Claims and scepticism sans evidence

The head of the LTTE’s Department of International Relations on Sunday announced that the LTTE Leader Velupillai Pirapaharan attained martyrdom fighting the military oppression of the Sri Lankan state on 17 May. However, the LTTE’s Department for Diaspora Affairs (DDA) told TamilNet that it would not comment without explicit authorisation from the LTTE leadership. In the meantime, the Intelligence Department of the Tigers reiterated on Sunday that the LTTE leadership is safe and it will re-emerge when the right time comes.

Tamil Nadu leaders, Mr. Vaiko and Mr. Pazha Nedumaran have expressed scepticism Sunday on the reports of Mr. Pirapaharan's demise.

Meanwhile, the general opinion prevails is that Colombo has failed in conclusively establishing the evidence for Pirapaharan's demise. It has not taken any credible efforts to verify evidence either.

Failure in the responsibility of coming out with the truth also falls on the Indian Establishment. The Indian Intelligence has recorded all the details of LTTE leader's physiognomy when it has taken him into custody in mid-80's in India. It should have verified his death with evidence at least for its legal purposes. But observers think that India maybe having its own reasons for its silence.

Even 'omnipotent' powers of the information age have not come out with any authentic statement.

Tamil rebels acknowledge leader is dead

(CNN) -- Tamil Tiger rebels acknowledged the death of their leader Sunday, nearly a week after the Sri Lankan government said it had recovered the body of Velupillai Prabhakaran and declared victory in the country's 25-year civil war with the rebels.

Prabhakaran "attained martyrdom fighting the military oppression of the Sri Lankan state" on May 17, according to Tamilnet.com, a rebel Web site, citing the group's international affairs spokesman.

On Tuesday, President Mahinda Rajapaksa declared victory against the Tamil Tigers.

"We are celebrating the defeat of terrorism," he said in a nationally televised speech before parliament. "We have won and restored democracy in the country."

The president declared a national holiday for the following day to celebrate the war's end and begin a new phase in the country's history.

A short time after the presidential address, the military announced that it had recovered the body of Prabhakaran, leader and founder of the Tamil Tigers.

The rebels initially denied the death of their leader, claiming on Tamilnet.com that Prabhakaran was "alive and safe."

The defense ministry said the bodies of Prabhakaran and 18 other senior rebel leaders were among corpses found in mop-up operations, after government troops routed the Tigers -- formally known as the Liberation Tigers of Tamil Eelam.

The leaders included Prabhakaran's eldest son, Charles Anthony, as well as Pottu Amman, the Tigers' intelligence leader, according to the ministry.

Prabhakaran founded the Tamil Tigers, who have been declared a terrorist organization by 32 countries. It initiated the use of women in suicide attacks and, according to the FBI, invented the explosive suicide belt.

Prabhakaran is accused of masterminding the killing of former Indian Prime Minister Rajiv Gandhi in 1991 in the Tamil-dominated Indian state of Tami Nadu. Sri Lankan authorities allege that Prabhakaran was avenging Gandhi's decision to send Indian peacekeepers to Sri Lanka.

Two years later, a Tigers suicide bomber, allegedly acting on Prabhakaran's orders, detonated explosives that killed Sri Lanka's then-president, Ranasinghe Premadasa, during a rally.

The rebels have fought for an independent state for minority Tamils in Sri Lanka since July 1983. An estimated 70,000 to 80,000 people have died during the quarter century of fighting.

Aminah claims PKR offered her DCM post

PENANTI, May 25 — Independent candidate Aminah Abdullah claimed today her former party had tried to bribe her by offering the Penang deputy chief minister post, adding she has an audio recording to back her allegations.

Aminah claimed two top PKR leaders came to her house a few weeks back to persuade her to rejoin the party, saying she would be given the post should she win the Penanti state seat.

The two leaders, one a special officer to a PKR executive councillor for the Penang state government and the other, a state level party supreme council member had also offered her the top post with the Penang Municipal Council but with the condition that she withdraw from contesting, claimed Aminah.

Aminah is one of three independents facing PKR’s Dr Mansor Othman in the by-election on May 31, called after incumbent Mohammad Fairus Khairuddin quit the seat and his DCM post under a cloud of graft allegations.

Fairus has been cleared of all charges and is said to be pursuing further studies. The Barisan Nasional (BN) has opted out of the contest claiming Fairus’s reasons to quit were flippant.

PKR strategy director and Batu MP Tian Chua had dismissed bribery claims, challenging those who made the allegations to lodge reports with the authorities.

Aminah claimed PKR de facto leader Datuk Seri Anwar Ibrahim was fully aware of the meetings.

“They also offered me RM80,000 worth of compensation and to return the deposit money but I have no intention of accepting the offer as I am a person of principles,” she said.

When asked for the name of the two leaders, Aminah refused to name them, saying the people will know their identity once they listen to the audio recording.

The three hour audio recording is available in a compact disc Aminah had prepared for the mass media. Also available are pictures of the implicated figures.

”My family members had done everything (recording and pictures). We did the recording because we know PKR people like to spin and lie,” said Aminah’s husband and campaign aide Mohamad Rofi Osman.

According to him, PKR leaders had met his wife and family three times and that had prompted them to record the conversation between them as proof.

Aminah who is also the former PKR Penang wanita chief said she will submit the proof to the Elections Commission tomorrow.

“The EC is the best body to handle this matter as they are responsible in electoral matters. We hope they will assess the evidence and perhaps take it to the Malaysian Anti-Corruption Commission,” she said.

Asked why she had not raise the matter on nomination day itself, where it was possible to disqualify PKR candidate Mansor Othman by submitting proof of attempted bribery, Aminah did not give a straight answer and only said that “it is better to do it today.”

Meanwhile, PKR election director Saifuddin Nasution in an immediate response said party lawyers will give her a notice today, demanding she withdraw and apologise for her allegations.

“We would have to listen to the recording first before we can give any comments,” he told a press conference held at the party’s office here.

Mahkamah Rayuan Tidak Memperkasakan Demokrasi : Aziz Bari

KUALA LUMPUR : Sejak merdeka hanya ada tiga orang hakim yang berani membuat keputusan yang tidak menyebelahi parti yang didokong oleh kerajaan pusat.

Profesor Aziz Bari berkata, itu pun keputusan Mahkamah Tinggi dan ada yang memprovok Kerajaan Persekutuan mengisytiharkan darurat.

Keputusan-keputusan yang menentang Kerajaan Pusat di buat dalam kes Stephen Kalong Ningkan di Sarawak (1966), Joseph Pairin Kitingan di Sabah (1986) dan Nizar Jamaluddin di Perak (2008).

Sejak Februari lalu kebanyakan hakim memberi keputusan yang menyebelahi Umno termasuk keputusan Mahkamah Persekutuan yang bertentangan dengan peruntukan perlembagaan yakni Perkara 72(1).

“Ertinya kita perlu sedar bahawa bukan semua keputusan mahkamah selaras dengan kehendak dan semangat perlembagaan,” tegasnya lagi.

Aziz turut mengingatkan, meskipun Zambry diputuskan oleh Mahkamah Rayuan sebagai sah, tetapi kedudukan Speaker Ganesan tetap haram kerana cara perlantikannya melanggar peraturan dewan.

Berbalik kepada keputusan Jumaat lalu Aziz berkata beliau berasa aneh mengapa Mahkamah Rayuan menyebut soal mandatori (kewajipan termesti) dalam soal undi tidak percaya.

“Memang perlembagaan tidak mewajibkan begitu tetapi undi tidak percaya adalah cara yang terbaik kerana ia selamat dari manipulasi”, ujarnya.

Mahkamah Rayuan memutuskan bahawa perlantikan Zambry sah kerana tidak ada kemestian di dalam perlembagaan bahawa mesti ada undi tidak percaya terhadap menteri besar yang ada.

Ketika mengulas perkara itu, Aziz berkata keputusan Mahkamah Rayuan tidak membantu memperkasa demokrasi. “Ia juga tidak selaras dengan kedudukan eksekutif di dalam sistem demokrasi berparlimen yang mesti mempunyai sokongan majoriti di dalam dewan”.

Aziz menegaskan di dalam keadaan undi tidak percaya tidak dihalang ia perlu dilakukan.

Katanya, “Mahkamah sepatutnya memperkasa keperluan undi tidak percaya ini dan bukan sebaliknya”. Aziz berkata Raus mempunyai tugas berat untuk meyakinkan mengapa beliau memutuskan bahawa menteri besar yang ada boleh disingkirkan tanpa undi tidak percaya.

Katanya, keputusan Mahkamah Rayuan itu akan membawa kesan yang besar kepada perlembagaan khususnya dan demokrasi umumnya.

Beliau mengakui memang ada keadaan di mana undi tidak percaya tidak perlu. “Tetapi itu di dalam keadaan menteri besar yang ada enggan atau lari darinya. Dalam kes di Perak sekarang ini jelas tidak berlaku; malahan Nizar bersedia menghadapinya,” kata Aziz.

