Controversial carpet dealer Deepak
Jaikishian filed an application in the High Court in Kuala Lumpur today
to strike out the suit filed by the widow of the late private
investigator P Balasubramaniam.
This was confirmed to Malaysiakini by lawyer Americk Sidhu (right) who is appearing for the widow, A Santamil Selvi, and her three children.
The matter came-up for case management before deputy registrar Norfauzani Mohd Nordin today.
Santamil Selvi and the children filed the RM1.9 million suit
on June 11, alleging conspiracy by nine defendants they named for using
unlawful means or unlawful acts to cause injury or damage against them
and the late Balasubramaniam.
It was previously reported that Deepak had yet to be served with the
writ of suit, despite eight others, including Prime Minister Najib Abdul
Razak and his wife Rosmah Mansor, having been served the papers.
Besides Najib and Rosmah, the others named in the suit are two of
Najib's brothers Johari and Nazim, senior lawyer Cecil Abraham and his
lawyer son Sunil, commissioner of oaths Zainal Abidin Muhayat and lawyer
M Arunampalam.
Last month, all the eight named applied to strike out the suit filed by Santamil Selvi (left) and her children.
Today, Deepak and his lawyer, Gabriel Daniel, applied for extension of
time to file the necessary papers to strike out the application of
Santamil Selvi and her children.
Norfauzani fixed Aug 21 as the deadline for Deepak to file the application. She also fixed the same date for case management.
Americk said after getting all the necessary applications he will then
seek instructions from Santamil Selvi to respond to all of them.
At present, he said, all eight have already filed the application tom
strike out the suit and he wanted to respond to all the applications at
one go.
'Unlawful acts' caused family to go into exile
In their suit, Santamil Selvi and the children claimed that conspiracy
among the nine defendants resulted in them having to go into exile for
almost five years from July 2008.
This took place after Balasubramaniam was forced to retract his first
statutory declaration linking Najib with the murder of Mongolian woman
Altantuya Shaariibuu.
The widow and the children are claiming for loss and damages as a result
of being forcibly removed from Malaysia against their will on July 4,
2008.
They
claim they were threatened or induced by the defendants, who conspired
with one another against her husband and their family after
Balasubramaniam was forced to come up with the second statutory
declaration to deny the content of the first.
Balasubramaniam, or Bala as he was widely known, was hired by political analyst Abdul Razak Baginda (left), then a close confidante of Najib, who was then deputy prime minister, to stop Altantuya from disturbing him.
He was among the last to see Altantuya alive when he accosted her at
Razak's Bukit Damansara home and handed her to Chief Inspector Azilah
Hadri and Corporal Sirul Azhar Umar.
Azilah and Sirul were convicted of murdering Altantuya by the High Court
in Shah Alam, while Razak, who was named as an accomplice in the
murder, was acquitted without his defence being called.
However, the two Special Action Unit members were acquitted by the Court
of Appeal last year, while a decision on the prosecution's appeal
against the acquittal is pending before the Federal Court.
Besides this, the Advocates and Solicitors Disciplinary Board is
scheduled to hear proceedings against Cecil and Sunil on Aug 23 over
their alleged role in drafting Bala's second statutory declaration.
This follows the revelation
made by Americk at a special annual general meeting of the Malaysian
Bar last year that Cecil admitted his role in the second SD to him.
That
afternoon, Rosmah called Deepak regarding the SD matter and the
discussion got to Bala. Deepak told Rosmah what he had found out from
Suresh and she asked Deepak to try and help to resolve the attempt to
frame her husband with the murder case. Deepak told Rosmah he will speak
to Bala directly and get a true picture of the entire events and how
this thing can be resolved.

Deepak Jaikishan was called to the MACC office a few times. This is already public knowledge and is no secret. What is still a secret, though, is what did Deepak tell the MACC? Until today we have not been given the gist of Deepak’s statement. And what we are also not being told is why after more than a month still no action is being taken.
From what we know, based on the newspaper reports, Deepak’s first couple of visits to the MACC office came to naught. Deepak told the MACC that he was ‘not yet ready’ to give his statement and went home, promising to return another day. Finally, on 25th January 2013, Deepak gave his statement to the MACC. However, until now, no one knows what he told the MACC. Neither Deepak nor the MACC are talking.
We are still trying to get our hands on a copy of the MACC report, and there is a strong possibility that that may happen very soon. In the meantime, while we try to get our hands on that report, maybe we can share with you the gist of what, according to our Deep Throat, Deepak told the MACC. Let us see whether this part of Deepak’s story is going to appear in his ‘official statement’.
The only part that remains hazy is: did Bala contact Deepak or did Deepak contact Bala that resulted in the meeting in Rawang that same evening that the first SD was released? Both claim that ‘the other person’ initiated the meeting. Nevertheless, the rest of the story appears consistent -- except for the part that Bala was allegedly promised RM700,000 by M. Puravalen as payment for the first SD, which Bala has thus far never mentioned but which Deepak says did happen.

In October 2006, Bala was in Razak’s office at the time when they received a phone call from Puravalen (picture above). Puravalen said he had something very urgent to discuss with Razak concerning Altantuya. Razak then agreed to meet Puravalen who arrived not long after that.
Puravalen told Razak that the police were about to arrest him (Razak) for the murder of Altantuya. Razak suddenly went pale and started to panic.
