Sultan on fatwas: Don’t question what I have approved

The Sultan says every fatwa issued in Selangor carries his personal stamp of approval.

FMT

SHAH ALAM: Making a firm stand about fatwas issued in Selangor, Sultan Sharafuddin Idris Shah said no one had the right to question or criticise a fatwa as each had his prior personal and full consent.

“A fatwa is only issued in Selangor after it has obtained my full approval and consent,” he said.

He added, “I urge Muslims to refrain from being too quick about criticising fatwas that are issued without first comprehending it fully.”

The Sultan said he offered this advice in order to prevent any untoward conflicts among Muslims in regard to the administration of Islamic affairs in Selangor.

He added, “…this is to preserve the dignity of Islam and prevent the religion from being easily ridiculed or disputed by irresponsible parties.”

Reminding the people that a fatwa was only issued after receiving consensus from all who sat on the National Fatwa Council, the Sultan explained that the Mufti of Selangor worked with scholars and professionals who were experts on not only Islamic matters but legal affairs as well.

“They discuss (fatwas) and determine the law, taking into consideration all the laws of the Quran, the Hadith and other related material.”

He added that he did not want the peace, unity and development of the people to be destroyed by those who were fanatical simply because they were influenced by external elements that were extremist in nature.

He said this in response to Sisters in Islam having filed a judicial review against a fatwa issued against them, branding them as deviant.

'Why different practice now in naming Selangor MB?'

Constitutional expert Abdul Aziz Bari has asked why there is a departure in practice in the appointment of the new Selangor menteri besar, compared to past practices involving Umno or BN, when they had the majority support.

Abdul Aziz said the present system is a constitutional monarchy, adopted after the country's independence.

He said prior to 1948, the rulers had absolute discretion when they were not constitutional monarchs.

However, following independence when the country adopted the Reid Commission report, the notion of discretion on the part of the Agong, the rulers and the Yang di Pertua Negeri, must be seen in the light of parliamentary democracy, he asserted.

“When there is a majority (in the assembly) no discretion exists,” said Abdul Aziz.

“The palace has accepted whatever given to them by the majority party, in the days of Umno-BN. The same should apply to Pakatan now,” he emphasised, warning otherwise a challenge on the basis of Article 8 of the federal constitution may arise.

Majority rules

He added the law is clear that majority is the rule, and that convention if there is any, is inferior and subservient to the law.

In any case, the former law lecturer said in Malaysia it is law, and not convention that regulates matters.

“The law is what used to be convention in the United Kingdom but here in Malaysia it has become law by virtue of it being codified in the constitutional provisions,” he said.

“Those days when the sultan could vet and scrutinise the MB's suitability, qualifications and others, are no more. It is now the business of the legislature, namely the Parliament or state legislative assembly,” Abdul Aziz said, adding the law and practice in Malaysia does not approve what was done by the palace today.

Abdul Aziz asserted that even if the sultan does wrong, there is nothing that can be done about it as he cannot be brought to court unlike governors.

“But he will go down into the history books and may not be judged favourably,” he warned.

Murdered Estonian model’s boyfriend arrested, couple were charged with drug possession, say reports

The boyfriend of Estonian model Regina Soosalu, whose death in Pulau Rawa has attracted national
interest, has been detained by police to assist investigations.

The Star reported that 28-year-old Tunku Alang Reza Tunku Ibrahim, who has links to a member of a royal family, was picked up by police yesterday and remanded for seven days.

Johor CID chief Datuk Hasnan Hassan confirmed Tunku Alang Reza's arrest, which brings to seven the total number of people detained in connection with Soosalu's murder.

The Star also reported that Soosalu and Tunku Alang Reza had been involved in a drug case earlier this year and were charged in the Magistrate Court on May 12 with possession of 5.84g of cannabis.

The couple pleaded not guilty and were released after paying a total of RM7,000 in bail money.

Their lawyer Bustaman Menon Abdul Hamid Menon told The Star the case was still ongoing and was last mentioned on May 25.

All of the suspects who have been arrested so far in connection with the model's murder were believed to have been on Pulau Rawa when Soosalu's body was discovered on the beach on July 1.

The Star quoted sources as saying those arrested were a bartender, two boatmen, a resort manager and an acquaintance of Tunku Alang Reza.

The 28-year-old Tunku Alang Reza has been remanded for a week along with a friend known only as Augustine, 30, with the custody order obtained from the Kota Tinggi magistrate’s court yesterday morning.

Hasnan Hassan said the autopsy is still being carried out and samples have been taken for tests.

