Our judges, regardless of their race and religion, must always be mindful that they have taken an oath to preserve, protect and defend our Constitution not for some but for all Malaysians.

I HAVE wanted to write this for some time – my tribute to the late Sultan Azlan Shah who passed away on May 28, 2014. Not so much because he had been reading my column, but rather on two occasions which I had the honour of meeting him, he had encouraged me to keep on writing.

I was also troubled that when he passed away, he had not been accorded the appropriate recognition by leaders of our legal profession of his contribution to the administration of justice in this country.

This could be due to some differences with the Sultan’s decision not to call for fresh state elections when Pakatan Rakyat lost the majority control of the Perak state assembly in February, 2009. I had at that time written extensively that the Sultan’s decision was constitutionally correct.

Interestingly, the Federal Court’s judgment which subsequently endorsed the correctness of his royal decision is now being relied upon by his then most vociferous and sometimes insolent critics in Pakatan Rakyat to justify replacement of the embattled Selangor Mentri Besar, Tan Sri Khalid Ibrahim without the need for a state assembly sitting or the dissolution of the assembly.

Sultan Azlan belonged to the generation of great Malaysian jurists including the likes of Tun Mohamed Suffian Hashim and Tan Sri Eusoffe Abdoolcader. He was, after all, the youngest ever appointed High Court Judge and Lord President.

Not many knew that whenever the Malaysian Bar stood up for the independence of the judiciary, he was always there with and for us.

I still remember the keynote address he gave at the 14th Malaysian Law Conference on October 29, 2007; of which I was the organising chairman.

The conference was held one month after 2,000 or so lawyers walked for justice from the Palace of Justice to the Prime Minister’s office to hand over a memorandum asking the government to set up a royal commission of inquiry to investigate the V.K. Lingam video tape which implicated the then chief justice, Tun Ahmad Fairuz Sheikh Abdul Halim.

At that time, the Malaysian Bar was aware that Tun Fairuz was said to have asked for an extension of an additional six months, allowed under the Federal Constitution, when he turned 66 on Nov 1, 2007 – the mandatory retirement age for judges. Needless to say, it was an open knowledge then that the Bar was dead against this. When my committee and I had an audience with Sultan Azlan inviting him to deliver the keynote address, this was made known to him.

In an obvious act of retaliation, I received a letter from the judiciary a few days before the conference that judges would not be attending the conference due to “unforeseen circumstances”.

A High Court judge from Ipoh who was supposed to deliver his paper had to pull out in the last minute. Nevertheless, I am grateful that the then Industrial Court President, Datuk Umi Kalthum Abdul Majid sent most of the Industrial Court chairmen to participate in the conference.

As a result, only a handful of senior judges turned up at the opening of the conference and also the dinner later in the night hosted by then Prime Minister, Datuk Seri Abdullah Ahmad Badawi. One senior judge who was noticeably present was the then President of Court of Appeal, Datuk Abdul Hamid Mohamad who subsequently became the chief justice. He appeared to be a keen supporter of the Bar at a time when the relationship between the Bar and the judiciary could be said to have reached its lowest ebb.

On my part, I accorded him every courtesy and opportunity being the most senior judge present to be seated close to Sultan Azlan and the Prime Minister during the photography sessions and at the dinner.

He did not appear to me to be upset with the Bar Council and I was appreciative that he had turned up with the full knowledge, of course, that he might just succeed Tun Fairuz if the latter did not get the extension. Hence, his recent criticisms of the Bar Council came rather as a surprise to me.

In his keynote address, Sultan Azlan broke tradition and expressed his sadness over the state of our judiciary then. He also called for judicial reforms.

For the sake of posterity, the following important excerpts of his speech ought to be reproduced in which he said:

“In matters concerning the judiciary, it is the public perception of the judiciary that ultimately matters. A judiciary loses its value and service to the community if there is no public confidence in its decision-making.

“Sadly, I must acknowledge that there has been some disquiet about our judiciary over the past few years and in the more recent past. In 2004, I had stated that it grieved me, having been a member of the judiciary, whenever I heard allegations against the judiciary and the erosion of public confidence in the judiciary.

“I am driven nostalgically to look back to a time when our judiciary was the pride of the region, and our neighbours spoke admiringly of our legal system. We were then second to none and the judgments of our courts were quoted confidently in other common law jurisdictions. As Tun Suffian, a former Lord President of the then Federal Court, said of the local judges who took over from the expatriate judges after Merdeka that the transformation was without ‘any reduction in standards’.

“There is no reason why judges with the assured security of tenure they enjoy under the Constitution should not discharge their duties impartially, confidently and competently.

“Countries such as Singapore and Hong Kong, who have a similar legal system and who share similar laws, and whose judges and lawyers are trained as ours, are ranked in these surveys as amongst the best in the world (Hong Kong is placed first and Singapore ranks as fourth in the world).

“There is one further important point that I feel compelled to say. This deals with a judge’s quality in decision-making. We in Malaysia live in a multi-cultural and multi-religious society. Our founding fathers accommodated this diversity into our Constitution that is reflected in the social contract, and saw this diversity as strength.

“Judges in Malaysia must be ever mindful that they are appointed judges for all Malaysians. They must be sensitive to the feelings of all parties, irrespective of race, religion or creed, and be careful not to bring a predisposed mind to an issue before them that is capable of being misconstrued by the watching public or segments of them.

“I am reminded of the proud accolade of the late Tun Suffian in his Braddel Memorial Lecture in 1982, when speaking of the Malaysian judiciary to a Singapore audience he said: ‘In a multi-racial and multi religious society like yours and mine, while we judges cannot help being Malay or Chinese or Indian; or being Muslim or Buddhist or Hindu or whatever, we strive not to be too identified with any particular race or religion – so that nobody reading our judgment with our name deleted could with confidence identify our race or religion, and so that the various communities, especially minority communities, are assured that we will not allow their rights to be trampled underfoot.’ ”

No doubt, he received a standing ovation for his landmark speech. After the conference, the palace called up the Bar Council Secretariat for more information regarding leaders of the Bar, and he was kind enough to confer one of them with a Datukship.

Indeed, our judges, especially those at the apex court, regardless of their race and religion, must always be mindful that they have taken an oath to preserve, protect and defend our Constitution not for some but for all Malaysians.

If their decisions especially on sensitive racial and religious issues are predictable because of their race and religion, then they have failed miserably to measure up to the standards set by Sultan Azlan and Tun Suffian. If that is so, then I am afraid issue of race has become the sine qua non for appointing a judge in this country.

In this respect, I have written that judicial diversity and meritocracy should go hand in hand, and a judiciary that does not reflect society’s diversity will ultimately lose the confidence of that society. (See Judicial diversity creates confidence, The Sunday Star, Nov 13, 2011)

Singapore just celebrated her 49th national day and they have already overtaken us in this regard by leaps and bounds as both their Attorney-General and Chief Justice are Singaporean Indians – Vijaya Kumar Rajah, 57, and Sundaresh Menon, 52.

But sadly in Malaysia, it is an unthinkable thing for any qualified non-Malay even of exceptional capability to be appointed as the Attorney-General or the Chief Justice.

Of course, words are easy compared to putting them into practice. But it remains my fervent hope that the above wise words of Sultan Azlan will be a constant reminder to all our judges whenever they dispense justice in our beloved land.

Similarly, our judges who sit at the apex court should never abdicate from their powerful position as the guardians of our Constitution whenever there is any infringement of constitutional rights in any segment of our society.

They, as Abdoolcader once pointed out, must not just stand there and fold their arms and do nothing; otherwise they might as well “hang their heads in sorrow and perhaps even in mortification in not being able to at least entertain for consideration on its merits any legitimate complaint of a public grievance or alleged unconstitutional conduct.”

