There has been no official request from Manila to deport Manuel K Amalilio, suspected of scamming 15,000 Filipinos of RM859 million.
KOTA KINABALU: Mohammad Kamal Said aka Manuel K Amalilio, the fugitive wanted by the Philippine authority was yesterday charged with possessing a Philippine passport and sentenced to two years’ jail by the Magistrate’s Court here.
Magistrate Nuruhuda Mohd Yusof imposed the sentence on Mohammad Kamal Sa’aid, 47, after he pleaded guilty to a charge framed under Section 12 (1) (d) of the Passport Act 1966 which is punishable by a maximum fine of RM10,000 or a jail term of up to two years or both, upon conviction.
The proceedings was held at a medical ward Queen Elizabeth Hospital One here, where the accused was admitted believed to be suffering a liver ailment.
The accused, who was defended by counsel Hairul Vaiyron Othman, was detained at Terminal Two of the Kota Kinabalu International on Jan 25, for committing the offence.
The charge stated that, Mohammad Kamal possessed the Philippine passport under the name of Amilillio Manuel Karingal bearing the numbers XX4025549 which he had obtained fraudulently.
The accused was ordered to serve his jail sentence from the date of his arrest on Jan 25 this year.
Prosecuting officer Inspector Azwal Azman told the court that the accused was arrested by a police team and among items seized were his MyKad as well as his Philippine passport.
He said investigation by the Commercial Crime Investigation Department confirmed that he is a Malaysian in possession of a Philippine passport without legal authority.
Pleading for a light sentence, his counsel submitted that his client had no criminal record.
Hairul also said that Mohammad Kamal had regretted what he had done and requested for an appropriate sentence to be imposed on him.
No official request to deport
In reply, Azwal applied for a deterrent sentence taking into account that this case had involved Malaysia and the Philippine.
The magistrate also ordered the passport to be surrendered to the Immigration Department following an application by the prosecution for further action.
Mohammad Kamal became infamous overnight following his arrest by the police.
He is accused of being the mastermind of an investment scheme and had fled to Sabah from the Philippines after allegedly cheating 15,000 Filipinos of nearly 12 billion pesos (RM895 million) last November.
State Police Commissioner Hamza Taib revealed that the police had detained the accused in Ranau over “identity issues” and not the investment scam in the Philippines.
There had been no official request by Manila police to Bukit Aman to arrest Mohammad Kamal so far, said Hamza.
In November last year, the Philippine police launched a manhunt for the accused, purportedly a Malaysian from Sabah who went by a different name in the Philippines.
The accused, who allegedly told Filipino investors that he was related to several senior Sabah politicians including Chief Minister Musa Aman, was said to have operated a pyramid investment scheme under a company called Aman Future Group Philippines Inc, promising returns of up to 67%.
The victims had used their savings, mortgaged homes and borrowed to invest in the scheme.
Among those who lost money in the scheme are senior Philippines government officers and including President Benigno Aquino’s sister Kris who was said to have invested 50 million pesos in it. A family of 25 members reportedly lost a total of 150 million pesos, while another investor claimed to have lost 31 million pesos.
Musa’s ‘distant relative’
Many affected Filipinos have also been coming to Sabah to look for Mohammad Kamal.
Musa has admitted that Mohammad Kamal is a “distant relative” but denied that he had interfered in the Filipino’s repatriation.
“I have a large family and I have just recently been informed that this individual is a distant relative,” he was reported as saying in a statement on Sunday, adding that he learned about Mohamad Kamal “through the news”.
“Let me make it very clear that the Sabah state government did not and will not intervene in this matter. This is a police and Interpol matter…
“Whether or not Amalilio (Mohamad Kamal) is a relative, the authorities should investigate the matter and take the necessary action. No one is above the law,” he said, while expressing hopes that Malaysian and Filipino authorities would cooperate to resolve the matter quickly.
The Philippines media reported its Interior Secretary Mar Roxas as accusing Musa of blocking the extradition Mohammad Kamal while Philippine Justice Secretary Leila de Lima said the accused was whisked away by the Malaysian authorities 10 minutes before he was to board a flight to the Philippines.