Aziz berkata umumnya keputusan Mahkamah Rayuan itu adalah berita sedih buat demokrasi di negara ini.

“Di sisi perlembagaan istana dan mahkamah mempunyai tugas untuk mempastikan semak dan imbang. Raja dan hakim berperanan mempastikan keadilan dan ketelusan, bukan mengambilalih fungsi rakyat dalam memilih kerajaan”.

Beliau tidak bersetuju dengan para peguam Umno yang mendakwa keputusan Mahkamah Rayuan menamatkan krisis politik di Perak.

“Yang pasti Nizar akan memohon untuk membuat rayuan dan kalau ditolak ia akan menyebabkan rakyat melihat mahkamah dengan pandangan yang negatif,” ujarnya.

HINDRAF – Can You Lead Us, Are You the Third Force?

The first thing that comes to mind is that it is a racist movement only to enhance the Malaysian Indians, right? Right!!!!

Well, the well-oiled mechanism of manipulation, propaganda, imagery and public relations wizardry to frighten and silent the public has obviously put them in such a light.

Frankly, don’t you agree that Malaysian Indians are responsible for the largest problems (ie, theft, robbery, suicide, stateless people etc) statistically in proportion to their populace as a minority in Malaysia?

Yes, you may argue that the Malays, the Chinese, and all those lain-lain face the same faith and predicament in this society. But again, why have those who care so much for them not waged a war against the government to safeguard their interests? Is it because these so-called leaders have their own individual needs or the needs that serve society or they fear the almighty government?

The biggest distortion of the truth comes from us. It is us as one Malaysians with our lying in silence that causes all the mayhem.

HINDRAF may have by default triggered the tsunami of March 8, 2008 but the message has always been the truth to its cause no matter how narrowly you see it. Whether they are racists or not can only be answered by you - if you can see the bigger picture.

Today, we have two factions in the Malaysian political scene; one UMNO-led BN and PKR-led Pakatan. Both gloat on their objectives and their track records yet they can’t even see beyond themselves without stepping onto each other’s shoes. It is always a tit for tat contest and the public suffer.

Now, why don’t we create a third force, a force that is independent? Here again, when I mean independent, I mean totally independent without any selfish needs. Solitude in its objective for doing what is the truth and right without any compromise.

HINDRAF, I believe, can be a serious contender for a third force only if all Malaysians embrace and expand their pursuit for the truth and moral obligation of a people-elected government without the usual shenanigans that we are all accustomed to based on race, religion, following or creed.

There are many active and some lip service NGOs in Malaysia. What is the purpose of these NGOs? The phrase non-governmental organization came into use with the establishment of the United Nations in 1945 with provisions in Article 71 of Chapter 10 of the United Nations Charter [1] for a consultative role for organizations that neither are governments nor member states.

HINDRAF, similar to other NGOs, was developed to emphasize humanitarian issues, developmental aid and sustainable development.

Now the golden question is, how can it enhance the society? Can HINDRAF in affiliation with other NGOs in Malaysia cut across the racial barriers and create the third force to dictate the path of Malaysia? In my opinion, yes it can; only if all the NGOs can forgo their own alter egos and understand that HINDRAF was waged for the truth and reality that faced the obedient and peaceful Malaysian Indians as opposed to the racial stand that most of us believe.

HINDRAF should be ready to move ahead and carve out the direction with the other NGOs to expand the horizon for humanity and we the people should heed this call to show that a third independent force can dictate the course of our nation to create the necessary check and balance.

My people, it is you and only you who can make the change without the bigotry that we have in us individually for a truly Malaysian nation.

Najib’s 1 Malaysia has morphed to 1 Police State

The sudden police raid of party headquarters without a search warrant means that the police does not care about ‘rule of law’ in a civilised society.

Barging into the party premises and snatching a ’server’, brazenly ignoring the objections of party personnel is tantamount to the behaviour of police in communist and totalitarian states like Nazi Germany and Communist Russia.

The police in Malaysia has changed its character.from a guardian of the people, to become a secret police.

Malaysia’s own secret police behaviour is no different from the behaviour of the Gestapo, the Kempetai of Japan. We are living in a police state.

DEFINITION OF A POLICE STATE.
The term police state describes a state in which the government exercises rigid and repressive control over the social, economic and political life of the population. A police state typically exhibits elements of totalitarianism and social control and there is usually little or no distinction between the law and the exercise of political power by the executive.

The inhabitants of a police state experience restriction on their mobility and on their freedom to express or communicate political or other views, which are subject to police monitoring and enforcement. Political control may be exerted by means of a SECRET POLICE FORCE which operates outside the boundaries normally imposed by a constitutional state.

PEOPLE MUST STAND UP FOR THEIR RIGHTS
The people of Malaysia must wake up and see that their ideals of a free, democratic and multiracial society that is goverened by the rule of law does not degenerate into a police state. They must be on the alert and prevent their rights from being trampled upon.

The DAP and PR will do its duty to protect the rights of the people, and if the Prime Minister does not respond to the call of change, we shall take the case of freedom of loving people of Malaysia to the United Nations, and call for them to send a fact finding mission to Malaysia.

Losers On All Sides

It reflects how low the public’s respect for our judiciary is that a unanimous reversal by the appellate court of a High Court’s decision should be greeted with such widespread scorn.

We must await the Appeal Court’s written judgment so we could weight its wisdom, legal and otherwise, and compare it to that of High Court Judge Aziz Rahim who made the initial ruling in Nizar vs. Zamry. Justice Aziz gave his within a week. Let us hope the Appeal Court judges, being more senior and higher in the judicial pecking order, would do better and come out with theirs faster. After all they have to set the proper example.

At least the Appeal Court had the common sense to have a quorum of three to hear the appeal. It would have been better on a case of such import involving fundamental constitutional issues to be heard with the full quorum. At least those judges showed better judgment if not common sense than Appeal Court Judge Ramli who in his wisdom decided to hear by himself the appeal on the associated stay of execution.

Regardless, this case is headed to its final level of appeal. Let us hope that the Federal Court would hear this case with its full quorum and not just the minimal. While that is not a legal requirement, it is from the perspective of public credulity. At a time when the image of our judiciary is anything but pristine, this would be an opportunity to restore some credibility.

Thus far these are what we have. In favoring the plaintiff, Justice Aziz Rahim effectively declared that the Sultan of Perak Raja Azlan Shah erred in appointing Barisan’s Zamry as the state’s Chief Minister to replace Pakatan’s Nizar. Justice Aziz cited principally the precedent of the 1966 case of Stephen Ningkan vs Abang Openg.

What is unique here is that Raja Azlan Shah is no ordinary sultan, having served as the nation’s highest judge from 1982 to 1985. In this decision, Justice Aziz is in fact telling the former chief justice that the country’s statutes and legal precedents do not support the sultan’s action. More simply and directly stated, the sultan was wrong

This precedent was set during Raja Azlan Shah’s tenure as a judge, long before he ascended to the Perak’s throne. Meaning, he should be fully aware of the precedent and its attendant legal reasoning when he deliberated on Najib Razak’s (as head of Perak’s Barisan) request to have Zamry replace Nizar.

The only possible explanation for Raja Azlan’s ignoring that precedent must be that he felt that it did not apply to him as a Malay sultan. After all how could a sultan be compared to a mere mortal, the governor of a state? In Malay culture, a sultan is God’s representative on earth; his mandate comes directly from heaven. It is not for mere mortals to trifle with it. Sultans have daulat, a special status denied those common-blooded governors! Unfortunately for our sultans, that is not what is provided for in our constitution.

This delusion of having a special mandate from high above is of course an affliction affecting not only our sultans but also all hereditary leaders everywhere, save the most enlightened.

In reversing the decision, the Appeal Court effectively sided with the sultan. The sultan alone could decide whether the Mentri Besar still commanded the confidence of the Assembly. Presumably the sultan had special divine powers to read the minds of the legislators and how they would vote before there was any voting!

In his decision, Justice Aziz Rahim made some uncomplimentary remarks about the role of the State Legal Advisor (SLA). Indeed the role of the permanent establishment as represented by the police and State Secretary, in addition to the SLA, merit an even greater scrutiny as they reflected the degradation of our pubic institutions. I await the Appeal Court’s written judgment to see whether those wise judges will also comment on this equally pertinent issue raised by Justice Aziz.

Had leaders of the permanent establishment been more professional and less partisan in discharging their duties and obligations, they could have acted as buffers and be the restraining force that would have prevented this crisis from escalating. Instead they became part of the problem, and a major one at that, instead of the solution.

As to the SLA’s claim of neutrality, Justice Aziz “will take it with a pinch of salt.” The SLA admitted to being “instructed” from the respondent’s solicitors in wording his affidavit, a term that took Justice Aziz by surprise. One would have thought that being a legal advisor and thus professionally trained, the SLA would act on his own judgment. Alas those are the qualities of our top officials.