PETALING JAYA: Lawyer Edmund Bon has not violated any ethical principles of the legal profession, said Andrew Khoo, co-chairperson of the Bar Council’s Human Rights Committee.

Khoo was commenting on elections watchdog Bersih 2.0’s statement that lawyers Bon and New Sin Yew were violating human rights principles by representing Selangor Mentri Besar Tan Sri Khalid Ibrahim in his complaint with the Registrar of Societies (ROS) against PKR for wrongful dismissal.

“Every litigant has a right to seek a lawyer of his or her choice. Lawyers, in taking up the cases, should not be necessarily seen as identifying or agreeing with the cause of the client.

“Even for an unpopular cause, clients have the right to legal counsel.”

Bersih chairperson Maria Chin Abdullah recently said that both Bon and New, who is a member of Bersih’s steering committee, were violating the very principles they claimed to champion.

She also denounced Khalid’s recent actions as a betrayal of those who had voted for PKR, and called the ROS “fundamentally against” the freedom of expression.

Members of the legal fraternity have both criticised and thrown their support behind Bon, who recently tweeted “Since many are sidetracked by critique (regarding) lawyers, please read the Basic Principles of Role of Lawyers.”

Last week he also posted “I have said time again there are some lawyers who are politicians (in parties) and some lawyers only. I choose the latter. I have no conflict.”

Cooperative Boost For New Generation Of FELDA Settlers

SERDANG, Aug 18 (Bernama) -- Datuk Seri Najib Tun Razak said Monday the government is prepared to consider the participation of the FELDA Vision Generation Alliance (GWGF) in the FELDA Investment Cooperative 2 (KPF 2).

The prime minister said GWGF had shown interest in the cooperatives sector and was confident that its participation would benefit the settlers investing in the cooperative.

"We are prepared to consider the sound ideas and proposals of GWGF.

"Hopefully, the cooperation will bring greater progress to the FELDA community," he said at the Aidilfitri reception organised by GWGF at Universiti Putra Malaysia (UPM) in Serdang.

KPF 2, a cooperative specially for the new generation of FELDA settlers, was approved in 2011 and is set to be an economic development model for the new generation, complementary to the FELDA Investment Cooperative.

Najib said GWGF was the best example of a non-governmental organisation that promoted government policies pertaining to development of the rural community and eradication of poverty.

As such, he invited GWGF to provide sound inputs and proposals to the government for the continued improvement of the income and standard of living of the FELDA community.

On another matter, the prime minister welcomed the setting up of a golf academy at UPM, citing it as an appropriate measure to uncover talents from among the children of FELDA settlers.

"The first generation of FELDA settlers were not good at golf; they probably played marbles, tops or sepak takraw. However, the second generation are a talented lot with potential and can become champions of golf (like in the GWGF annual golf championship 2014 held yesterday)," he said.

Also present at the reception were FELDA director-general Datuk Faizouli Ahmad and GWGF president Tan Sri Rozali Ismail.

ISIS militants fighting in Iraq and Syria have revealed a bizarre soft spot for the chocolate hazelnut spread Nutella.

The images were subsequently uploaded to Twitter - sparking an intense debate among the fighters and their supporters over the virtues of Nutella.

After the images of the Nutella-loving jihadists emerged on Twitter, a number of users joked that the spread could be the best way to put a halt to the group's expansion in the Middle East.

One Twitter user going by the handle @FatCated asked: 'Could an embargo on Nutella or Chupa Chups (a type of lollypop) destroy the morale of #IS mercenaries? #ISIS'

Another calling herself Ariane al-Britania joked: 'It is very possible that Nutella is responsible 4 the radicalization of Muslims in the West lol.'

It is not the first time ISIS militants have used social media to reveal their surprising interests.

In the wake of Hollywood actor Robin Williams' death earlier this week dozens of ISIS militants and sympathisers took to Twitter to express their love of his film Jumanji.

Among the Yezidi Kurds the fear of death is still looming. They know how real that fear is.

This man has managed to save himself and Peshmerga soldiers are now helping him to reach safety.

The difficulties for these refugees haven’t ended yet. This woman was praying for death to come.

This woman tells the story of the Yezidi girls who committed suicideA woman told Rudaw that three of her daughters committed suicide after they were raped by ISIS militants and were later allowed to join their family on Mount Shingal.

The mother said: My daughters were calling on people to kill them, but no one wanted to do that. So they jumped from the mountain and ended their bitter life.

The mother recounted her daughters’ story on camera, but YPG fighters on the mountain seized the Rudaw camera and erased the tape.

This woman tells the story of the Yezidi girls who committed suicide.

“They took the girls by force and raped them, and after they returned they killed themselves.”

This war has claimed everyone its victim: men, women, young and old. This man has grown old among his people, but he had never expected to see a day like this.

“In my whole life I have never seen something like this. Our world is destroyed. I can’t say anything.”

The Peshmerga have now opened a road to save the Yezidis.

“There was spot that was occupied by the ISIS. The Peshmerga came and took over it. As soon as our people saw the Peshmerga had arrived, they began descending the mountain.”

These people are running towards life, but hunger, thirst and searing heat is following them.

These refugees have paid a high price to reach safety. They have been walking for three days and three nights to reach Zakho, but that is not their ultimate goal. They wonder what their fate would be in the midst of this war.

Ex-Selangor MB takes PAS to task for wasting time in state crisis

Former Selangor menteri besar Tan Sri Muhammad Muhammad Taib has criticised PAS for taking its time to make a decision on the MB crisis in the state, even when Umno has announced that it would support Tan Sri Abdul Khalid Ibrahim.


Muhammad (pic), who is also a PAS member, said that PAS should immediately make a decision, taking into account the current reality of the Selangor crisis.

"They're late, the party is over, the bride and groom have left.

"Making decisions so late. What does it mean? We have to look at today's reality… don't have to wait till August 17… we have to focus on what happens today," he told The Malaysian Insider.

Muhammad also questioned the Islamist party which has delayed getting involved in the Selangor issue, whereas 30 state assemblymen have already stated their support for Datuk Seri Dr Wan Azizah Wan Ismail to take over as MB.

"I think they are late and have been left behind. There are already 30 supporters."

Muhammad also said the decision of 12 Barisan assemblypersons to support Khalid as announced by Deputy Prime Minister Tan Sri Muhyiddin Yassin previously was also a "big mistake".

"This is why he (Khalid) must be removed from Selangor. It is a serious thing when you receive support from Umno."

He said the issue should not be ignored and should instead be given immediate consideration from PAS, especially those who have yet to make a stand.

"That is the biggest mistake. Why leave it? When he is supported by Umno, it shows that Khalid can be their tool."

He also reminded Pakatan Rakyat, especially PAS, to wake up and make quick decisions.

"I think Pakatan has to wake up and go back to running Selangor. The people of Selangor are beginning to get tired of the childish antics."

The fact that Dr Wan Azizah has managed to acquire the support of 30 assemblymen also showed that PAS no longer has a reason to support Khalid.

"They (Pakatan) already have a majority of the support in the state assembly, so what is the excuse? There is none anymore, they have the numbers and have to respect the people's mandate."

Muhammad had previously slammed Khalid for his stubbornness to step down from his post even after being sacked by his own party, PKR.

He said Khalid had to give up his position as MB although he had PAS's support.

The upheaval in Selangor became more critical after Khalid took a drastic move to sack five PKR and DAP exco members, while insisting that he was the rightful MB after getting the Sultan's approval.

PKR and DAP had called on PAS to make a decision right away without waiting for its August 17 meeting.

The Islamist party said repeatedly that it would not make a stand ahead of the meeting this Sunday. But, yesterday, two of its Selangor assemblymen declared support for Dr Wan Azizah. – August 15, 2014

Tough to prove alleged nudists ran foul of the law, say crime lawyers

The prosecution may have an uphill task proving its case if 15 people who were allegedly involved in nude sport games on a Penang beach are charged, criminal lawyers said.