Soosalu was initially thought to have drowned but suspicious wounds on her body led to police reclassifying her death as murder.

An Estonian news website has linked a two-minute video clip made by Vision Studio entitled “Remembering Regina” in which the model speaks about her life and hopes in Malaysia.

The clip, which was published on July 8, carried the words “We remember not just that you are gone but your existence had given us memories too beautiful to forget”.

In the video, Soosalu talked about how warm Malaysia is since she was from a cold country and said she was unsure if she would continue living in Malaysia permanently.

According to the website, her family last spoke to her on June 27 and claimed that they were only told about her death on July 8.

Meanwhile, in another article, The Star reported that Tunku Alang Reza is an ardent surfer who enjoys water sports.

Sources close to him said he usually spends his time at Pulau Rawa and Mersing as his late father, Tunku Alang Ibrahim Tunku Muhammad Archibald, owned the Alang Resort on the island.

The Star reported that these places have been his playground since he was a boy.

Tunku Alang Reza is a grandson of Almarhum Tunku Muhammad Archibald Almarhum Tunku Temenggong Ahmad, the first cousin of former Johor ruler Sultan Iskandar Ibni Almarhum Sultan Ismail.

After Soosalu was found dead on the beach, Tunku Alang Reza was silent as sources said he was too distraught to talk about it.

However, on Tuesday, he wrote about his grief on Facebook, describing Soosalu’s death as “the worst tragedy of my life”.

He bemoaned the loss of Soosalu, saying: “Regina, my love has passed away on July 1, in the holy month of Ramadan. She is my love, my best friend and will continue to be my inspiration for the rest of my life.”

Tunku Alang Reza is the second of five siblings, including four boys.

He has a younger sister and all of them are in their 20s.

Police hold boyfriend of Estonian model found dead in Malaysia

(Malay Mail Online) – Tunku Alang Reza Tunku Ibrahim, 28, the boyfriend of Regina Soosalu, who was found dead on a resort island on July 1, has reported to police to be remanded into custody at the Kota Tinggi court in Johor Baru, Malaysia, on July 10. He will be held for a week in order to assist police in their murder investigation into Soosalu’s death.

Reporting to the police station and also detained together with Tunku Alang is an associate of his identified only as “Augustine”. The detention of the two men brings the total number of people held in connection to the suspected murder to seven.

Among the other five people in custody are a bartender, two boatmen, and a manager all from the resort on Rawa island where Regina Soosalu’s body was found. They were detained separately. The day she died, Soosalu was meant to check into the Alang Resort, located elsewhere on the island and owned by her boyfriend’s family.

According to The Star, Tunku Alang and Regina Soosalu were awaiting trial on drug possession charges related their arrest at Taman Century in Johor Baru on January 11. They are charged with possession of 5.84 grams of cannabis, to which they pleaded not guilty and posted bail of RM7,000 on May 12.

Regina Soosalu, a successful Estonian model in Malaysia, was found dead on a resort island last week. Previously assumed to be a case of drowning, police have now classified the case as murder after discovering wounds on the model’s body.

“Initially, the police investigated the case as a drowning incident. However, we classified it as a murder case after finding injuries on the body,” said Johor CID chief Datuk Hasnan Hassan in a press conference.

Soosalu, who lived in Kuala Lumpur, arrived on Pulau Rawa for a vacation on July 1, according to The Malay Mail. However, it remains unclear whether she had company.

Quoting an unnamed source, Malaysian newspaper The Star reported that the 30-year-old model was last spotted leaving her room for a walk near a jetty by hotel workers. Her body was found on a beach on the same day.

However, the model’s death was only publicised five days later when her boyfriend Tengku Alang Reza Ibrahim posted it on Facebook. In a status update that was later deleted, he wrote: “I am deeply saddened and totally heartbroken to confirm the worst tragedy of my life. Regina my love has passed away on July 1, in the holy month of Ramadan.”

The late announcement spurred shock and questions among Soosalu’s friends. One of them, who refused to be named, told the Malaysian Digest that they couldn’t understand why her death was made public until five days after her death.

Six people who were on the island on July 1 are now detained by police to assist investigation. The model’s boyfriend was not among the detainees.

Soosalu’s family was informed of the model’s death through the Estonian embassy in Beijing. Her stepfather and mother are expected to arrive in Malaysia today.

"Sultan Selangor pun macam anjing sial bodoh dengar cakap orang... allah milik orang kristian, islam melayu malaysia nak rampas konon, melayu anjing sial."