Puravalen told Razak not to worry and that he will handle this matter provided that he (Razak) agreed that he (Puravalen) will act for him as his lawyer. Later Razak’s family found out that Puravalen was actually linked to Kalimullah and was feeding information to the ‘other side’ (Karpal Singh included) through Kalimullah. Razak’s family suspected that Puravalen, who is very close to Sivarasa, was trying to fix up Razak so they decided to sack Puravalen and replace him with Shafee Abdullah.
In July 2008, Puravalen was the one who introduced Bala to Sivarasa and Americk. Sivarasa then arranged for Bala to meet DSAI to discuss signing a SD to directly implicate Najib and Rosmah to Altantuya’s murder. Bala met DSAI twice, the first time a few days before the SD was signed and the second time on the SD day itself wherein he sat beside DSAI and gave his PC flanked by his lawyer.
The first time Puravalen brought Bala to meet DSAI, he was promised RM700,000.00 if he agreed to come up with the SD by 1st July 2008. DSAI had agreed to pay the RM700,000.00 through Puravalen and the payment was to be made in two stages -- Part A, RM200,000.00, immediately and Part B, RM500,000.00, after the PC. On 1st July 2008, Bala made the SD and proceeded to conduct the PC on 3rd July 2008, organised by DSAI and his lawyers at the PKR HQ.
Unfortunately for Bala, after the PC, Puravalen only paid him RM100,000.00 although he had received RM200,000.00 from DSAI. Puravalen told Bala that DSAI had instructed for the balance to be paid after a few days. The balance RM500,000 Puravalen pocketed all to himself without Bala knowing. This angered Bala and he tried to contact DSAI through his lawyer, Americk, and other people he knew in PKR such as Sivarasa. But DSAI never responded at all to him because DSAI believed that Bala was fully paid.
At the same time, Bala started getting calls from the Brickfields Police Station and he became worried that the police will lock him up again like the last time during the Altantuya case. He started to panic as DSAI was not responding to him and the lawyer had just cheated him of his only income to enable him and his family to leave Malaysia. Bala doesn’t know that Puravalen cheated him.
Bala, the next day after waiting for DSAI or his lawyer to call him, realised that he had been cheated of his promised money by DSAI and the lawyers. He then contacted Deepak through a mutual friend, Suresh, and asked to meet Deepak so that he could relate what had happened. Deepak informed Suresh that he will first discuss this matter with Rosmah and get back to him ASAP.
That afternoon, Rosmah called Deepak regarding the SD matter and the discussion got to Bala. Deepak told Rosmah what he had found out from Suresh and she asked Deepak to try and help to resolve the attempt to frame her husband with the murder case. Deepak told Rosmah he will speak to Bala directly and get a true picture of the entire events and how this thing can be resolved. Deepak spoke to Bala on the phone number given by Suresh and asked him if he was prepared to tell the truth of about SD conspiracy, which was now being exploited as a political asset by Najib’s competitors.
However, Bala was reluctant to do so as he said he didn’t want to trust any politicians as DSAI had cheated him on the amount of money promised and at the same time he was worried that Najib’s people were going to get him arrested again like during the Razak Baginda case. Deepak told Bala don’t worry because if he was willing to tell the truth he will be protected and will not be harassed by the police. He can get this assurance.
After a long chat, Bala was still unconvinced and told Deepak he will call back later. Deepak then called Rosmah and reported the entire conversation to her. She then told Deepak to come to the Putrajaya house and meet her husband to explain all the matters. Deepak went to Putrajaya, Sri Satria, and met Najib and Rosmah on the first floor lounge and detailed his conversation with Bala. Najib asked Deepak to convey to Bala that it was important that he speak the truth and tell about RM700,000 promise by DSAI.
The reason DSAI had asked Bala to make the SD was because to stop Najib from taking over PM post from Pak Lah and DSAI informed Bala that he needed Najib and Rosmah to be directly implicated. The timing was perfect and DSAI wanted this whole thing to implicate Najib and Rosmah to prevent him from becoming PM and thus allowing him to succeed with his September 16th plan to get the MPs in Sabah to defect so that he could become PM as they were demoralised at that time under PM Badawi’s administration.
Deepak met Bala in Rawang at about 9pm and they had a long discussion about the entire affair involving the SD and his experience during the time he was employed by Razak Baginda. The next day Bala signed his second SD to contradict the first SD that he had signed.
Private investigator P. Balasubramanian’s interview in Singapore
Deepak Jaikishan said he would approach P Balasubramaniam in the next few days over drinks to discuss the matter of the statutory declaration.
PETALING JAYA: Businessman Deepak Jaikishan today did not rule out the idea of collaborating with former private investigator P Balasubramaniam to reveal “the truth” behind the 2006 murder of Mongolian translator Altantuya Shaariibuu.
“It’s a bit too soon for me to say [if we shall collaborate], but we are definitely on the same team. We both want justice. He is a very brave man, and I pray that his endeavours are successful,” Deepak told FMT when contacted today.
He said he would approach Bala, as he is popularly known, for a chat over drinks in the next few days.
“We have a common goal, which is that justice prevails. It’s not easy, what we are doing, as we are accusing higher authorities of committing a criminal act,” said Deepak.
When asked whether he would also call Bala as a witness for his defamation suit against Prime Minister Najib Tun Razak, Deepak said “yes”.