They said although it was a crime discovered through technological advancement, the laws, including the Penal Code, are ill-equipped to handle this matter.

Lawyer Fahri Azzat said the public came to know of the incident because it was captured on video and uploaded online for everyone to view.

"This could not have happened in the 18th century when the Penal Code was codified," he said.

Police said they were investigating the suspects under Sections 294(a) and 509 of the Penal Code.

Section 294(a) states that whoever, to the annoyance of others, does any obscene act in any public place shall be punished with a maximum three months jail or a fine or both.

Under Section 509, a person guilty of using a word or gesture intended to insult the modesty of another can be jailed up to five years or fined or both.

Fahri said that Section 294a required that the obscene act in a public place must be at the annoyance of others present at the scene.

"The annoyance must arise at the time of the act, not after. It is not enough to be irritated knowing or watching the act later," he added.

He said in that sense the suspects did not run foul of the law.

Word of the nude games spread after a five minutes and 52 seconds video titled “Pesta Bogel di Teluk Bahang, Penang” went viral on social media.

The video showed a group of 15 men and women in the buff participating in various activities at a hut and on the beach.

Police have identified all 15 participants, consisting of seven locals, four Singaporeans, two Myanmar nationals and one each from India and the Philippines.

Police have remanded two men, a Malaysian and a Singaporean, in connection with the alleged nude festival held at Pantai Teluk Kampi in the Teluk Bahang National Park in Penang in May.

Lawyer S.N. Nair said the prosecution has several ingredients to produce, chief among them was to prove its case beyond a reasonable doubt.

"Moreover, the identities of the suspects need to be proven and the video clip is at best secondary evidence and the admissibility of the exhibit depends on several extraneous matters."

He said the authenticity of the video also has to be proven, among others.

Lawyer Datuk Naran Singh said prosecution needs to show that the nudists had intended to insult the modesty of another person in public to prove their case under Section 509.

"One's modesty cannot be violated by watching the footage of a video taken in May," he said, questioning what public interest could be achieved by prosecuting them.

He said the police could call the suspects and reprimand them instead of subjecting them to further humiliation.

But, Datuk Baljit Singh Sidhu said the prosecution could prove its case because annoyance and intention to insult one's modesty could come from a witness who had viewed the video.

"A report was made and police are right to investigate because there is public interest element involved as the incident occurred at a public beach." – August 15, 2014.

'Ask ex-deputy minister Waytha about RM540mil'

 
MIC has hit back at the demand made by Indian NGOs for details of the RM540 million allegedly distributed to the Indian community, saying P Waythamoorthy as former deputy minister should be well aware of the matter.

"All this information has repeatedly been published in Tamil newspapers, as well as online, before and after GE13.

"Hence, I am baffled by their request especially with Mr Waytha, as all these information were available to him during his tenure as deputy minister in the Prime Minister's Office," MIC director of strategy S Vell Paari said n a statement today.

He was responding to Copingo, a coalition of Indian NGOs led by Persatuan Hindraf Malaysia (PHM) leader N Ganesan, that had asked for details of the funds yesterday.

Vell Paari said PHM chairperson P Waythamoorthy and Copingo chairperson Ganesan were raising the issue merely to gain political mileage.

“Obviously their motive is political mileage and to portray themselves as the ‘saviours of the Indian community,” he said in a statement today.

Vell Paari added that the move was done to gain popularity among the Indian community while sullying the name of the country’s prime minister.

“Their motive was not for verification of facts but an attempt to question the integrity of the prime minister and to tarnish his image.

“Trying to gain popularity by criticising and making baseless allegations is easy. But it won't last long as the same medium they use to make allegations can be used to provide information,” he said.

'Ample publicity'

Vell Paari ,in his statement, said the detailed breakdown of the RM540 million was published in eight multi-page supplements in various Tamil dailies from September 2012 to August 2014 and also distributed to the community through their Nambikei–Janji Ditepati book distributed during the run -p to the 13th general election.

"The claim of nothing tangible has come about is baseless, as proof of this funding can be seen in the form of hundreds of new and refurbished buildings in Tamil schools that have been listed," he said.

Vell Paari also said MIC leaders have constantly done their part in explaining the distribution of the RM540 million, as well as the status of the allocations made between 2012 and 2013.

“Clarifications (were made) by Dr S Subramaniam, the MIC deputy president and P Kamalanathan, the deputy education minister, in March 2014 when questions was raised on the whereabouts of the funding given for Tamil schools.

“Also, since April 18, 2014, Kamalanathan has been constantly updating the status of the 39 remaining school projects under Budget 2012 when awarding Letters of Award to the Indian contractors involved.” summed up Vell Paari.

'Game over, sultan must appoint Wan Azizah' - Malaysiakini

The Selangor sultan should appoint PKR president Dr Wan Azizah Wan Ismail since she commands the majority in the state assembly, said constitutional law expert Abdul Aziz Bari.

"In law dissolution (of the assembly) is not the option now. I dare say it is even against the constitution and democracy.

"There is no need to waste time and money when the majority is clear on Wan Azizah's side

"The law is clear, the sultan must appoint Wan Azizah to allow the state running to go back to normality," he added.

Yesterday, Wan Azizah revealed that she had the support of 30 state assemblypersons, including two from PAS, to assume the menteri besar post.

The Kajang assemblyperson added that the 30 have lost confidence in the leadership of current menteri besar Abdul Khalid Ibrahim.

This prompted Khalid to call on her to prove her support via a vote of no confidence against him in the 56-member state assembly.

However, Aziz criticised the menteri besar over his stand.

"Khalid should be consistent if he wants to retain his credibility and honour

"He did not care to show his claim to have the majority support when the met the Sultan on Aug 11 but now he demands that when Wan Azizah came up with the hard evidence of the majority support actually on her side.

"I still say that the game is over for Khalid," he added.

Palace must act swiftly

The constitutional expert pointed out that the problem now is if the palace drags its feet over the latest development.

"It should have been swift just like when it granted audience to Khalid and took whatever he said at face value.

"The same must be granted to Wan Azizah if the palace is to remain neutral and stay above political fray," he added.

Aziz (right) also noted how the sultan, during his meeting with Khalid, had said that the internal problems in PKR are not of his concern.

Therefore, the constitutional expert added whether PAS agreed with Wan Azizah becoming menteri besar is now irrelevant hence there is no need to wait until the party's Aug 17 meeting to discuss the matter.

Wan Azizah has submitted a second letter to the palace seeking an audience with the sultan after her first request was turned down.

Question mark over legality

Meanwhile, Aziz said since Wan Azizah commanded majority support, a big question mark hangs over the legality of Khalid as menteri besar and the remaining exco members, namely the government of Selangor

"Khalid has a duty to clear that by allowing the house to convene as soon possible without waiting for November.

"This is because the government has to be legal in order to endorse critical decisions which involve contracts and agreements. Going by the book the only option is for Khalid to resign.

"As his hold on government is a big question mark Khalid has no authority to advise the sultan or even continue to sit on the boards of so many state GLCs.

"Such a senario would lead to confusion and chaos," he added.

In view of this, Aziz said the sultan must step in, not to dissolve the house, but grant an audience to Wan Azizah, who has shown the hard evidence.

"If he is still not sure then he needs to convene the house. Khalid has no authority to stop this as his hold to office is in big doubt," he added.

Aziz pointed out that the situation would not have come to this if the sultan had asked Khalid to furnish him with clear proof when he granted him the audience four days ago.


Selangor crisis today

Legitimacy of Khalid’s tenure questioned again

Although Khalid is hanging on tooth and nail to his Menteri Besar's post, the law clearly states he must go.

PETALING JAYA: PKR vice-president N.Surendran says Khalid Ibrahim has no legal right to stay in office as Dr.Wan Azizah has shown “clear and unambiguous” proof of 30 assemblypersons who are with her.