Switch in rest days may affect our revenue, say business owners in Johor

Despite Johor Menteri Besar Datuk Seri Mohamad Khaled Nordin’s confidence that the switch in the state's rest days to Friday and Saturday will not have a huge effect on the state's economy, commerce groups say otherwise.

The change in the state’s rest days to Friday and Saturday would inadvertently affect businesses, said these groups.

Moving away from the usual Saturday and Sunday observed by most companies locally and internationally would reduce business opportunities, they said.

“You will only have four business days to communicate with companies elsewhere and get things done,” said Tan Sri Lim Sing, vice-president of the Associated Chinese Chamber of Commerce and Industry of Malaysia (ACCCIM).

“So, of course, this won’t be good for business when states are working on different timetables.”

Earlier today, the Johor sultan declared that effective next year, the rest days would be reverted to Friday and Saturday. This turns the clock back to how things were prior to 1994, which was when former Johor menteri besar Tan Sri Muhyiddin Yassin had swtiched the rest days to Saturday and Sunday.

Mohamad Khaled said in Muar earlier today that the private sector had the option to either follow the state government or observe Saturday and Sunday as rest days.

He said those having Sunday as their rest day could still have dealings with the state government as Sunday would be a normal working day for state government employees.

"I don't think with current rapid technological development, a switch in weekends will have a huge effect on the state's economy,” he said.

Commerce groups, on the other hand, expressed concerns that with so much activity going on in the Iskandar region, businesses may lose out with fewer transaction days in a week.

"Iskandar Malaysia attracts major foreign investments and globally, Saturdays and Sundays are recognised as weekends,” said P. Sivakumar, president of Johor Indian Business Association.

He said Singapore, especially, has invested heavily in the project and the decision would not please Singaporean firms with business dealings across the straits.

Lim agreed that businesses with foreign entities in Johor’s crown jewel could suffer some repercussions.

“There are many overseas companies involved In Iskandar. Problems would likely arise when firms are not able to coordinate since most companies get the weekends off,” he said.

However, he said potential hurdles stemming from the switch in rest days could be overcome, given the flexible nature of businesses to adapt and persevere in tough business climates.

“People would eventually familiarise themselves and adapt to the new rest days,” Lim added. - November 23, 2013.

‘There is no monarchy system in Islam’

A religious teacher claims that the monarchy system is never part of Islam.

PETALING JAYA: An outspoken religious teacher courted controversy today by saying that the monarchy system has no Islamic roots, and thus it does not represent Islam.

“Monarchy does not exist in Islam; how come they (sultans) can be appointed as the head of religion (ketua agama Islam). This is wrong,” said Ustaz Wan Ji Wan Hussein in an interview with FMT.

“Prophet Muhammad himself never claimed such title (head of religion) but during the reign of Caliph Umar Al Khattab, he used the term Amirul Mukminin meaning ‘leader of the Muslims’, not the leader of Islam,” he added.

Wan Ji then explained that he had to voice out his concern over the matter as it was wrong in Islam for a Ruler to be appointed as the head of Islam.

“I am responsible to speak out over this matter. If they are not using the term ‘head of religion’ then I’ll not voice out my concern but they are using it and it is wrong,” he said.

The young preacher also said that the concept should be read through the historical context where it was first established by a man called Muawiyah after the death of the last Caliph Ali bin Abi Talib.

Wan Ji outlined the history by recalling that Muawiyah created the Umayyad dynasty which later led to the creation of Abbasiyah and Uthmaniyah dynasty.

“Muhammad once said before his passing, the first man who twisted my preaching came from the Umayyad clan. The prophet was referring to Muawiyah who turned the Islamic government run by the caliphs into a monarchy,” he said.

Wan Ji who graduated from two foreign Islamic schools from Pakistan and Egypt continued by saying that in Islam, to be selected to lead the community, one needs to be picked by qualification and not paternal linage.

“Islam does not teach you that way,” he said.

Adding to his thoughts, he also said that the Malay rulers should not solely rely on people’s money (which is paid by the government) as their source of income .

“That is unfair and un-Islamic,” he said.

The Malay rulers, by convention and in accordance with the federal and state constitutions, play the role of the guardian of the Islamic religion for their subjects. This has been in practice since the time Islam started in this country. The Sultans are also considered the protectors of the Malays.

Member of royalty jailed for assaulting national boxer

A member of a royal family was sentenced to four years' jail by a sessions court in Johor Baru today, along with two others, for seriously injuring national boxer Muhamad Farkhan Mohd Haron.