“Yes. It had never occurred to me before this, but now that you asked, yes, we definitely would like him to come as a witness to the suit,” said the carpet dealer.
Last night, Bala returned to Malaysia after almost five years of having mysteriously fled the country.
Upon his arrival at the airport, he immediately swore that the first statutory declaration (SD) he made in 2008, which implicated Najib in Altantuya’s murder, was the truth.
He claimed that “circumstances” had forced him to retract the allegations made in the first SD, and he would reveal the whole truth “inch by inch”.
Deepak had previously told the media that it was he who persuaded Bala to reverse the first SD, as a favour for Rosmah Mansor, Deepak’s close associate once and the wife of the prime minister.
But despite Deepak’s role in the affair, Bala told reporters last night that he would not actively seek collaboration with the businessman.
“[But] if he [Deepak] comes forward and wants to work with me, I am okay with it. But I won’t go looking for him,” Bala said.
Meanwhile, in a press statement today, Deepak said: “I urge PI Bala to divulge the names of the people involved and why it is that only employees of Najib and Rosmah were involved and on whose orders and ‘main reason’ did they commit this heinous crime on a pregnant Mongolian woman.”
“I also urge our former inspector-general of police [Musa Hassan] to confirm that Najib had called him and interfered in this murder investigation at that time…
“Bala has my complete support and prayers and I hope that the spirit of Altantuya can ‘rest in peace’ once the ‘real murderers’ are found guilty.”
Carpet trader Deepak Jaikishan has today filed a defamation suit
against Prime Minister Najib Abdul Razak for his comments and claims
that the businessperson “is not credible”.
The suit was filed at the Kuala Lumpur High Court registry this afternoon through law firm M/s Daim & Gamany.
Deepak claims the prime minister had uttered the defamatory words at a press conference last month, after chairing a BN meeting. The trader cited areport in Malaysiakini titled PM dismisses Deepak's allegations as 'not true', in which Deepak said Najib painted a discrediting picture and tarnished his reputation during the press conference.
The
statement made by Najib reflected Deepak as not having a good
reputation, being a liar and a person who could not be trusted, having
low morals, and who does not deserve to have any professional relations.
Deepak is seeking for general, aggravated, and exemplary damages. He claims that Najib had maliciously questioned his credibility.
The
crux of the carpet trader's suit is over Najib's statement, and
Deepak's role in helping former private investigator P Balasubramaniam
to retract his first statutory declaration related to Najib's alleged
involvement in the Altantuya Shaariibuu murder, for political analyst
Abdul Razak Baginda had been charged with abetting and acquitted.
The
suit comes just before Parliament is to be dissolved for the 13th
general elected. If Najib does not move to dissolve Parliament by April
28, it will dissolve automatically on that date to pave the way for the
election.
Lawyers Sivarasa Rasiah and Afiq M Noor were present when the suit was filed. 'Second SD drafted by Cecil and son'
Deepak
in his statement of claim says he was asked to play a role in the
retraction of Balasubramaniam's first statutory declaration (SD) dated
July 1, 2008.
The statement says that on the evening of July 3,
2008, Deepak received a call from Rosmah Mansor (Najib's wife), asking
him to resolve a problem arising from the first SD, which refers to
Najib's alleged links with the Mongolian translator Altantuya.
“I
was asked to go to their official residence in Sri Satria to discuss
with Najib. I informed Najib that Balasubramaniam does not want to meet
with me and that the first SD is the truth.”
During the meeting, Najib contacted his lawyer and younger brother Nazim (left)
to discuss ways so that Balasubramaniam would retract the first SD.
Deepak contacted Balasubramaniam and relayed the private investigator's
intention to meet Najib or Rosmah should they want him to withdraw the
first SD.
However, Deepak claims, after discussions with Najib and Rosmah, it was suggested that Nazim would meet with Balasubramaniam.
Between 11pm and midnight on July 4, Deepak, Balasubramaniam and Nazim met at The Curve in Damansara.
“During
the discussion, Nazim asked Balasubramaniam to make the second SD,
denying the allegations made in the first SD in return for money,
protection and to leave the country.
“The second SD was prepared
by senior lawyer Cecil Abraham and his son Sunil Abraham from Zul
Rafique & Partners on Najib's instructions. Balasubramaniam signed
the second SD on the morning of July 4 before a commissioner of oaths,”
Deepak adds in his statement of claim.
He further claimed that Cecil and Sunil refused to attend the press conference by Balasubramaniam (right) on his second SD. Another lawyer by the name of Arulampalam accompanied Balasubramaniam during the media meet.
Deepak
claimed he acted as directed by Rosmah and expressed regret for taking
part in the conspiracy to help Najib and Rosmah in the preparation of
the second SD.
What he related in his statement of claim, he adds, is the truth and he would prove it on his day in court.
Commenting
on the filing of his suit later, Deepak said he has promised to give
the entire amount of damages he could get if he wins the defamation suit
to Altantuya's children and family.
Cecil Abraham has previously refused to comment on the allegations made against him by Deepak.
Carpet trader Deepak Jaikishian says he has not decided whether to meet
with former private investigator P Balasubramaniam, who intends to
return to Malaysia on Sunday and remain here permanently.
Deepak said he does not plan to meet Balasubramaniam at the KL International Airport when he arrives.
