The NRD office rejects on the slightest technicality birth certificates for up to even the sixth generation Malaysian born Indians, which will destroy a child’s whole life by denying him or her all the facilities of health and education which is a right enshrined in the costitution.

On the pretext that the six children of Maruthayee not having witnesses, their applications for Birth Certificates were rejected right at the Counter of the National Registration Department (NRD) headquarters in Penang.

Section 5 of the Child Act specifically states:-

5 (1) The following persons shall be qualified to give information concerning a birth, that is to say:

Father of the child

Mother of the child

The occupier of the house in which the child was, to the knowledge of the occupier, born;

Any person present at the birth.

Any person having charge of the child; and

Any of the person having personal knowledge of the birth.

6 Registrar to record particulars

6 (2) A Registrar may before recording the birth or death, put questions to the informant to satisfy himself of the occurrence of the birth or death.

But this UMNO racist and religious supremacist regime arbitrarily and blatantly rejects the application of these six innocent children in direct contravention of Section 7 of the U.N Convention which provides the child shall be registered immediately after birth and shall have the right from birth to a name, the right to acquire a nationally and as far as possible, the right to know and be cared for by his or her parents. It is birth right.

States Parties shall ensure the implementation of these rights in accordance with their national law and their obligations under the relevant international instruments in this field, in particular where the child would otherwise be stateless.

The UMNO NRD officers are so gross especially when two of Maruthayee’s (mother) children have birth certificates. Plus the mother has a birth certificate and Identity Card. But the father is in jail because of some poverty related crime or no crime at all but is forced to plead guilty and serves jail sentence.

It is about time UMNO follows Article 14 of the Federal Constitution (citizenship by operation of law) and issue these six, and thousands of other Indian children their rightful and innate birth certificates.

Even for this innate birth certificates UMNO expects the poor Indians to beg them.