Surendran explained that with this development, Article 53(6) of the state Constitution was now operative meaning “Khalid can no longer exercise the usual executive powers of an MB.”

Surendran stressed, “It is not business as usual. Any acts or policy decisions purported to be done by Khalid, including entering into contracts and other commercial dealings, may be tainted with illegality.”

He also said this made Khalid’s resignation all the more urgent and that he should step down immediately.

Surendran, who is also the MP for Padang Serai, said Khalid’s intention to cling on to his post until the state assembly sits in November was pointless as the law clearly states Khalid shall be “deemed to have vacated the office of the MB”.

He also said, “With a clear majority for Dr.Wan Azizah, there is not the slightest reason for a dissolution of the state assembly.

“Khalid must uphold his oath to ‘preserve, protect and defend’ the Selangor Constitution, and quit now.”

Surendran compared the situation in Selangor to that in Perak involving Nizar and Zambry in 2010, saying that Article XVI(6) of the Perak Constitution was exactly the same as Article 53(6) of the Selangor Constitution.

Suhakam: Cops overreacted in student case

The human rights organisation says the Sedition Act should'nt be used against the student who liked the 'I Love Israel' Facebook page.

KUALA LUMPUR: Suhakam has registered its dismay over the police’s use of the Sedition Act against a Form Five student who clicked ‘Like’ on the “I Love Israel” Facebook page.

Calling it an “overreaction” on the part of the police, Suhakam chairman Hasmy Agam also blamed the teachers concerned for mishandling the situation to the extent that the basic rights of the student were threatened.

He said, “It is unfortunate to note that the teachers concerned had failed to handle the matter responsibly as educators.”

Hasmy also lamented that the incident and reactions to it went “contrary to the spirit and articles of the Convention on the Rights of the Child, to which Malaysia is a state party.”

He also said, “Such an incident is another example of how the Sedition Act can restrict freedom of expression.”

The student has been under heavy criticism and threats since the incident, prompting Suhakam to call on all relevant parties to act with discretion when dealing with matters concerning the social media and views expressed online.

“Suhakam urges all parties to practise restraint and not to partake in actions that promote ignorance and hatred,” Hasmy said.

He also said Malaysians should strive harder to exercise respect and tolerance towards each other.

Suhakam urged the Ministry of Education to incorporate human rights in the school curriculum to promote better respect and understanding of the basic rights of all citizens, including students.

Khalid making use of PAS, says Husam

In sacking PKR and DAP Excos and retaining PAS Excos, he meant to show he had the Islamist party's support.

PETALING JAYA: PAS vice-president Husam Musa today lamented that Selangor Menteri Besar Khalid Ibrahim had made use of his party in trying to hold on to power.

He said Khalid’s action of retaining the PAS members in the Selangor Exco and dismissing the DAP and PKR Excos had the potential to break up Pakatan Rakyat.

He meant to show that he still had the support of PAS, Husam added.

“The expulsion of PKR and DAP Excos and the retention of PAS Excos should have been preceded by consultation with the PAS Central Committee and should have been done with the approval of other members of the coalition,” he said in a press statement.

“As far as I know, the PAS central leadership never met to discuss the matter and has not given anyone the mandate to decide on it.

“As such, Khalid has dragged in PAS in his fight for political survival in a way that threatens PAS’s good name.

“If he values PAS’s gesture of friendship, he shouldn’t drag the party down any deeper.”

Husam advised Khalid to “resign honourably because doing so does not mean the end of his political career.”

Sultan tells MB to do and say nothing until 27th August

Selangor Menteri Besar Khalid Ibrahim has communicated with His Royal Highness the Sultan of Selangor regarding the latest political developments in Selangor.

HRH has indicated that he is satisfied that Khalid has the majority support in the Selangor state assembly as per the meeting of 11th August 2014.

HRH has asked Khalid to not make any decision or issue any statement until HRH returns to Malaysia on 27th August 2014.

Khalid also asks all those who feel that he has misled HRH to contact the Sultan directly to obtain an explanation.

Khalid files a complaint against his dismissal with the RoS

(The Rakyat Post) – In a sudden move against his former party, Selangor Menteri Besar Tan Sri Abdul Khalid Ibrahim has filed an official complaint on his dismissal from PKR to the Registrar of Societies (RoS), yesterday.

According to his counsel New Sin Yew who confirmed the matter, the notice which was filed by legal firm Bon Advocates, yesterday, claimed that the party’s disciplinary board and central leadership council had breached PKR’s constitution in dismissing Khalid.

New said that RoS having received the notice would be replying to them soon.

It is learnt PKR risks being de-registered if RoS finds the party guilty of breaching the party’s constitution.

On Aug 10, PKR disciplinary board chairman Datuk Dr Tan Kee Kwong announced Abdul Khalid’s immediate dismissal for disobeying the decision of the Central Leadership Council.

Tan cited that Abdul Khalid had gone against the decisions made by the party’s leadership council which met on July 21, which decided PKR president Datuk Seri Dr Wan Azizah Wan Ismail as the new Selangor Menteri Besar.

Khalid’s bluff called that he still commanded majority support in Selangor State Assembly after expulsion from PKR last Saturday

Tan Sri Khalid Ibrahim should have gracefully and honourably resigned as Selangor Mentri Besar when he was sacked as a member of PKR last Saturday (August 9), as his appointment as Selangor MB stemmed from the trust and mandate given to him by PKR and the Pakatan Rakyat coalition after the 13th General Elections last May, and once this mandate was withdrawn by PKR by his expulsion from the party, his continued tenure as Selangor Mentri Besar became completely untenable.

Article 53(6) of the Selangor Constitution is very clear as it states: “If the Mentri Besar ceases to command the confidence of the majority of the Legislative Assembly, then, unless at his request His Highness dissolves the Legislative Assembly, he shall tender the resignation of the State Executive Council.”

The only way for Khalid to continue as Selangor Mentri Besar under these circumstances – although it would have been a dishonourable and unethical act – was for him to establish that he still commanded the support of the majority in the State Assembly despite his expulsion from PKR and to make such a representation to the Sultan of Selangor.

But Khalid misled the Sultan of Selangor in the royal audience on Monday that he still commanded the majority in the State Assembly when clearly this was not the case – and Khalid dared not undertake any verification from the Selangor State Assembly members before meeting the Sultan of Selangor, knowing fully well that he would not be able to demonstrate that he enjoyed the majority support among the State Assembly members.

As a result, Khalid had continued as Selangor Mentri Besar under false pretences after the false representation to the Sultan of Selangor on August 11 when he had an audience with the Sultan.

The public meeting and declaration of 30 Selangor State Assembly representatives – 13 PKR, 15 DAP and 2 PAS – yesterday that they have lost confidence in Khalid and support Datuk Seri Dr. Wan Azizah as Mentri Besar had called the bluff of Khalid’s pretence and false representation that he still commanded the majority in the Selangor State Assembly.

Khalid should not compound his reckless and outrageous disregard for the fundamental democratic and constitutional principle that a Mentri Besar who have lost the support of the majority in the State Assembly should tender his resignation to the Sultan, as it is evident there is a clear majority in the Selangor State Assembly for the appointment of a new Mentri Besar to replace Khalid.

There is only one honourable way out if Khalid believes that he still commands support of the majority in the Selangor State Assembly, which is to immediately convene an emergency Selangor State Assembly which could be held in a matter of days for a confidence vote to be taken – and not to resort to the dishonourable, unethical, unprincipled and undemocratic course of clinging to office for as long as possible until November before facing a confidence vote.

Khalid is confronted with the stark choice of salvaging whatever is left of his personal and political honour by either resigning gracefully or convening an emergency Selangor State Assembly for a confidence vote to be taken OR leaving behind a disreputable political legacy completely bereft of honour, ethics or principle.

