Mat Zain Ibrahim says the AG had neglected in his duties in informing the severity of the Sulu invasion to the Agong and the Cabinet.
PETALING JAYA: Attorney-General Abdul Gani Patail was today slammed for not immediately reacting to the Sulu invasion in Sabah which led to deaths of 10 Malaysian security personnel.
Former KL CID chief Mat Zain Ibrahim today said Abdul Gani should have immediately advised the Yang Di-Pertuan Agong and Cabinet ministers on the legal aspects as stated in the constitution.
“If from the first day the AG had advised the Agong that the actions of more than 150 armed intruders can be classified under the law as waging a war against the Agong, then the latter would not have hesitated to command his troops to launch a suitable retaliation to save the country and himself,” Mat Zain said in an open letter to IGP Ismail Omar.
“The first information received on the invasion… is more than enough to erase all doubts that they were waging a war against the King and not for any other reason,” he added.
Mat Zain accused Abdul Gani of knowing that the intruders’ actions were against the constitution, but had deliberately refused to advise the Agong.
“Gani’s deliberate delay in advising the Agong and Cabinet is not only irresponsible, but can be classified as high treason,” Mat Zain said.
He claimed this was not the first time Abdul Gani had “hidden real facts from the Agong”, and said this was “becoming a norm” for the latter to not disclose information to the rakyat.
“Moreover, despite all the testimony on Abdul Gani, the prime minister (Najib Tun Razak) refuses to take action against him for reasons unknown,” he said.
“However, now that the intrusion has been classified as waging a war against the Agong, the PM has no choice but to advise the Agong to set up a tribunal to scrutinise Abdul Gani’s behaviour for failing to perform his duties as AG,” he added.
Uninformative statements
Mat Zain then blamed Abdul Gani for the deaths of the 10 Malaysian policemen and said their sacrifices could have been avoided if the former had reacted to the situation immediately.
He also blamed their deaths on uninformative statements issued by Home Minister Hishammuddin Hussein and Sabah chief minister Musa Aman on the invasion.
“Their decision to hide the real situation was deliberate and had led to the deaths of 10 of our men,” he said.
“(Their statements) would have affected the troop’s cautiousness and readiness to fight.”
Yesterday, a high-powered prosecution team led by Abdul Gani had put forward its case against several members of the detained Sulu armed group involved in the intrusion into Sabah.
Eight people from southern Philippines were charged in the makeshift court with engaging in terrorism and waging war against the Agong.

Ismail berkata anggota keselamatan telah menambah baik persiapan awal PRU13 dan kini bersedia untuk mengawal keselamatan sepanjang PRU.
“Orang ramai mempunyai peranan yang sangat penting, jadi mereka diminta bersikap rasional."
"Jangan bertindak seperti negara kita tiada undang-undang,” katanya.
Terdahulu beliau menerima sumbangan berjumlah RM354,782 daripada 10 penyumbang meliputi badan bukan kerajaan.
Sektor korporat antaranya Bank Islam, Adabi Consumer Industries serta Persatuan Polis Agama Buddha.
Sumbangan itu akan diagihkan kepada lima penerima iaitu Ibu Pejabat Polis (IPD) Tawau, Balai Polis Lahad Datu, Balai Polis Tungku Lahad Datu, Balai Polis Cenderawasih dan Komtek Felda Sahabat 16 Lahad Datu.

The Lahad Datu intrusion issue should not be politicised as it could jeopardise the deportation process of the group, said Home Minister Datuk Seri Hishammuddin Hussein.
He said there were just too many speculations on the issue and that most of them were baseless.
"We do not want to sensationalise the issue as it could jeopardise our operations,” Hishammuddin said.
“This is something everyone should understand, so avoid it being politicised, avoid it being used to scare the people here, because that is not the situation. We have always been on top of it from the beginning.”
He was commenting on rumours on social media which claimed that the group had now infiltrated Kota Kinabalu and that they are not retreating from Lahad Datu.
On whether action can be taken against those spreading the rumours, Hishammuddin said they may consider it, especially against those who spread false information which threatened the safety of the people.
He, however, hoped that many will realise not to trust these sources after the real facts are revealed.
"I hope the people can see how professional our enforcement teams are.
"If we want to take action, we could have done it on Day One. We are above this. In this sort of situation, we do not wish to see any one hurt for whatever reason.
"We want to avoid bloodshed. We want to ensure the safety of our security personnel and also that of the Filipinos in Lahad Datu. The international media may not realise this,” he said.
"No point to speculate on details because there are many conditions. Some maybe fulfilled, some may not. What is important is that this issue be settled amicably,” he said.
The armed intrusion tragedy in Lahad Datu, Sabah, may just be a blessing in disguise as it unites Malaysians and make them, including the opposition, realise the importance of having strong national defence- Defence Minister Ahmad Zahid Hamidi.
The deaths and injuries sustained by national security forces personnel in the tragedy, proved that it was not a drama staged by the government, and hence reduced the opposition’s attacks on national defence and security issues.
“I would like to thank all quarters for accepting the fact that national defence is not an issue that can be politicised.
“It seems that after the tragedy, even the opposition is not keen to question the ability of our police and military forces,” he told.
On matters concerning five former military officers who were reported to have politicised the tragedy in their bids to enter politics and gain political mileage, Ahmad Zahid said they really should not have done that.
“They still think they are smarter than the current leaders in the Armed Forces when in reality, they are corrupting the politicians’ minds,” he said.
On the action that could be taken against them, the minister said the people could simply reject these former military officers from being their representatives.
He said the government would not take any action against them under the Armed Forces Council regulations as the five former officers did not represent the voice of the rest of former military officers.
Meanwhile in SANDAKAN former prime minister Tun Dr Mahathir Mohamad said the country could handle the challenge posed by the incident because it had experience in facing guerrilla warfare.
He said the government had made the appropriate decision when it decided to beef up the country’s defense in the eastern region of Sabah.
The government had taken the incident as a lesson to protect the people from whatever threat, he said.
“We can use it as a lesson so that we can always provide protection to the people and ensure that the country continues to be stable and can develop rapidly,” he said.
Mahathir said the security forces had fought against the communist terrorists previously and had defeated them although the world community had said that the guerrillas could not be beaten.
Commenting on the action by individuals using the social media to question the action of the government in tackling the incident, he said the people were now wiser and better trained to master knowledge at the tertiary institutions.
Thus, he said, they were more mature in their thinking and the government should take into consideration the people’s maturity in political, economic and social matters.