"Not at the moment. I have not thought of meeting him.
"Welcome
home, Bala, hopefully now the couple who ordered the murder of
Altantuya Shaariibuu will instead run away to Sulawesi," he said in
jest, in a text message sent to this writer.
Deepak played a role in getting Balasubramaniam to come out with a second statutory declaration
(SD) to undo his first one, in which Balasubramaniam claimed Prime
Minister Najib Abdul Razak had a role in the murder of the Mongolian
translator.
The first SD,
which was was issued in 2008, states that Najib had links with
Altantuya in 2006, when he was deputy prime minister and defence
minister.
Balasubramaniam also claimed that the then
inspector-general of police Musa Hassan told Najib that he (Musa) would
help 'to take care' of the murder case in which political analyst Abdul
Razak Baginda, - who had hired Balasubramaniam - was implicated.
A day after making his first SD, the former private investigator
retracted it and made the second SD, which Balasubramaniam later said
was made under duress.
Last August, Balasubramaniam returned to
Malaysia and since then, there have been some significant developments
regarding the SDs following Deepak's fallout with Najib.
Deepak then named a well-known "Tan Sri" lawyer and his son as being involved in the drafting of the second SD.
Boustead
Holdings Bhd's acquisition of Deepak Jaikishan's Astacanggih Sdn Bhd
included a clause prohibiting Deepak from speaking about the deal
without Boustead's permission.
This was divulged by PKR
strategy director Rafizi Ramli today, after he scrutinised several of
Boustead's documents that he viewed as a minority shareholder in the
company.
"The agreement specifies that Deepak cannot make any
statement without the (permission) of Boustead, which verifies my claim
that the deal was to shut Deepak up," Rafizi told a press conference in
Petaling Jaya today.
Previously Rafizi had alleged that the
wholly-owned Boustead subsidiary Bakti Wira Sdb Bhd's purchase of
Astacanggih was a means to silence Deepak over his revelations about the
deal, the alleged complicity of Raja Ropiaah in "cheating" him.
It
was also to silence him on the purported involvement of Premier Najib
Abdul Razak and family members in corruption, and a cover up linked to
the murder of Mongolian national Altantuya Shaariibuu. Malaysiakini is attempting to reach Boustead for its comments.
Ready to go to court Rafizi
also today declared he has no intention of answering the letter of
demand sent to him by Defence Minister Ahmad Zahid Hamidi over his
allegations on the Boustead deal.
Indeed he is challenging the
minister to take him to court so that he can let loose the arsenal of
information he has pooled with regards to the deal.
He
believes it will lead to an indictment of Zahid for negligence at least,
and at most, for failing to look after funds for military veterans and
servicemen, which are currently heavily invested in Boustead via fund
manager LTAT.
"I am more than ready and quite eager to meet him
in court. He should ask his lawyer to quickly file a summons against
me," quipped Rafizi.
Rafizi had alleged that Zahid has failed to
watch over the LTAT funds invested in Boustead by allowing the deal to
go through. The defense ministry through LTAT controls 60 percent of
Boustead with numerous seats on the board.
Other
than the RM130 million payment to Awan Megah Sdn Bhd, owned by Selangor
Wanita Umno chief Raja Ropiaah Raja Abdullah, Boustead Holdings Bhd has
more goodies for the company that it did not reveal to Bursa Malaysia,
PKR says.
“This is durian runtuh (a windfall) for Raja Ropiaah... After reading this I wish I was her,” PKR director of strategy Rafizi Ramli said today.
Speaking at a press conference at party headquarters in Petaling Jaya, Rafizi (left)
revealed that he found this out after given access to two agreements,
one a land development deal between Raja Ropiaah’s Awan Megah,
Boustead’s wholly-owned subsidiary Bakti Wira Sdn Bhd and Astacanggih
Sdn Bhd, which is owned by controversial carpet trader Deepak Jaikishan;
and the second, an agreement to buy out Astacanggih from Deepak.
Rafizi
went through the documents at the Boustead headquarters in Kuala Lumpur
this morning, in his capacity as a minority shareholder.
The extra perks accorded to Awan Megah in the agreements described by Rafizi are:
An
RM15 million contract given to Awan Megah by the Defence Ministry last
June, despite its seven-year failure to deliver the construction of the
National Defence Institute or Puspahanas.
Awan Megah will retain 23.2 acres of land in Shah Alam that is worth millions of ringgit.
Boustead advanced RM4 million to Raja Ropiaah to buy a 20 percent stake in Astacanggih.
The
agreement specifies that Bakti Wira will undertake to pay all debts
incurred by Awan Megah to GuppyUnip Sdn Bhd, so that GuppyUnip will
agree to terminate its joint-venture agreement with Awan Megah.
All
these additional perks, Rafizi said, are being given freely to the
company owned by the Selangor Wanita Umno chief, as if they are a
windfall.
Asked if the documents specify any reciprocation of like
value on Awan Megah’s behalf, Rafizi said that he does not see that in
the documentation, adding further that unlike most standard contract
involving land transfers, it was strange that this deal does not require
neither Awan Megah nor Astacanggih to ensure the over 200 acres of land
be transferred to Bakti Wira which is footing the bill for all of the
payments in the deal. Rafizi added that he will be
bringing his findings, which covered over 12 pages of notes he took down
while perusing the contracts, to the PKR political bureau meeting this
evening to consult with the party leadership and representatives from
the Pakatan-controlled Selangor government and decide what to follow up
on. Confident he can mount legal challenge
Labelling
his findings “juicy” and “scandalous” Rafizi said that he is confident
he can mount a legal challenge to declare the contract null and void as
the current situation around the deal may have violated conditions set
in the contract.