PETALING JAYA: The criticism and attacks on Edmund Bon, the lawyer for Tan Sri Khalid Ibrahim, are attempts to interfere with his work, says MCA Youth.

Bon is the Selangor Mentri Besar's lawyer in his defamation suit against the Malaysian Insider for accusing Khalid of abusing his position.

MCA Youth legal bureau chairman Choo Wei Sern, in a statement on Thursday, said Bon was bound by the 'cab-rank rule' (which originated from English jurisdiction and obligates a lawyer to accept any work in the field he professes to practice).

Choo said since there was no conflict of interest in Bon representing Khalid, politicians should not interfere with his work as an advocate, solicitor and an officer of the court.

"We hope that Mr. Bon will be afforded the same respect and liberty as are afforded to other lawyers to carry out their duties without fear or favour in the interests of justice," he said

Bon had taken to Twitter to defend his decision in representing Khalid, explaining that he had been representing him since 2008.

Abdul Khalid Says Sultan Has Ordered Him Not To Make Any Decisions, Announcements Until Aug 27

SHAH ALAM, Aug 15 (Bernama) -- Selangor Menteri Besar Tan Sri Abdul Khalid Ibrahim said today that the Sultan of Selangor had ordered him not to make any decision or announcements concerning the state's menteri besar post until the Sultan returns to the country on Aug 27.

Abdul Khalid said he had communicated to the Sultan the latest political developments in Selangor including the sentiments among the state assemblymen.

"When I had an audience to brief him (on the MB crisis in Selangor) on Monday (Aug 11), the sultan had said he was satisfied that I had the majority support in the State Assembly.

"He has now instructed that I do not make any decision or announcement regarding the menteri besar's post until he returns on Aug 27, after which I will have an audience with him again," he said in a statement today.

As such, Abdul Khalid advised the parties which claim that he had misled the sultan on his majority support to write directly to the sultan to get further clarification.

Yesterday, Parti Keadilan Rakyat (PKR) president Datuk Seri Dr Wan Azizah Wan Ismail announced that she had the support of 30 Pakatan Rakyat assemblymen including herself and two PAS state assemblymen, Saari Sungib (Hulu Klang) and Hasnul Baharuddin (Morib) in the 56-seat state assembly to take over the menteri besar's post.

Dr Wan Azizah said she had written to Sultan of Selangor to get his views if there was a need for the Speaker to call for a state assembly meeting for the change in menteri besar.

Dr Wan Azizah, who is also the state assemblyman for Kajang, also advised Abdul Khalid to respect the law and democratic principles by immediately resigning because he had lost majority support.

Yesterday, in his immediate reaction to her claim, Abdul Khalid said Wan Azizah's claims should be translated through the legal process at the state assembly.

Meanwhile, Selangor PAS secretary Mohd Khairuddin Othman said Selangor PAS was leaving to the party's top leadership to deal with the two renegade assemblymen, Saari Sungib (Hulu Kelang) and Hasnul Baharuddin, who had ignored the 24 hours ultimatum given by Selangor PAS to them yesterday to retract their support for Dr Wan Azizah to be the new MB.

"We (the 13 other PAS assemblymen in Selangor) have sought a meeting with the PAS president (Datuk Seri Abdul Hadi Awang) and PAS secretary-general (Datuk Mustafa Ali), and will submit our report (on the two breaking ranks).

"We will leave it to the party's top leadership to deal with the two accordingly," he said in a statement here.

He further said that Selangor PAS had asked local leaders to meet the duo yesterday to give them a chance to "repent" but the effort failed.

NGOs: Palanivel can’t see beyond his nose - Malaysiakini

Copingo, a coalition of Penang Indian NGOs, has accused MIC president G Palanivel of being a leader who peddles deception.

Copingo chairperson N Ganesan took Palanivel to task for describing the memorandum of understanding (MOU) inked between Prime Minister Najib Abdul Razak and Persatuan Hindraf Malaysia (PHM) prior to the last general election as a “mistake”.

"Does the Indian community need such a leader who cannot see beyond the tip of his nose?" he asked.

"Palanivel, is asking for fair share of the common wealth of one’s country a mistake, is requiring effective correction programmes for the growing underclass problem in the community a mistake?

"Is asking for a complete upgrade of Tamil primary schools in the country a mistake, is asking for fair living opportunities for the Indian poor a mistake," he added.

Ganesan (right), who is also a PHM leader, said when leaders like Najib and Palanivel "deceive endlessly",  the Indian community in the country would continue to be in the doldrums.

"The policies of Najib are nothing more than a cover for creating more profit opportunities for those already well-endowed, and often at the expense of the poor and vulnerable resulting in increasing marginalisation of those at the bottom," he told Malaysiakini.

Meanwhile Palanivel’s policies, he said, are there to provide cover for his boss so that the MIC president can keep his job.

MOU that wasn't

PHM chief P Waythamoorthy had been heavily criticised for the MOU with Najib in which the leader was subsequently awarded a deputy ministership.

He eventually quit his cabinet post after accusing the PM's administration of failing to uphold its end of the bargain after BN won the general election.

PHM is a breakaway organization from the Hindu Rights Action Force group Hindraf led by Waythamoorthy's brother P Uthayakumar.

In 2007, Uthayakumar's Hindraf shot into national spotlight when it staged a massive street protest in Kuala Lumpur over the plight of the Indian community.

The cornerstone protest is often cited as one of the key reasons in a swing of votes in favour of the opposition in the general election held the following year.

Uighur girls get calls to be ISIS sex slaves

BEIJING: Chinese police is probing claims that teenage Uighur girls based outside the Xinjiang province were being telephoned and asked to serve as "sex slaves" for ISIS jihadists in the Middle East.

State-run Global Times, quoting online posts alleging a number of phone calls made to Uighur girls, reported that they were being telephoned and asked to serve as "sex slaves" by ISIS jihadists.

Xinjiang, which is on boil over the native Muslim Uighur protests opposing Han settlements, as well as several parts of China has witnessed terror attacks carried out by the East Turkestan Islamic Movement (ETIM) comprising of Uighur youth who have also been found to be fighting in Syria along with ISIS.

A post on Sina Weibo, akin to Twitter, claimed some high school Uighur students from Xinjiang, have received these calls. These appear to be soliciting them to give up studying and travel to Iraq to become "sex slaves".

The post immediately caught wide attention and was reposted at least 2,000 times before it was deleted on Monday. A person identified as Zheng who claimed knowledge about such calls was quoted by the Chinese daily as saying that he was told by several Uighur school girls about similar phone calls."They told me that they received anonymous calls, asking them to go to Syria through Indonesia for battlefield service. They were asked to dedicate themselves to jihadists. But the girls did not report this to the police. They were hesitant, because (they thought) all Muslims are brothers and sisters," Zheng noted.

He said the solicitation may expand from individuals to larger groups.

"Many teenagers (studying outside Xinjiang) are from rural areas in southern Xinjiang. They are easily affected due to their family backgrounds," Zheng said.

Police in Altay prefecture in Xinjiang said they are following up on the issue. "It is possible that such calls do exist,One of our investigation focuses at present is how the students' numbers were leaked," an officer from the Altay bureau said. pti The officer added that before local students leave to attend schools outside the region, they all have to go through a training session.

"Such training is more about warning against participation in illegal religious activities, instead of being designed to guard against such calls, but I believe students will be highly alert if they receive such calls," the officer said.

Meanwhile, an anti-terrorism official in Xinjiang said they have taken note of similar online revelations, and authorities are looking into the issue.

However, this is yet to be confirmed. Li Wei, an expert on anti-terrorism with the Chinese Institutes of Contemporary International Relations, said it would be very difficult to actually send those students out of the country, even if the alleged instigators are able to contact the students.