NONEJudge Zamri Bakar sentenced Tunku Nick Tazuddin Izwan Syah Tunku Qadir, 28, Alex Foo Hee Wee, 42, and Mohamad Arif Husin, 36, after finding them guilty of voluntarily causing hurt to Farkhan.

Tunku Nick, Foo and Mohamad Arif were found guilty of committing the offence under Section 325 of the Penal Code at No 44, Jalan Molek 3/2, Taman Molek, between 4.30am and 7am on May 6, 2012.

A person convicted of an offence under Section 325 can be jailed for a maximum of seven years.

Tunku Nick resides at Istana Bukit Kesenangan in Johor Bahru.

The judge also rejected their application for a stay of execution of the sentence pending appeal, resulting in Tunku Nick, Foo and Mohamad Arif to spend time in the lock-up.

DPP Dzul Iswari Mohd Jaafar prosecuted in the case, while the three were represented by Zamri Idrus, Norman Fernandez and Masri Mohammad.

Lawyer Gobind Singh Deo held a watching brief for the national boxer, who was also a SEA Games gold medallist.

Missed the London Olympics

On June 15 last year, Gobind gave given the Attorney-General's Chambers an ultimatum, demanding to know whether it would take action on the assault against Farkhan.

Farkhan, the 2009, Laos Sea Games gold medallist, is said to have been assaulted with wood, iron rods and a samurai sword by a member of the royal family and his friends on May 6, 2012, after which he lodged a police report.

The assault caused Farkhan to suffer a broken jaw and miss last year's London Olympics.

To make matters worse, Farkhan's father, Mohd Haron Ismail, who was disturbed by the attack, died of a heart attack several weeks after the incident.

After this, the prosecution charged Tunku Nick, Foo and Mohamad Arif for the attack.

Leong Pei Koe, 29, was also fined RM8,000 yesterday after he pleaded guilty to making the obscene hand gesture.

The quantity surveyor from Subang Jaya, Selangor, was a picture of remorse before he was sentenced by magistrate Muhamad Hidayat Wahab yesterday afternoon.

Speaking in English, Leong who had no lawyer, said he was sincerely sorry for what he had done.

He apologised to the Raja Permaisuri Agong, police and also the people of Malaysia.

"I promise that I will not do it again," he said in a choked voice.

Leong faced two charges of committing obscene acts in public.

GEORGE TOWN, Feb 12 – Police arrested a man believed to have flashing an obscene hand gesture to Raja Permaisuri Agong Tuanku Hajah Haminah in an incident at the Bayan Lepas International Airport here yesterday.

Barat Daya police chief Supt Hatta Md Zin said in the 12.30pm incident, the 29-year-old suspect was believed to have flashed the obscene hand gesture when the car carrying Tuanku Hajah Haminah passed by at the airport.

“It is learnt that the suspect’s father was sending the suspect to the airport and that they were having an argument. Maybe the suspect was angry with his father and made the obscene hand sign.

“Coincidentally, the car carrying Raja Permaisuri Agong passed by and one of the officials saw the suspect’s gesture and arrested him,” Hatta said when contacted here today.

He said the suspect had been remanded until Feb 14 to facilitate further investigation under Section 294 of the Penal Code which carries a maximum three months’ jail upon conviction.

Meanwhile, Penang branch of Kerabat Pusaka Merong Wangsa Association of Malaysia today lodged a report about the incident at the Barat Daya police headquarters here.

Its chairman, Azhar Abdul Majid, the act of flashing an obscene hand gesture to Raja Permaisuri Agong was indeed rude.

“We want the police investigate the incident and bring those involved to justice,” he said, adding that they also hoped that the police would take stern action against the suspect to prevent recurrence of the incident.

Johor sultan in limelight again over heritage issue

After the controversial bidding for the WWW 1 car number, the Johor sultan is back in the limelight with 30 individuals lodging a police report yesterday against a blogger for his articles on how the ruler dealt with the heritage of the late Johor sultan.

According to a Bernama report, the report was lodged at the Sentral police station in Johor Bahru yesterday against blogger Syed Abdullah Hussein Al-Attas, who is a paranormal practitioner.

NONEThe 30 claimed that the articles posted by Syed Abdullah in his blog, Uncleseekers contain provocation, sedition and insulting content against the Johor ruler Sultan Ibrahim Ibni Almarhum Sultan Iskandar (right), the crown prince, leaders and government servants of the  state government.

Khairil Azlishah Jalil, 32, a businessperson who represented the complainants, demanded that the blog be closed as it has published confidential documents.

"As Johor people, we are loyal to the Sultan Ibrahim as constitutional monarch. We are not happy with the allegations and sedition which can split the Johor people and (jeopardise) the harmony of the state.