Political, Not Legal Problem
All disputes could ultimately be decided by the courts. However whether some should, is another matter. A perfectly rational and easily comprehensible reason could be advanced on whether certain disputes are best resolved outside the court system. This ongoing dispute in Perak is one such case. It is essentially a political dispute, and as such it would have been best resolved in the political arena. No less a veteran politician than Tengku Razaleigh has said this, and I agree with him.

At the other end of the spectrum, Law Professor Shad Saleem Fariqi said it well and correctly. “… [T]his political crisis in Perak is like a “hydra-headed monster that cannot be eliminated so easily by ding-dong judicial decisions.”

Since the case has landed in court, it still could have played a crucial role in resolving it, had the various participants and institutions been more professional and less partisan. Imagine had the court expedited the case and Justice Aziz rendered his decision prior to May 7th, before that disastrous legislative session where the Raja Muda delivered his speech. The nation would then have been spared the ugly spectacle. Now that singular repulsive episode will forever be engraved as part of the Malaysian democratic tradition.

Had the principal players demonstrated a modicum of restraint and (dare I say it?) wisdom, and delayed the session till after the court’ decision, that too would have spared our nation that shameful blemish.

Najib’s appealing the case only added to the volatility and uncertainty; it is a major distraction and at a time when the nation can least afford it. Even if Barisan were to ultimately prevail, the price – political and otherwise – will be severe. More significantly, it will set yet another precedent on the enhanced powers for our sultans. After the humiliation then-Prime Minister Abdullah Badawi suffered at the hands of the Sultan of Trengganu not too long ago, a reversal of Justice Aziz’s decision will legitimize and cement the sultans’ enhanced powers.

On the other hand, if Barisan were to lose, this judgment would further strengthen the earlier precedent. At the most elemental level, it would establish once and for all that the powers of the sultan within a state are no different than that enjoyed by a governor.

While I would welcome such a development, those who cling to the idea of Ketuanan Melayu or that Malay sultans have a “special” if undefined role in the nation, must pause and ponder the vast implications of such a development. I doubt very much that Najib Razak in his hasty pursuit of immediate short-term gains has reflected on this critical point.

This case has thus far only created losers on all sides. It already exposed the sorry ineffectiveness of our institutions, in particular the permanent establishment. It has revealed the inadequacies of the monarchy in ensuring a smooth transfer of power. It rekindled the sorry memory of the constitutional mess we went through in the 1980s. Most of all the pitiful losers are the people of Perak. Their leaders, from the elected ones in the Assembly, to the hereditary ones in the palace, and the professionals in the permanent establishment, have all failed the people of Perak.

To be reminded that these leaders are paid for by the citizens’ hard-earned cash would merely add the proverbial salt to the still-raw wound, one that has yet to stop bleeding much less begin to heal.

This case awaits its final adjudication at the highest level. When it started the first judge, Judicial Commissioner Mohammad Ariff Yusof, recused himself as he was formerly associated with PAS, Nizar’s party. Now on its final stage, the sitting Chief Justice is Zaki Azmi, up until a few years ago a legal advisor to UMNO, a party in this dispute. Will Justice Zaki heed the example of Judicial Commissioner Ariff? It is on such simple and elemental matters that the credibility of our judicial system hangs.

Pastikan bumiputera berjaya

SELAIN daripada pandangan ahli panel, kolokium 1Malaysia: Hala Tuju Ekonomi Bumiputera turut membuka peluang kepada peserta untuk berkongsi pandangan. Kepelbagaian latar belakang peserta yang terdiri daripada ahli perniagaan, pegawai kerajaan, ahli akademik dan pemimpin persatuan perniagaan membolehkan isu yang dibincangkan dikupas daripada sudut yang berbeza dan menarik.
Antara beberapa perkara yang menuntut penjelasan selanjutnya daripada ahli panel termasuk soal status syarikat bumiputera iaitu kumpulan bumiputera mana yang dimaksudkan. Turut dilontarkan ialah permasalahan mengenai kesukaran syarikat bumiputera mendapatkan bantuan modal. Keputusan kerajaan memansuhkan kementerian MeCD turut mengundang keresahan komuniti usahawan bumiputera.

Berikut pandangan ahli-ahli panel:

NORIZAN: Dalam soal MeCD, saya tidak hanya bercakap dalam konteks membantu usahawan bumiputera semata-mata. Kerana saya sentiasa yakin tanggungjawab ini tidak harus dibebankan kepada satu atau dua kementerian.

Apa yang saya tekankan ialah MeCD itu sebenarnya lebih kepada menyediakan peluang pekerjaan untuk orang Melayu. Ketika ramai yang bercakap mengenai institusi kewangan seperti terutama bank yang seolah-olah tidak mahu membantu usahawan Melayu, saya cuba melihat dengan meletakkan diri di pihak bank.

Jika Melayu itu dilonggokkan dengan pelbagai elemen negatif, maka saya juga agak sukar untuk meluluskan pinjaman. Jadi bagaimana kita mahu mengubah persepsi bahawa orang Melayu itu sebagai bangsa yang gagal dan sentiasa memerlukan bantuan. Hakikatnya ramai orang Melayu yang mampu menjadi usahawan berjaya.

Oleh itu bagaimana kita mahu tonjolkan kejayaan Melayu ini supaya apabila pihak bank ada keyakinan untuk membantu. Ini harus difikirkan supaya jangan dilihat Melayu itu dalam kelompok usahawan yang gagal. Saya suka mengaitkan dalam konteks belia yang man kita sering menyatakan belia itu adalah aset. Tapi cara kita melihat dan melayan belia adalah sebaliknya.

Semua yang dilakukan belia itu tidak betul sehingga kita merasakan mereka adalah liabiliti. Begitu juga yang berlaku terhadap usahawan Melayu.

Saya tertarik kepada pandangan yang mengatakan bahawa ada kegagalan dalam sistem penyampaian di antara kerajaan dengan komuniti usahawan bumiputera dan rakyat kebanyakan. Saya melihat terutamanya selepas Pilihan Raya Umum Ke-12, kerajaan seolaholah tidak tahu bagaimana caranya untuk berkomunikasi dengan rakyat.

Dalam peranan media baru kerajaan seolah-olah hilang arah dan masih bercakap tentang media arus perdana. Saya ambil contoh satu isu yang ditulis oleh media cetak dikupas daripada sudut yang berbeza oleh lebih ramai penulis blog.

Maka, kupasan di blog itu pastinya akan mempunyai pengaruh yang besar sebab ia melibatkan ramai pihak. Jadi kerajaan perlu melihat perkara ini dengan serius iaitu bagaimana untuk berkomunikasi dengan generasi X dan Y.

MOHD. NOORDIN: Saya tertarik dengan pelbagai komen yang diberikan terutamanya mengenai pelbagai masalah yang dihadapi. Apa yang boleh saya cadangkan kepada GABEM ialah permasalahan yang ditimbulkan ini bukanlah sesuatu yang asing.

Salah tanggapan atau pandangan negatif terhadap komuniti usahawan Melayu ini sememangnya serius sehingga sudah ada persepsi negatif di kalangan pihak bank terhadap mereka.

Bagi saya tanggungjawab di sini ialah bagaimana kita untuk menukar salah tanggapan ini. Apa yang perlu dilakukan untuk meyakinkan pihak bank bagi menolong usahawan bumiputera.

Kita sudah ada contoh yang mana usahawan bumiputera mampu menolong syarikat bukan bumiputera berkembang sehingga ke peringkat antarabangsa. Pastinya dengan kemampuan itu, kerajaan tidak akan teragak-agak untuk menolong mana-mana syarikat bumiputera.

Sekarang kita sudah sedia maklum masalah yang dihadapi oleh usahawan bumiputera. Maka seharusnya kita bersama-sama mencari formulasi bagaimana untuk mengubah persepsi negatif itu.

Cabarannya ialah bagaimana untuk kita mencapai kejayaan itu bukan secara mensabotaj orang lain, tetapi menerusi kredibiliti dalam apa jua yang kita lakukan seterusnya mendapat penghormatan daripada kaum lain.

Rahim Thamby Chik: Dari segi definisi istilah bumiputera, istilah majoriti itu ada 100 peratus, 49 peratus atau 30 peratus. Tapi apa yang diharapkan biarlah syarikat 100 peratus bumiputera itu menjadi lebih baik. Bagaimanapun dalam keperluan masyarakat perniagaan, adalah lebih kita menggunakan kaedah perkongsian iaitu dengan penyertaan pelbagai kaum.

Ini kerana dari segi penguasaan ekonominya, kaum bukan bumiputera adalah lebih baik. Maka boleh berlaku interaksi yang mana kaum bumiputera boleh menggunakan kepakaran, pengalaman dan kebijaksanaan kaum lain.

Keduanya kita mesti lihat dari sudut pasaran yang luas iaitu di peringkat rantau dan global. Sebab pasaran itu lebih besar dalam ia merupakan syarat bagi kita memperluaskan kek ekonomi. Kerana itu juga kita perlu pandai menggunakan bantuan yang ada.