He said some of these included areas under the
purview of the Selangor government pertaining to land status and
transfer of ownership.
Malaysiakini is attempting to reach Boustead for its comments. The
tripartite land deal first took the limelight when Deepak became miffed
with Raja Ropiaah for allegedly “cheating” him and came to the media to
start his one-man crusade against the Selangor Wanita Umno chief and
the family of Prime Minister Mohd Najib Abdul Razak, whom he has linked
to various allegedly corrupt deals and a cover up linked to the deal of
Mongolian national Altantuya Shaariibuu.
The deal began to catch
criticisms from another front after it was alleged by PKR that funds
from contributions of veterans and serving military servicemen are being
used by Boustead to bail out and give a windfall to Raja Ropiaah and
pay off Deepak.
Boustead is 60 percent owned by military servicemen’s fund LTAT, hence the link that lead to the allegations.
In an exclusive interview with FMT, Deepak Jaikishan reveals the alleged dark side of the prime minister's wife and makes a series of startling allegations.
PETALING JAYA: Bizzare black magic rituals and an insatiable appetite for wealth. These were some of the revelations of Deepak Jaiskishan about Rosmah Mansor, a woman he claims has no conscience.
According to her one-time confidant, the prime minister’s wife has allegedly cast spells on numerous people, including her husband, former premier Abdullah Ahmad Badawi and the latter’s son-in-law Khairy Jamaluddin.
Deepak claimed that Rosmah would go to the extreme in order to achieve her ambition, which is to be richer than the Sultan of Brunei.
“She indulges in bizzare witchcraft rituals that no religion in the world will accept,” he told FMT in an exclusive interview here.
When Abdullah delayed naming Najib Tun Razak as his successor, Deepak claimed that Rosmah turned to the black arts for help.
“Abdullah and his family went through a tough time, no thanks to Rosmah’s witchcraft. Almost the entire Cabinet is under her spell,” he alleged.
However, Deepak said that Rosmah, whom he termed as the country’s “prime minister”, could not put a spell on former premier Dr Mahathir Mohamad because the latter has his own protection.
“She tried something but it didn’t work. Maybe he is protected in some ways.
“You see, it’s not like you can simply put a spell on someone. It only works if the person is weak in some ways. For example, it works if the person is not spiritual,” he added.
Deepak said that Rosmah employed the services of shamans from Kelantan, Terengganu and even India.
‘Amassed a wealth of RM30 billion’
In another startling allegation, the carpet dealer also claimed that Najib and Rosmah have accumulated a fortune amounting to about RM30 billion since taking over the reins in 2009.
He also confirmed the allegations regarding Rosmah’s penchant for expensive handbags and jewellery, saying that he personally arranged the purchase of valuables amounting to about RM300 million over the past five to six years.
“That’s only from me, you should ask the others…,” he added with a smirk.
The carpet dealer also revealed how Rosmah used him to keep tabs on projects that were being awarded by her husband.
“She will inform her people in the ministry to hand me information pertaining to the contracts, which I will then deliver to her,” he said.
Deepak added that some of the deals brokered by Rosmah would be executed without Najib’s knowledge.
“The value mentioned to Najib will be different from what Rosmah has planned. We used to communicate in codes so that Najib won’t understand.
“So when she telephones me and speaks in a certain way, I will know that Najib is next to her and I will know how to handle the matter,” he said.
Deepak revealed that he has become acquainted with Rosmah when she wanted to purchase carpets, and then over time, the bond grew stronger.
Asked what he received in return, he said: “Contracts! I received several contracts worth millions.”
However, Deepak refused to reveal what soured the ties, saying that it was a complicated matter.
“The gist of it… money and betrayal of promises,” he said when pressed further. “I was betrayed and I don’t handle betrayal very well,” he added.
Deepak also denied that he is backed by politicians and dismissed the speculation that he is spilling the beans on the instructions of Deputy Prime Minister Muhyiddin Yassin.
Commenting on the Altantuya Shaariibuu episode, he claimed that Najib knew the slain Mongolian national and he believes that a photograph of the two does exist.
“If you think about the choice of words Najib uttered when swearing on the Quran, he said that he didn’t know the ‘Mongolian woman’ but did not specifically mention Altantuya,” he added.
Meanwhile, Deepak said that more details on Rosmah’s black magic endeavours would be revealed in his second book, titled “The Black Magic Woman”, scheduled to be launched tomorrow.
He would also file a RM3 billion suit against, Najib, Rosmah and the Malaysian government next week for the business losses he suffered over the last few years.
“I will also file a separate defamation suit for RM100 million against Najib for describing me as not credible instead of denying the allegations,” he added.
In an open letter to Dr Mahathir Mohamad, the carpet dealer is asking the former premier to call on Najib Tun Razak to quit and allow his deputy to take over.
PETALING JAYA: Who is behind Deepak Jaikishan? This has been the burning question since the carpet dealer decided to spill the beans on Prime Minister Najib Tun Razak and his wife Rosmah Mansor.