Sun Lizhou, a Xinjiang-born scholar from Chongqing University, said the authenticity of such calls still needs to be verified, "but since some Uygurs are reportedly fighting alongside IS in Syria, it would be possible to speak to the students on the phone."

"Junior or senior high school students are an easy target of such incitement since they are psychologically immature and many are rebellious in their teenage years. A lack of objective judgment also makes them vulnerable to these audio or video files," Li said.

An anonymous anti-terrorism official in Xinjiang said separatist groups tend to link themselves with overseas terrorist organizations, such as the IS, so as to boost their international standing, and win recognition from those groups in exchange for financial and personnel support.

The IS is also reportedly planning on expanding its "holy war" to Xinjiang.

According to a report from Phoenix Weekly, in a video released early July, IS leader Abu Bakr al-Baghdadi claimed he will take revenge on those who took away the rights of Muslims in 20 countries, with China allegedly placed at the top.

"This is the habitual practice of terrorist groups for propaganda efforts. It won't have any substantial influence," Li said.

Women and Teens Suffer 'Barbaric Rape' by Islamic State Fighters

Iraqi civilians are being subjected to “barbaric” sexual violence committed by Sunni Islamic State (IS) jihadist fighters, the U.N reports.

Two U.N. officials say they’ve received accounts of “barbaric acts” of sexual violence including “savage rapes” being used as weapons of war against women and teenage girls and boys belonging to the Yazidi, Christian, Turkomen and Shabak minority groups in Iraq. As many as 1,500 Yazidis and Christians may have been forced into sex slavery and human trafficking, the UN reports.

“We condemn, in the strongest terms, the explicit targeting of women and children and the barbaric acts the ‘Islamic State of Iraq and the Levant’ has perpetrated on minorities in areas under its control, and we remind all armed groups that acts of sexual violence are grave human rights violations that can be considered as war crimes and crimes against humanity,” Nickolay Mladenov, special representative of the U.N. secretary-general for Iraq, and Zainab Hawa Bangura, special representative of the secretary-general on sexual violence in conflict, said in a joint statement issued from Baghdad.

The UN warned on Tuesday that Yazidis are on the brink of an imminent mass genocide at the hands of IS. The United Nations Refugee Agency (UNHCR) estimates 20,000 to 30,000 Yazidis remain trapped in searing temperatures on top of Mount Sinjar in northwest Iraq with little food, water or medical supplies. The Yazidis — a majority Kurdish-speaking religion that combines elements of Christianity, Islam and the ancient Persian faith Zoroastrianism — were trapped after fleeing IS militants who issued them an ultimatum: convert to Islam or die.

The U.S. and France are both stepping up efforts to relieve the plight of Iraq’s Yazidis, who IS consider to be devil worshippers, and other religious minority groups. The U.S. is sending 130 “advisers” into northern Iraq to help assist in the evacuation of the thousands of Yazidis still stranded on the mountain. The Defense Department emphasized that the advisers, all Marines and Special Operations forces, won’t be used in combat roles but will plan and perhaps carry out the evacuation of Yazidis. The addition of 130 advisers brings the total number of U.S. military personnel in Iraq to more than 1,000, The New York Times reports.

DAP parliamentary leader Lim Kit Siang said ‎it is clear that the two-term MB has lost the confidence of the majority in the 56-seat assembly.

"As an emergency state assembly can only be convened by the menteri besar, is Khalid prepared to uphold the word and spirit of the Selangor constitution to convene such an emergency meeting?‎" he said in a statement today.

Fifteen DAP assemblymen, together with 13 from PKR and two from PAS, today declared their loss of confidence in Khalid and fully backed Dr Wan Azizah for the MB post.

This means Khalid now only has support from opposition Umno who has 12 representatives, as well as himself who is now an independent candidate after he was sacked from PKR last week for defying party orders to make way for Dr Wan Azizah.

Islamist party PAS has 15 assemblymen in the state, of which 13 has yet to declare their stand.

PAS Hulu Kelang assemblyman Saari Sungib and Morib assemblyman Hasnul Baharuddin today were the first state lawmakers from Selangor PAS to publicly back Dr Wan Azizah.

In an immediate response, a defiant Khalid had said he remained the MB until the state assembly deemed otherwise.

Lim said today's development also showed that Khalid had committed a "grave wrong" for misleading the Selangor sultan into believing that he commanded the support of the majority, when he knew that it was not the case.

On Monday, Khalid said the state ruler had consented to him remaining as MB as he still commands the support from the majority of the assembly.

Lim said before his audience with the Sultan, Khalid was both duty and honour-bound to verify he still commanded the support of the majority of the state assembly members to continue as menteri besar.

This, he said, was to ensure that he would not be guilty of misleading the sultan.

"But despite being in the midst of a political crisis after being sacked as a member of PKR, Khalid never tried to verify with the Selangor state assembly representatives, particularly from the 43 PR reps, if he still commanded their support."

The DAP adviser said the only honourable way out for Khalid now is to resign gracefully. – August 14, 2014.

Cops in a bind over teen who 'liked' pro-Israel page - Malaysiakini

The police are caught in a situation where they would be criticised whether or not they take action against the teenager who allegedly clicked ‘Like’ on a pro-Israel Facebook page, said Communications and Multimedia Minister Ahmad Shabery Cheek.

“If the police don’t act, people get angry. If the police act, people get angry. This is where the enforcers need to use their discretion,” he told reporters today.

He said this when reporters asked whether it is disproportionate to investigate a Form Five student under the Sedition Act for supposedly clicking ‘Like’ on a Facebook paged called ‘I love Israel’.

The 17-year old has reportedly denied clicking ‘Like’ on the web page and has lodged a police report out of fear for his safety, after being harassed.

Penang police chief Abdul Rahim Hanafi said they schoolboy is being investigated under Section 4(1)(a) of the Sedition Act and the police has already recorded his statement.

A person convicted under the provision can be fined up to RM5,000, jailed up to three years, or both, on the first offence.

When asked again whether it is necessary to investigate the teenager for such a serious offence for supposedly clicking ‘Like’, Shabery stressed that he is merely being investigated and no action has been taken against him yet.

“I think he merely ‘liked’ the page, perhaps the police would recommend that no further action should be taken against him. However the police want more information, that’s normal,” he said.

Copingo, a coalition of Penang Indian NGOs, is demanding answers from BN leaders about the RM540 million supposedly allocated to the Indian community.

Copingo chairperson N Ganesan directed the questions at Prime Minister Najib Abdul Razak and MIC president G Palanivel.

He said Najib has been bandying this number about for some time but nothing tangible seems to have come forth for the Indian community from the expenditure.

"The allocation is an illusory allocation, just another deception," he told Malaysiakini.

Ganesan (left) said the growth of the underclass among the Indians seems to be untouched, the evictions of displaced Indian estate workers is happening even today and there has been no real attempt at a resettlement programme for these workers.

He added that single mothers continue to face daily miseries and suffer in silence.

Ganesan also noted that the statelessness issue is not getting serious attention now as compared to before the general election.

"Tamil primary schools continue pretty much in their dilapidated condition despite some hand-outs and a few additional schools being built.

"The RM540 million seems not to have done anything for these critical problems," he said.

'The great deception'

Recently, Persatuan Hindraf Malaysia chairperson P Waythamoorthy asked Palanivel to account for the money.

However, the MIC president said that he was only aware of the RM38 million allocation to the Indian community.

Ganesan said in refusing to be held accountable for the RM540 million, Palanivel is effectively kicking the ball back to his boss.

"But we hardly hear a whimper from his boss, who like a broken record only repeats he has spent RM540 million for the Indian community, more than any prime minister in the history of the country," he added.

Ganesan said Najib is "really guilty of a much larger sin of deception" than the RM540 million alleged allocation.

He reminded that Najib had signed a historic Memorandum of Understanding (MOU) with the Indian community, represented by Hindraf on April 18 last year.