"We do not represent any party or NGO. We found that the content in the blog is increasingly rampant, therefore we want the police to investigate," Bernama quotes Khairil as saying.

The blogger has to date published 60 articles in Malay on the topic of "Sultan Johor Atau Kerabatnya?" (Johor Sultan or his relatives?) including some documents that are said to expose the controversy surrounding the heritage of the late Sultan Iskandar ibni Almarhum Sultan Ismail.

Sultan Iskandar died in 2010 and was succeeded by his son, Sultan Ibrahim.

The articles also referred to a lawyer who had claimed that a member of the Johor palace has issued death threats against him.

The lawyer, Kamal Hisham Jaafar, who is alleged to have embezzled RM660,000 from a Johor-based company, has fled the country.

He has said that he could not return to answer the allegation for fear of his life, after having received five death threats since last year.

Johor Royalty linked to assault on rapper

(Malaysian Digest) - A Johor royalty by the name of Tengku Mishal Ibrahim has been implicated in connection to last week’s assault on a hip hop entertainer outside a night club.

The incident which happened last Thursday was tweeted by many sympathizers of victim Mikhael Adam Mohd Rafae (aka SonaOne), 24, with some claiming it was not the first time Tengku Mishal had been involved in violent acts.

Among those who took up to Twitter to implicate Tengku Mishal to the incident were siblings and Fly FM radio deejays Hafiz Hatim and Hani Farhana Hatim or better known as Hunny Madu.

“If u are wondering who that is on my profile pic. It's Mika @ItsSonaOne. Beaten up at roots at 4am by Tunku Mishal Sharin Tunku Ibrahim,” Hafiz tweeted on Saturday.

“Anyone has Tunku Mishal Sharin bin Tunku Ibrahim's phone number/address? He has crossed the line way too many times. Stop him bfo he kills.

“Get ur newspapers now. Get Tunku Mishal Shahrin away from our society. He who thinks he's king of the world shud live in a cage,” he added.

Meanwhile, his sister Hani tweeted: “A year ago, same dude assisted to bash Abe (Hafiz) up. Both happened at The Rootz (the nightclub). Thank you T.Mishal.”

“This is not the first time. @cowbear (Hafiz) was also the victim last year by his kuncu-kuncu (henchmen),” she added.

According to sources, Hafiz had also been a victim of Tengku Mishal’s alleged violent conduct last year.

Hafiz on Saturday had also enquired through Tengku Mahkota Johor Tunku Ismail Ibrahim on Tengku Mishal.

“kenalan Tuanku iaitu Tunku Mishal telah melakukan perkara yg melampaui batas. No one is above the law except GOD. Thnx.” Hafiz tweeted Tunku Ismail.

To which Tunku Ismail replied: “I know him. He is banned from Johor long time ago. I don't like the guy.”

“terima Kasih Tuanku. Last I heard he fled the country already. Ur time is very much appreciated. Wish us well,” said Hafiz in his reply to the Johor prince.

Hafiz also expressed concern over the likelihood that Tengku Mishal will get away with his latest alleged assault.

“his (Mikhael Adam) spirits are still up n hopefully everyone will help out when needed to coz wat the man in blue told us wasn't assuring.

“We are waiting the authorities to do SOMETHING.. But wait we shall while Mishal parties. Yday he was spotted at Lust, actions taken: Nada,” said Hafiz

He also said that “we gonna go loud” on the matter.

Hafiz could not be reached for comment when called on his cellphone by Malaysian Digest earlier.

Mikhael Adam sustained injuries on the head and face after he was assaulted in front of Lot 10 shopping complex in Jalan Bukit Bintang on early Friday morning.

In the 4am incident, Mikael Adam had got into a car with two women friends after work when he was approached by the suspect who pulled him out of the vehicle.

"I was punched repeatedly until I fell. I could only cover my head and face with my arms and hands to avoid from being more severely injured. Then, I lost consciousness after I was stomped on the head," he told reporters while being treated at a private hospital here.

Mikael Adam said he was taken to the hospital by a friend who was informed of the incident by his two women friends when he was unconscious.

He said his friend had lodged a police report on the incident at the Tun Razak Police Station not long after the assault.

Mikael Adam is a graffiti artist, music producer, songwriter, rapper and live performer who is under the Kartel Records label, headed by local hip-hop artiste Joe Flizzow.

Meanwhile, Dang Wangi police chief ACP Mohamed Zulkarnain Abdul Rahman confirmed receiving a report on the incident, saying an investigation was being carried out.