Ketika ini bantuan daripada kerajaan sangat banyak dan berada di bawah pelbagai kementerian. Ini kadang-kadang menyebabkan masyarakat ekonomi bumiputera berasa keliru. Sebab itu saya rasakan kita perlu ada satu suruhanjaya yang menyelaras bentuk bantuan ini. Saya suka mencadangkan sekiranya Gabem menjadi satu pusat perantara yang boleh membekalkan maklumat kepada usahawan bumiputera menerusi satu portal misalnya.

Gabem bertindak dan menyelaras dengan bantuan badan-badan ekonomi lain.

Kita juga berhasrat untuk menubuhkan apa yang disebut sebagai Kelab Glokal Bumiputera (KGB). Iaitu persatuan yang menghimpunkan syarikat-syarikat bumiputera yang berjaya untuk turut bersama-sama membantu usahawan bumiputera lain.

Ini kerana tanggungjawab membantu dan mengangkat martabat masyarakat ekonomi Melayu itu tidak dipikul oleh kerajaan semata-mata.

Ahli KGB ini boleh menggunakan platform syarikat mereka untuk membantu syarikat bumiputera lain misalnya dengan menyalurkan bantuan berbentuk modal.

Menerusi KGB ini juga kita mahu membentuk menyediakan satu senarai syarikat bumiputera yang berjaya yang apabila ada projek bersaiz mega, kita boleh sarankan nama-nama mereka. Sebelum ini tidak ada pihak yang dapat menyediakan nama-mana syarikat ini kerana tiadanya satu koordinasi yang bersepadu.

Untuk itu GABEM berhasrat untuk menghubungi semua kementerian dan mendapatkan latarbelakang syarikat yang berjaya bukan sahaja untuk menjadi ahli KGB, tapi bagi membolehkan usahawan Melayu mengenalpasti dan menolong antara satu sama lain.

Sebenarnya inilah juga kejayaan kaum Cina menerusi kekuatan pertubuhan perniagaan yang mereka ada. Kerana tu kita berhasrat untuk merapatkan permuafakatan di kalangan setiap pejuang ekonomi Melayu bumiputera dan berjuang dalam satu keluarga dan pasukan. Supaya ada rangkaian bagi setiap apa yang berlaku untuk mengangkat antara satu sama lain.

Kita juga mahu ada permuafakatan antara syarikat berasaskan kerajaan (GLC) dan pegawai-pegawai kerajaan. Jika tidak sistem penyampaian kita akan hilang arah. Pembahagian projek misalnya boleh jadi diberikan kepada kroni-kroni.

Sebab itu kita mahu pegawai kerajaan yang menyedari tanggungjawab mereka supaya masyarakat ekonomi Melayu mendapat manfaat daripada perkhidmatan yang diberikan. Seterusnya dapat kita lahirkan satu sistem yang efisien, telus dan akauntabiliti.

Gerakan itu mesti efektif dan efisien dalam memastikan apa yang diluluskan pemerintah sampai kepada masyarakat ekonomi kebanyakan.

Saya juga sarankan agar kaum bumiputera melakukan jihad ekonomi. Bagi orang bukan bumiputera, perkataan jihad ini mungkin sesuatu yang ditakuti. Tapi bagi orang Islam jihad merupakan satu kewajipan.

Kita mahu melihat kecemerlangan adalah satu jihad yang harus bagi masyarakat ekonomi kita. Saya melihat politik tidak banyak membawa kesan perpaduan di kalangan kaum bumiputera. Sebaliknya peranan itu boleh dimainkan menerusi ekonomi.

Kemakmuran ekonomi akan membawa banyak faedah kepada pegangan kita. Kekuatan ekonomi juga merupakan rangsangan paling baik untuk menyumbang kepada satu perpaduan yang kukuh antara kaum di negara ini.

GABEM juga mahu menggalakkan satu syarikat dalam satu keluarga. Orang Melayu ramai yang kaya harta benda tetapi banyak juga yang terbiar. Seharusnya dalam satu keluarga itu ada sebuah syarikat yang tidak semestinya bertujuan untuk berniaga. Tetapi untuk mewujudkan budaya pengkorporatan dan memberi nilai kepada harta-harta kita.

Malaysia Backs Sri Lankan Resolution Based On Non-Interference Stand

DAMASCUS, May 25 (Bernama) -- Malaysia has expressed support for a draft resolution introduced by Sri Lanka at the Human Rights Council (HRC) in Geneva, in pursuant of Malaysia's principled position with regard to non-interference in the internal affairs of other countries.

Foreign Minister Datuk Anifah Aman said the members of the Organisation of the Islamic Conference (OIC) and Non-Aligned Movement (NAM) in the HRC had also expressed support for the Sri Lankan draft resolution based on the same principle.

The draft resolution relating to the situation in Sri Lanka reaffirmed the principles and purposes of the United Nations (UN), including the principles of non-interference in matters which were essentially within the domestic jurisdiction of states, he said in a statement to Bernama.

"This is precisely the case with Sri Lanka, and it has the sovereign rights to undertake appropriate means in dealing with the internal situation, without the interference of other countries or the UN," Anifah said, adding that this important principle had been endorsed by NAM as well as OIC.

It was issued following MIC president Datuk Seri S. Samy Vellu's statement on May 23 asking Malaysia not to support the Sri Lankan draft resolution calling for UN member nations not to interfere in the internal affairs of Sri Lanka.

He had said Tamils in Malaysia constituted 1.4 million of 1.8 million Indians in the country and as such, their feelings had to be respected.

According to Samy Vellu, there had to be a war tribunal in Sri Lanka to bring people who perpetrated crimes against the Tamil community there in their war against the Liberation Tigers of Tamil Eelam (LTTE).

Anifah said the Sri Lankan government had undertaken efforts, on its own and together with the UN and other international organisations, to extend humanitarian assistance as well as promote and protect human rights.

The Malaysian foreign minister said this included the visit by UN secretary-general Ban Ki-moon to Sri Lanka on May 22 which reflected that Sri Lanka was extending cooperation to the UN and other international organisations.

"We are hopeful that the Sri Lankan government would further undertake concerted efforts to bring about a conducive environment for all segments of the people of Sri Lanka to come and work together towards finding a fair and comprehensive political solution which is acceptable to all parties, besides contributing positively to promoting lasting peace and stability in Sri Lanka," said Anifah.

He said the international community should be supportive of the reconstruction efforts and, at the same time, ensure the promotion and protection of all human rights, including economic, social and cultural rights.

"The draft resolution also outlines efforts by the Sri Lankan government in the future to protect and promote human rights, rights of minorities and others," according to the foreign minister.

The Sri Lankan government had officially announced that the LTTE had been crushed by the armed forces and its founder-leader Velupillai Prabhakaran had been killed, along with his top aides.

Anifah left Damascus yesterday after leading the Malaysian delegation at the 36th Session of the Council of Foreign Ministers of the OIC.

தமிழ் மக்க்களின் அணையா விடுதலைச் சுடர்

தமிழீழ மக்களின் விடுதலைக்காகவும், செழுமையான எதிர்காலத்திற்காகவும் தனது வாழ்நாளை அர்ப்பணித்து போராடிய தமிழீழ தேசியத் தலைவரும் தமிழீழ விடுதலைப் புலிகள் இயக்கத்தின் தலைவரும் தலைமைத் தளபதியுமாகிய மேதகு வே.பிரபாகரன் அவர்கள் சிங்கள ஆதிக்கப்படைகளுடனான போரில் வீரச்சாவினை தழுவியுள்ளார் என்பதை அனைத்துதமிழீழ மக்களுக்கும், தமிழக மக்களுக்கும், புலம்பெயர்ந்து வாழும் தமிழ் மக்களுக்கும், சர்வதேச சமூகத்திற்கும் தாங்கொண்ணா துயருடன் அறியத்தருகின்றோம்.

கடந்த 37 வருடங்களாக தமிழீழ மண்ணில் பொங்கிப் பிரவாகித்த விடுதலை வரலாற்றின் ஆன்மாகவும் குறியீடாகவும் விளங்கியவர் எமது தேசியத்தலைவர். ஒரு கால்நூற்றாண்டுக்கு மேலாக அடக்குமுறைக்கு முகம்கொடுத்து நின்ற ஒரு தேசிய இனத்தின் வரலாற்றையே மாற்றுகின்ற விருப்போடும் துணிவோடும் நம்பிக்கையோடும் எதிரிக்கெதிரான விட்டுக்கொடுப்பற்ற ஒரு பெரும் விடுதலைப் போரை தலைமையேற்று நடத்தியவர் அவர். கற்பனைககு எட்டாத தற்தியாகமும், கட்டுப்பாடும், வீரமும், ஒழுக்கமும் நிறைந்த, உன்னதமான ஒரு விடுதலை இயக்கத்தைக் கட்டியெழுப்பி, பெரும் படையணிகளோடும் ஒரு தனித்த தேசத்திற்குரிய நிர்வாகக் கட்டமைப்புகளோடும் கனரக ஆயுத வல்லமைகளோடும் போராட்டத்தை வழிநடத்தினார்.