Speculations abound, with some claiming that he is working for the opposition while there are also those who believe that he is linked to Deputy Prime Minister Muhyiddin Yassin.
Deepak, however, claims that he is acting on his own in order to protect the dignity of the nation.
But in an open letter to former premier Dr Mahathir Mohamad, the carpet dealer’s remarks have strengthened the suspicion that Muhyiddin is pulling the strings.
In the letter, Deepak expressed his disappointment with Mahathir’s statement that Najib should ignore the allegations levelled against him.
Pointing out that Mahathir himself has described Najib as a weak leader, Deepak called on the former premier to urge Najib to resign before the 13th general election.
“I’m just concerned that there might be chaos after the 13th general election.
“So it’s best for deputy prime minister (Muhyiddin) to lead a rejuvenated Barisan Nasional for the general election,” he added.
Deepak also denied having links with the opposition and described himself as a nationalist just like Mahathir.
“We are both defending the nation’s dignity. Mahathir may think that I’m working for the opposition but it’s not true. I’m a nationalist and we will never allow anyone to compromise our nation’s dignity,” he said.
Deepak also said that he chose to speak to the media about Najib and Rosmah because he had exhausted all other avenues to get justice.
“In the last two years, I approached the courts to get justice on several business dealings that went sour, involving Najib’s family.
“Although the courts ruled in my favour, the government agencies ignored them and swept Rosmah Mansor’s dirt under the carpet. So what else do you want me to do?” he asked.
Last week, Mahathir said that Najib should ignore Deepak’s expose.
“When I was prime minister, many accused me of corruption… I don’t have to respond. Up to the people, If people want to believe him, what to do,” he had said.
Deepak has claimed to being instrumental in getting private investigator P Balasubramaniam to retract his first statutory declaration which implicated Najib and Rosmah in the death of Mongolian translator, Altantuya Shaariibuu.
Najib, however, dismissed the accusations by saying Deepak is not a reliable person.
Controversial
carpet trader Deepak Jaikishan is seeking immunity from prosecution in
exchange for more information regarding the Prime Minister Najib Abdul
Razak’s alleged “misappropriation of power and corruption”.
Deepak made the appeal in a letter which was handed over to the attorney-general in Putrajaya at 12pm today.
In
the letter, Deepak expressed his willingness to provide the relevant
authorities with more information pertaining to the alleged misuse of
power by the country’s top-most leader.
“I am ready to cooperate
with whichever enforcement agencies, to provide more information on the
prime minister’s (alleged) involvement in the misappropriation of power
concerning his family, on the condition that I am accorded protection
from any criminal prosecution and issued a certificate of immunity,” he
stated in the letter.
Accompanying him to deliver the letter today was PAS vice-president Mahfuz Omar.
Speaking to Malaysiakini, he said the letter was received by Abdul Ghani’s representative, who he only knows as Haji Nasaruddin.
Deepak
said he is giving the attorney-general till March 11, which happens to
be the businessperson’s birthday, to respond to the request.
Deepak had previously claimed to have been the middle man involved in getting private investigator P Balasubramaniam to make a second statutory declaration (SD), which reversed an earlier one linking Najib to murdered Mongolian national Altantuya Shaariibuu.
This revelation was followed by several other allegations concerning the premier, all of which were denied by Najib and dismissed as unfounded and not credicle.
Tun Dr Mahathir Mohamad's suggestion yesterday to ignore all Deepak Jaikishan's allegations has stirred the hornet's nest as the controversial carpet dealer today promised more revelations in his second book.
Titled "Black Rose 2.0: Black Magic Women", the 47-page book will discuss rituals used in the country"s administration.
"i will be launching my 2nd book BLACK ROSE 2.0 'BLACK MAGIC WOMEN' where d names, photos, address, payments made & rituals ... will be published in this 47page book," Deepak (picture) announced in a text message here.
Early last month, the launch of Deepak's first 26-page book "Black Rose 1.0" was derailed after PKR's Rafizi Ramli made his revelation alleging Deepak's involvement as a jewellery middleman for a local dignitary.
Yesterday, Dr Mahathir had advised Prime Minister Datuk Seri Najib Razak to not entertain any accusations put forward by Deepak.
The longest-serving prime minister said that Najib should expect various allegations to surface while holding a political post, drawing parallels to his time in administration.
Deepak has been in the limelight of late, lobbing repeated accusations against Najib and Umno leaders, and has promised to dish more dirt on other scandals linked to other politicians.
On Wednesday, Deepak had announced that he will seek immunity under the Witness Protection Act 2009 before exposing further alleged power abuse involving the country's top leadership.
PAS vice-president Datuk Mahfuz Omar had promised to look into the carpet dealer’s request for protection after Deepak claimed he had been a victim of government intimidation.
The carpet dealer had recently admitted that he helped private investigator P. Balasubramaniam repudiate the latter's earlier statutory declaration on the 2006 murder, including finding two lawyers to draft the new statement.
A cloud of mystery has hung over the identity of the lawyer who drew up Balasubramaniam's second SD, dated a day after his first on July 3, 2008, regarding Altantuya's 2006 murder, for which two elite police commandos have been convicted and are facing death sentences.
Deepak's first book claims to tell the true story behind Balasubramaniam's second statutory declaration (SD), and can be found online for free.