Ganesan said that 16 months later, Najib has not delivered even one ringgit of the items he signed for in that contract.

"In this one act, Najib has effectively delivered to the Indian community one of the largest deceptions in the history of post-independence Malaysia," he added.

MB crisis: All eyes now on palace and PAS - Malaysiakini

 
Even though PKR president Dr Wan Azizah Wan Ismail claimed a majority in the state assembly earlier today following the support of two PAS representatives, there are still major hurdles that she and her party need to clear with the Selangor palace and PAS.

The relationship between Wan Azizah as well as PKR and the Selangor palace and PAS would come under increasing scrutiny over the next few days, which could decide the fate of the state's leadership.

Central to this is whether PKR and its de facto leader Anwar Ibrahim would be willing to submit a second candidate for the MB post.

The Selangor palace had already rejected Wan Azizah's request for an audience with the sultan earlier this week as it did not wish to delve into PKR's internal affairs.

The Kajang assemblyperson had penned a second letter today seeking and audience to inform the monarch of the majority that she holds in the state assembly to oust current MB Khalid Ibrahim.

With the latest development, there have been calls for the sultan to instruct Khalid to resign given that Wan Azizah has majority support.

However, PAS secretary-general Mustafa Ali yesterday said he "heard" that the palace had rejected Wan Azizah's candidacy as MB, and thus the party was also seeking for PKR to submit a second candidate.

Fresh state election

If the Selangor palace does not grant Wan Azizah an audience at the second time asking, PKR and DAP might need to wait until the state assembly convenes again in November in order to push through a vote of no confidence and remove Khalid.

A hung assembly could prompt the sultan to dissolve the state assembly and call for fresh polls.

Pakatan insiders have become increasingly wary of the prospect of a snap polls as they believe PAS and PKR would suffer major losses compared to the 13th general election.

Key to avoiding this would be to ensure PAS' support alongside PKR and DAP for the MB change.

Malaysiakini previously reported that a meeting between top PAS leaders last Sunday arrived at four conclusions - to stay in Pakatan Rakyat, to withdraw support for Khalid, to reject Wan Azizah and request a second name from PKR to be submitted.

This brought to fore the name of Azmin Ali, the PKR deputy president and Selangor PKR chief who has been eyeing the MB post for quite some time.

A meeting between PAS president Abdul Hadi Awang and Anwar in Kuala Terengganu on Monday had failed to break the deadlock, and the party's political bureau would hold a crucial meeting tonight before proposing their conclusions for the all-important central committee meeting this Sunday.

Sources from Anwar's inner circle have admitted that the PKR leader might not succeed in pushing through Wan Azizah's candidacy after all due to possible resistance from the palace and PAS.

Malaysiakini understands that PAS leaders are also increasingly unhappy with PKR strategist Rafizi Ramli and secretary-general Saifuddin Nasution for publicly insisting that PKR does not consider any other candidate apart from Wan Azizah for the MB post.

However, if PAS could finally reach an agreement with PKR after backing Khalid previously and throw their support for the MB change, Khalid's independently run government could collapse with the withdrawal of four remaining PAS exco members.

According to sources, Pakatan’s presidential council might hold a meeting right after the PAS central committee meeting on Sunday in another bid to reach an agreement that has eluded all three Pakatan components.

A strong show of support from all Pakatan parties could then lead to a new MB being appointed while averting a state election.

The state ruler, Sharafuddin Idris Shah, would return from his overseas trip on Aug 23 and Pakatan would be hopeful of reaching a consensus on the matter before this.

The Kajang move

Attempts to replace Khalid as the MB of the state has now dragged on for nearly six months.

In February, PKR initiated the 'Kajang Move' by triggering the resignation of assemblyperson Lee Chin Cheh to pave way for a by-election in Kajang and install Anwar as the MB replacing Khalid.

However, Anwar was disqualified from contesting the by-election following his sodomy conviction at the Court of Appeal in March, and Wan Azizah, his wife, stood in his stead and returned as an elected representative.

Khalid remained as MB thereafter but overtures to replace him gathered momentum again after his controversial water deal with the federal government and approval for expressways in the state increased unhappiness on his leadership among PKR and DAP leaders.
                  
After a protracted period, PKR decided that Wan Azizah would be its MB candidate but Khalid refused to step down, asking his party to follow "procedures".

Things were made murkier when PAS, through its president Abdul Hadi openly supported Khalid to remain at the helm.

PKR issued a show-cause letter to Khalid for his refusal to step down and later sacked him from the party.

Despite that, Khalid obtained consent from the ruler earlier this week to remain as MB, and proceeded to sack PKR and DAP excos while retaining the four PAS excos.

Khalid has today refused to change his stand despite Wan Azizah's majority claim, stating that it must be translated into a vote of no confidence in the state assembly.

PETALING JAYA: Shooting back at Khalid Ibrahim for his latest tweet insisting he will stay on as Selangor’s Menteri Besar (MB), PKR vice-president N.Surendran said the latter had “no legal or moral legitimacy” to cling on to his post any longer.

Surendran explained, “Article 53(6) of the Selangor State Constitution states that if the MB ‘ceases to command the confidence of the majority’ of the members of the assembly, he shall tender his resignation and that of the state Exco.”

He added that with the confirmation today of the 30 members who are backing Dr.Wan Azizah over Khalid that Article 53(6) is operative.

Surendran also said, “Khalid is bound by the Constitution to leave office immediately” rendering it pointless that Khalid insist on waiting until a vote of no-confidence is passed.

“Khalid’s immediate twitter response suggests that he intends to desperately cling on to office until there is a motion of no confidence.”

Surendran questioned Khalid’s logic saying, “…there is no doubt that he does not have the confidence of the assembly.”

“Khalid must now seek an immediate audience with the Ruler and tender his resignation.”

Surendran also said, Khalid owes the people an explanation as to why he said on August 11 that he had informed the Ruler of the confidence the majority of the assembly had in him.

“He must now also explain upon what basis he made such a statement to the Ruler of the state of Selangor,” Surendran said.

Put it to a vote

The Sultan of Selangor now has a golden opportunity to do the right thing for Selangor. He should dissolve the Assembly so that a fresh election can be held.

Today Datin Seri Wan Azizah Wan Ismail claimed that she had the support of 30 State Assemblymen in Selangor and therefore should be accepted as the new Menteri Besar.

This argument—or the presentation of 30 Assemblymen at a Press conference—may be technically valid under the law because of the bad precedent set in Perak in 2008, but it should not be followed by the Sultan because it’s a travesty of Parliamentary practice .

Lest we forget, the Perak Barisan Nasional took a similar approach during the Perak crisis in 2008, which created an uproar amongst Pakatan Rakyat supporters.

The Pakatan Rakyat felt that Datuk Seri Mohammad Nizar Jamaluddin should have been removed—if at all—by a vote of confidence in the State Assembly. Any other process was unacceptable.

The determination by the monarch, so the argument went, should not be done in private. The removal of a Menteri Besar required nothing other than an open vote in the Assembly, as has always been the practice in Westminster.

Why do we insist on open public trials in our courts (except in exceptional circumstances)? It’s because in a democracy we eschew secrecy and we value openness.

The people want to know about and be involved in all processes that are important and affect their lives. They want transparency and they distrust powerful people making decisions behind their backs.

It’s the same with public office. The people vote for the party that forms the Government, and when that party no longer has confidence in the Menteri Besar, this must be shown to the people via the open process called the “vote of no confidence” in the Assembly.

This will demonstrate clearly and democratically that the Menteri Besar no longer has majority support. Any other manner of removing a sitting Menteri Besar this must be rejected as undemocratic.

Why? Well, those in favour Wan Azizah have apparently signed statutory declarations attesting to their support for her. However, statutory declarations in Malaysia can be made and unmade—and no less than a top lawyer for the Prime Minister was involved in one case.