அரசியற் போராட்டத்திற்கு இணையாக சமூக மாற்றத்திற்கான போராட்டங்களையும் முன்னெடுத்தார். போராட்டக் களங்களில் எமது மகளிர் நிகழ்த்திக் காட்டிய சாதனைகளுக்கு களம் அமைத்துக் கொடுத்ததன் மூலம் எமது சமூகத்தில் பெண்களுக்கிருந்த தனித்துவமான பங்களிப்பை வெளிக்காட்டியவர் அவர்.

தலைவரின் போராட்ட அனுபவமும், தற்துணிவும், வீரமுமே எவ்வித நெருக்கடிகளையும் எதிர்கொள்ளும் உந்து சக்தியாக, எமது போராட்ட சக்கரத்தின் அச்சாணியாக இருந்திருக்கிறது. அமைதிப் பேச்சுவார்த்தைகள் முறிந்து, சர்வதேச சக்திகளின் துணையுடன் ஒரு பெரும் யுத்தம் மீண்டும் எம்மீது திணிக்கப்பட்ட போது, தலைவர் அவர்கள் அதனைத்துணிவுடனேயே எதிர்கொண்டார்.

போர் நெருக்கடியான கட்டங்களை எட்டி எமது நிலப்பரப்புகள் எதிரியால் சுற்றி வளைக்கப்பட்டு ஒரு பெரும் யுத்தம் எம்மக்கள் மீது ஏவிவிடப்பட்டபோதும் தலைவர், தான் வாழ்ந்த மக்களுடனேயே நின்றார். மக்களதும் தளபதிகளினதும் தொடர்ச்சியான வேண்டுகோள்களையும் மீறி அவலப்படும் மக்களை விட்டு வெறியேற மறுத்தார். எமது மக்கள் எதிர்கொண்ட அத்தனை வலிகளையும் தானும் சுமந்தார். இறுதியில், விடுதலைக்கான இந்த நீண்டபாதையில், எந்த மக்களுக்காக ஆயுதமேந்தினாரோ அம்மக்களுடனேயே கடைசி மணித்துளிவரை நின்று போராடி வீரச்சாவடைந்தார். ’எம் மக்களுக்கு உரிமைகளைப் பெற்றுக் கொடுங்கள்’ என்பதே அவரது இறுதிக் வேண்டுகோளாக இருந்திருக்கிறது.

வரலாற்றின் ஓர் உண்மை மனிதனாக, ஒரு விடுதலைப் போரொளியாக, அடிமைப்பட்டுப்போன ஓர் இனத்தின் மீட்பராக, ஓரு சமூகத்தின் அரசியல் வழிகாட்டியாக, விடுதலையின் ஒரு குறியீடாக, தமிழினச் சின்னமாக, உலகத் தமிழ் இனத்தின் ஒரு வரலாற்று நாயகனாக வாழ்ந்த எங்கள் தேசியத் தலைவர் மறைந்து விடவில்லை. தமிழீழ தேசத்தின் தலைமைச் சுடராக எம் தேசமெங்கும் அவர் ஒளிவீசிக் கொண்டிருக்கின்றார். மானிடத்தின் விடுதலையை நேசிககும் எல்லோர் மனங்களிலும் அவர்என்றும் நிறைந்திருக்கின்றார். அழிவென்பதே அற்ற ஒரு தத்துவார்த்த ஒளியாக அவர் எங்கும் நிறைந்திருக்கின்றார். உலகெங்கும் விடுதலையை அவாவி நிற்கும் இனங்களுக்கு தலைவரின் வாழ்க்கை ஒரு வழிகாட்டி. எம் மக்களுக்கு உரிமையைப் பெற்றுக் கொடுங்கள் என்பதே அவர் எங்களுக்கு விட்டுச் சென்றிருக்கும் விடுதலைப் பத்திரம். இதனையே எங்கள் மனங்களில் ஏந்துவோம். தலைவர் ஏற்றிய விடுதலை நெருப்பை அதன் இறுதி இலக்குவரை அணையாது பாதுகாப்போம்.

எமது தேசியத் தலைவரினது வீரவணக்க நிகழ்வை அதற்குரிய எழுச்சியுடன் மேற்கொள்ளுமாறு அனைவரையும் வேண்டுகிறோம். திங்கட்கிழமை 25.05.2009 முதல் ஒரு வாரத்திற்கு எமது தலைவரை நினைவு கொள்ளும் வீரவணக்க வாரமாக எமது இயக்கம் பிரகடனப்படுத்துகிறது.

தலைவரது இலட்சிய நெருப்பை எம் மனங்களில் ஏந்தி அவர் கடைசிவரை போராடிய எமது மக்களின் விடுதலையை வென்றெடுக்க உழைப்பதே அவருக்கான உண்மையான மரியாதையாகும். எமது தலைவரின் வீரச்சாவையிட்டு தம்மையோ ஏனையோரையோ வருத்திக் கொள்ளும் எவ்வித நடவடிக்கைகளையும் மேற்கொள்ள வேண்டாமென அனைத்து தமிழ் மக்களையும் பணிவன்புடன் வேண்டிக் கொள்கிறோம்.

எமது தேசியத் தலைவரோடு வீரச்சாவைத் தழுவிய அனைத்து தளபதிகளுக்கும் மாவீரர்களுக்கும் மக்களுக்கும் எமது வீரவணக்கத்தைச் செலுத்துகிறோம். இம் மாவீரர்கள் பற்றிய விபரங்கள் விரைவில் வெளியிடப்படும் என்பதை அறியத் தருகிறோம்.

Tamil Tigers confirm leader's death

(Al Jazeera)The Liberation Tigers of Tamil Eelam (LTTE) have confirmed their leader, Velupillai Prabhakaran, has been killed.

"We announce today, with inexpressible sadness and heavy hearts that our incomparable leader and supreme commander ... attained martyrdom fighting the military oppression," Selvarasa Pathmanathan, the LTTE's head of international relations, said in a statement on Sunday.

The Tigers said Prabhakaran had been killed on Tuesday during fighting between the LTTE and the Sri Lankan military and declared a week of mourning.

The military had previously announced Prabhakaran, 54, was shot on Monday while travelling in a small convoy of vehicles in a bid to escape the final battle between the two sides.

'Final request'

The LTTE statement read: "For over three decades, our leader was the heart and soul and the symbol of hope, pride and determination for the whole nation of people of Tamil Eelam,"

"Since the failure of the peace process and the escalation of the war forced upon the Tamil people, the LTTE was faced [sic] to confront the Sri Lankan military that was supported by the world powers.

"This deliberate bias and position taken by the international community severely weakened the military position of the LTTE.

"Our leader confronted this threat without any hesitation. He would not waver in his desire to be with his people and fight for his people till the end.

"His final request was for the struggle to continue until we achieved the freedom for his people.

"His legend and the historical status as the Greatest Tamil Leader ever are indestructible," Pathmanathan said in the statement.

Body 'cremated'

The Sri Lankan authorities have not published a post mortem examination report or officially confirmed how or when he died.

A government spokesman said on Tuesday that the body would be given to an undertaker, but General Sarath Fonseka, Sri Lanka's army chief, told the privately-run Sunday Rivira that the body had been cremated and his ashes thrown in the sea.

Fonseka said Pottu Amman, the LTTE intelligence chief, and Prabhakaran's wife, Mathiwadini, were among the dead, but have yet to be officially identified.

The government released footage of Prabhakaran's body for the first time on Tuesday after a pro-LTTE website, Tamilnet, denied the government's announcement that he had been killed.

Sri Lanka said Sunday it would not allow aid workers complete access to civilians who remain held in camps after the conflict, saying LTTE remnants still remained among the refugees.

Ban Ki-moon, the UN secretary-general, on a visit to a camp housing 200,000 Tamils, had called for his staff to be given "unhindered access" to those displaced in the decades-long war that ended last week.

The government said that "as conditions improved, especially with regard to security, there would be no objections to such assistance".

Ban, who toured the Menik Farm facility on Saturday, described the conditions as overcrowded and the detained civilians as "badly in need of food, water and sanitation".

The government has described the camps as "welfare villages" and says it wants to resettle all displaced civilians as soon as possible.

But Tamil activists say they are "concentration camps" with inmates penned in behind barbed wire.

During his visit, Ban urged Rajapakse to probe alleged human rights violations committed during the defeat of the Tamil separatists, a joint statement on Sunday said.

The UN estimates that up to 7,000 civilians have been killed in fighting since the beginning of the year.