Lest complications arise in the government’s bid to have Manuel Amalilio deported to the country, the Department of Justice is ignoring reports that the man behind a P12-billion investment scam is related to Sabah’s chief minister.
Justice Secretary Leila de Lima insisted Amalilio, whose return from Malaysia was aborted at the last minute last month, was a Filipino and said she did “not want to be dwelling” on reports he was related to a top official of Sabah, where he had fled since last year to escape prosecution.
“I hope that you understand that my only mission, our only mission in so far as the Philippine authorities are concerned as directed by the President is to ensure the return of Mr. Amalilio here by whatever means legally possible and according to the principles of comity and reciprocity under international law because the Philippines and Malaysia are friendly nations,” she told reporters.
The justice secretary said her office would not want to be dragged into controversies that “might complicate” things.
She stressed the documents on Amalilio’s Filipino citizenship came from official sources and therefore, “there is a presumption of validity, of genuineness.”
De Lima also made it clear Amalilio’s nationality had never been an issue when authorities first coordinated for his deportation with their counterparts in Malaysia.
The justice secretary said that reports on Amalilio’s impending deportation had elicited the interest of some people. She did not elaborate.
“We assure the people that we are taking steps and efforts towards that end of making sure that he faces the bar of justice before the Philippine justice system,” she said.
Most of Amalilio’s co-accused in syndicated estafa cases filed in connection with the Aman pyramid scam are now in the custody of the National Bureau of Investigation.
Meanwhile, the panel of special prosecutors tasked to handle the Aman cases have started preliminary investigation hearings on complaints filed against Pagadian City Mayor Samuel Co. But Co and his lawyer did not show up in the first hearing on Jan. 30 held at the DOJ, according to Senior Assistant State Prosecutor Edna Valenzuela, who heads the special team of prosecutors.
Valenzuela said they have scheduled two more PI hearings on Feb. 7 and 13.

Rakyat perlu menilai antara Pemimpin yang bercakap berasaskan fakta dan pemimpin yang hanya tin kosong, nyaring bunyinya kerana tidak berisi apa-apa.

Any deportation needs to follow strict procedure, if there is no request for deportation, then the Philippine authority cannot take Amalilio from Sabah.
Besides, Manuel K Amalilio is wanted by the Malaysian authorities for using a fake identity.

Even though Amalilio has been sentenced to 2 years jail but the PKR still trying to play up this issue.
They would not let go of any shred of issues that could allow them to bring down Musa Aman.

The PKR only wanted to assume the worst of the government and the Chief Minister.
They are always looking for any issues to play up, to politicize and to gain publicity.
They failed to link Musa Aman to the RM40 million case now they wanted to use this case to bring him down.
Musa Aman had explained that he does not interfere with Amalilio's deportment. However the PKR still wanted to believe that he did.
Hamza Taib also said that the Philippines did not make any request for deportment therefore Amalilio cannot be deported that day.
Amalilio was arrested because he was found using a fake passport, it has nothing to do with the scamming case in his own country.

De Lima maintains: Amalilio is Filipino, not Malaysian
MANILA, Philippines—Justice Secretary Leila De Lima reiterated Wednesday that Aman Futures Group founder Manuel Amalilio is a Filipino and not a Malaysian, Radyo Inquirer 990AM reported.
Amalilio has a legitimate Philippine passport and birth certificate from the National Statistics Office, De Lima said.
She dismissed rumors that Amalilio is a Malaysian, saying this would not affect pending cases filed against the leader of the P12-billion investment scam.
But De Lima refused to comment on reports that Sabah Chief Minister Musa Aman is a relative of Amalilio and was the one who blocked the deportation of Amalilio from Malaysia.
Philippine Ambassador to Malaysia Eduardo Malaya has said that a Malaysian court ordered the imprisonment of Amalilio for two years for carrying a fake Philippine passport.
Bukankah sudah terbukti Amililio ni orang Malaysia, kenapa masa nak claim dia ni Filipino???
Harap perkara ini dapat ditanggani dengan segera demi kepentingan rakyat dan juga keselamatan antara Malaysia-Filipina.

Walaupun Kamal ini ada kaitan saudar adengan Datuk Musa, dia tetap kena hukum sebab langgar undang-undang. Ini terbukti, siapapun yang buat salah takkan dapat lari daripada hukuman.
Jadikan hal ini sebagai pengajaran dan yang lain tu jangan pula berangan-angan nak miliki passport negara lain.
Terbukti Musa hanya menjalankan tanggungjawabnya terhadap rakyat dan tidak menyalahgunakan kuasa sebagai CM untuk melepaskan Amililio daripada hukuman.
Selepas ini jangalah ada pihak yang cuba meragui keihklasan Musa membantu rakyat.
Kalau cukup bukti tidak musatahil si Amilio ini kena hantar ke Manila utk berdepan dengan kesalahan yang kononnya dia buat.
Tapi setakat ini belum ada lagi perkembangan lanjut mengenai perkara ini jadi kita terpaksalah tunggu apa tindakan pihak berkuasa dari Filipina pula.
Terpulanglaj kepada rakyat untuk menilai senario ini. Fikir secara matang dan bukannya dipengaruhi emosi.

He said the growing interest to invest in Sabah was due to its social, economic and political stability, important pull factors for any country.
"Nobody would want to visit your country, let alone invest, if they deem it politically unstable or there is social unrest. Fortunately, we in Sabah are blessed not only with natural wonders and a rich cultural heritage but also with hospitable people who value peace and harmony in spite of our religious and racial diversity," he said.
He said it was therefore important for peace loving citizens in Malaysia and Sabah included to uphold the spirit of unity, cooperation and consideration so as to continue the state's path to prosperity and progress.