So, a statutory declaration in Malaysia is worth very little in the big game called politics. Likewise, being present at a Press conference means nothing. It does not mean support in a way that serves the constitutional process.

What is so difficult about having a proper vote in the Assembly? One might surmise that the Barisan Nasional in Perak had to employ “other means” in 2008 because the Speaker was not on their side at that time, which made it difficult to convene a special sitting.

However, the Speaker in Selangor today is from the DAP. So what’s the problem?

I urge His Royal Highness the Sultan of Selangor to put the democratic process in the right place, once and for all.

If the Pakatan Rakyat does not call for a vote in the House, then dissolve the Assembly so that the people can decide the issue.

Whatever the case, we must never resort to the Perak precedent because it’s no good for democracy, the country and our people.

Malaysia Airlines now faces SEXUAL assault

Malaysia Airlines is hanging their head in shame. The airline is now facing a sexual assault claim that happened in full flight, involving one of its employees.

The act occurred on a flight travelling between Kuala Lumpur (Malaysia) and Paris, where an Australian passenger filed the complaint just after treading ground. The person accused of the crime has been arrested by the French authorities.

The passenger suffered an anxiety attack just after taking off, and the flight attendant went to treat her in order to prevent panic in the aircraft. Apparently, she had communicated her apprehension of flying with Malaysia Airlines because of the recent events that had occurred with the company.

Triggering the anxiety were both recent cases: the disappearance of flight MH370 last March with 239 people aboard bound for Beijing; where the remains of which have not yet been found, as well as the demolition of flight MH17 on July 17th in Ukraine, the beginning of the wave of tensions between the West and Kremlin.

The attendant went to comfort her, but ended up sexually assaulting her. According to the French authorities, the defendant has admitted the facts.

Tan Sri Khalid Ibrahim had committed the grave wrong on Monday of misleading the Selangor Sultan into believing that he still commanded the majority of the Selangor State Assembly members after being sacked as a PKR member last Saturday, when Khalid knew that this was not the case.

Before his audience with the Sultan on Monday, , Khalid was duty and honour-bound, whether morally, politically and constitutionally, to verify that he still commanded the support of the majority of the State Assembly members to continue as Mentri Besar before making any representation to the Sultan that he still commanded the majority of the State Assembly, so that he would not be guilty of the grave wrong of misleading the Sultan as he had done on Monday.

But despite of being in the midst of a political crisis from being sacked as a member of PKR, Khalid never tried to verify from the Selangor State Assembly representatives, particularly from the 43 Pakatan Rakyat State Assembly persons from PKR, DAP and PAS who had given him the mandate to be the Pakatan Rakyat Mentri Besar of Selangor after the 2013 General Elections, whether he still commanded their support simply because he knew that he could not get such a majority support.

This is one major consequence of the declaration by 30 of the 56 Selangor State Assembly representatives today (15 from DAP, 13 from PKR and 2 from PAS) that they have lost confidence in Khalid as Selangor Mentri Besar and support Datuk Seri Dr. Wan Azizah as the new Selangor Mentri Besar.

The only honourable way for Khalid to purge his grave wrong of misleading the Sultan on Monday that he still commanded the support of the majority of the State Assembly after being sacked as a PKR member is for him to resign gracefully, as it is crystal clear that he is hanging on the post of Mentri Besar solely on the “unconditional support” of the 12 Umno/Barisan Nasional State Assembly persons, while a clear majority of 30 out of 56 Selangor State Assembly representatives have lost confidence in him, with 13 PAS Assembly members yet to declare their stand.

, the headline in of the news portals, reflects Khalid’s state of mind to have a last-ditch stand to cling on to the Mentri Besar’s post for as long as possible, instead of facilitating a democratic transition of power like a graceful resignation on his part or the convening of an emergency State Assembly meeting on vote-of-confidence in the Mentri Besar.

As an emergency State Assembly can only be convened by the Mentri Besar, is Khalid prepared to uphold the word and spirit of the Selangor State Constitution to convene such an emergency State Assembly meeting?

KUALA LUMPUR: A STUDY on the human rights needs of the country is being conducted to become the basis of the National Human Rights Action Plan (NHRAP).

Minister in the Prime Minister’s Department Nancy Shukri said the National Human Rights Policy Plan Research would pave the way for the implementation of the NHRAP, thus raising the standard at human rights in the country.

She said the implementation of the action plan would take into account values enshrined in the Federal Constitution and the position of Islam as the country’s official religion.

The 18-month study, which started on July 1, is gathering data, including existing policies on human rights and feedback from the public.

“Phase one focuses on data collection, existing policies and analysis of the current status of human rights in the country, while phase two will focus on activities like public engagement.

“The research team will provide a report that includes the concept of human rights and the actual position of human rights in Malaysia. There will also be unique action plan proposals submitted as part of the report,” said Nancy yesterday.

Several ministries, departments and about 40 experts from local universities will be involved in the two phases of research.

“Research will be based on five fundamentals proposed for the NHRAP, which include civil, political, economic, social, religion and cultural rights,” she said, adding that the research would look into the rights of endangered groups, Orang Asli, indigenous people and international obligations.

“The research will also include public consultation in a meaningful and comprehensive manner.”

The team is headed by Associate Professor Dr Shamrahayu Ab Aziz and assisted by Dr Gan Chin Chuan.

Both are members of the Human Rights Development Action Plan Steering Committee, which is chaired by Nancy.

In October 2012, the government agreed to develop the NHRAP in Malaysia as part of a long-term effort to ensure human rights are preserved and protected in the country.

On 19 June, the first meeting on the Implementation of the National Human Rights Action Plan Research Policy was held and chaired by Nancy.

PAS Rejects Wan Azizah As Selangor MB - Mustafa Ali

KUALA LUMPUR, Aug 14 (Bernama) -- PAS has rejected the proposal for PKR president Datuk Seri Wan Azizah Wan Ismail to replace Tan Sri Khalid Ibrahim as the Selangor Menteri Besar.

PAS secretary-general Datuk Mustafa Ali said PKR was well aware of PAS' stand on the Selangor menteri besar crisis as the matter and the reasons for the rejection had been conveyed to them in a closed-door meeting.

"However, PAS rejected Wan Azizah not because of her gender," he told a press conference after attending PAS Political Bureau meeting at its headquarters here Thursday night.

When asked whether the rejection was due to her qualifications, Mustafa disagreed, stressing that that he was not going to disclose any reasons for the rejection.

He also said PAS did not nominate anyone from the party for the menteri besar's post as it was still holding to the opposition pact's consensus that the post belonged to PKR despite the fact that PAS has more seats in the state assembly.

Mustafa said PAS, however, had yet to make any decision on its stand on the Selangor Menteri Besar crisis because the matter would only be finalised at the party's central committee meeting on Aug 17.

On the move made by two PAS assemblymen - Saari Sungib (Hulu Kelang) and Hasnul Baharuddin (Morib) - in giving their support to Dr Wan Azizah, Mustafa said they did it in their personal capacity.

"They are not acting in the party capacity. We will investigate the matter and to be fair, we will ask them to give their explanations," he said.

On the four PAS state executive council (Exco) members who attended the Selangor Exco meeting yesterday despite having been told to boycott it, Mustafa said their presence were needed to ensure that the opposition-led state government would continue to function.

"Without the four Exco members, the state government will collapse. Their presence were vital to ensure that the opposition-led government still exists and they attended the meeting on behalf of the sacked DAP and PKR Exco members.

"We care for the people's wellbeing too. If they did not attend the meeting, no decision can be made for the people," he said.

Also present at the press conference were PAS deputy president Mohamad Sabu, assistant secretary-general Datuk Takiyuddin Hassan and acting Dewan Ulama chief Datuk Ahmad Yaakob.