US Justice Dept. files "Motion to Dismiss" in IMF case

Responding to the law suit filed in the District Court of District of Columbia requesting to obtain a declaratory judgment to force the United States to oppose Sri Lanka’s pending IMF loan application, the lawyers representing the defendants, Timothy Geithner, Secretary of the Treasury, and Meg Lundsager, Executive Director of the IMF, filed a motion in the Court to dismiss the case on the grounds that the plaintiff has no standing, the court lacks jurisdiction, there is no private right of action to enforce "policy goals," and under federal law both defendants are immune from legal prosecution, Bruce Fein, counsel for the plaintiff said.

On March 30, 2009, Tamils Against Genocide (TAG) filed a lawsuit against the Secretary of Treasury and United States Executive Director of the International Monetary Fund (IMF) seeking a declaratory judgment that United States law prohibited voting in favor of a pending $1.9 billion IMF loan request by the Government of Sri Lanka (GOSL) because of its pattern of gross violations of internationally recognized human rights.

Group representatives said that Counsel Bruce Fein is reviewing the legal brief considering the developments on this matter in the light of developments in the last several weeks.

In the interim, the U.S. Secretary of State and the British Foreign Minister issued statements to the effect that the time was no right for the loan because of the human rights misbehavior of the GOSL.

A pending amendment in the United States Senate filed by Senators Patrick Leahy and Sherrod Brown would prohibit the IMF balance of payments loan absent a certification by the Secretary of Treasury that the assistance is "necessary to prevent significant and imminent hardship among the general population."

Also, while the complaint detailed the human rights violations until March 30th, and recorded the information as part of filed documents, Rights organizations and the international community have become more aware of the rights abuses by Sri Lanka during the last six weeks including possible war crimes exposed from images provided by the private and military satellites.

Mr. Fein said that he is considering a response, but leaning towards dismissing the IMF lawsuit voluntarily and let the political processes unfold. "The resources needed to provide an effective rebuttal to the Government's position is very high," Fein added.

The Defendants' brief said that plaintiff's argument, that voting against the loan application would result in diminishing of rights violations of relatives in Sri Lanka, is only a "speculation about a series of remote contingencies involving third parties not before the Court," and does "not satisfy the redressability, causation, and injury prongs of the standing inquiry," and therefore, the "complaint must be dismissed for lack of standing."

Secondly, the brief said, "this Court lacks jurisdiction because the plaintiff's complaint presents a political question. Plaintiff seeks to have this court make decisions about propriety of foreign aid expenditures and the best way to prevent alleged human rights abuses. But such foreign policy decisions are inherently political, and the Constitution has committed such decisions solely to political branches."

Thirdly, responding to the plaintiff's contention that the court should create a private right of action because the "Congress did not expressly preclude judicial review," the Defendants said,"the plaintiff has the governing standard precisely backwards. Because Congress did not create a private right of action expressly, and because, indeed, it creates alternative mechanisms for Congress itself to monitor the Executive Branch's actions, plaintiff simply has no private action."

Lastly, the Defendants' legal memorandum pointed out 22 USC 286h, and argued that the immunity from legal process of IMF officials are incorporated into United States domestic law, and therefore, "both defendants are immune from legal processes for acts committed in their official capacities as Governor and Executive Director of the IMF."

Thousands of people gathered at the Batu Caves temple this morning to protest against the Sri Lankan government despite a police warning against the rally.

The protest rally was to voice the opposition against the war crimes perpetuated by the Sri Lankan government against innocent Tamils in its ongoing war against the LTTE.

LTTE has been fighting for a separate Eelam state in the north of Sri Lanka. The war reached a boiling point earlier this week with the Sri Lankan government claiming victory with the killing of LTTE chief Velupillai Prabhakaran.

In the process, thousands of innocent victims, almost all of whom were Tamils, have been killed and about 100,000 made homeless.

The protest today was organised by the World Tamil Relief and the Coalition of NGOs movements.

Among those who attended the rally included MIC information chief and Deputy FT Minister M Saravanan, DAP’s Teluk Intan parliamentarian M Manoharan, DAP’s Ipoh Barat MP M Kulasegaran, PKR’s Padang Serai MP N Gobalakrishnan , Kapar MP S Manikavasagam and Batu Caves temple committee chairperson R Nadarajah.

Also present were DAP’s Klang MP Charles Santiago and MIC Youth wing advisor S Vell Paari.

Yesterday the Selangor police urged the public not to join the protest as it was being held without a police permit.

State deputy police chief Jamshah Mustafa however said that people can go to Batu Caves to pray but “not for an illegal rally”.

But despite the police warning, there was no strong police presence in Batu Caves.

One of the organisers SP Pathi told Malaysiakini that they had originally expected some 15,000 people to participate today but conceded that the police warning would mean fewer people turning up.

Eyewitnesses said that a few hundred people had gathered by 10am. By noon the crowd size had swelled up to about 4,000. By the time the rally ended at about 1pm organisers said some 5,000 people had attended.

Several posters condemning the Sri Lankan government were also seen pasted in Batu Caves. A platform was set up on the field within the temple compound where fiery speeches were made.

First to speak to the crowd was Nadarajah who said that he was pressured by some quarters not to allow for the rally to take place in the temple compound today.

“But I insisted on it being held in support for the Sri Lankan Tamils,” he said to the loud approval of the crowd.

Saravanan also lauded the presence of so many politicians at the rally despite their political differences.

“I am proud that we can stand united here for our Sri Lankan Tamil brothers,” he said.

He also lashed out at the Indian government, particularly the Tamil Nadu state government, for not doing anything to stop the attacks on civilians in Sri Lanka.

“If one Prabhakaran is killed, thousands of Prabhakaran will rise. If Israel can be formed, a Tamil nation can be formed too,” he added.

He also urged the Malaysian government not to support a draft resolution tabled by Sri Lanka at the United Nations calling for member nations not to interfere in the internal affairs of the country.

He said such a support for Sri Lanka would hurt the hearts of Malaysian Tamils.

Yesterday MIC president S Samy Vellu also similarly called on the government to retract its support for the draft resolution.

Manoharan meanwhile said that the Sri Lankan president Mahinda Rajapakse had committed war crimes by killing innocent Tamils in the country.

“He is guilty of war crimes and must be charged in the war crimes tribunal,” he added.

Gobalakrishnan also similarly condemned Rajapakse for “murdering innocent children and women”.

He said that the spirit instilled by Prabhakaran would remain even if he was killed.

Kulasegaran urged the Malaysian government not to give any financial aide to Sri Lanka as it would seem like it was supporting the war crimes in that island state.

“The government of Malaysia is going to give RM3 million to Sri Lanka. We cannot allow that. I will raise this issue in the parliament,” he said.

A donation campaign was also launched at the rally to collect funds for the Tamils in Sri Lanka.

The Batu Caves resolutions

Later at a press conference, several resolutions and immediate plans were revealed to assist the Tamils in Sri Lanka.

“We will form a peace team to be sent to Sri Lanka to help rebuild the lives of the war victims,” said organising committee member K Arumugam.

And among the resolutions passed included a call for the United Nations to start a probe on the Sri Lankan government and to institute war crime charges against the Sri Lankan leaders.

Another resolution called for the lifting of all restrictions imposed on the international community to assess the full nature of the catastrophe that has struck the Tamils in Sri Lanka and offer immediate relief.

The protest group also wanted the formation of an independent Tamil state and until then the establishment of a UN peacekeeping force on the island to maintain peace.

“We call upon international community to offer all necessary humanitarian aid through international aid agencies.

“We also call upon the Malaysian government to recognise the plight of Sri Lankan Tamils and institute immediate measures to give assistance and financial support to the Tamils in Sri Lanka,” they said.

They also wanted the government to withdraw its support for the Sri Lankan resolution in the UN.

BN mulls options for Perak but DAP wants polls

KUALA LUMPUR, MAY 24 — Hoping for an end to the Perak crisis, the prime minister today said that an emergency assembly is an option to end the impasse but the DAP slammed the idea and called for fresh polls.

Datuk Seri Najib Razak said this when asked if such a move could short-circuit plans to appeal to the Federal Court by establishing that Barisan Nasional (BN) is in control.

“That is an option for us but it is not the only way to show majority,” Najib said of an emergency sitting.

“We hope that there is finality although I understand that there is a high probability of an appeal. They have the right and we accept that,” said the Umno president who has been blamed by the opposition for engineering the Perak power grab.

“Forget about it, Najib, impasse will get worse. Only option — hold elections now!” DAP supremo Lim Kit Siang shot back hours later.

After 16 weeks of dispute, the Court of Appeal had on Thursday declared Datuk Seri Zambry Abd Kadir as the rightful mentri besar.

But Pakatan Rakyat (PR) are ready to make a further appeal to the Federal Court to uphold an earlier High Court decision which had ruled in Datuk Seri Nizar Jamaluddin’s favour.

Najib also took a swipe at PR leader Datuk Seri Anwar Ibrahim who had questioned the integrity of the judiciary after the Court of Appeal had overruled the High Court.

“He himself tried to establish federal government by defections," he said, referring to Anwar’s Sept 16 takeover plan.

“So, the judiciary is right in saying it is legal,” Najib concluded.