The former close associate of Rosmah once again wants the prime minister and his wife to come clean on the many accusations he had hurled against them.
PETALING JAYA: Carpet dealer Deepak Jaikishan today once again urged Prime Minister Najib Tun Razak and his wife Rosmah Mansor to reveal publicly their alleged links with Mongolian national Altantuya Shaariibuu.
“Will Najib, Rosmah and others come to the court as witnesses if subpoenaed over the matter? Will they tell the truth under oath?
“Of course, this can only happen if the police and the MACC investigate my claims on the matter against them. Will this be done?” asked Deepak today.
Speaking to FMT, the former close aide of Rosmah said he had made countless accusations against Najib, Rosmah, their lawyers as well as certain Umno leaders but so far no one has responded to rebut him.
“The police have not started any investigations on the criminal breach of trust case involving a Defence Ministry land and an Umno senator.
“Likewise, no action seems to be forthcoming on my accusations about Altantuya’s death. Everyone concerned seems to be acting like a demigod and pretend not to have heard anything that I have said,” he added.
He said that he was confident nothing would be done as long as Najib and Umno remained in power.
He added that Umno under Najib was completely paralyzed with party leaders and ministers end up being part of a lame duck government.
“I only hope that truth and justice will prevail under a new Malaysian administration,” he said.
Recently Deepak sought immunity from Pakatan Rakyat for him to turn state witness if Pakatan forms the next government after the general election.
Pakatan on its part said that the Whistleblower Act 2010 and Witness Protection Act 2009 were sufficient in according protection to Deepak and urged him to write to the Attorney General to provide him with the necessary legal protection.
Deepak is currently providing statements to the MACC on Najib and Rosmah’s alleged links to the 2006 murder of Altantuya.
Deepak had previously alleged that he paid a substantial sum of money to the premier’s family to be a party in a defence project deal headed by Selangor Wanita Umno chief Raja Ropiaah Raja Abdullah.
The businessman also claimed that Rosmah had asked his help in persuading private eye P Balasubramaniam to repudiate his first statutory declaration implicating Najib in Altantuya’s murder.
Today, former premier Dr Mahathir Mohamad urged Najib not to entertain Deepak’s accusations.
“When you are the prime minister, people say all sorts of things. When I was prime minister also they accused me of corruption … I don’t have to respond,” he said.
Najib had previously dismissed Deepak’s claims on the grounds that he (Deepak) was not credible.
FMT also learnt that Deepak would be holding a press conference next Wednesday at the AG Chambers in Putrajaya along with his lawyers.
Prime Minister Najib Abdul Razak should not waste his time rebutting
allegations thrown at him and his family by controversial
businesspersson Deepak Jaikishan.
"Najib doesn't have to
respond," former prime minister Dr Mahathir Mohamad told a press
conference in Cheras, Kula Lumpur, today. As
the prime minister, Mahathir added, Najib would be accused of
everything under the sun, and he went on to recount how he himself had
his share of accusations when heading the government.
Pressed
further on the serious allegations that Najib's family members accepted
cash in return for governmental favours, Mahathir said such accusations
should be taken to the proper venue, such as the courts, which could
decide the matter.
The carpet trader recently raised serious
allegations against the prime minister and his close family members,
accusing them of covering-up in the murder case of Mongolian national
Altantuya Shaariibuu
Deepak
made it clear that he only came forward because he had been cheated in a
land deal by Selangor Wanita Umno chief Raja Ropiaah Raja Abdullah.
Most
recently, Deepak accused Najib of ordering the Lembaga Tabung Amanah
Angkatan Tentera-owned Boustead Holdings Bhd to buy him out from his
company involved in the said land deal.
In an immediate reaction,
Deepak said today that the police had not acted on Raja Ropiaah's
alleged criminal breach of trust or the corruption in the Bukit Raja
land deal.
"We all know that's never going to happen, but still I
will take Tun Mahathir's advice and hope that both truth and justice
will prevail under a new Malaysian administration," he said in an SMS
message.
'Exercise wisdom'
Meanwhile,
asked about the recent protest by workers of national car maker Proton
over the uneven pay rise made to address the minimum wage of its lower
paid staff, Mahathir said it was up to the management to do what it
thought was best, but he believes wisdom must be exercised.
"The implementation must be done wisely."
The
Proton workers yesterday held protests at the car maker's plants in
Shah Alam and Tanjung Malim to protest uneven wage increments.
Workers
earning RM600 were given a RM300 raise to reach the RM900 minimum wage
scale, while those already earning RM900 to RM1,200 are only given
increments of between RM30 and RM40.
It would not be possible to raise the wages of all Proton staff, Mahathir said, as it would financially burden the company.
"RM300
out of RM600 is a 50 percent increase. You can't give the same increase
to all, from the lowest to the directors. (Proton will go) bankrupt,
lah."
The lawyer-politician says that the carpet businessman must provide his evidence to the authorities so that the police can reopen the Altatntuya's murder case.
PETALING JAYA: New evidence must be produced to help the police reopen investigation on the murder of Mongolian translator Altantuya Shaariibuu, said DAP chairman Karpal Singh.
“Carpet dealer Deepak Jaikishan must come forward with the evidence. Tell us what you have,” said the lawyer-politician.
