan Palsu dan Kesalahan-Kesalahan Terhadap Keadilan Awam tidak ujud lagi. Siapa yang sepatutnya dipersalahkan? Siapa yang menyebabkan Sistem Keadilan Jenayah kita menjadi kucar kacir, sehinggakan sesiapa juga boleh mempermain-mainkannya tanpa takut kepada sebarang tindakan dan hukuman undang-undang. Saya tidak teragak-agak untuk menyatakan bahawa keadaan ini berpunca daripada “precedent” yang dibuat oleh Tan Sri Gani Patail dan Tan Sri Musa Hassan sendiri. Jika mereka boleh merekacipta keterangan palsu dan menggunakan dua daripada tiga laporan yang dipalsukan itu pula dalam prosiding kehakiman Suruhanjaya DiRaja, dan kemudian mendabik dada mengatakan mereka bersih daripada sebarang salah laku jenayah; jika Tan Sri Musa boleh memberi keterangan palsu dalam perbicaraan dalam Mahkamah Tinggi Kuala Lumpur seperti yang dilaporkan oleh seorang Penggubal Undang-Undang YB R. Sivarasa dalam bulan Mac tahun ini, dan tiada tindakan dikenakan; jika Tan Sri Musa Hassan boleh mengemukakan Pernyataan Tuntutan yang tidak benar dalam samannya terhadap DSAI serta menuntut berjuta Ringgit sebagai ganti rugi pula dan menayangkan pula saman tersebut kepada dunia, maka P.I. Bala dan Rahimi Osman juga tidak bimbang akan tindakan undang-undang terhadap mereka. Cuma yang tidak bernasib baik, mungkin Brig.Gen (B) Datuk Mohamad Yasin Yahya bekas Panglima Brigade Sabah (saya juga tidak pernah mengenali beliau) yang telah berpuloh tahun menabur keringatnya mempertahankan kedaulatan Negara, akhirnya diaibkan dengan dituduh memberi keterangan palsu (walaupun kemudiannya didapati tidak bersalah) ketika memberi keterangan di-Mahkamah melibatkan satu kes Dato Ramli Yusuff.
13. Memandangkan keadaan terbaru ini,mungkin Dato Shafee ingin menimbangkan semula cadangan saya diperenggan 7.16 dan 7.16.1 dalam Surat Terbuka ini.

Berbalik kepada laporan saya kepada YDH IGP Tan Sri Ismail Omar pula, kini terserah kepada budi bicara beliau untuk mengambil posisi beliau dalam hal ini, dan lain lain isu yang saya dedahkan dalam laporan saya kepada beliau bagi memelihara kewibawaan dan keberkecualian serta imej PDRM yang tercemar teruk sejak 2006. Saya yakin YDH Tan Sri akan melakukan sesuatu. Untuk faedah Datin dan juga pembaca lain yang mungkin berminat membaca Surat Terbuka ini, saya telah akhiri laporan saya kepada Tan Sri Ismail Omar tersebut itu seperti diperturunkan dibawah;

Saya berharap laporan yang saya kemukakan ini tidak menambahkan bebanan masaalah yang berada dalam tangan Tan Sri sekarang ini.Saya sedar siapa saya dan kedudukkan saya dalam masyarakat dan saya turut sedar dengan siapa saya berhadapan dan apa yang boleh berlaku keatas diri saya dan keluarga dengan pendedahan yang saya tonjolkan dalam laporan ini. Namun begitu saya turut yakin sebilangan besar rakyat dan pemimpin Kerajaan khasnya dalam PDRM yang cintakan keluhuran undang-undang dan keadilan. Pada ketika saya berpangkat ACP/SAC II, saya telah dilonggokkan dengan keterangan dan bukti daripada Ketua Polis Negara,Timbalan Ketua Polis Negara,Pengarah-Pengarah dan Pemimpin Tertinggi Polis serta Pegawai sehingga anggota berpangkat Konstabel mengenai peristiwa insiden mata-lebam. Dengan bahan bahan tersebut saya diminta untuk membuat keputusan sendiri dan seorang diri sama ada memilih menyelamatkan maruah PDRM ataupun menyelamat TSRN. Dengan sedih saya memilih untuk mencadangkan TSRN, seorang yang saya sanjung tinggi sebagai seorang ketua, sahabat dan juga kawan keluarga dituduh dibawah Seksyen 323 Kanun Keseksaan. Saya Cuma berharap saya telah melakukan sesuatu yang saksama kepada beliau. Kini saya memohon maaf kerana melonggokkan pula bahan serupa dan meletakkan Tan Sri didalam situasi yang sama, yang saya berada 12 tahun lalu. Saya turut berharap situasi yang kita alami adalah yang terakhir buat PDRM.

Akhirkata saya mendoakan Tan Sri sentiasa berada dalam kesejahteraan dan kesihatan untuk seterusnya memimpin Pasukan Polis Di Raja Malaysia kearah kecermelangan dan kegemilangan serta dihurmati sepertimana yang pernah dinikmati dalam era sebelum 2006.

Closing the Books on Murder in Malaysia

The closing of a case earlier this week by Malaysia's attorney general over allegedly false statements by a private investigator that tied Prime Minister Najib Tun Razak to the 2006 murder of Mongolian translator Altantuya Shaariibuu literally lets unknown persons close to the prime minister get away with murder.