He also claimed that that several international law experts had supported his view, including Queen’s Counsel Lord Anthony Lester of Herne Hill, who advises the British crown.

But the DAP was not impressed as Lim ridiculed Najib’s idea.

“Let me tell Najib — forget about it, as such an emergency Assembly meeting is no viable option and it could only make the impasse worse, dragging the nearly four-month-old political and constitutional crisis and stalemate indefinitely into the future,” the Ipoh Timur MP said in a statement.

He noted that the protracted political and constitutional crisis and stalemate will stand as the strongest testament debunking Najib’s slogan of “1 Malaysia. People First. Performance Now”.

“What right has anyone to talk about 1 Malaysia when he is incapable of promoting 1 Perak, in fact single-handedly responsible for the political and constitutional impasse in orchestrating the unethical, undemocratic, illegal and unconstitutional power grab since early February?

“Najib should bite the bullet and agree that the only way to end the political and constitutional impasse in Perak is to dissolve Perak State Assembly and return the mandate to Perakians in a state-wide general election so that Malaysians can turn from the Perak stalemate to reunite to face the worst global economic crisis in a century,” Lim said.

He called on Najib to learn the lesson of Michael Martin who became the first House of Commons Speaker for 300 years to resign, even giving up his seat as MP — because had had lost all moral authority to continue in the office in the UK parliamentary expenses scandal.

“There can be no dispute that Datuk Zambry Abdul Kadir has no ‘moral authority’ in the first place to become Perak mentri besar unless he wins the mandate in a general elections.

“No amount of political shenanigans and judicial contortions can give Zambry any moral authority, which can only be found in a new poll in Perak,” he said.

He told Najib to spare the key national institutions in the country from further damage, saying he would be doing even more harm to all the key national institutions in undermining public confidence in their credibility, integrity and legitimacy in his stubborn refusal to hold new state general elections.

Murugiah ‘ousts’ Kayveas as PPP chief

PUTRAJAYA, May 24 — In the style of its birthplace Perak, the People’s Progressive Party (PPP) today has two presidents with Datuk T. Murugiah replacing Datuk M. Kayveas in an “emergency meeting” that is questionable in legality.

Murugiah was sacked from the PPP with six supporters last week but his supporters called for today's emergency meeting at the Putrajaya International Convention Centre (PICC) and voted him president.

The senator and deputy minister said he will inform Barisan Nasional chairman and prime minister Datuk Seri Najib Tun Razak about the election.

Earlier, PPP members from around the country were bussed in for the meeting at the PICC where a resolution to overturn a decision by the party disciplinary committee on May 16 to expel Murugiah along with six supporters was passed unanimously earlier this morning.

Murugiah was then elected with three new vice-presidents and a new supreme council in the meeting held under tight security with heavy police presence besides officers from the Prime Minister’s Department, where Murugiah is a deputy minister.

Murugiah stressed to reporters that he was caught by surprise with the outcome of the meeting.

He described his reversal of fortune as a second political tsunami and change for the country.

“I will not threaten to leave the Barisal National,” Murugiah said in order to contrast his stand from his predecessor. However the fact the meeting was meant to dump Kayveas was obvious to everyone from the start.

Banners proclaiming Murugiah as president had been prepared while prominent pictures of him with prime minister Datuk Seri Najib Tun Razak was also projected into the hall after he was successfully elected.

He said his first order of business was to meet the prime minister and other coalition leaders to explain the new developments in the party.

He will also meet the Registrar of Society (ROS) tomorrow on the new changes to the party.

He was visibly upset when asked about the legality of the meeting or if it would be challenged in court. He said it was up to the ROS to endorse the meeting and resolutions.

“Don’t ask me about the legality. I did not organise the meeting and I was just invited to come,” he said, adding there were five lawyers acting as independent observers and reporters could ask them if the meeting was held legally.

Murugiah snapped at a broadcast journalist who asked if the party now had two presidents and how he could have elected since he was expelled from the party.

“That is an allegation.” he said, adding angrily that a resolution was passed to overturn the decision.

He indicated that Kayveas would find out about the latest development from the press.

The press conference then ended abruptly.

During his speech earlier he told members that he would work towards getting PPP their own building and getting the party financial accounts in order.

He promised to serve the party as president and as a deputy minister.

Najib Wants Malaysians To Imbibe Three Pillars For National Unity

PUCHONG, May 24 (Bernama) -- To achieve national unity, the people should work with the government in making 1Malaysia a success by subscribing to the three pillars for national unity, said Datuk Seri Najib Razak.

The three pillars are the concept of acceptance, principle of nationhood and concept of social justice.

"We need to move from the concept of tolerance to that of acceptance. If we can accept our multiracial society as a strength, we will accept the other races as our loyal friends," he said after launching the national-level Unity Week, here, today.

The people, he said, should therefore forge national unity regardless of their race, religion and culture as it was the basis for a more progressive and successful Malaysia.

Through the principle of nationhood, Najib wants the people to know the nation's history, and appreciate the role of its past leaders in building Malaysia and the foundations of nation building.

"When we know the nation's history, we will be able to know where we stand and the nation's future direction," he said.

On social justice, Najib said each citizen, whether in the urban or rural areas, who need help must be helped.

Hence, he urged everyone to support the 1Malaysia concept in order to bring the country to greater heights.

He said the Barisan Nasional government was a considerate and responsible government which looked after the interests of all communities.

While refuting the various accusations against the government made by Hindraf leaders of late, Najib said the government was sincere about improving the lot of the people and did wish to be seen as cruel.

"They have been released (from detention), but are now making statements which are extreme and I leave it to the people to judge. There is a limit to what one can voice out...don't do anything that can threaten national unity and security," he said.

At the event, Najib also handed over Unity awards to the Unite Sports Club in the sports category, Alleycats lead singer Datuk David Arumugam or whose real name, Thiagarajan Arumugam, in the arts category, Sinar Harian in the media category and Zubedy Sdn Bhd in the corporate category.

Perak - the epicentre of Umno fault-line

The judgment of Justice Abdul Aziz Abd. Rahim in the case of Nizar vs Zambry has attained clairvoyance status.

It had positioned the institution of rulers above politics, dignified the sultans and preserved the revered constitutional monarchy for generations to come.

In the ancient times the announcement of gestation or birth of crown prince will usually send sages and spiritual leaders into solitude in meditation and prayers in the harsh wilderness with the hope that the ruler to come will be benevolent to the subjects. History bears testimony of such adoration with monuments and poems of virtues and valour of such kings.

Today more than a billion souls, Hindus, Christians and Muslims all in India salute the great emperor Asoka knowingly or unknowingly when they rise in veneration of the majestic Indian national flag, the centre of it bears the wheel of Asoka.

But not all Rulers invite admiration. Scorn and disdain of the people witnessed the extinction of absolute monarchy in many parts of the world and replaced with power to the people by new systems of constitutional monarchy or an outright republic of a nation.

Power is placed in the hands of people’s representatives but authority is given not to deny the will and wishes of the people.

But the hearts of men are so easily corrupted.

Neither constitutional monarchy nor the presidency of a republic could remove the abuse of power and expansion of corrupt playing fields of those in whose hands the people have placed their power and authority that were removed systematically from the absolute monarchs.
Power corrupts and absolute power corrupts absolutely, so the saying goes.

The creation of constitutional monarchy and a system of parliamentary democracy with people’s power concentrated in the hands of UMNO in the last 52 years only goes to show that indeed UMNO enjoys the goodwill of the people of Malaysia.

But all that is about to change.

The epicentre of UMNO’s power shattering phenomenon is hidden deep in the emotions of the Perakians. It may well be UMNO’s fault line that may trigger the next and decisive Tsunami. A sea of people with their emotion translated into tidal waves of anger may well bring about permanent destruction to the once invincible fortress that now lies damaged at the shoreline built by UMNO painstakingly for more than 50 years led by many of their visionary leaders of the past.

But wait! Alas, those political leaders opposed to UMNO who now ride these tidal waves of anger (except for some notable veterans), are poor surfers unable to comprehend the deep current and direction of the waves. Tidal waves are fast and furious. Either you surf it or sink in it.
Many of these surfers are amateur opposition new kids on the bloc with the new found fame of Yang Berhormat. They try very hard to impress the undecided and uncertain people who had swung to the opposition in anger during the 2008 general election.

These YB’s must bear in mind that it takes more to continue winning the hearts and minds of the people than apple distribution in parliament house or bicycle paddling to the parliament entrance or constant holding of candle light in vigils and screaming “Saya YB, Saya YB” when apprehended by the law enforcement officers or even offering prayers to the ghost of unknown Ghengis Khan descendant who was blown to smithereens.

Many of these meaningless publicity stunts exhibited by these poor surfers are not only amusing but alarmingly annoying.

Internal squabbles aplenty, in short the Opposition’s value to people is fast descending to junk bond status.