Yesterday, former Inspector-General of Police Musa Hassan said that the police must reopen Altantuya’s case if there is new evidence found pertaining to the murder.
In December, Deepak alleged that the prime minister’s wife, Rosmah Mansor had sought his help in getting private investigator P Balasubramaniam to retract his first statutory declaration which implicated the premier’s family in Altantuya’s death.
The businessman also claimed that the prime minister’s brother, Nazim Razak, had helped him to seal a deal with Balasubramaniam.
Deepak is slated to approach the Attorney-General Chambers, to request protection under Whistleblower Act 2010 and Witness Protection Act 2009 before making further expose.
On providing legal protection to Deepak, Karpal said,”Protection must be given to him, especially since this is a high profile case.”
On related matter, PKR vice president N Surendran said that the police should reopen the investigation as there are two men sentenced to death for Altantuya’s murder.
“There is no statute of limitation for murder cases. We must prevent a miscarriage of justice by looking at the new evidence,” he said.
In 2009, two police officers, Corporal Sirul Azhar Umar and Chief Inspector Azilah Hadri were sentenced to death by the High Court for murdering Altantuya.
They have since filed an appeal against the verdict. Trial date is yet to be fixed.
Carpet trader Deepak Jaikishan claimed that Prime Minister Najib
Abdul Razak was directly involved in Boustead Holdings Bhd's acquisition
of Astacanggih Sdn Bhd, which he owned.
At a press conference at
PAS' headquarters in Kuala Lumpur today, Deepak said Najib had done so
to protect his family members involved in a dodgy land deal.
"The order was given by Najib directly to the Boustead chairperson.
“I know this because I was there when the instruction was given," said Deepak (centre in photo), who did not state when or where the meeting took place.
In view of this, Deepak urged Defence Minister Ahmad Zahid Hamidi to withdraw his defamation suit against PKR director of strategy Rafizi Ramli over the latter's statement on the same matter.
"He
(Rafizi) did not know this. If at all, any (court) action should be
directed at Najib, because he gave the instructions," he said during a
press conference following a meeting with PAS leaders today. Boustead Holdings' corporate exercise
Previously, Astacanggih had been embroiled in a court battle with Awan Megah (M) Sdn Bhd over a land deal gone sour.
In Nov 28 last year, Deepak dropped a bombshell when he claimed that he had to pay a large sum of money in 2007 to a member of Najib's family to help facilitate the land deal.
At the time, Najib was defence minister and the deal involved land owned by the Defence Ministry.
Eventually,
Astacanggih dropped the suit after Boustead Holdings, through its
subsidiary Bakti Wira Developments Sdn Bhd, acquired 80 percentinterests in the company.
The acquisition is reported to be part of Boustead Holding’s corporate exercise
to acquire an 80 percent interest in the 200-acre development land in
Bukit Raja at a total price of RM160 million or RM18.37 per square feet.
Boustead Holdings is owned by Defence Ministry-backed pension fund Lembaga Amanah Angkatan Tentera (LTAT).
LTAT chairperson Admiral (Retired) Mohd Anwar Mohd Nor (right)
maintained, at the time, that the corporate exercise was carried out
purely due to commercial reasons and because of other considerations.
This came under fire from the opposition, with Rafizi stating the deal made “no commercial sense” and accused the the government-linked company is abusing the pension funds of military personnel.
The Selangor govrnment has also said it will not approve any development on the land in contention.

Protection Act 2010, to prevent any fallout following revelations he
plans to make concerning a cheating case involving a top Malaysian
leader.

said he decided on the move after listening to advise from PAS
leadership during a meeting with them at the PAS headquarters this
morning.
During the meeting, he said PAS informed him there is no
need for a guarantee of immunity as the safety of a witness is already
guaranteed under the Act.
“I am seeking PAS’s help as I will not get any help under the Najib (Abdul Razak) government.
“I
am following the suggestion given (by PAS). I will write a letter to
the attorney-general (AG) and hope he will respond immediately,” Deepak
said during a press conference.
Also present at the press
conference today were PAS vice-president Mahfuz Omar, lawyer Asmuni Awi,
PAS deputy secretary general Syed Azman Syed Ahmad Nawawi dan Kuala
Selangor MP Dzulkefly Ahmad.
PKR director of strategy Rafizi
Ramli had previously said that Deepak will immediately be stripped of
his whistleblower status if he reveals the information to the public.
He
said the act only allowed protection if the witness provides the
information to the Malaysian Anti-Corruption Commission (MACC) or
police.

The carpet dealer claimed today the authorities had tried to intimidate him when they sent five police officers to bring him to “a certain officer’s house” to have his statement recorded on his alleged involvement in the second sworn statement on the murder of Mongolian Altantuya Shaaribuu.
“Instead of the Duta police station where I was supposed to record my statement, five police officers had escorted me to record my statement at a certain officer’s house.
“This is the typical cloak-and-dagger style to intimidate. I know how they work. The government is very powerful but they cannot hide the truth,” he said.
Deepak further said the police had asked him if he knew who had murdered Altantuya.
“I replied I know the personality involved but I’m not 100 per cent sure who was at the location (of the murder),” he said while refusing to divulge the name of the person in question.

The Bar Council subsequently launched an investigation on the identity of the lawyers and possible misconduct in the drafting of the second sworn statement on the matter but said Deepak had refused to co-operate.