The closure of the case appears to write the final chapter in one of Malaysia's most sensational murder cases, one involving a gruesome death, intrigue in high places, more than 100 million euros in alleged bribes and a trial that appeared to be rigged to keep prosecutors as far as possible away from Najib, then the deputy prime minister, and his wife, Rosmah Mansor.

The private investigator, P Balasubramaniam, was hired in 2006 by Abdul Razak Baginda, one of Najib's best friends and a defense analyst from the Malaysian Strategic Research Centre think-tank, to attempt to keep Altantuya away from Baginda because he had jilted her. She was demanding revenge and US$500,000 for her role as a translator in the sale of French submarines to Malaysia. A French prosecutorial team continues to probe the sale of the subs to Malaysia and whether kickbacks were paid to top French and Malaysian politicians.

In July of 2008, as the trial droned on, Balasubramaniam issued a statutory declaration alleging that Najib, then the deputy prime minister, was involved in the murder, only to retract the entire contents of the declaration a day later and issue a second saying he had made the first under duress (Note: Both declarations can be found here).

Balasubramaniam's lawyer, Americk Sidhu, denounced the closing of the case, saying that if the supposedly false statements were investigated thoroughly by police, they would have led to the conclusion that people close to Najib were involved in the murder.

De facto Law Minister Nazri Aziz, in a written statement to parliament, said the case was closed because Balasubramaniam had given conflicting statutory declarations, and that anyway, they didn't affect the trial of two of Najib's personal bodyguards and Abdul Razak Baginda, which ended in April of 2009 after a 159-day trial in which the bodyguards were sentenced to death. They are appealing the verdict, with suspicions running high that they will somehow be given their freedom in exchange for their silence on whoever ordered them to kill the woman.

"Although there are contradictions between the two statutory declarations, the contradictions do not affect the outcome of the trial of Altantuya," Nazri said. "Moreover, the individual (Balasubramaniam) is still believed to be abroad." Nazri added that the decision to close the case was made after "careful consideration" of the results of the police probe and witness statements.

Although the two bodyguards were convicted of the crime, Baginda was acquitted under controversial circumstances without having to put on a defense. He then hurriedly left the country for England, where he has remained ever since. One of the two bodyguards said in a cautioned statement that they had been hired to commit the killing and were to be paid RM100,000 to do it. But the statement was never introduced into the marathon trial and never was anybody asked who had done the hiring or made the payment offer.

The 27-year-old Altantuya, the translator in some phases of the billion-dollar purchase of French Scorpene submarines that netted Baginda's company €114 million in consulting fees, was shot in the head and her body was blown up with explosives in a patch of jungle near the suburban city of Shah Alam. Before she died, she told Balasubramaniam she had been promised US$500,000 for assisting in the submarine transaction.

In the bodyguard's cautioned statement, it emerged that Altantuya, almost with her last words, told her two assailants that she was pregnant and begged them not to kill her. That has led to speculation that her body was blown up with C4 explosives to hide any DNA evidence of who the father might be.

Balasubramaniam, who remains somewhere in Chennai, has continued to insist loudly that Razak Baginda, who is married, had told him that the translator had been Najib's sexual companion before the then-deputy prime minister passed her on to Baginda because it wouldn't look good for a prospective prime minister to have a girlfriend.

After making the first declaration, Balasubramaniam was hauled into a Kuala Lumpur police station, where he was forced to recant it in a second under threat to his family, he later testified. After that, according to statements he made under oath, he was taken to meet with Mohamad Nizam Razak, Najib's brother, and Deepak Jaikishan, described as a "business associate" of Najib's wife, Rosmah Mansor, where he was promised RM5 million to leave the country and shut up. He later displayed cancelled checks showing he had been paid RM750,000 out of an account maintained by Jaikishan. According to his sworn statement, Balasubramaniam said Rosmah was "very pleased" that he had agreed to retract the statutory declaration and wanted to have breakfast with him.

Nazri told the parliament that Balasubramaniam was initially investigated for providing false statements, which would make him liable to three years in jail and a fine. That makes it a mystery why the case was dropped against him, since one of the statutory declarations was demonstrably false – either the one implicating Najib and describing the murder, or the one recanting it.

A team from the Malaysian Anti-Corruption Commission first made an appointment to interview Balasubramaniam in the UK, where he was staying out of fear for his safety, but cancelled the appointment without an explanation.

"The evidence is staring you in the face," Sidhu said in a telephone interview from Australia. "A whole pile of witnesses can confirm the first statement and who have been investigated by the police have said the original statement was made of his own free will. If they had investigated, they would have had to interview Rosmah, Nizam and Jaikashan over the checks to Bala.They can't afford to charge him. If they do that, they would hang themselves. They had no alternative but to close the file to save Najib and his entourage."

To say Balasubramaniam's first statement was explosive is an understatement. In addition to saying Najib had been Altantuya's lover before he turned her over to Razak Baginda, Balasubramaniam wrote that Najib had a sexual relationship with the Mongolian woman and that she liked anal sex. Before she was killed, according to the statement, she told Balasubramaniam that she, Baginda and Najib had been together at a dinner in Paris during the transaction over the submarines.

Najib has repeatedly denied he had ever met the woman, swearing to Allah that no meeting had taken place. During the trial of the two elite bodyguards, a friend of Altantuya who had accompanied the woman to Malaysia said there was no record in immigration that she had ever been in the country.