While the surfers struggle at the high sea, close to shoreline the current Chief Architect surveys the damaged fortress and the coming of the tidal waves. Both he must confront and contain swiftly.

This Chief Architect is formidable, commanding an army of bureaucrat’s allegiance. His monumental fortitude sends uncluttered vibrations that he is determined to stay for more than one term as the commander in chief of the government of Malaysia.

The RAHMAN theory must die or UMNO will die. Die UMNO, this, the Chief Architect cannot and will not allow.

Najib Razak is a bangsawan pedigree. A Razak creation. Born and bred in the ways of leadership. As the son who enjoys the unseen goodwill left behind by the then chief architect of NEP in the 1970’s, he now enjoys the ancient cryptic command of the universe; the Vedas call it positive karma.

His reading of people’s anger is correct. He knows that he needs time to waft like gentle breeze to soothe the angry and humid emotion of the people. His weekly meet the people sessions is just about the right antidote in times like these. Just like his father.

His less than one hundred days in the seat of power shows that he is moving in the right direction.

Will Najib initiate the correct moves to dissolve the Perak State Legislative Assembly? Every thought is pointing to the inevitable. Dissolution of the Perak State Legislative Assembly is imminent.

Q: Why is it that ministers are only having KPIs now? Does this mean the government had no focus?

A: It's just that we have not used the methodology, KPIs and the balance-score card system in such a rigorous way. And we have not applied it to ministers and deputy ministers.

Q: The ministers have submitted the preliminary KPIs to the prime minister. Have they done a good job of it?

A: This is only the first round. For many ministers, and even for me, there is a learning curve.

Q: So, what's your KPIs?

A: I just submitted what was being used as preliminary KPIs, the number of incidents that have been reported to and recorded by the police. I said this was all that we had (as a yardstick).

But I have asked the Institute for Inter-Ethnic Relations of Universiti Kebangsaan Malaysia, headed by Professor Shamsul Bahrin, and his researchers to help me find out whether...

Q: If it takes a few cycles to fine-tune KPIs, how solid are these KPIs which were prepared in just six weeks?

A: Whatever that was submitted by the ministers are what we call preliminary KPIs. They are very preliminary, based on the KPIs for their own secretary-generals, but not solely based on them.

After the preliminaries, there will be a dialogue between my colleagues and I to fine-tune the KPIs with the help of experts. Then, the second round will be a discussion with the prime minister, to see whether the KPIs are realistic.

Then, we will implement it. The prime minister has set another deadline in November, which is when they have the first assessment. After Nov-ember, we will be going into KPI Version 2.0.

Q: That means the first assessment in November is not going to be an assessment on the ministers, but rather it is an assessment on the effectiveness of the KPIs?

A: Yes. There is a wide range of quantitative and qualitative aspects of performance, and of a different nature, too, from ministry to ministry.

Q: Besides setting a target for what is deemed to be a success, are ministries setting a target for what is deemed to be a failure?

A: I think there would a grading scale. For instance, if we set a target for getting a passport ready in three hours, would it be realistic to say that, if for some reason you deliver it within six hours instead, that it is a failure? No, I would still say that it is a success.

Q: How many hours would constitute failure?

A: That would depend on public perception. People want speed, but most are also reasonable. They ask for reasonable speed. If you tell people their documents will be ready the next day before 5pm, and you keep to that promise, they would be happy.

But, for those who need their passports urgently, special efforts will be made to get the passports ready in time.

Q: What are the KPIs for the home minister?

A: Each minister will probably have a few KPIs. But we would like the minister to identify what he thinks are the most important and relevant KPIs to the people.

Q: What is the role of Khazanah in all this?

A: Khazanah and Malaysia Airlines used KPIs to turn the airline around.

Q: Is a minister's performance going to be made public?

A: The public is going to be making their assessment anyway, with or without disclosure. But there are bound to be some headline KPIs.

Q: KPIs are supposed to make ministers more answerable than in the past. But, like the report card system previously, no one knows what the report card reads. Surely we shouldn't have to wait five years for the elections?

'Two LTTE leaders were killed as they marched to surrender'

London LTTE's political wing leaders B Nadesan and S Puleedevan were gunned down by the Sri Lankan army as they came out holding white flags to surrender, according to a media report.

Balasingham Nadesan was the head of the political wing of LTTE, while Seevaratnam Puleedevan was the chief of the Tigers' peace secretariat.

"For several days I had been the intermediary between the Tiger leadership and the United Nations as the Army pressed in on the last enclave at the end of a successful military campaign to defeat the rebellion," a Sunday Times correspondent wrote.

The correspondent quoted a Tamil, who was in a group that managed to escape the war zone, to describe what happened on the morning of May 18 when the two leaders were killed.

This source, who later spoke to an aid worker, said Nadesan and Puleedevan walked towards the Sri Lankan army lines with a white flag in a group of about a dozen men and women. He said the army started firing machine guns at them.

Nadesan's wife, a Sinhalese, yelled in Sinhala at the soldiers: "He is trying to surrender and you are shooting him." She was also shot down.

According to the source, who is now in hiding fearful for his life, all in the group were killed.

Thousands of people gathered at the Batu Caves temple this morning to protest against the Sri Lankan government despite a police warning against the rally.

sri lanka conflict protest in batu caves 240509 07The protest rally was to voice the opposition against the war crimes perpetuated by the Sri Lankan government against innocent Tamils in its ongoing war against the LTTE.

LTTE has been fighting for a separate Eelam state in the north of Sri Lanka. The war reached a boiling point earlier this week with the Sri Lankan government claiming victory with the killing of LTTE chief Velupillai Prabhakaran.

In the process, thousands of innocent victims, almost all of whom were Tamils, have been killed and about 100,000 made homeless.

The protest today was organised by the World Tamil Relief and the Coalition of NGOs movements.

sri lanka conflict protest in batu caves 240509 12Among those who attended the rally included MIC information chief and Deputy FT Minister M Saravanan, DAP's Teluk Intan parliamentarian M Manoharan, DAP's Ipoh Barat MP M Kulasegaran, PKR's Padang Serai MP N Gobalakrishnan and Batu Caves temple committee chairperson R Nadarajah.

Also present were DAP's Klang MP Charles Santiago and MIC Youth wing advisor S Vell Paari.

Yesterday the Selangor police urged the public not to join the protest as it was being held without a police permit.

State deputy police chief Jamshah Mustafa however said that people can go to Batu Caves to pray but "not for an illegal rally".

One of the organisers SP Pathi told Malaysiakini that they had originally expected some 15,000 people to participate today but conceded that the police warning would mean fewer people turning up.

Eyewitnesses said that a few hundred people had gathered by 10am. By noon the crowd size had swelled up to about 4,000. By the time the rally ended at about 1pm organisers said some 5,000 people had attended.

First to speak to the crowd was Nadarajah who said that he was pressured by some quarters not to allow for the rally to take place in the temple compound today.

"But I insisted on it being held in support for the Sri Lankan Tamils," he said to the loud approval of the crowd.

Saravanan also lauded the presence of so many politicians at the rally despite their political differences.

"I am proud that we can stand united here for our Sri Lankan Tamil brothers," he said.

He also lashed out at the Indian government, particularly the Tamil Nadu state government, for not doing anything to stop the attacks on civilians in Sri Lanka.

He also urged the Malaysian government not to support a draft resolution tabled by Sri Lanka at the United Nations calling for member nations not to interfere in the internal affairs of the country.

He said such a support for Sri Lanka would hurt the hearts of Malaysian Tamils.

Yesterday MIC president S Samy Vellu also similarly called on the government to retract its support for the draft resolution.

Manoharan meanwhile said that the Sri Lankan president Mahinda Rajapakse had committed war crimes by killing innocent Tamils in the country.

Gobalakrishnan also similarly condemned Rajapakse for "murdering innocent children and women".

He said that the spirit instilled by Prabhakaran would remain even if he was killed.

Kulasegaran urged the Malaysian government not to give any financial aide to Sri Lanka as it would seem like it was supporting the war crimes in that island state.

"The government of Malaysia is going to give RM3 million to Sri Lanka. We cannot allow that. I will raise this issue in the parliament," he said.

A donation campaign was also launched at the rally to collect funds for the Tamils in Sri Lanka.

The Batu Caves resolutions

Later at a press conference, several resolutions and immediate plans were revealed to assist the Tamils in Sri Lanka.

"We will form a peace team to be sent to Sri Lanka to help rebuild the lives of the war victims," said organising committee member K Arumugam.

Another resolution called for the lifting of all restrictions imposed on the international community to assess the full nature of the catastrophe that has struck the Tamils in Sri Lanka and offer immediate relief.

The protest group also wanted the formation of an independent Tamil state and until then the establishment of a UN peacekeeping force on the island to maintain peace.

"We also call upon the Malaysian government to recognise the plight of Sri Lankan Tamils and institute immediate measures to give assistance and financial support to the Tamils in Sri Lanka," they said.

They also wanted the government to withdraw its support for the Sri Lankan resolution in the UN.
